When someone pays rent on January 1 it will due on December 31. That's 12 months

Now how many days difference between Dec 31 and Jan 1 of the following year? It's just one day difference

Now for him that pays on 18 of April, his rent should due by 17 of April the following year.. That is also one day difference

If we go by your conclusion which is 17 of March, that's 30 days different. That's 11 months, not 12 months

I am a lawyer called to the bar in 2008.I have been practicing law for 12 years now. I am shocked at the level of ignorance exhibited by some folks here even after being corrected.
Under the Nigerian tenancy laws, a year is 365 days ie 12 calendar months. The OP paid for 1 year which makes him a yearly tenant.
A yearly tenancy expires on the eve of the anniversary of the tenancy.In this case the OP's tenancy became operational on the 18th of April,2019. The tenancy therefore terminates without more on the eve of the anniversary of the tenancy which is 17th of April 2020.
That is complete 365 days or 12 months.
Even if he paid on the 29th of March the law will take the last 2 days of the month into cognisance in detemining the computation of 365 days.
Any other calculation is erroneous.He is entitled to pay his rent latest 17th of April, 2020.

Now if he does not pay by that date, his tenancy expires on the basis of effluxion of time. If he holds over without paying after that date he becomes a tenant at will and is entitled to 7 days quit notice.His landlord still has to go to court to apply for a notice of owner's intention to recover possession.

However where by reason of the tenancy agreement the tenant pays on or b4 the expiration of his tenancy, the tenancy continues and remains extant for another year that is assuming he still pays for 1 year.

I hope this settles the controversy. If you argue after this then you have a special bed space reserved for in Timbuktu.Dont mention pls

If you count April again, that'll be 13

If you don't have any intention of leaving the house, pay him ASAP.

A year starts from the 1st of January and ends on the 31st of December. 12 months.
Your birthday is always on a particular date(say 20th December), a calendar year ends on the eve of the said date.

If he paid, say on the 1st of April, his rent ends on the 31st of March. (April - March).
But in this case, he paid on the 18th of April, so the extra 17 days are automatically added to, therefore spanning to 17th of April.

More so, Nysc is not always a complete a 12-month calendar year. Mine was from 5th of May to 14th of April.

no notice to quit and he wants to evict you. Get a lawyer to send a letter to him. He is using self help which is against the law. Once your rent expires and you have not renewed, he is supposed to give you notice of owner's intention to recover premises. I can write a letter to him but it comes with a fee.

Im sure you are conversant with tenancy for a 'fixed term' if that clause was inserted in the agreement it is an escape route for the landlord see sections 13(5), 24 & 26 tenancy laws of Lagos.

It is evident that there is no tenancy agreement otherwise parties will not be in dispute on the date of commencement.
It can thus be deduced that the tenancy is one of a yearly tenancy and not a fixed term.
