The Abuja Division of the Court of Appeal on Thursday affirmed the victory of Governor Kayode Fayemi of Ekiti State at the July 14, 2018 governorship election in the state. The three-man panel, led by Justice Stephen Adah, in a unanimous judgment, dismissed the appeal filed by the Peoples Democratic Party and its candidate in the election, Mr. Olusola Eleka. Describing the appeal as “unmeritorious,” Justice Adah affirmed the July 28, 2019 judgment of the Ekiti State Governorship Election Petition Tribunal which had upheld Fayemi’s victory at the poll. The Independent National Electoral Commission had declared that Fayemi and his party, the All Progressives Congress, polled a total of 197,459 votes to defeated Eleka and the PDP who placed second with 178,121 votes in the July 14, 2018 election. Dissatisfied with the outcome, PDP and Eleka had filed their petition before the Ekiti State Election Petition Tribunal which sat and delivered its judgment in Abuja. The petitioners alleged, among others in their petition, that the election was marred by a lot of wrongs, including non-compliance with the Electoral Act. But the tribunal on January 28, 2019 dismissed their petition and affirmed the results declared by INEC. The petitioners further appealed to the Court of Appeal, raising seven issues against the judgment of the tribunal. But delivering judgment, Justice Adah, who gave only a summary of the Court of Appeal’s verdict on Thursday, resolved all the seven issues raised against the appellants and in favour of the respondents — Fayemi, INEC and APC. Babatunde Fashola, the Minister of Power, has said that some states in Nigeria can now boast of constant power supply. He made the assertion on Channels Television’s Sunrise Daily on Wednesday. “Sitting down here I can tell you some states that have almost 24 hours – Kebbi, Yobe. . Some have five, some have 10 and there are still outages,” he said. He added that the constant power supply in some states is due to the increase in the transmission capacity, noting that the transmission capacity has grown to about 8,100 watts as of December 2018. The Economic and Financial Crimes Commission,EFCC, Lagos Zonal office, on Wednesday, March 27, 2019, arraigned one Omotayo Tapere before Justice Mojisola Dada of the Special Offences Court sitting in Ikeja, Lagos State on a two-count charge bordering on possession of document containing false pretence and forgery. One of the counts reads: “That you, Omotayo Tapere (aka Robert Fine), sometime in 2018 at Lagos, within the jurisdiction of this Honourable Court, had in your possession fraudulent email sent from Robert.fine231101@gmail.com, your email account to Fredrica Fox through her email,Frederica2014@hotmail.com titled “I am in love”, professing love to her, a representation you knew to be false.” The defendant pleaded not guilty to the charge when it was read to him. In view of his plea, prosecution counsel, M.A. Bashir, asked for a trial date and prayed the court to remand the defendant in prison custody pending the determination of the case. Counsel to the defendant, Oye Akanni, however, told the court that a bail application had been served on the prosecution. He, therefore, urged the court to admit his client to bail in liberal terms. . In his response, the prosecution counsel, Bashir, urged the court to allow him to respond to the bail application, saying, “My Lord, the prosecution is still within the time provided by Law to respond to the bail application filed by the defendant.” Justice Dada adjourned the case to April 17, 2019 for hearing of the bail application and commencement of trial. Oyo State Governor, Abiola Ajimobi, has advised the Governor-elect, Mr Seyi Makinde, to focus on developmental issues instead of his campaign of calumny against his person, family and administration. He said Makinde’s move was aimed at tarnishing his image and rubbishing his “eight-year selfless service” to the state. The governor’s position was contained in a statement by his Special Adviser, Communication and Strategy, Mr Bolaji Tunji, on Tuesday. He said the Peoples Democratic Party ought to start talking about its plans for the state and how to build on the foundation laid by his administration instead of carrying on with its acrimonious campaign. Ajimobi said he was appalled by the unprovoked media attacks by opposition parties, especially sympathisers of the PDP and its governorship candidate, who he said were still practising politics of bitterness. He said, “It is disheartening that more than two weeks after the election, the opposition parties, especially the PDP, have carried on as if they are still campaigning. “Now that elections have been won and lost, there should be an end to acrimonious and incendiary comments. Political discussion has moved from the pre-2011 era. Rapper Cardi B has defended herself after a video emerged showing her discussing drugging and robbing men when she was still a stripper. In the three-year-old clip, the rapper explained how she would target men while working in New York. The video inspired the hashtag #SurvivingCardiB, a reference to the documentary Surviving R Kelly, as well as calls to boycott Cardi B. She has now responded to the controversy in a lengthy Instagram post, writing she did things in her past “I felt I needed to do to make a living”. Nollywood actress, Etinosa, after putting the blame of her embarrassing action on alcohol, has said she should have been careful with the drink. Etinosa had earlier insinuated she was drunk when she went naked on MC Galaxy’s Instagram live, an act which trended last week, and she has now stated that she should have been more careful with alcohol. The actress while speaking with PulseTV, expressed shock at how her video went out in public despite the fact it was supposed to be a private video. She said; “I don’t really know, I can’t say anything about the person who sent the video to Instablog or how it got there. Those things are private things. Your weakness should be covered but unfortunately for me, I happened to be out there. Many Nigerian celebrities have taken up the practice of having baby mamas rather than getting married, but Chinko Ekun might not be taking that path anytime soon. The Nigerian rapper revealed that his mother begs him not to have a baby mama. Speaking with punchng.com, Saturday Beats, he reveals that his mum doesn’t want him to have a child out of wedlock, though he also took his time to state that he doesn’t condemn those who do so. He said; “My mum doesn’t want me to have a baby out of wedlock. Personally, I can’t condemn the act because most people have reasons why they have children out of wedlock. It may be that they do not wish to be committed to any woman but they want a child. A lot of people have baby mamas. Chinko Ekun also talked about his love life, revealing that despite being famous, he has been heartbroken multiple times. He also went on to reveal that he can’t get married to an actress or singer. He said; “I have been heartbroken a lot of times, even after I became famous. Girls are funny; stardom has nothing to do with a partner’s loyalty at all. “I don’t chase after women; I would prefer a lady who is intelligent. I can’t marry a musician or an actress because it is not easy to be a celebrity. The life is not easy to keep up with. I face a lot of stress; I just want my wife to be able to take my children out normally without any form of paparazzi. The Kaduna State Peoples Democratic Party (PDP) has condemned the absence of Governor Nasir el-Rufai and his deputy, Banabas Bala Bantex, amid attacks and killings in Kajuru and other communities in the state. It described the recent killings in Kajuru, Birnin Gwari and Sanga local government areas by armed bandits as avoidable, saying the governor and his deputy’s absence for more over one week showed lack of government’s commitment to the people’s safety and well being. In a statement issued by the state PDP Publicity Secretary, Abraham Alberah Catoh, it strongly condemned the ‘disappearance’ of el-Rufai and Bantex without public notice, in the midst of crisis, saying it showed that the state was operating in the height of irresponsibility. “The killings would have been averted if the federal and state governments have been responsible and had fully engaged security agencies with required proactive measures and equipment to fight insecurity,” he said. Former President Olusegun Obasanjo has raised the alarm that Nigeria was more divided and in danger over the current state of disunity in the country. Obasanjo said the country was in a worse situation at the moment when compared to the period of the civil war. The former President stated this on Thursday while speaking at a one-day 2019 annual retreat/conference and general meeting of members of Association of Chief Audit Executives of Banks in Nigeria held in Abeokuta. Obasanjo who was a guest speaker, spoke on five Ps. He urged Nigerians to partner one another and even go further, at home, within communities, states, countries, sub-African region and African continent. He said, “When we look at this country today, even during the civil war, we were not as divided as we are today. “Today, we are in danger if we don’t take partnership seriously. Partnership within our people and partnership within Africa and the rest of the world.” Addressing the members of ACAEBIN, Obasanjo said private sector is the life blood of development in every economy of a country. He hinged his talk on ‘Politics; Population; Prosperity; Protection and Partnership.’ He said, “As chief audit executives, it is defined by virtue of what you are doing as a profession. If the audit is awry, banking business will not be right. “What I want to emphasise is that, it is a must as Nigerians and as Africans, that we have certain elements that we have to take very seriously which I put as five Ps. “The first is politics which is governance. Nollywood actor, Uche Maduagwu has reacted to an interview in which Olakunle Churchill revealed how he met his estranged wife actress Tonto Dikeh at a night club Below is an excerpt of the interview in which Olakunle Churchill also debunked claims that he squatted in Tonto’s house during the early stages of their relationship. When Churchill was asked to confirm if truly he squatted in Tonto Dikeh’s house, he said: You mean squatting? This is ridiculous. Before I met the Nollywood actress, Tonto Dikeh, I was already one of the most successful young millionaires in Africa. I met her at a night club, during my brother’s birthday party in 2014 and it was about the same time I acquired the latest Benz cars. Three months after we met, she got pregnant. I have never really stayed in Nigeria for too long, because I do business in Ghana, although I have an office at Ikoyi. She visited me in Ghana several times and when she broke the news of her pregnancy three months into the relationship, I decided to visit her in Nigeria. The Peoples Democratic Party and its presidential candidate in the February 23, 2019 presidential election, Alhaji Atiku Abubakar, said on Monday that they had assembled over 400 witnesses to testify at the Presidential Election Petitions Tribunal, where they would challenge the victory of President Muhammadu Buhari and his All Progressives Congress’ victory at the poll. They spoke through the National Legal Adviser of the PDP, Mr Emmanuel Enoidem, on the premises of the Court of Appeal in Abuja, venue of the tribunal where they filed their petition on Monday. Enoidem spoke to journalists after a joint petition of the party and its presidential candidate was filed at the tribunal’s secretariat. A twitter user has revealed that a mother lost five of her children in the school building that collapsed in Ita-Faji, Lagos Island On Wednesday, March 13, 2019. Sources said about 100 pupils were inside the school building when it collapsed. The cause of the collapse is still unknown. Efforts are still ongoing to rescue as many students alive as possible. Spanish club, Real Madrid have unveiledZinedine Zidane for the second time after he agreed to become the new coach of the club again. The French football legend who left the club after winning the Champions League last year signed a deal that will keep him with the club until summer of 2022. Speaking in his first press conference since signing the new deal, Zidane revealed his reason for leaving the club and why he decided to return to the club. He said: ‘When I went it was the right time to leave. I have had various offers since then but I wanted to stay here in Madrid. My first reaction when the president called me was to come back. The name of Imo State governor, Rochas Okorocha, was not on the list of newly elected senators that was published on the Independent National Electoral Commission’s website. INEC published the list of elected federal lawmakers ahead of the presentation of the Certificates of Return on Thursday. In the slot for the three Imo Senatorial districts, only Senator-elect Onyewuchi Ezenwa Francis (Imo East), who won on the platform of the Peoples Democratic Party, was listed. For Imo West Senatorial district, whose seat Governor Okorocha contested, it was blank except for an INEC remark, which read, “Declaration made under duress.” Imo North’s slot was also empty except for a “Supplementary” remark. Okorocha had contested the seat on the platform of the All Progressives Congress. He was declared winner by the Returning Officer for the Senatorial District, Innocent Ibeawuchi. Candidate of the Peoples Democratic Party (PDP) in the Imo State governorship election, Mr Emeka Ihedioha, has emerged governor-elect of the state. Ihedioha, a former Deputy Speaker of the House of Representatives, secured 273,404 votes to defeat defeated Uche Nwosu of the Action Alliance (AA) and Senator Hope Uzodinma of the All Progressives Congress (APC). Nwosu, who was backed by Governor Rochas Okorocha, finished second with 190,364 votes; followed by Senator Uzodinma who got 96,458 votes. The PDP candidate won 28 out of the 33 local governments in the state, leaving the All Progressives Congress with only five. Mr Makinde received 515, 621 votes to defeat his closest rival from the APC, Bayo Adelabu, who polled 357, 982 votes. The margin of defeat is 157,639 votes. The African Democratic Congress’ candidate, Olufemi Lanlehin, despite quitting the race to endorse the PDP candidate, came third with 12,375. Former governor Adebayo Akala, who was the candidate of the Action Democratic Party before he defected to the APC, also received votes totaling 8,664 to come a distant fourth position. Forty two (42) political parties contested the governorship election, even though many of them dropped their ambition at the last minute to align with either the PDP or the APC. Their names remained on the ballot, notwithstanding and they received votes. Although the governorship election was successfully conducted, it suffered a number of skirmishes, recording two deaths at the last count. THERE was a clash between soldiers and policemen at the main gate of the headquarters of the Independent National Electoral Commission in Port Harcourt. Though the reason for the disagreement was not clear because most journalists were barred from entering the place by soldiers, it was gathered that the soldiers wanted to take over the manning of the gate, a decision that was said to have been resisted by the police. Many persons, including journalists, who were close to the INEC office gate left immediately, to avoid choking as a result of the teargas that was shot into the air by the police at a point. Reports reaching Daily Independent have it that a member of the House of Representatives representing Akinyele/Lagelu Federal Constituency of Oyo State, Hon Olatoye Temitope Sugar, was shot and has been rushed to the University College Hospital (UCH) Ibadan. An Ilorin High Court, presided over by Justice Adenike Akinpelu, yesterday, sentenced a notorious armed robber, Olatunji Ibrahim Ariyo, and his cohorts to death by hanging. Ariyo, who is notorious in the state capital for his nefarious activities, was sentenced alongside Ganiyu Sulyman Yaro, Timothy Oyebanji, Lukman Olateju Sanda and Akeem Olayinka (deceased). According to Justice Akinpelu, the convicts were tried on a six-count charge of criminal conspiracy, armed robbery, causing mischief by fire and theft. The court held that, on April 25, 2015, the convicts committed the said offences at Agbarere, Ilorin. “Each of the convicts is sentenced to imprisonment for a term of two years and the sum of N25,000 is imposed as fine on each of them on count five for causing mischief by fire. Each of the convicts is sentenced to death to be executed pursuant to Robbery and Firearms Act on count one, two, three and four for the offences of criminal conspiracy to commit armed robbery and armed robbery, respectively,” the judge said. A 45-year-old man identified as Aminu Mai Unguwa Tsanni, from Tsanni village, Batagarawa LGA of Katsina State, has been arrested for allegedly having sex with two men in a Katsina hotel. Spokesperson for the State’s police command, SP Gambo Isa, who confirmed the incident, said that Aminu lured the duo of Abdullahi Abubakar, 20, of Yar-Kasuwa Qrts, Katsina and Rabi’u Yahuza, 23, of Sabin Layi Qrts, Katsina, to King Paradise Hotel and had unlawful carnal knowledge of them one after the other. However, nemesis caught up with them when the principal suspect couldn’t pay the victims their agreed price of N10,000 each as bargained. The suspects in retaliation, took away his two handsets. Aggrieved by their action, Aminu reported the matter at Sabon Gari Division as an ordinary case of theft of handsets. . However police investigation revealed that it was a case of unnatural offence as confessed by the trio. A court held on Friday in Ibadan, Oyo State, that a woman that has children for her husband and had married him before a house is built has the right to live in the house with her children even after divorce under the provisions of the Married Woman Property Act 1882. The provisions of the Married Woman Property Act 1882 formed the basis of the landmark judgement by the Chief Judge of Oyo State, Justice Munta Abimbola, in a property suit between a divorced couple, Toyin Arajulu and her ex husband, James Monday. The court held that “a husband who marries a wife and builds a house during the pendency of the marriage, stands the risk of losing that house if he later divorces the woman who had children for him unless such woman, of her own volition, leaves the matrimonial home.” Justice Abimbola, while ruling on the matter, emphasised what is known in law as the “palm tree justice,” which indicates that it does not matter in whose name the property stands or who pays what (on the property) and in what proportion as determination of such matters transcends all rights, legal or even equitable. But simply what order is fair and just in the circumstances of the case, citing the case of Home Vs Home (1962) 1 WLR 1124 at 1128.S 17 Married Woman Property Act 1882, which is a statute of general application. In her suit, Toyin had claimed that while she was married to James, they had put resources together and built two flats of three bedrooms at Ayedun in Akure, Ondo State and procured a plot of land at No 7, Fadana Biala Estate, Olodo, Ibadan, where they built a three-bedroom flat and a storey building which is still under construction before their divorce in July 2014. In his counter claim and defence, the ex-husband stated that when he bought and constructed the Akure property, his wife was a full housewife and had no contribution to the project.
