There is no doubt that they have a right of appeal against the ruling of the court but whether the proceedings of the court should be stayed is another matter entirely. I think it will boil down to whether the court considers them a necessary party or not. Judging by the refusal of their application to be joined, the court doesn't consider them a necessary or even desirable party.
Thus I don't see how the court can allow their motion for stay of proceedings. To do so would be to Approbate and reprobate in a way. Why grant a stay of proceedings to someone whom you think is not necessary to the case in the first place. They have a better chance of getting the stay at the court of appeal.
I totally agree with you but on the other hand, don't you think that such interlocutary appeal against the ruling of the court should ordinarily act as a stay at the lower court?

Are the law makers ignorant of their powers? Don't they know what to do when the President fails or refuses to veto bills? (I bet you don't know too)
And FYI, a bill doesn't become law until the necessary assents have been secured.

I wonder why the affected constituency was denied the opportunity to be joined when they have sufficient interest in the suit. But then again, if they have not been joined, do they have the locus standi to bring an application for stay of proceedings when they are not a party before the court?

Hehehehehe. I understand you jare. But mehn, some divorce cases can be sooooo somehow. I once witnessed one, where the case was high on the cause list and the lawyers on both sides were stylishly telling the judge to stand down the hearing of the case until the last case on the list, but the judge declined. They didn't want the case to be heard in a packed court because both parties were present. When the woman took to the witness box and started testifying in open court, within about twenty minutes the judge practically chased her out of d box n stood down the case until three pm. The things she was saying were just too raw. Very messy case I tell you. I have never seen anything like that again.
Lols. I can imagine. But I pity the parties whose private lives are being laid bare for the world to make a jest of and be entertained by. It's unfortunate.

I remember the day he came for his divorce proceeding. Na so frank just gentle inside the witness box. All the gra gra that he usually displays on TV weren't there. I actually pitied him when he was telling his story.

Lols. It's ok. But the thing is, such order of mandamus has not even been made. PDP only obtained the leave of court to be able to bring the application wherein they would ask for an order of mandamus to be made against Aminu Tambuwal. The court also reserves the discretion to grant or refuse such application when eventually brought.
