The reason is so stupid. The Governor will appeal and will still remain the Governor till Appeal sits. Development in Bayelsa will be delayed.
The governor can't appeal cos the case is between that small party, tribunal and INEC not PDP. The only person that can appeal the case is INEC and APC will participate in a fresh election by substituting the name of their deputy like the supreme court ruling of the former Bauchi state governor who won election but the supreme court nullified his victory for presenting a deputy that forged his certificate and order for a fresh election. The ex Bauchi state governor presented a new deputy, contested and won the fresh election. I'm very sure you were young then to know this history. grin

If ANDP is to participate in the fresh election it means they would conduct primaries to be able to field a candidate and this is a process of its own.

So if they are allowed to conduct primaries it simply follows that every other party will conduct fresh primaries.

ANDP had candidate that was disqualified so no fresh nominations

There would be no room for fresh primaries nor substitution of candidates. These same candidates that participated in the previous election would participate in the fresh election. APC has no candidate.

The sitting governor remains the governor untill the case gets to the Supreme Court and the Supreme court uphold d the judgement...

The next stage is appeal court anyway... And if the judgement of the appeal court states otherwise... Case closed.

Put another way, why would the law allow the INEC to correct its "mistake" or misrepresentation of the law, and the parties would be denied such an equal opportunity within the same process?

How can you also legally prove your case of unlawful exclusion when elections have not taken place? It is only when the election holds and you are not part of it that you have a ground to appeal.

Unlawful exclusion of any form including party logo can be challenged only after elections.

Natasha Akpoti's deputy in Kogi State..... Her deputy was disqualified for been under-aged and she went to the FHC in Abuja two weeks before the Kogi elections.

Justice Giwa averred that INEC was wrong and the man's name should be restored on November 9, 2019.

Kogi elections took place November 16, 2019.

Post-election cases in Nigeria now has a time limit of 6 months. Its now impossible for a governor to almost complete his tenure before his case is decided at the Supreme court.

This is a fresh election. The party that was excluded will be allowed to submit their candidates, so would APC submit candidates.
The time for nomination/submission of candidates has elapsed. Only the party who went to court to get this judgement will be included. All other parties/candidates remain the same.

Imo state was a case study.The fourth position became the winner.

The "fourth position" only because many votes cast for him, were criminally excluded from the votes count to begin with. ICYF, the courts reversed those criminal exclusions and corrected that shenanigans.
