Just imagining....... All things being equal, be expecting response from August. If it is refusals, their decision is always between 3-4 weeks if submission date. So be hopeful |

Zaid123: My spouse to be let me put it that way Let your GF re-apply as soon as the GCMS note is out but for your own, be positive on it and if eventually otherwise, allow your girlfriend application to be approved then you apply for spousal work permit. It depends on who among you has the higher chance of approval sha. |

Zaid123: Dear NL I need an advise I have been a silent reader on this thread for this year i applied for study permit in June though still awaiting their response but my GF too also apply but she was refused last week and we have ordered for gcms note and also write to Dalhousie University to issue her another letter for January. Please I need advise on the following
1 if my application is refused how will it feel to the VO if my GF is applying again and we apply as a couple with marriage certificate knowing fully well that I had already applied for study permit and was refused because I know they will issue a spousal work permit for me
2 looking at the time frame when she’ll apply again maybe by September is it advisable to apply as a couple won’t it show a bit of desperation

Gcms notes is only applicable to the previous visa refusal(s). You add your siblings birth certificate to show your family ties but spouse and children BCs are stronger |

Linzo: That $360 is the approved market rate and not official rate. OK, for example if you're paying for student Visa using paper route you will pay N54,050 against $235 for Visa fee. Please thank me at least letting you know this. Go to bank ask the customer care direct and guide you on how to overseas fee. Omonoba1981: Does that mean going the paper way, seems to be better! Online route is better during the high season period. VFS does send all your docs to Nairobi or Ghana. What they do is to scan the basic docs to them leaving behind many vital docs that explain certain areas of application. |

Is it that one's documents are physically submitted in a designated office here in Nigeria, but they are then sent to Nairobi for appraisal? They are sent to Nairobi for processing but the concern there is that most of the vital documents that explain your situation are left behind in Lagos |

Twallace: You are right. Those Nairobi VOs are doing poor job. They don't seem to look at the application well. This is not the first case Yes, they are trained but many of them in Nairobi treat applications with prejudice. There was a court judgement against one of them at the Judicial review where the court lambasted the VO for poor job done. Somebody who have travelled to the UK, US twice and Canada twice on visit was given limited travel history. The court ordered that another VO should treat the application and the person was gladly approved at the UK office. |

Many people will just post the reason for their refusal or the GCMS notes without posting the initial refusal letter sent to them. The tone of the last in the letter determines what they expect you to do when re-applying. If the visa just asked you to respond to the concerns, you don't need to look for additional documents or new information to supply, the refusal is just to address or explain some grey areas the VO pointed out in the GCMS notes . But if the VO mention that "this application is closed", you need to re-apply if your situation has changed or you have new information to supply. |

rolorolo: Really? Did you see the part where the VO said has savings? Funny enough, I applied alone. He mentioned that I applied for TRV with family. That was in 2016. I have been to Canada before with my family. Besides, the brother referenced in his concerns was very wrong as my co-sponsor is my sister and I presented my birth certificate and hers to proof that we share the same parents. I feel the VO did not review the file thoroughly as what he mentioned as his concern is not a reflection of my application. The person was quick to conclude and with even wrong information which is not reflective of my profile. Respond to the funny concerns and let them know that you meet the requirements. Some VOs have a predetermined motion to refuse application no matter how watertight your applucation may be. |

IF YOU INCLUDE AN AFFIDAVIT O RETURN WITH YOUR APPLICATION AND WAS REFUSED, AFTER ADDRESSING THE VO's CONCERNS, When submitting visa applications, it may be helpful to draw their attention to a declaration stating that you understand the nature of temporary entry, and that you will not overstay. As the Federal Court noted in Zhang v. Canada (Citizenship and Immigration), 2014 FC 499:
''It is apparent that the visa officer has also failed to consider any other reasons raised by the applicant to support her claim that she would return to the PRC. For example, her study plan states that her fiancé lives in China, he owns his own business there and he has purchased an apartment in her name. The applicant’s declaration explains that her fiancé is not interested in living abroad but that her study “is also one part of the preparation for our future career; therefore I will not stay in Canada for long term” (see para VI of the declaration, Applicant’s Record [AR] at 28). The declaration also states that the applicant plans to have a family in China and to take care of her parents there and that she understands the repercussions of failing to leave Canada (at paras VII and IX, AR at 28-29). As stated in Cao v Canada (Minister of Citizenship and Immigration), 2010 FC 941 at para 13 [Cao], “[t]he decision to submit the applicant’s declaration is not a banal gesture. The declaration is a clear statement that the applicant understand the consequences of overstaying his welcome in Canada, and for this reason, it will not happen.” |

Many applications for a temporary visa (TRV) to Canada are rejected because the applicants don’t have bonds strong enough to make them return to the home country.
The form letter of refusal from Canada also advises against re-applying unless the applicant has some new evidence. Since most applicants have done the best job they can with the first application, and have no new evidence to offer, so they give up.
An acquaintance who works wit VOs in a Canadian embassy has a different take on this: apparently it CAN be useful to immediately re-apply, with the same application and same evidence. Here`s why.
The average VO has something like 45 seconds to assess each application for a TRV. Why so many applications? Partly because travel agencies will submit multiple applications for a single client to many countries, hoping for at least one approval out of the many refusals.
So the overworked VO will routinely refuse applications unless there is a compelling reason to approve. But if the applicant re-submits, challenging the VO’s reasoning in a cover letter, but essentially drawing the VO’s attention to the strong evidence already presented in the original application, then the VO has to pay more serious attention, and the chances of approval rise significantly. Essentially the applicant is taking his application out of the big pile of applications in the first in-basket and putting it in the smaller pile for special VO consideration.
At least that’s what my “insider source” says. So, if you want a TRV, apply early, giving yourself enough time to re-apply. If you really want to make the best case, give yourself time to get the CAIPS notes after the first refusal, then address those VO concerns in the new cover letter. |
