OK... Did this Tribunal starts its sitting since 8months..?

Well, I believe Covid disrupted and extended its sitting. Anyway, a judgement has been given, and unless set aside by a higher court, it stands.

That was a preelection matter, if the deputy can provide the minimum required which is just proof he attempted WAEC he can partake in the election. The constitution in itself gaurantees his right to vote and be voted for where he has not been convicted of a crime within past 10 years.

Gbamsolutely. The problem is all man for himself. You remember how they deserted the dancing senator during the Osun election? They only came to pay him a visit and never stood by him during the election and APC robbed PDP day light off that mandate. While about 6 APC governors camped in Osogbo till they declared the present governor the winner. Wike is a force to recon with in PH but outside PH, na another man zanga ooo.

Not the end of the Road, this is Nigeria angry

They should use the refund of his salaries so far to subsidise the fund for the re-election.

Did he not assume office? Which refund?

Ok if he refunds who will compensate him for the time wasted?

I’m an APC supporter but we all need to be empathetic lol

What a country

What he meant was that does the tribunal not have expiry date for a petition.
Like in the case of Lyon vs Lokobiri, the supreme Court ruled that the tribunal time for the petition expired before the judgement that removed Lyon

A Tribunal definitely has a duration. So many things were grounded due to the pandemic, and I believe that's the reason it extended up to now.

The Apex Court's disqualification of the APC's candidate was a pre-election matter. This ruling is given by an Election Petition Tribunal set up to hear post election cases. The ruling could still be challenged up to the Supreme court level.

By Pre-election, do you mean that the case was in court before the election?

Also, I thought that there is a 90 days allowance to challenge an election? So how come we are still hearing this kind of news from that state?

Bayelsa state governorship election tribunal has nullified the gubernatorial the election of Bayelsa state that was held in November 2019.

The tribunal took the decision after it agreed with the candidate of Advanced Nigeria Democratic Party that it was unlawful for the Independent National Electoral Commission, INEC, to exclude the party from participating in the election.

The court ordered for a fresh election within 90 days.

AHHHHHHHHHHHHHHHHHH. The sad thing is the masses will pay for the nonsense all these people are doing. Both PDP and APC. That small state won't see any reasonable development in a long while. Pity.

Question is who will be the sitting governor for the next 90 days? Is it the same governor or the speaker becomes the governor since the election has been nullified.
speaker

You are not correct. A nullified election means that the candidates and their nominations are no longer recognized by the court. The court deems it that nothing happened at all.
Please go and read and get some knowledge.

Primaries and substitution of candidates are pre election matters and are not affected by this judgement.

Haha, you don't know anything. You should take your own advice and go read up what constitutes an election as defined by the electoral act guiding elections in Nigeria. An election starts from when INEC gives a notice of its intent to conduct it. Everything from the primaries to when the Supreme Court puts a final seal on an election matter are all part of an election.

What many people don't know is that many of those mushroom parties are surrogates of the leading 2 parties in Nigeria (APC and PDP). It is for reasons like this that they keep those surrogates always contesting in elections and that is why we see parties scoring 1,500 votes, 750 votes etc and we start wondering. Three things may happen. 1) The current governor to appeal and win his case (Best option) 2) Another election is conducted with Lyon participating (Very unlikely) 3) One of the surrogates mentioned earlier activated, with APC actively campaigning (See Rivers elections) with federal might etc. So to me, the best option is for the current governor to get good lawyers and appeal this case to the last. It is risky for him to participate in a fresh election because A RULING PARTY HARDLY LOSES AN OFF SEASON ELECTION (by hook or by crook) !!!

If both courts rule in support of the tribunal in less than 60 days, who becomes the sitting governor? Speaker? And speaker na PDP guy so PDP keeps ruling till after election. I have a feeling Lyon will still win this election.

grin

I don't see that happening lets be sincere...

Appeal court or Supreme court will overturn the judgment.

There would be no room for fresh primaries nor substitution of candidates. These same candidates that participated in the previous election would participate in the fresh election. APC has no candidate.
