Aregbesola’s Emergence Changes Presidential Calculations •It’s the dawn of freedom, says new governor •PDP expresses shock •Hold Obasanjo responsible – Atiku From Tunde Sanni in Ibadan, Chuks Okocha in Abuja and Yinka Kolawole in Osogbo, 11.26.2010 The Court of Appeal sitting in Ibadan yesterday nullified the election of Olagunsoye Oyinlola as governor of Osun State and declared Rauf Aregbesola, the Action Congress of Nigeria’s candidate in the 2007 election as the winner of the gubernatorial poll. The court subsequently ordered the immediate swearing-in of Aregbesola as governor. The judgement signaled a major change in the political dynamics and calculations for the presidential race in the forthcoming election, as it effectively made the ACN the largest opposition party in the country. But in a swift reaction to the judgement, Aregbesola described his victory as the dawn of happiness and freedom for the people of the state while the Peoples Democratic Party expressed shock and surprise over the judgement. Former Vice President Atiku Abukakar, on the other hand, laid the blame for PDP’s loss on his former boss President Olusegun Obasanjo. President Goodluck Jonathan has however congratulated Aregbesola for his victory in the court and pledged to work with him. Senior Special Adviser to the President on Media and Publicity, Ima Niboro said the President assured Aregbesola of the cooperation of his government in the performance of his duties. With yesterday’s ruling, the ACN is now effectively in control of Lagos, Osun, Ekiti and Edo States, while Ondo State, whose governor Olusegun Mimiko captured the state on the platform of the Labour Party, has always had the tacit support of the ACN. Political pundits who commented on Aregbesola’s victory yesterday said they expect pressure to be mounted on Mimiko to decamp to the ACN some time in the future. But even if he elects to remain with the Labour Party or go back to his former party, the PDP, the ACN’s rise in ascendancy, said the pundits, cannot be ignored. They pointed to the fact that with ACN in control of almost two-thirds of the states in the South-west, should the party led by Asiwaju Bola Tinubu forge an alliance with the Muhammed Buhari-led Congress for Progressive Change, they would control the largest voting block in the country that could potentially snatch victory from the PDP during the presidential poll. “Owing to their populations, the South-west and the North-west where Tinubu and Buhari hail from, have the highest number of voters in the country. “All it takes for them is to form an alliance to take on the PDP, and should this happen, this could significantly alter the political calculations for the presidential election in the forthcoming elections,” volunteered one political observer. Another significant outcome of the ruling, observers pointed out, is that the South-west is now in control of the Yoruba progressive and their affiliates, who have traditionally held sway over politics in the region. In a unanimous Appeal Court decision, the five-man panel of justices led by Clara Ogunbiyi nullified the results of the controversial 10 local government areas in the state, which Aregebsola had pleaded in his petition as being fraught with malpractice. The appellate court subsequently gave Aregbesola 198,799 votes as against the 172,880 votes for Oyinlola, to declare him winner of the 2007 election. The affected controversial councils, according to Justice Ogunbiyi who read the lead judgement are: Atakumosa, Ayedade Boluwaduro, Boripe, Ife Central, Ife East, Ife South, Ifedayo, Isokan and Odo Otin. Earlier, Justice Ogunbiyi had dismissed the cross appeal filed by Oyinlola’s counsel Yusuf Alli (SAN) challenging the results of election in Atakumosa West and Ifedayo Local Government Councils. While resolving all the issues raised in favour of the appellant, Justice Ogunbiyi held that the allegations of over-voting, non-counting of votes and irregularities at polling centres bordered on non-compliance with the Electoral Act. Citing the case of Omoboriowo vs Ajasin, the judge held that in election cases, proof beyond reasonable doubt is not criminal in nature but proof based on preponderance of evidence. She noted that the fact that the appellant failed to prove the crime that went on underneath did not mean that he did not have a case, noting that by virtue of Section 137 (1) of the Electoral Act 2006, this will depend on the content of pleas. She frowned at a situation where the lower tribunal treated the evidence of the witnesses presented by the appellant as mere allegations. Citing the case of Agagu vs Mimiko, Justice Ogunbiyi said it was a complete misconception on the part of the lower tribunal and a grievous miscarriage of justice to casually dismiss the evidences given by the 69 witnesses called by the appellant to prove his case. On the testimonies of party agents, which the tribunal dismissed as irrelevant, Justice Ogunbiyi said rather than focusing on whether or not the evidence of the party agents could be relied upon, the concern of the tribunal ought to have been whether the witnesses were competent to testify. She held that the electoral commission offered no evidence to disprove the evidence of substantial non-compliance raised by the petitioner. She pointed out that any defendant who fails to adduce reasons for its defence has tacitly admitted the facts adduced by the plaintiffs. Justice Ogunbiyi said the INEC abandoned its pleading and cannot fault what the petitioners have proven in their evidence. On the controversial expert report, Justice Ogunbiyi said since the tribunal admitted to the witness as being a finger print expert, it acted in error by not according the document its due weight. In all, the presiding judge held that the appellant has been able to prove the allegations of non-compliance with the Electoral Act in 10 of the local government councils and subsequently voided the results in the affected councils. Aregbesola stated that yesterday’s victory was for the entire people of the state and saluted them for their courage. In a statement issued after the ruling, the new governor of Osun State said: People of our land, I salute you. I salute you for your courage! I salute you for your resilience! I salute you for your steadfastness. I salute you for your determination to keep faith with democracy in the face of intimidating odds. I salute you for insisting on justice and fair play." He said he clearly won the election on April 14, 2007, but "a pack of brigands, backed by the then do-or-die presidency and supported by a compromised segment of the security forces, stole our votes, subverted the popular will and illegitimately imposed themselves on us." The ACN in a statement by Lai Mohammed, its spokesman said yesterday’s judgement "struck a final, deadly blow against election riggers, who must now be consigned into where they belong – the dustbin of history." The party said the victory "is particularly sweet music for all democrats, who have continued to fight to wrest Nigeria from the deadly cabal of election riggers, who have made Osun State their base." However, the PDP expressed shock and surprise over the judgement. Its National Secretary, Abubakar Kawu Baraje said the judgement of the Court of Appeal sitting in Ibadan came to the party as a rude shock. ''This is a rude shock to us as political party. What we won through the ballot box, is gradually been taken away from us through the courts. Let the opposition continue to win through the court. PDP will continue to win through the ballot box. “Osun State is a PDP state. The victory of the Action Congress of Nigeria will be shortened. We will take back our mandate,'' said Baraje. However, the Atiku Abubakar Campaign Organisation blamed former President Olusegun Obasanjo "for PDP’s serial losses in the South-west." The organisation said Aregbesola’s victory was a consequence of Obasanjo’s mismanagement of the PDP in the entire South-west. "Obasanjo should just get out of the party so that we can rebuild the party we formed. All Obasanjo has done in his South-west zone was to tear down the party, cause divisions and force out credible and loyal party members," the campaign organisation said. In his reaction, Oyinlola, speaking through his Chief Press Secretary, Lasisi Lagunju said: "The decision has come to us as a rude shock and we see it as a further test for this democracy. “We note that the judgement went as predicted by the ACN, which had in the last couple of days inundated the media with what was going to be. "Prince Olagunsoye Oyinlola as a law abiding citizen and a stakeholder in the Nigerian Project, wishes the ACN and the judiciary the best of luck. “In the last seven and a half years, the administration of Prince Oyinlola did its best to lift Osun State from the morass of despondency he met it to a level which today is the envy of all." Governor Kayode Fayemi of Ekiti State congratulated Aregbesola and said: "The judgement of the Ibadan Court of Appeal on the Osun gubernatorial election has once again, given hope to the hopeless, and a blow against election riggers, who must now be consigned into the dustbin of history." Meanwhile, it was jubilation galore in Osun State yesterday following the victory of Aregbesola in the court. Many ACN supporters were seen on the streets jubilating and using their brooms to sweep the major streets in Osogbo as a symbol of sweeping Oyinlola and PDP away from the state. |
