I paid twice. One before filing and second after the process was complete. Some ppl also pay upon success, a premium fee.

Hi everyone, i am not sure anyone knows me on this thread, but i thought to drop my Canada study journey.

my timeline as much as i can remember goes thus:

Applied January 9 2021 , got refused February 2021, reason: Personal assets and financial status

Applied again April 2021, addressing the issues, got refused in August 2021 for same reason, personal assets and financial status

Began my journey to JR because i did all i could, everyone i chatted with on thread 19 didnt know whatelse i should do that i hadnt done.

So i consulted a lawyer, he read my notes and documents submitted, said i had a good case.

In my first application, the denial reason was that they could not find documents of financial proof, i remember i was asked to submit MBS but i declined, i was told it was not compulsory, at least their request letter said so, so i asked them to process with the traditional bank statements i provided, i was wrong, it was not an option, i was refused 2 days after i ignored their request.

So to improve my chances, i liquidated my fixed deposits in my first application, paid 95% of my tuition from it and reapplied, lo and behold, i was slammed with lump sum deposit despite my explanation and documentary evidence the lump sum were from my liquidated fixed deposits.

my journey to JR began in September, a month after my second refusal, IRCC refused to settle at first instance, i became pensive and put in a third application in December, finished paying my tuition, bit the bullet and did GIC, it was expensive but it was worth it. I did a third application because the case had gone quiet and i had already almost given up on it. i started questioning my choice to go through JR, my lawyer was in high spirits and was very much sure we will win.

He was not in support of my third application but i did it anyway. The third application was untouched from December 2021 to May 2022, it was as if they wanted to see the direction of my case in court.

So in that same May, the judge granted leave (this means the judge is interested and wants to hear the case which will most likely rule in my favor)

2 days after the judge granted leave, IRCC comes forward to settle and reopen my file. 2 days after they settled, my third application which was untouched gathered momentum, medical request dropped like a week after settlement, PPR a month after. the second application which was still reopened was withdrawn after i got PPR.

Immediately after i received my PPR, i put in my son's application and it was approved in 6 weeks.

we arrived BC last week and preparing for my resumption in January 2023.

I hope everyone on this journey and awaiting decisions draws strength from this post.

Mayo, you said it all. Everyone is quick to discourage JR. JR is not for the faint hearted, you can be lucky to get settlement soon or you may be on it for a while longer, but the essence of JR is blotting wrong immigration records from your history, and it may be helping the next person. I have seen cases where lawyers wish for the case to get to court stage cos if there are new cases of a similar rejection in future, ircc will settle faster. more cases getting to court mean more case examples to reference. fortunately, many cases never make it to court if you use a good lawyer. most of these lawyers are also used to ircc lawyers and they most often settle before it goes far. while some have to wait a little longer. some are just a way to frustrate the applicant or delay the process to see if indeed the money you claim is yours will still be there or you have returned it.

If you feel as though they made a mistake, by all means challenge the decision. the truth is, as nigerians, we glorify suffering and ill-treatment, to the extent that we say, they locked someone up and the person is released, you say why were you walking at night. Such mentalities go on with us and it affects us, that's why we all have culture shock when we travel.

I will tell you that JR may or may not be easy but if you believe your profile warrants a positive decision, with the guidance of your lawyer by all means do so. Not everyone will get PPR the same way, some will apply 5 times, others 1ce, others will have to do JR, others will dump it and go to UK.

Lets stop this mentality, i went through JR and i can tell you its challenging, same with waiting for a deicison on your reapplication for 6-9 months, but what has been helpful is the group of people on the same journey with me helping me and i know it will end in praise. Stop saying things like, if i were you, i will use the money for JR to pay tuition, look, you can do all things right and still not get your PPR, lets stop glorifying stories when you havent walked a mile in their shoes.

With my close to perfect application, 80 percent tuition paid, very able sponsor, trying to show that my sponsor can give me money and he deposited it in my account since November 2020, with all my explanation which i hammered on in two different parts of my letter attaching documentary evidence, i still received lump sum rejection. stop making people's pain a story or word of admonition, if you can afford JR, and you feel you were cheated, by all means pursue it!

The rate at which nairalanders discourage JR is unfair . Seems we are not concerned about incoming generations and those behind us. We need to end this our suffering and smiling way of life.

Indians and other countries held them by the balls for many years via JR. Today, the new generation are enjoying it. Reduced flimsy excuses, increased approval rate, 2 weeks study permit timeline. Judicial review also expand your knowledge of immigration laws, discover abnormalities. Make you work true it with your lawyer.


Most of the reasons stated to refused Africans are unreasonable. Which judge mostly insult them before sending them for a re-determination.


Truly, JR is not for the faint hearted, filled with uncertainty, anxiety, cost etc, But has so many advantages for the incoming applicants as far as Africa is concerned.


If you have the money for JR, please go for it. Be the voice to your country , be the voice to the voiceless Africa.


Most unreasonable reasons we celebrate, promote and made our own immigration law can't stand the test of JR. E-G


Career progression

Something like having Masters and going for ordinary diploma is Canada.

Based on the Canadian immigration law, there's no place given to Visa Officer's to decide students career. Your career progression is left for the school to decide, if school decided to give you letter of acceptance, it's none of Visa Officer's business to comment on your progression or qualifications for the course. A federal court rule below on that.


Secondly , I disagree with the Respondent’s argument that the decision is otherwise reasonable. Having reviewed the Applicant’s educational plan myself, it is clear that at no point does she ask for career counseling advice. Yet this Visa Officer apparently fancied the opportunity to assume the role of career counsellor and opine that the Applicant’s intended studies in Canada would not enhance her work for her brother. Such extraneous considerations make it obvious that the Visa Officer engaged in an unreasonable review of the evidence.


This is straightforward and clear. The judge called that unsolicited career counseling



Proof of fund

Below is IRCC’s own study permit guidelines



Students are required to demonstrate financial sufficiency for only the first year of studies, regardless of the duration of the course or program of studies in which they are enrolled. In other words, a single student entering a four-year degree program with an annual tuition fee of $15,000 must demonstrate funds of $15,000 to satisfy the requirements, and not the full $60,000 which would be required for four years. Officers should be satisfied however that the probability of funding for future years does exist (i.e., parents are employed);




Proof of employment is enough to demonstrate next year tuition fee. Whereas, someone was refused here in September for not having funds for whole course.

This person actually showed 150,000CAD balance in his father's account. Cost of whole course is less than 50,000CAD plus living expenses.



Third party sponsor (uncle) , personal assets, establishment in home country



Below is a Federal court of Canada rule on that.


In my view, the Officer’s finding that the Applicant had insufficient funds to support his studies is not justified in light of the uncle’s signed declaration and evidence indicating his financial stability and willingness to support the Applicant, including his commitment to offer the Applicant employment once he completes his studies.

[22] I also agree with the Applicant’s submission that the Officer’s reasoning that his uncle’s funds could be withdrawn at any time is speculative and that the Officer arrived at this conclusion without providing a rationale. This is a ground for setting aside the decision (Huot v Canada (Citizenship and Immigration) 2011 FC 180, at para 26).



 I also disagree with the Respondent’s argument that it was reasonable for the Officer to find that there is little incentive for the Applicant to return to Mauritius after his studies. As the Applicant’s counsel argued during the hearing, the Applicant has provided elaborate reasons about his intention and ability to study in Canada. The Applicant has also been transparent that he is not wealthy, but has taken steps to secure the financial assistance of his uncle.

[28] As the Applicant’s counsel rightly noted, the Applicant is fortunate to have an uncle who is willing to fund his studies in Canada so that he may obtain credentials that are highly valued in Mauritius. It is uncontroversial that many students often rely on family members to help fund their post-secondary studies. Here, the Respondent attempts to assert otherwise, seemingly on the grounds that the Applicant comes from a less affluent background. This reasoning is absurd and perpetuates stereotypes about those who consistently face barriers to accessing higher education. The Applicant has clearly demonstrated that he has secured the funds to finance his studies. The fact that he comes from a lower-income background should not preclude him from seeking out and accessing educational opportunities.

[29] I find that the Officer failed to take into account the totality of the evidence before them and came to an unreasonable conclusion.

I had been waiting to see your notes since your refusal.

I will say, show them you can actually spend the funds, this includes paying your tuition and do gic (this may not be an option considering that your source isnt only being questioned, but your abilty.

Then improve your hometimes, a lot of photos can do this and state how you cannot leave your business, aged parents, associations you belong to and if you are an active member will help.

I have gotten two refusals.

My first application.....

I applied first early this year. Self sponsored. 18M in three banks all statements attached, but had lump sum deposit in one of them (sold some assets).

HERE WAS THE REFUSAL REASONS

"I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based in your family ties in Canada and your country of residence."

"I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR based on personal asset and financial status."

REQUESTED GCMS....

HERE IT IS......

PA is self funded. Employment letter shows PA makes 16,000 annually. Funds provided are not commensurate to PA income. Transaction on bank statement shows lump sum deposit. Source of funds unknown. Concerns about funding. Bank statement to be verified.

{[/b] please note that in my SOP I stated there the businesses that I do I attached CAC OF MY COMPANY I ALSO PUT THE RECEIPT OF ALL EQUIPMENT THAT I HAVE FOR MY BUSINESS, so my only source was not just my salary, but I think I was judged based on only my salary as my only source of income}[b]

HERE IS THE REPORT FROM IMMIGRATION AND BORDER CANADA

"I have reviewed the application. the applicant is seeking to study in Canada. I am not satisfied that the applicants will leave Canada at the end of their stay as a temporary residence. I note that the client is single, mobile, is not well established and has no dependents. taking the applicants plan of studies into account the documentation provided in support of the applicants financial situation does not demonstrate the funds will be sufficient or available. I am not satisfied that the proposed studies would be a reasonable expense weighing the factors in this application I am not satisfied that the applicant will adhere to the terms and conditions imposed as a temporary residence. For this reason above I have refused this application."

SECOND APPLICATION.....

I submitted LOE, I explained the source of income, I gave a detailed financial table that shows how much I make from each equipments and how much I have in the bank. I used a sponsor (cousin) this time around he has 13M balance and sent me 2.6M for my first semester tuition.

I paid first semester tuition. I still submitted my personal bank statement of 17M. They verified my bank account from the first application and I also reminded them that the funds are still very much there seated for months now that it is mine....

Yet I still got a refusal ... Here is the reasons again from my refusal letter. I just requested for my gcms note

"I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based in your family ties in Canada and your country of residence."

"I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR based on personal asset and financial status.".......


I ORDERED GCMS FOR THE SECOND APPLICATION, HERE IS WHAT IT SAYS....

I ALSO NOTE THAT THE APPLICANT COUSIN INTEND TO CO-SPONSOR studies however given the evidence of relationship/connection to third-party sponsor and the history of financial support are not sufficiently substantiated,I have concerns about the credibility of the sponsorship, limited obligation for the 3rd party sponsor to provide ongoing financial support.

based on the review of this document presented in support of this application the application appears not to be well established in the home country

I am not satisfied that the applicant to leave Canada at the end of their stay as temporary resident, I note that the applicant is not well established in home country has not demonstrated proof of dependent dependents. given the lack of family ties or economic motives to remain in home country the applicant incentives to remain in Canada may outweigh their ties to their home country

Weighing the factors in the application I am not satisfied that the applicant will depart Canada at the end of the period authorised for their stay

for the reasons above I have refused this application.[/b]


Please can you advice or let me know what next to do.... As I have addressed the concerns from the first application I even used a sponsor this time around.....

if you have a few dollars, have a legal counsel to look at it and if you really addressed the officer's concerns. It's 50-50, especially when you have refusals within the same year, if you reapply, you may be refused again. I believe that officer has a lot of litigation issues right now, about 3-4 ppl i know are pursuing JR for this particular officer.

To also add, did your wife write a supporting letter considering it’s a joint account, more like to show that It was a decision between you both ans you can access the money. If you did that the. There’s no other BUT I can think of. Well till your notes are out, I pray it’s not that our Officer.

Oh it’s a Naira credit card. I was offered one, 200k per month and 2% on amount drawn.

If any institution approaches you to get a credit card, it somehow means you are financially responsible so a visa officer shouldn’t doubt your financial situation or establishment?

You didn’t understand me, I’m saying the visa officer referring to your funds as being in a company account is an error.

Showing money is barely even the issue for most refusals, it’s the source. So yes the source is very important. You will see reasons like “funds seem available but not sure it will available throughout the course”. they are questioning source and whether or not it’s borrowed. GIC and payment of tuition is the way to go, even if it’s questioned, they know the funds have to be used for the purpose intended. So I will say mention the source, don’t hammer on it if you feel your source is weak but hammer on the fact that it’s now in GIC and you have paid full tuition

Don’t want to start a conversation on this, the only explanation is we shldnt give too much tot or give them too much credit, in Nigeria, most of them are will be graded as diploma holders, they are also overworked since they aren’t working at full capacity! I hear it’s about 1 visa officer to 300 applications a day or so. And our records also don’t help, if you check the federal court website, you will see various cases, most of it are refugees and humanitarian cases, so many Nigerians. It’s normal for extra strutiny to be attached

When I approached my bank for GIC, they actually debited me 3k to credit my cibc account but I called them to reverse cos i needed exactly 10k to be moved.

Well I am very knowledgeable about it, banks do it but they don’t prioritize it. You have to get a living expense sheet from your school which shows possible cost.

So if you wish, one can transfer 3k to student deposit account with cibc, it’s also a way to prove that you have the intention to move your living costs to Canada. And you will be writing in your sop you have transferred 3k to your cibc account and you will be moving the rest once your visa is approved.

do u have evidence or knowledge of someone that paid living cost at official rate?.I have not seen any oo.I even asked my bank and they said form A is only for school fees and medical emergencies. I stand to be corrected o but this was what my bank told me

Everything is still grace and how lenient each VO,s are . Someone on this platform paid 8kCAD as tuition deposit and 4.5M as POF without any work history and got approval .

Bsc business admin, I work in an investment bank, sell stocks and the likes. I’m the head of compliance, just ensure the company follows rules and regulations

For me I think I made progress in how I have been able to change the mind of the visa officer. In my first application they said I’m not well established, I didn’t show that funds were available, duno why they said this, cos I attached bank fixed deposit letters, and I ignored NSE request when they asked, they also said I have weak social and economic ties. This second one, the only issue was lump sum and that’s just cos I liquidated the money they said wasn’t shown.

So sometimes reapplication is good but sometimes it can be a trap, lol

No actually, bank can transfer living funds to you. Recently it’s about 3-4k per semester. Living cost is covered only that it’s not prioritized over school fees or medical bills, so they put a cap to it.
The beauty of the GIC is if they pay you, you can change it to Naira black market and even make double provided the black market rates go up.

For me, company sponsorship is just a no no, it requires a lot of due diligence. So I will rather just use business and co as ties, and proof of asset

I agree.one thing about GIC is that weda u like it or not,u will still spend that money on black market uf u r still going to move money from Naija. but it helps answer lump sum questions I think o.Company account could be dicey I also agree.Also he did not tell us if they have been paying tax cos the company may have to submit that too if they are to sponsor him

That’s the issue, I duno if it’s recognized. I watched a webinar on ksas page, held with an ex visa officer. The ppl assessing may not be Nigerians, they are probably not even used to the investment, how can they verify, for me, you could have used a bank they recognize, like a list of banks on my bank statement, I think that’s what they are not comfy with. Please get a consultant to advise you on how to address this, it will be tough without them seeing it as a lump sum even if you attach all documents.

That’s another angle, that’s why I said even their law itself states that an applicant must show that he has funds available, whether I am established or not is now overdoing. Does my course of study align, yes, Is the money there, if it’s not, did the person giving you money write a letter? Will this person come back? That is all they need

I understand dear.it is well.I think the issue may b d lump sum and they probably think if the job was so sweet as to them considering to even make u the M.D, why do u still need a sponsor?.also they may feel that course can be read in Nigeria, y Canada ?.
This V.O can be somehow.if u were an Indian, u would be given PPR straight up.and my brother in Canada told me Nigerians are doing better in Canada in terms of criminality than indians

See ehn, let it stay if you can. Or let your dad write a letter saying they will release money monthly, the money doesn’t have to move to your account. I have seen ppl get approved for stating the intention but your dads account has to be loaded too and consistent income and inflow coming in

And company sponsorship is also worse. That’s why I said I will rather have the lump sum come from his dads personal account than company. They hardly check all that, only a few actually check well and understand. Once they see company they become suspicious. GIC is really pricey, not everyone can afford it. I know I spent extra 1m cos of black market. So for me, if he’s not in a hurry, move the money monthly till he’s ready, some ppl actually use 1 year to build account. That’s the best but not everyone has that luxury of time

my dear ,let his dad pay the school fees and if possible open a GIC for him ooo.cos lump sum this days is dicey.also,if his name is on the CAC documents, it will fly since his dad is the director and he is one of the owners but the only negative is that the company account MUST BE VERY WELL FUNDED
