The accused are Shu-Uei Tsao, 42, Biao Ma, Hui Chen, 50, Quin Li, 56, Zhou Jiaquing, 46, Junying Dai, 58, Zhilian Zhang, 51, and their company Beautiful City (Pty) Ltd. “The police received a tip-off about an illegal factory employing foreign nationals, prompting them to conduct a raid.” The factory produced cotton-fibre sheets. After the raid, police led an investigation which revealed that between 2017 and 2019, the accused operated Beautiful City and employed 91 undocumented Malawians, including 16 minors aged between 14 and 16. “Upon their arrival, the victims were confined to the premises under inhumane conditions, with armed guards controlling their movements. The victims were forced to work 11-hour shifts, seven days a week, without proper training or safety equipment,” Mjonondwane said. She said senior state advocate Valencia Dube presented further evidence, calling several Beautiful City employees, mostly Malawian nationals and one South African truck driver, who testified about being deceived into working at the factory with promises of a better life. Many had previously worked at Chinese-owned factories and were recruited under false pretences. The victims described harsh conditions, including being transported in windowless trucks to the factory, which they were not allowed to leave. They worked long hours with no breaks, were forced to work on holidays and were prohibited from bringing in food. Personal communication was banned and they were made to operate defective machines without protective gear, leading to accidents. One worker lost a finger and was denied medical care. The factory had a high wall, razor fence and armed security, reflecting the exploitive environment, with workers often threatened with firearms and subjected to extreme control. Judge David Mhango ruled the accused were liable for the offences. “The NPA welcomes the conviction, as it demonstrates the dedication of law enforcement in addressing organised crime and human trafficking cases,” Mjonondwane said.

Farmers and agricultural workers are flooding into South Africa from neighbouring countries such as Zimbabwe, Lesotho, Namibia, and Mozambique. This data was detailed in a recent Parliamentary Q&A, where the Department of Employment and Labour (DEL) was asked for the total number of work permits issued in the last financial year. In response, the DEL explained that it provides recommendations on corporate work visa applications regarding the availability of local labour in various categories. According to the department, it received 60 corporate work visa applications covering 6,255 migrant workers. Of these, the DEL negatively recommended (rejected) 5,383 (86%) and positively recommended (approved) 872 (14%). The approved visas included workers from several countries, including China, India, the Kingdom of Eswatini, Namibia, Mozambique, Lesotho, Pakistan, the UK, Israel, and Zimbabwe. The various sectors included agriculture, education and training, manufacturing, mining, maritime, wholesale, and retail. However, 91% (796) of the recommended approvals of work visas from the Department of Employment and Labour were for farmers and agricultural workers. Most of these foreign agricultural workers came from neighbouring countries, Zimbabwe (445), Lesotho (250), Namibia (70), and Mozambique (30). WHY ARE THEY COMING TO SOUTH AFRICA? The chief economist of the Agricultural Business Chamber of South Africa (Agbiz), Wandile Sihlobo, told BusinessTech that these migrant farmers and workers are moving to South Africa for better opportunities and pay. “South Africa’s agriculture is robust and growing. We had about 924,000 people working in primary agriculture at the end of the last quarter of 2024. “There are workers in the sector from neighbouring countries who are attracted by competitive wages in South Africa’s agriculture,” he said. “The revised agricultural Minimum Wage in South Africa is R28.79 per hour. In Namibia, the sectoral determination for farm workers is at R10 per hour.” This makes work in South Africa attractive, he said. In some instances, Sihlobo added that farmers also provide lodging, which assists. Some, such as Lesotho, bring unique skills in sheep shearing, amongst other aspects. However, Sihlobo stressed the importance of ensuring that South African workers receive primary work opportunities and that neighbouring countries supplement them when necessary.

These were the findings of the Competition Commission's Media and Digital Platforms Market Inquiry (MDPMI) provisional report, which was released on Monday. The report called for action against search engines like Google and social media sites like Meta. The MDPMI was created and empowered by the Commission to establish an inquiry to investigate if there are features that may prevent and impede competition in the South African media landscape. GOOGLE NEEDS TO PAY Paula Fray, a panel member at the commission explained search engines like Google play a major role in helping and hurting South African media organisations. She explained that Google receives between R800 to R900 million from South African news content. The search engine, however, destroys around R160 to R200 million in potential value for South African media. “Our assessment is that the imbalance in the share of total value is around R300 to R500 million annually,” Fray said. The inquiry also found that there is a definite bias in Google’s algorithm, and this disadvantages South African media organisations in favour of international news outlets. THE ROLE OF SOCIAL MEDIA The MDPMI found that a majority of South Africans use social media as their primary news source. The report found that platforms like X, TikTok, Meta, and YouTube drive news consumption in the country. Fray said that Meta and X have deprioritised South African posts with links and this reduces referral traffic. The report also found that South African news outlets are struggling to monetise views on YouTube in particular. R300-500 MILLION IN COMPENSATION James Hodge, the MDPMI chairperson said that South Africa needs to impose a 5-10% digital levy or tariff on social media and AI companies to compensate SA media for their loss in revenue. He said that search engines need to also restore referral traffic. Google needs to adjust search algorithms to support SA news media and reduce bias toward foreign platforms, Hodge explained. These search engines also need to help support monetisation. He said that Google for example needs to share anonymised user data and provide SEO assistance. In terms of direct compensation, Hodge said that Google should pay SA media houses between R300 to 500 million annually over 3-5 years to address lost revenue and the imbalance in shared value. He also added that Meta needs to stop deprioritising news on the Facebook feed to restore referral traffic to the media from its peak with at least a 100% increase in referral traffic. It is important that Meta and X also stop deprioritising news posts with links in the user feed. Lastly, Hodge said that YouTube needs to improve the ability of the media and broadcasters, including the SABC, to monetise their content on its platform through increases in the revenue share to 70% and active promotion of higher value direct sales by the media.
