U parked the road by the road side because the brake failed is wrong. U may be guilty of contributory negligence.
The cause of the damage was d dug gutter leading to d fall of d pole n d fence on your bus. Again u reasonably ought to have known that by parking your car on d road where construction/ digging of gutter was ongoing could lead to further incidents including what happened. U could have towed, pushed, to a safer place. The digging was already there before u parked. Not after u parked.
Besides, are you sure the incident was not due to natural cause? Storm, flooding due to rain
U also need to consider the cost of litigation and enforcement of judgement if u won the case and time it will take you to finish the case.

Legal Advice Seriously Needed Before I Commit Suicide.

My emphasis is on the word "before".
Meaning either way you'd still commit suicide but you just need a legal advice before doing it.

In that case, I won't waste my energy on you.

But just in case I got that wrong....accept the heartbreak and move on.
You'd never gain much from depleting your scarce resources to chase a legal battle that may go either way.
It makes no financial sense.
It makes no practical sense either; except to a troublemaker.

Remember, you were at fault by overnight parking by the roadside.
So the law isn't your friend on this too.

Times heals everything.
Let this go but please fight your case if you strongly believe that the only reason Toyota manufactured that bus is so that you can make it in life.

If the construction work is still on going you need to contact some journalist get some lawyers ready for help and move down there to create a better movie enough to stop the work for that day and possibly for some days. Otherwise, this is my country and my people will tell you that we don't refer to someone we know very well as that man, is either you call him by his name, eg Daddy funke or Daddy chukwuma.

Take as many photos as you can. If you have an android phone, download open camera and set it to show date and position . Make sure your photos include the vehicle with its license plate.

Get an honest estimate of repairs. Avoid an overinflated one. You can consider getting two or three

In a real nation, you'd find a good lawyer to help you sue and get a replacement, then gradually pay your debts, all done fast.

But here, you have to pay lawyers first, 'tip' the police or journalist or whoever helps your case get attention, still battle with an unresponsive, unwilling to pay company, while case just keeps getting adjourned and money keeps going on airtime, transportation and tips, and still, only luck can help you after.
Gauge all this, is worth it? Really, you know your country, can you afford to get justice?

Like someone said, better start thinking of another way to move forward, before you're in more debt, sorrow n high bp.

Unfortunately, you're now going to restart from debt. Keep that thought aside for now. Think; What do you have? What can you start with? No skills? (invest in that next time). If you can get pro bono help, or pay after a won case, still try your luck with justice, but start thinking of how to move forward. You don't know what the future holds. What happened simply shows how random life can be.

Also: PAY OFF YOUR DEBTS. It's not good to owe people. Nothing wrong in sacrificing to be off debt

My brother abeg take am easy..Some days are like that, Since u said the bus can't be repaired, you can consider selling it by parts...Look for those that will buy the engine, if the engine is sound you can get a deal of 80k or more for the engine only depending the model of the bus..then you sell the body as scrab (Mgbuka)..some can pay up to 20k - 40k for a Scrab car but it depends on how greedy the person you met is..from there you can couple things up..it won't cover all the expenses but it's better than suicide. My 2 cent

IF your car fails brake, doesn't mean you cannot still drive it down to your house. Or the nearest motor park. People drive bus or wagons 100km with failed brakes just to get home. It takes skill.

Suing the company may not be in your interest because u parked your bus at the
roadside and not in a secure garage.

Your insurance policy may be the key to getting something out of the damage.

Did they Cordon off the Works?
Any caution tape?
Did they put warning signs?
Any traffic management?
Did they have a safety officer on site?
Do they have a proper EHS policy?
Did they close down the road?


It is just that this is Nigeria and the job is probably direct labour or paddy paddy. If you cannot demonstrate that you adopted best safety practices, you are liable. So what if it was a child the pole fell on?

Car parked at owners risk is a disclaimer for commercial premises. It is to absolve them of liability if the car is broken into or vandalized. It does not apply in this case

Have an accident on your site in a petrol station and all your paper better be in order.

Lawyers abroad can take on cases with an agreement to share the monies paid out to the plaintiff. Not sure if we do that here. Note that the longer you wait, the more difficult it will be


Your questions above are not relevant in the instant case. The simple reason being that it wouldn't have stopped the damage. It would probably have been different if eg someone fell inside the dug gutter.

The fact that this is Naija, or that it is direct labour or paddy paddy does not and cannot be a defence to escape liabilty.. If the pole had fallen on a child or anybody, the point is, to claim damages, you must prove that the person/company u are sueing caused it by his action or inaction or actually fell the pole on u, that he owes u that duty of care. Eg. If u park your car under a coconut tree and a coconut fell off on your windscreen and broke it, who will you sue? NOBODY.

Lawyers in Naija infact do "pro bono" do cases free of charge. And sometimes just recover their money spent on client's case as well as the agreed fees. I wouldn't call it sharing money.
