Toxic Waste Ship Berths in Apapa

A ship laden with toxic waste with registration name Maersk Vashville Hamburg berthed yesterday at the Tincan Island Port, Lagos.

Worried about the deadly implications of the arrival of the ship, relevant government authorities are meeting today to work out a plan of action.

THISDAY had reported that the ship loaded with toxic waste was headed for the country today but it arrived ahead of time.
A Dutch agency, VROM-Inspectorate and the International Network for Environmental Compliance and Enforcement (INECE) blew the alarm.

And as expected, the ship from Maersk Line, with registration number IMO 9304760, berthed at the Tin Can Island Port.
The important meeting will take place at 10.am and would involve officials from the Nigerian Navy, Nigerian Customs Service, State Security Services (SSS), Nigeria Police, National Environmental Standards & Regulatory Enforcement Agency (NESREA) and other relevant Federal Government agencies.

Director-General and Chief Executive Officer of NESREA Dr. Ngeri S. Benebo told THISDAY yesterday that her agency has not been receiving the cooperation of the Nigerian Ports Authority (NPA) since the arrival of the ship.

“My deputy director came from the headquarters and on her way, she was called by the Ports Authority that they (NPA) have already checked the manifest and the container is not there. That was what the NPA told her.

“At the same time, the Maersk Line also called my office and told my Special Assistant at about 2pm that she should tell me that they have checked the manifest and the container is not there. So, we should tell the ports authority to allow them do whatever they want to do. But I told her to tell them that I can’t attend to that now and I am coming to Lagos,” she said.

She further stated that the NPA invited her deputy director to a meeting scheduled by 5pm yesterday but she insisted that their assignment was to check the manifest and not to attend any meeting.

“But there is nobody to give instructions, everybody in NPA has gone. My officers have been here but they have not talked to my officers on the issue. But hopefully, by 10 am tomorrow (that is, today), we will meet at the Port Manager’s office and may be, from there, we come here and start work,” she said.

Benebo stated that she was not satisfied with the level of security of the ship and expressed worry that the ship or its content might disappear.
The director-general stated that the container was being tracked abroad to be impounded before being shipped into Nigeria but it slipped along the line.

“They were being tracked when they were about to be shipped so that they can be impounded. But along the line, the containers slipped and they could not locate them. So, by the time they were able to successfully track the containers to know which ship would carry them, they realised that it was on this ship coming to Nigeria.

"We got the alert on April 6. As a matter of fact, they said it was going to berth on April 16. So, they too must have got wind that Nigerians are on alert. They felt that we may not be prepared. So, they made sure it was here this morning,” she explained.
She confirmed that despite several protests, the Nigerian Customs has rebuffed all attempts to accommodate NESREA in the ports, thereby undermining efforts at policing the influx of toxic and hazardous products into the country.

The VROM Inspectorate, an independent unit of the Ministry of Housing Spatial Planning and the Environment, is the abbreviation of the Dutch name for housing, land-use planning and environmental management while INECE is the global network of environmental compliance and enforcement practitioners.

THISDAY gathered from documents obtained exclusively  that the vessel, NASVILLE operated by American President Lines (APL), a wholly owned subsidiary of Singapore-based Neptune Orient Lines, has some 70 storage (lead) batteries classified as Basel-code A1180, broken television among other things.

The Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposa (Basel Convention), which Nigeria is a signatory to, lists products under code A1180 to include waste electrical and electronic assemblies or scrap containing components such as accumulators and other batteries, mercury-switches.

Others include glass from cathode-ray tubes and other activated glass and PCB-capacitors, or contaminated with constituents such as cadmium, mercury, lead, polychlorinated biphenyl.

These hazardous wastes are responsible for a wide range of abnormal health conditions including congenital heart diseases, cancer, and leukaemia.
This is not the first time that a ship with toxic waste is being sent to Nigeria.

In April 1987, a ship with solid toxic waste arrived the Koko Port in Delta State through Benin Republic but then it was not illegal to transport wastes to other countries. However, the uproar it generated prompted laws to change such act, particularly in countries that lack the capacity to turn waste into good use. All the residents where it was dumped died within 3 years.

Yar\'adua\'s role in shielding ibori through the instrumentality of oandoakka is most unfortunate,now that both characters are out of the way,ibori has no hiding place again.Most regrettable however is the role played by efcc under mrs waziri who decided to play to the gallery by deliberately diluting the evidence presented to the court thereby paving way for ibori\'s acquittal by the court of appeal,this casts a big slur on the continued chairmanship of mrs waziri in the post-yar\'adua\'s dispensation.

What I dislike is Waziri\'s antics of playing politics with her position and office. She likes to pretend to be fighting corruption when in the real sense protecting and abetting the vice. Nothing has been heard about EFCC\'s appeal against Ibori\'s acquittal. Nigerians fail to understand that EFCC chooses weak and compromising lawyers, prepares a weak argument inorder to lose the case and blame the courts, or claim they are following \"rule of law\". Farida Waziri has lost the confidence to speak against the backdrop of the news that Ribadu might be back. She along with notorious Aandoakaa worked assidously to protect corrupt people. One of Ibori\'s file that was awaiting destruction has finally been revived. Last week Waziri spoke apparently through Festus Kayemo against the withdrawal of charges against Ribadu; Can the \'learned\' Kayemo dispute the fact that Ibori is an ex-convict in Britain which information was not disclosed in his (Ibori\'s) Code of Conduct form. Which Nigerian govt has charged him on this?

According to court documents sent from the UK to the Economic and Financial Crimes Commission and obtained by our correspondent in Abuja, Ibori had been charged for theft in the UK, alongside his then girlfriend, Miss Theresa Nkoyo Nakanda.

Ibori, who was working as a cashier at Wickes Store, in Ruslip, London, in 1990, had allowed his girlfriend to pass through his check without paying for the goods she collected.

He was said to have proceeded to dispose of the till receipts in order to cover up the theft.

Both were charged with one-count of theft under Section 1 of the Theft Act 1968, of the UK, and fined £300 British sterling and ordered to pay £450 as costs.

A signed statement by a British police officer, Mr. DC John McDonald, who arrested Nkoyo Ibori in 2007, on suspicion of being involved in money laundering, stated that the EFCC had requested the documents concerning two previous convictions held on record in the UK, for prosecuting their case against Ibori.

Mcdonald stated, “On November 1, 2007 at 2050 hours, I arrested Mrs. Theresa Nkoyo Ibori at the Heathrow Airport on suspicion of being concerned in money laundering. She was later conveyed to the Police Station at Heathrow Airport.

“During the procedure of booking in Mrs. Ibori at the police station, it is routine to obtain copy of her fingerprints, these fingerprints are obtained on the computer-based National Automated Fingerprints Identification System.”

McDonald noted that should the fingerprints obtained match with any already held on police national fingerprint database, then a report would be produced in due course.

“As a result of Mrs. Ibori’s fingerprints being taken, a report was produced stating that the fingerprints were an exact match to a set of fingerprints held for an individual, Theresa Nakanda, under the Police reference number 134269/90F,” the statement read.

The documents made available exclusively to The Punch, further stated that the prints were obtained on August 28, 1990, at Uxbridge Police Station, adding that Nakanda was Mrs. Ibori’s maiden name.

Continuing, it confirmed that Ibori was on February 7, 1992 at the Isleworth Crown Court in the UK, convicted of one-count of handling stolen goods.

“The circumstances of that charge relate to Mr. Ibori’s possession of a stolen American Express Card belonging to another knowing or believing that card to be stolen,” it added.

It noted that the original arrest for that offence took place on September 12, 1991 at Euston Rail Station, stressing that Ibori was fined £100 and ordered to pay £50 as costs.

“During the procedure following the arrest, Ibori provided the address of 3, Atherstone Road, Harrow, Middlesex.

“I can confirm that as a result of documentation in my possession that James Ibori and Miss Theresa Nakanda once owned this property,” McDonald added[/size16.[/b]

Gov. Uduaghan, who was reputed to be worth about N3b when he became the governor of Delta State, did not have a history of wealth. According to sources in Delta State, Uduaghan worked in Delta Steel Company as a medical doctor and later established his own clinic in Warri. The clinic was not “a great financial success” as to put him in the league of very rich people in Delta before he was appointed the commissioner for health, Delta State. Elendureports.com spoke with a Delta businessman who claims Uduaghan approached him for business months after he was appointed health commissioner.
Elendureports.com has also discovered some properties in the Washington, DC area tied to Uduaghan. The properties are located at Millennium Square. PH 3-A North and 5-C North, 1155 23rd Street, N.W. Washington, DC 20037 are properties allegedly owned by Uduaghan. However, the Uduaghan who owns these properties is Victor, a pediatrician based in Newark, New Jersey.
Victor Uduaghan, an assistant professor at New Jersey Medical School graduated with an MBBS degree from the University of Benin in 1994. He did his residency between 1999-2002 at Mount Sinai School of Medicine at Jersey City Medical Center, Jersey City, New Jersey.
On the 10th day of May, 2001, 2200 M Street LLC sold apartment 5-C North, 1155 23rd street, N.W. Washington, DC 20037 to Flatwillow L.L.C for the sum of $1,180,000.00. The apartment consists of 2 bedrooms, 2.5 baths, and occupies a space of 1,859 sq ft. However, the apartment was registered as sold on June 19, 2001. The current value of the property is about $1,173,690.00.
About six weeks later, 2200 M Street LLC sold another apartment to Flatwillow L.L.C. The cost of apartment PH 3-A, 1155 23rd street, N.W. Washington, DC 20037 was $3,250,000.00. This apartment consists of 4 bedrooms, 4.5 baths and occupies a space of over 3000 sq ft. The deed shows it was sold on June 27, 2001, however, our investigations show there was a sale of this same apartment on July 17, 2001.
According to court documents, Millennium Square is supposed to be affiliated to the Ritz Carlton hotel chain and had promised “the highest quality, most luxurious building in Washington DC.”
Our sources allege that the two apartments mentioned above belong to Victor Uduaghan, the younger brother of the Delta State governor. From all available records, Victor Uduaghan was doing his residency at Mount Sinai School of Medicine in New Jersey in 2001 when the properties were purchased.
The only plausible explanation, according to sources, is that Emmanuel Uduaghan, who in 2001 was a member of the Ibori administration used his younger to buy these multimillion dollar properties in Washington, DC.
Our search revealed that Victor Uduaghan owns a property on 1155 23rd street, NW Washington DC. Documents in our possession listed him as having a DC area phone number. When this reporter called the number it was disconnected. Victor Uduaghan’s name is not on the list of residents at the Millennium Square.
Some of the prominent residents at the Millennium Square are: Majority Leader of the United States Senate, Sen. Harry Reid, Sen. Frank Lautenberg of New Jersey and the publisher of Thisday Newspapers, Nduka Obaigbena. Obaigbena bought his apartment in 2006 for $1,950,000 from another Nigerian. A former Nigerian governor owns some apartments in the building. We are withholding his name for now.
Elendureports.com contacted Gov. Emmanuel Uduaghan in the course of writing this story. This reporter sent him a text informing him about this story and asking for his comments. About 30 minutes after we sent the text message we were contacted by 2 top officials of the Delta State government. It was suggested to us that a face to face interview with the governor could be arranged. We insisted on a telephone conversation with the governor. One official promised to get back to us. As at the time of writing this story, about a month later, there has been no contact from anybody.

The Economic and Financial Crimes Commission has stormed two big banks and quizzed some top officials of the Delta State Government in its bid to establish the veracity of a petition filed against former Governor James Ibori. The anti-graft agency has also launched a fresh manhunt for the former Governor with its operatives now trailing him for arrest.



Ibori is wanted to make a new statement following the fresh petition sent to the EFCC by the Delta State Leaders, Elders and Stakeholders Forum.



In the petition submitted by the DSLEF, led by Chief Edwin Clark, the Forum alleged that Ibori used 800 units of shares owned by the Delta State Government in Oceanic Bank Plc to secure N44bn private loan from Intercontinental Bank Plc during his tenure as governor between 1999 and 2007.



Saturday Punch investigation revealed that EFCC operatives had obtained a statement from Clark in his Abuja residence, during which the former Information Minister shed light on the petition, while forensic auditors had examined the books of the Delta State Government and the two banks in continuation of their investigations.



It was gathered that detectives from the anti-graft agency had visited Asaba, the state capital and took hold of documents relating to the shares and loan transactions from relevant top officials of the government and the banks in a bid to establish the veracity of the claim in the petition written by the DSLEF.



The DSLEF had in the petition to the EFCC alleged that Ibori deployed the 800m units of shares in the acquisition of an American oil services company, Ascot Oil, which currently has its headquarters in Port Harcourt, Rivers State.



The group further alleged that 520m out of the controversial 800m units were sold in questionable circumstance.



Consequently, Chairman of the anti-graft agency, Mrs. Farida Waziri, deployed detectives to question the managements of the two banks to establish their connivance or otherwise in the alleged scam.



A reliable source in the EFCC revealed that Waziri mandated the detectives to thoroughly examine the records of the state government and the two banks this time around, since it was believed that their officials did not cooperate with the agency in its earlier move to prosecute Ibori for alleged money laundering offences.



The source also added that the fresh manhunt for Ibori was to enable him respond in writing to the petition by the Delta Elders Forum.



It was, however, gathered that it had not been possible for the detectives to track down Ibori for interrogation on the matter.



The EFCC source said, ”Our detectives have visited Asaba and they looked into the records of the state government. Some key officials of the state government were interrogated by our team to enable us stumble on information that could help us in the course of investigation.



”Our detectives also interrogated the managements of Oceanic and Intercontinental banks to afford them the opportunity to defend their action in the financial scam alleged by the elders of Delta State. The Delta leaders had claimed that 800 million units of shares owned by Delta State Government in Oceanic Bank were tampered with in order to secure a private loan of N44bn from Intercontinental Bank.



”The Delta elders further stated in the petition that the shares were not only mortgaged, but that about 520m out of the 800m shares had been sold in yet uncertain circumstance. The EFCC cannot come into conclusion until our detectives secure the statement of the major players in the deal.



”Our detectives have also launched a manhunt for the former Governor James Ibori because it is quite natural that they must talk to him to enable him to confirm or deny the allegation contained in the petition. The allegations are grievous, and that is why we are looking for ex-governor Ibori to come and give his own side of the story. But sadly, the former governor has failed to make himself available to the detectives.”



Speaking with our correspondent on Thursday, Clark confirmed that operatives of the anti-graft agency had obtained his statement on the petition against Ibori. But he declined further comment.



”Some men from the EFCC have visited my house in Abuja and we exchanged information on the petition we wrote to the commission on the financial malpractices perpetuated by Ibori in the administration of the state, but I don‘t want to speak further on the matter,” Clark said on the telephone.



Ibori could not be reached for comment at press time.



Asked to confirm whether officials of Delta State Civil Service were quizzed by the EFCC, the Commissioner for Information, Delta State, Mr. Oma Djebah, said he could not speak on a matter concerning the former governor of the state. “I only speak for the present government,” he said.



EFCC‘s spokesman, Mr. Femi Babafemi, in an SMS message sent to Saturday Punch in response to the enquiry on the extent of investigation into the latest investigation against Ibori, said the investigation was ongoing.



”The investigation is ongoing. Any further information is capable of jeopardising the process, please,” Babafemi said
