The Divergent Series: Divergent, Insurgent and Allegiant

This particular one is spun out of my love for science-fiction movies especially the dystopian ones. This movie takes us to a world which is very much unlike the one we live in. It is set in a not so distant future in a city in which the citizens live in factions organized by “the founders” of the city.

This arrangement is further disrupted by the emergence of the “divergent“; a small group of people whose DNAs aren’t as structured as their counterparts. This brings about lust for power resulting in mayhem and the intense need to eliminate these group of outcast known as the “divergents“.

The series with its numerous cliffhangers is that which keeps you on your toes. You’ll find yourself eager to know what happens next. It comes with a lot of action but not without a touch of romance, science and the law altogether. There is no authoritative definition of law and most certainly, there will never be. Any attempt at giving a universal acceptable definition of law will be akin to forcing a camel through the eye of the needle or forcing a fish to climb a tree. Consequently, theories of law are founded to establish an understanding of the nature of law. These theories allow us to attempt the question as to what is law and what the law ought to be.

Now, there are schools of jurisprudence which influences the answer. These theories of jurisprudence include, but not limited to, the positivist theory, realist theory, natural law theory, historical theory etc. The positivist believes law to be nothing more pretentious than what a recognized sovereign authority has enacted. For instance, Section 4 of the 1999 Constitution of the Federal Republic of Nigeria vested the National Assembly with the powers to make laws for the Federation. It follows, therefore, that where the constitutional procedure of law making is strictly adhered to, any law emanating therefrom is valid, nothing more, nothing less. The question as to whether it is just or unjust is inconsequential. On the other hand, the realist theory is against this view. For them, what the court says in resolving disputes is the law. Indirect rule was a system of governance which was predominantly used to govern pre – existing power structures in Africa, especially by the British and France, up until they devolved other means of governance.

In Nigeria, the system was introduced by Lord Lugard who thought that Nigeria being very big and vast would be impossible to handle if they ruled directly. Hence they employed the services of traditional rules and traditional political system who would rule their areas but be subject to the orders of the British administration. Lord Lugard is mostly referred to as the father of indirect rule in Nigeria as he introduced it to Nigeria to aid his governance.

Indirect rule operated thus; the British governance made the traditional rules intermediaries between them and the people and allowed the people retrain their cultures. This they did to ensure that the people see them less as intruders but people willing and ready to partner with the traditional institutions already in place. It is important to note that they only did this regarding chiefs that welcomed them with open arms. Other that didn’t were either killed or replaced.

In the north, the political administration system was highly centralized and it had the full co-operation of the people. There was also a tax system already in place. Hence it was easier, with regard to other regions for indirect rule to thrive. The Northern province was divided into six provinces headed by a British official known as the “resident”. The provinces were further divided into districts to be headed by an official known as “district commissioner”.

The culture of lawyers putting on wigs as part of their courtroom dress code came as a result of the prevailing practices of that period. Basically, it can be rightly said that it has its roots in fashion.

Not until the 17th century, lawyers were expected to appear in court with clean, short hair and beard. Portraits of judges from the early 1680’s still show judges who had their natural hair with no wigs on. It was Charles 11 who was the king of the United Kingdom from 1660 to 1685 who returned from France and brought with him the trend of putting on periwig from Louis xiv’s court; and from then on, the English society adopted the trend as did barristers.

However, wigs in those days Wigs were also worn for some other reasons.

1. There were people who wore wigs in order to hide the fact that they were getting bald. These set of people were usually wealthy like Louis xiv because wigs were costly during that period.

2. There were those who wore wigs as to prevent people from knowing that they shaved their hair, because there was a prevalent infestation of lice and other diseases in those days.

Furthermore, Wigs gradually went out of fashion during the reign of George 111 (1760-1820). By the end of the century, they were mainly worn by Bishops, Coachmen, and men of the legal profession. During this period that the wearing of wigs were becoming less fashionable in the society, lawyers and judges felt that it sufficiently differentiated or made them stand out from the rest of the society thus their continued interest in wearing wigs.

3. In recent times, many judges and lawyers who wear wigs have argued that it brings a sense of formality and solemnity to legal proceedings. According to Kevin Newton, a Washington DC lawyer, the above reason is in fact, the overwhelming point of having them (wigs). Some others argue that wig is a symbol of anonymity, an attempt to distance the wearer from having personal involvement in a case and also a way to visually emphasize on the supremacy of the law.

However, in Britain, the tradition of wearing wig in court was challenged in 2007 in a case presided over by Lord chief justice Baron Philips of worth matravers. The chief justice held in the case that wigs would no longer be worn during civil or family cases. But wigs and robes are still to be used in criminal trials.

Why lawyers wear wigs in the court room

Most common wealth countries still entertain the wearing of wigs and gowns in their courts. Nigeria is a case study. In Nigeria, all the lawyers and judges still wear wigs during proceedings; however, this is dependent on the court they are appearing in. For instance, in the magistrates courts, lawyers are not required to appear on wigs and gowns while pursuing a suit. But the full robe of wig and gown is required in other courts starting from the high court upwards.

Some criticism to the wearing of wigs by lawyers

There have been so many criticisms of wigs by many scholars who advocate for its stoppage.

1. That it has colonial origin

In Africa, it is almost half a century since the colonialists left; however, it seems that they left their wigs behind. Wigs as worn by lawyers and judges are not indigenous to the African community, thus they are seen as a continuation of the relics of colonialism. Many writers have lamented that it is appalling to see one of the most enlightened institutions still following the footsteps of the colonialists even at a period where Africa is seeking emancipation from colonial influences in many areas.

2. Discomfort

Wigs have also been criticized on the ground that it makes for the discomfort of the person wearing it. Africa as a continent has cases of high temperature; it is unreasonable and unbecoming for a lawyer or a judge to wear wigs in such temperatures in the name that it befits the profession.

3. Unkempt

Some legal practitioners are so untidy in their approach to the profession that it becomes an eye saw to see the robes. The most dreaded part of it is that the so called wig is white in color and shows when it is not properly taken care of. So, wig is criticized on the ground that it defaces the profession when not properly taken care of.

It is quiet difficult to identify students who is really intelligent today, as there are no much differences between them and other students. But even at this, there are still some blunt characters intelligent students exhibit, that are seldom exhibited by other kinds of students.

In this article, I will share with you some of the characters intelligent students exhibit, that are never found in other kinds of students. So, if you really want to know who an intelligent student is, I advise you read this article painstakingly.

• Intelligent students are never dogmatic:

The most prominent character of people who are greatly endowed, is that they are never dogmatic. They are always open to critiques and correction. Apparently, one of the core attribute of a good student, is his/her open mindedness to obtain whatever is been thought. And this has also been shown to be one of the characters of students intellectually filled.

Anyone who is dogmatic and can never considers other peoples view, can not be said to be intelligent, because his intellects, is limited to his views alone.

• Intelligent students are creative:

Another great attribute of intelligent students is creativeness. Most intelligent students tends to be much more creative than other kinds of student. However, the reason for this, I can't really tell. Maybe it is because they spend much time thinking.

Intelligent students are inventive, and are always engaged in critical thinking, because they love it.

• Intelligent students often read books:

Even without being told, you should know that no student can automatically become intelligent over night. He/she must have been engaged in several relentless reading and researching. The most prominent character of about 97% of intelligent students, is reading and researching.

Intelligent students engage in intense reading and researching, in other to gain more knowledge, and to also retain the knowledge they already have.

• Intelligent students listens closely in the classroom:

Students who are intelligent, are also good listeners in the classroom. They are always attentive to gain whatever is being said in the classroom. In some cases, they get engaged in note taking in the class room, all with the aim of getting a vivid understanding of what is thought by the teacher, mentor or lecturers.

They make sure that they read through all what they noted in the class room and conjoin other materials (e.g Textbook or Note books) for better knowledge.

• Intelligent students love solving problems:

Another character that will help you identify an intelligent student, is his love for solving problems. Intelligent students are never indolent. They are always ready to solve educational problems as long as it will contribute to their knowledge.

Unlike every other student, an intelligent student is a problem solver. He/she does not run away from problems when they get too difficult. He will rather consult a superior to teach him the way to solve that problem.

• Intelligent students never postponed learning:

Intelligent students never skip learning. They would prefer taking their food away from them to asking them to stop learning. They love learning very much and would circumvent anything that will deter them from getting more knowledge.

I could remember those days, where we are told that there will be no classes in school, and majority of members of the class, will start celebrating. However, there are still some students who are not happy, just because the class was skipped.

• Intelligent students are well organized:

This might put you aback, but it is just the truth. Intelligent students often do their things in an orderly and organized manner. They make sure their learning materials are kept properly to avoid looking for them later.

It is very difficult to see an intelligent student who is not well organised. This is because they see orderliness as one of the values of learning. And this position is undoubtedly true.
