Appeal Court President rejects ‘unholy’ promotion

Yusuf Alli and Jimoh Adekunle 06/02/2011 01:04:00
Justice Isa Ayo Salami

The President of the Court of Appeal, Justice Isa Ayo Salami, has rejected moves by the Chief Justice of Nigeria, Justice Aloysius Katsina-Alu (CJN), to promote him to the Supreme Court.

Salami, in a protest letter to the CJN, described the plan as an “unholy move,” that would set a “dangerous precedent.”

In the last one week, there had been tension in the judiciary over the reported plan to remove Justice Salami and the querying of five judges over the recent judgment of the appellate court on Ekiti and Osun Governorship Election Petitions.

Those queried are Justices Clara Bata Ogunbiyi (who led the five-man panel on Osun Governorship Election Petition judgment) M. R. Garba; P. A. Galinje; C. C. Nwabueze; and A. Jaure.

Salami’s letter with the title “Offer of appointment to Supreme Court-Rejection” was dated 4th February 2011 with reference number PCA/S.25/Vol.I/143.

The letter reads: “A few months ago, I heard of rumours going round that plans have been hatched in certain quarters to remove me from the post of President of the Court of Appeal of Nigeria. My reaction then was dismiss these rumours as the talk shop gossip emanating from idle gossips or mischief makers.

“Regretfully enough a few days ago, precisely on 2nd February 2011 when I returned to Abuja from Ilorin where I had gone to attend the 8th day Fidau prayers of an aunt, information got to me that at the meeting of the Federal Judicial Service Commission held on 1st and 2nd February 2011, what was thought to be a rumour became the subject of serious discussion initiated by the Hon. Chief Justice of Nigeria, Aloysius Katsina-Alu, GCON.

“I was given to understand that even though the subject was not part of the agenda of the day, Your Lordship characteristically informed  honourable members of council of his proposal to strengthen the Supreme Court by moving me to that court and presumably to replace me with his minion or stooge. It was sadly not deemed fit and proper to discuss the proposal with me. Perhaps my view did not count for anything.

Neither was it expedient or decorous to place such an important matter on the agenda. No council paper was circulated.

“Interestingly, however, it was alleged that in giving reason for this disturbing action, the Chief Justice of Nigeria said that the appointment would add value to the Supreme Court. He further assured council members that I would not lose my seniority. I regret to say that I am not taken in. I am contented with being the President of the Court of Appeal.

“Indeed it is common knowledge that I had even in a more auspicious moment declined for good reason to be appointed to the Supreme Court. Nothing has changed since then. I prefer to remain in the Court of Appeal to continue to give service to the nation to the best of my ability.

“Finally, I prefer to follow in the wake of any worthy predecessors who in spite of their experiences retired as Presidents of the Court of Appeal with their honour and reputation unsullied.

“The present unholy move to push me out of the Court of Appeal for whatever reason has no precedence in our legal history. I do not therefore think it will be fair for the Chief Justice of Nigeria to seek to create a dangerous precedent which may give rise to chain reactions.

“Needless to say that the environment is already over-heated and in a state of flux. Let no one do anything to disrupt the status quo. Nigeria is after all greater than all of us.

“I remain loyal and committed to the Federal Republic of Nigeria and the oath of my office.”

SSS arrests aide for alleged threats to Amaechi’s life .

Wednesday, 02 February 2011 00:00 From Kelvin Ebiri, Port Harcourt.
. SPECIAL Assistant to Rivers State Governor Chibuike Amaechi on Students Affairs, Dike Princewill, has been arrested by the State Security Services (SSS) for purportedly threatening to kill the governor.

The Assistant Director, Operations and Intelligence, Mr. Kunle Ajanaku, disclosed yesterday that Amaechi’s aide was arrested at the weekend for sending death threats through short message services (SMS) to his boss to make him reverse his stance on the industrial action by teachers of the state-owned University of Science and Technology (RSUST). Ajanaku, who represented the State Director, Mr. Douglas Dogo, told journalists that shortly after the RSUST branch of Academic Staff Union of Universities (ASUU) embarked on a strike last October, the governor started receiving death threats from two female students of the University of Port Harcourt.

He explained that the governor had initially ignored the death threats but when they became persistent, he had to notify the SSS, which immediately started investigation aimed at unravelling those behind them.

Ajanaka said in the course of investigation, the SSS was able to discover through the International Mobile Equipment Identity (IMEI) numbers of the SMSs that the suspect had clearly and consistently used handsets belonging to his girlfriends.

And with the assistance of the service providers, he said the SSS tracked down the owners of the two cell phones and arrested them. According to him, it was in the process of interrogation that the girls disclosed that the governor’s aide had occasionally used their phones to send SMSs.

“The girls were not aware of the content of the messages he was sending out. He merely used their handsets to send the death threats. It took prolong interrogation for one of the girls to confess he (Princewill), who works in State House Port Harcourt, used her phone to send SMSs,” he said.

Following the confession of the girls, the SSS arrested Princewill somewhere around Old Government Reservation Area (GRA) at the residence of a top politician in the state. But the two girls have been released.

Ajanaku revealed that the suspect admitted to sending the SMS to the governor with the intention of blackmailing him to change his hard stance against the teachers who have been on strike since October.

The governor had shortly after the teachers went on strike threatened to mobilise students of the institution for a one million-man match against them for embarking on strike over the non-implementation of the 2009 Federal Government /ASUU agreement.

The SSS chief said the governor was shocked when it was discovered that Princewill was the main culprit sending the SMS.

In his reaction, the Acting Chief Press Secretary to the governor, Mr. Blessing Wikina, told The Guardian that the state government would not interfere with the work of the security operatives involved in the matter.
He charged the SSS to conduct a thorough investigation into the matter and let the law take its course. According to him, the incident would serve as a deterrent to other persons across the country that are involved in such an obnoxious act.

“We will not obstruct or interrupt in any kind of investigation being carried out on this matter by security agents, particularly as it borders on serious crime as this. We are not known to have romance with criminality,” he said

My question to him is this: how the blazes did Jim Ovia or Tony Elumelu escape the bank checks? Why werent all banks audited at once? Or did UBA & Zenith not have toxic loans? Agreed some had more, but these banks still had many bad loans didnt they? Why the selective justice then?

The people of Nigerians are the ones to give him the credit not by himself. For me, i haven't seen any change till i applied for loan.
Interest rates are going down and banks are doing better jobs before given loans now. I know of corporate bodies who have been able to get interest rate deals as low as 11.5% for employees personal loans. A lot of people are taking these lower interest loans to refinance high interest ones. There is less pressure on deposit hunting now, because the crazy 15% 20% returns has given way to 2 -3 %. If it continues this way there would be more money in the economy. AMCON is buying off banks bad loans that is why all there stocks are beginning to appreciate at the NSE and they should return to profit very soon.

It is true that INEC should accept the blame. However inability of those supposedly modern day graduates to have quick grasp of those machine should be blamed on all of us. If Nigerian University graduates do not have edge over non educated person, it is a gap that a right thinking government should use to access and correct our education system.
Obviously, INEC has overrated our fresh graduates.

Corps members disappointed us – INEC

As the voters’ registration continued on its fumbling note into day three yesterday, the Independent National Electoral Commission (INEC), attributed the inefficiency to low knowledge of the corps members who were deployed as registration officers. The Commission, while apologising to members of the public for the delay and general inadequacies attending the exercise across the federation, said “we are sorry but we will continue to improve.”

Featuring on a political programme, “Focus Nigeria”, the INEC National Commissioner in charge of Publicity, Prince Solomon Soyebi, lamented that the commission was not happy with the development but explained that the commission took it for granted that the corps members would know the basic operations of a computer, a belief, he said, turned out to be misplaced.

We assumed that these corps members should know how to operate a simple machine like the DDC machine in addition to the training they had but unfortunately, they disappointed us. We discovered they could not and many of them had to be battling with it unsuccessfully.

“These are graduates and we never expected it that any of them won’t be able to handle a computer but the reality was such that majority of them couldn’t and we had to shuffle them,” Soyebi added.
He also admitted that the upfront allowance the corps members were to be paid before the start of the exercise could not be paid due to tedious banking process, a development which also made the process of registration slow as many of them had nothing to eat during the exercise.

Soyebi, however, assured that the process would improve as the registration officers got used to the operation of the machines, adding that officials of the commission would be on hand to offer assistance to the registration officers to reduce the hiccups.
He also promised that the process of payment of the first installment of the corps members’ allowances would be fast tracked while other logistics would also be looked into with a view to addressing all observed lapses.

Meanwhile, the INEC Chairman, Attahiru Jega, has urged the people to exercise patience with it saying the noticed initial inefficiencies would soon give way.
He urged prospective voters to go to the nearest units to them, and wait patiently for their turn but could leave and come back if they experienced delay since the exercise would last for two weeks.
Jega who spoke in Abuja, however, called on voters not to wait till the tail end of the registration to avoid rush.

PoliticsRe: Sanusi Presented With Central Bank Governor Of Year Award by Remii(m): 9:44pm On Jan 09, 2011
http://www.bbc.co.uk/news/business-12126920

Nigeria is frequently cited as one of the most corrupt countries in the world, but its central banker has won two international banking awards.

Mallam Lamido Aminu Sanusi has been named as the Central Bank Governor of 2010 for both the African continent and the entire world, by the prestigious Banker Magazine.

The editor of the magazine, Brian Caplen, says that few candidate names generate an overall consensus on judging panels, and yet, when it came to finding the best global central bank governor of the year, Mr Sanusi was chosen unanimously.

The 49-year-old was appointed head of the Bank of Nigeria in June 2009.

He has been praised for salvaging a crumbling Nigerian financial sector, including implementing reforms that have put Africa's most promising market back on the map for global investors.

The magazine's country representative, Kunle Ogedengbe, stresses that Mr Sanusi embarked on a radical anti-corruption campaign aimed at saving 24 banks on the brink of collapse.

He also pressed for the managers involved in the most blatant cases of corruption to be charged, and, in the case of two senior bankers, convicted.

"The reforms initiated by Mr Sanusi have been necessary to sanitise the banking industry," Mr Ogedengbe says.

"Had these reforms not been initiated, Nigeria would have entered into another round of banking distress."

Extensive reforms
Despite the political challenge of facing up to powerful people who held considerable sway in the country, Mr Sanusi never swerved from his approach, and won the support of the public as they were made aware of the scale of corruption.

Coming from the north, Mr Sanusi bucked the established trend of appointing southerners
"He has carried out the sort of reforms that most of the central bankers in the world would like to have carried out in their territories," Lagos journalist Anthony Osae-Brown told BBC World Service's World Business News.

Two months into his governorship, Mr Sanusi embarked on the bailout of Afribank, Intercontinental Bank, Union Bank, Oceanic Bank and Finbank.

He dismissed their chief executives in a move designed to show that banking is no longer business as usual, but institutions that must serve the economy as a whole.

Another key reform of the banking sector enforced by Mr Sanusi has been to limit the tenure of bank bosses to a maximum of 10 years.

The chief executives will have to leave office at the end of their term regardless of their record.

The implementation of a stricter disclosure policy by the Central Bank of Nigeria has also led to a culture of greater transparency in the sector.

Career path
Mr Sanusi obtained a masters degree at the London School of Business and Finance in 1983.

He began his banking career in 1985 by joining the merchant bankers Icon Limited, a subsidiary of Baring Brothers of London and Morgan Guaranty Trust Bank of New York.

After becoming the head of the central bank, some people dubbed his extensive reforms as the "Sanusi tsunami".

He defended his actions, saying there was no choice but to attack the many powerful and interrelated vested interests who were exploiting the financial system of the country.

At a February 2010 conference on banking in Nigeria, he described his blueprint for reforming the Nigerian financial system as being built around four pillars.

enhancing the quality of the banks
establishing financial stability in the country
enabling a healthy financial sector evolution
ensuring that the financial sector contributes to the real economy
Talking later that month, he said that the crash in the capital market had been due to the high level of financial illiteracy on the part of the Nigerian investors.

Parallel interests
In parallel to his banking career, Mr Sanusi has also contributed to the nationwide debate over Sharia law.

In 1997, he obtained a degree in Sharia and Islamic Studies from the African International University in Khartoum, Sudan.

In an article in September 2000, he noted the problem of reconciling "belief in the universal and eternal applicability of the Sharia with the need to meet the requirements of a particular milieu."

And at a seminar in Abuja his talk was entitled Basic Needs and Redistributive Justice in Islam - The Panacea to Poverty in Nigeria.

Election looming
Nigerian government borrowing has increased around 50% by late 2010, while its spending has been rising in the run-up to the presidential primaries in the middle of January - a contest whose outcome could shape the political and economic landscape for the next few years.

The excess crude account, into which Nigeria saves windfall oil income, has dropped to $300m (£193m) from $20bn at the start of the presidential term in 2007.

The political uncertainty also means major pieces of policy, including some multi-billion dollar investment decisions, are on hold until after the elections.

The biggest decision regards the Petroleum Industry Bill, which will re-write Nigeria's decades-old relationship with foreign oil firms.

It will redefine the fiscal and legal framework governing investment, including its key offshore fields which are expected to yield most of its future production growth.

Until that bill passes, foreign oil firms will keep multi-billion dollar investments on hold.

Potential investors in the planned privatisation of the domestic power sector, one of the cornerstones of President Jonathan's policy, are also unlikely to go beyond statements of interest until the elections are over.

But banking reforms continue apace and the five-year tenure of Mr Sanusi means even a change in president is unlikely to derail them
