January to December is 12 months, aka 1 Year.
January to January is 13 months aka 1year and 1 month

So, if you pay rent on January, it expires December, and you must pack out or renew the rent on expiry date which is a date before the previous date that the rent was paid.

I can only laugh. This is what I usually argue when I about to get paid for my side jobs.
If I start on the 5th of July, people always wanna pay me on the 5th of August. And that'll make me work an extra day.
Look at it this way : From Sunday to Sunday is how many days?
And we all know 7 days make 1week.
So, to get the 7 days, you must count from Sunday to Saturday. If you add Sunday again, you have started another week

If your rent begins January 1, it expires December 31 not January 31.

Very good, a day after Dec 31 is 1st Jan right? So why is it April 18 - March 17 to u and not April 17 instead? Is a day after March 17 April 18? I hope u will get the logic now

Your landlord is correct, April to March = 12 months
April to April =13months

Illiterates every where...".Over sabi" and you are even quoting Maths.. So if you are bone in April, Your next birthday will be in March according to your calculation. Or yopu celebrate your bairthday after one year and one month!.

365 days makes one year and 18th April 2019 to 17th April 2020 is one year, that is 365 days ( or 364 days in this case because of leap year). 18th April 2019 to 17 March 2020 is 336 day which is 11 months.!!!

The tenant tenancy started on 18/4/19 as he stated. His rent will expire on the 17/4/2020.

What is written on the tenancy agreement is the determining factor to this. Unless the tenant tenancy agrement states 18th march and tenant moved in 18th april, his rent will expire 17th march 2020 unless there is an oral agreemnt with the landlord for waiver of 1 month to probably carry out repairs.

On the issue of notice to quit. According to lagos state tenancy law 2011 implemented by the then govt of babatunde fashola. The tenancy terms are fixed term. If you pay for 1yr rent, at the end of the tenancy, your landlord can give tou 7days notice of possession. But, after that first year, if you pay subsequent years, like you have spent 2yrs, 3yrs, 4yrs in the house. The landlird will serve you 6months notice to quit if he intends to evict you and in some cases the 6months notice to quit expires with your tenancy. If he serve it at the expiration of your tenancy, you are supposed to pay for the period of 6months notice to quit, which is mesne profit or pro-rata rent calculated per month.

If the 6months expires, the landlord aerves your 7days notice of possession which he can take legal actions to recover his property.

It is because of our poor legal system where tenant runs away in the night without tracing that makes people think they wont pay when they are given notice to quit.

Some benevolent landlords/landladies even wave the period so far the tenant will vacate and hand over keys to him/her.

The confusion there is that it wasn't April 1st.

I wouldn't wanna insult you...instead, I'd reiterate my stand on this issue..in my earlier posts...I made mention of the rationale for such calculations and I stated an old statute not limited to Nigeria alone...most Tenancy agreements that are meant to exceed a year, require some sorta registrations, seal, stamping and a charge...this means the Landlord is expected to pay a percentage...
So, some Tenancy agreements would intentionally hide under this 11months calculation so as to evade paying such charges..that's why some use the 11 months calculation..If your wanna register your tenancy agreement as a tenant...you can do it, but some landlords will not want it coz it means they have to pay the percentage charge..Hence, they hide under the 11 months calculation...making it seem like they are leasing out the said property for just 11months. Hence, they calculate it on 12 months basis thereafter...so, no agreement needs to be registered..

You are coming closer....The rent expires on 14th April and is due on 15th April (which is the-same day he paid in the previous year)

How many number of days do you get counting from January 1 to December 31? Count the same number of days from 18 of April and see where you will stop at March. Is there any date like April 2019? Is either 1st April 2019 or 4th December 2018 or any date. There is nothing like January to December. there must be a known date for the computation to be complete.

Take a look at sections 13(5) of the tenancy laws of Lagos 2011. There are always exceptions to the law.

Oh again mr poster, i hope there is no clause in the tenancy agreement that states that you must pay a month before expiration of your rent? Your landlord might be hiding under that clause to request for his rent.

Please bring out Your tenancy agreement and read if there was one. Because i know many tenants don't read tenancy agreements and landlords put some clauses to protect themselves too in it.

The rent will expire on 17/4/2020 following a year rent unless there is an agreement btw you and the landlord that it will expire on march 17,2020 which means he counted that 12days in April (18th-30th) a month which is not supposed to be....

Jan - Dec is 1 year not Jan-Jan.

Another instance is if you enter NYSC orientation camp today (02/04/2020) d POP date that will show in ur dashboard is (01/03/2021).

i hope i am able to convince you and not confuse you. Just take it easy with ur landlord and not try to claim anything because he will win.
