p3ndy79:You are pardoned sir.. A writ of summons is an originating process i.e, it is used to commence an action in court. An order of mandamus proceeds from the bench(Judge) during the course of an action already pending in court, it is totally different from a writ of summons which is issued by a lawyer. 3 Likes |

No court can convict a person based only on evidence of mens rea which was not followed up by actus reus. In other words, mere intention to commit a felony is not enough to secure a conviction unless such intention was followed by an overt act in furtherance of such unlawful purpose or intention. |

The speaker should have known the constitutional implication of cross-carpeting while in office. However, I'm of the opinion that the House should not take any further action on the issue since it is before the Federal High Court already. OP, your landlord has done his part by serving you a 6month quit notice which is to expire in December 2014, it's his property and he does whatever he wishes with it. However, if the tenancy agreement stipulates the conditions under which you may be ejected and you thing his reason for ejecting you is not covered by the said clause, then you may want to wait until he serves you a 7day notice and subsequent court processes in which case you will have the opportunity to contest your ejection. My advice to you though is to start looking for an alternative apartment because the court will hardly force a willing tenant on an unwilling landlord. |
