The Nigerian Army said on Saturday that some foreign interests and groups in the country are planning to scuttle the handing over on May 29 and scuttle the democratic process. The army said the “mischievous elements” had thought Nigeria would not have successful 2019 general elections but they were proved wrong. The acting Director, Army Public Relations, Col Sagir Musa, who stated this on Saturday, said the foreign interests were working to cause disaffection and divide the Multinational Joint Task Force which was fighting the Boko Haram terrorists and the Islamic State for West African Province fighters. The army spokesman, Musa, said, “The army has noted with great concern the efforts by some unpatriotic individuals, groups and foreign interests determined to cause mischief and exacerbate the security situation in this country in particular and West African sub-region. “These persons and groups are making concerted efforts to further induce the ISWAP and Boko Haram terrorists and bandits with funds and other logistic supports. Their body language and unguarded utterances seem to be in tandem with above and imply tacit support for the criminals. “Some of these mischievous elements thought that we would not have safe and successful general elections but were proved wrong. he House of Representatives on Thursday invited President Muhammadu Buhari, to address the nation on measures taken to tackle rising cases of killings, banditry, armed robbery and kidnappings. This followed a motion on the urgent “Need for Federal Government’s Intervention on the Ongoing Wanton Killing of Innocent Persons, Destruction of Property, Armed Robbery and Kidnappings by Heavily Armed Bandits Operating Within Safana/Batsari/Dansamu Federal Constituency”. The motion was moved by Rep. Ahmed Dayyabu-Safana (APC-Katsina) at plenary. Dayyabu-Safana said that some villages within his constituency had been serially attacked with many people killed by armed bandits. He said that as an immediate step in containing the evil activities of the heavily armed bandits, the president should urgently declare a state of emergency in the federal constituency. “The recent spate of the said attacks on members of my constituency has reached an alarming stage as the perpetrators of this act continuously kill innocent persons in my constituency. “They set their homes ablaze while defenceless men and women are abducted to an unknown destination. “Up to four villages within my constituency are currently under attack in the last 48 hours. “The villages are Massa in Batasari Local Government Area, where no fewer than five persons have been killed, Alhazawa in Safana LGA has been totally displaced. Guzurawa village in Safana LGA also has several persons murdered in cold blood. Read also: Police, abductors of Buhari’s in-law in gun duel “And just yesterday, Gobirawa Village came under attack with no fewer than 12 dead bodies littered in the bush while many are still missing. “These killings have continued unabated and these bandits seem to be unstoppable with a specific instance at Gobirawa Village in Safana LGA. “The bereaved villagers there are forced to abandon the corpses during the burial and scamper for safety, when they sighted the bandits coming back to launch another offensive,” he said. He expressed worry that the bandits, who operated both at night and in broad day light on motorbikes, paraded sophisticated weapons including AK 47 assault rifles. He added that they paraded other dangerous weapons which they used in committing heinous crimes against his constituents. The lawmaker said in spite of persistent cries from the affected communities, the security operatives appeared not be proactive, especially on security tips off and most times failed to respond promptly. “The fundamental duty of any government is the protection and preservation of lives and property by being responsive in the face of this type of cruelty and atrocity committed against its citizen. “It is the constitutional duty and responsibility of this hallowed chamber to take action whenever these levels of inhuman and brutal attacks are being inflicted on any community or group of people,” he said. Rep. Bashir Babale (APC-Kano), who said that “Infrastructure has collapsed where banditry takes place”, compared the former administration with the present one. He said that it was wrong to have accused the erstwhile government of being docile. Rep. Gabriel Onyenweife (APGA-Anambra) said that “Nigeria is not a safe country. The executive should take the lead and lead Nigeria from a failed security state”. Similarly, Rep. Chika Adamu (APC-Niger), who spoke with tears, said the government must urgently find solution to the problem. “We must do something, Mr Speaker, I can’t go to my village and spend a night since the last one year,” he said. Rep Useni Moriki (APC- Zamfara) said that his own local government was not safe. “What happened in Yobe, in Borno in the northeast is now happening in northwest, in Zamfara, in my own local government,” he said. Also Rep. Abiante Awaji-Inombek (PDP-Rivers) said it was different strokes for different people. “Here we are, convinced that we have a problem on our hand but outside of this place, some will tell you that Nigeria is more secured than before. That tells you that we are not on the same page,” he said. Mr Yakubu Dogara, Speaker of the House, said it was necessary to invite the President for an address since the issue of banditry had become national. The motion was unanimously adopted by members when it was put to a voice vote by the Speaker. The House, therefore, urged the Federal Government to deploy the military to the areas under attack to assist the police and other security agencies in flushing out the criminal elements operating in the constituency. It also called for the declaration of state of emergency in the area while urging the National Emergency Management Agency (NEMA) to urgently provide relief materials to the victims of the attacks. 5' FEATURED Six things Osinbajo can’t do in Buhari’s absence Published May 1, 2019 Eniola Akinkuotu, Abuja President Muhammadu Buhari traveled last Thursday on a 10-day ‘private visit’ to London. For the first time since becoming President, Buhari failed to inform Nigerians the purpose of his visit and had also refused to transmit a letter to the National Assembly to inform the legislature of his absence; nor did he name Vice-President Yemi Osinbajo as the Acting President. The President’s action has generated a debate regarding Section 145 of the Constitution, which states, “Whenever the President is proceeding on vacation or is otherwise unable to discharge the functions of his office, he shall transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives to that effect, and until he transmits to them a written declaration to the contrary, the Vice-President shall perform the functions of the President as Acting President.” It adds that if the President does not return within 21 days, the National Assembly can, by a resolution, mandate the Vice-President to perform the functions of the office of the President as acting president. According to the Constitution, the executive functions of the Vice-President include: participation in all cabinet meetings and, by statute, membership of the National Security Council, the National Defence Council, Federal Executive Council, and the Chairman of National Economic Council. Although the vice president may take an active role in establishing policy in the executive branch by serving on such committees and councils, the relative power of the Nigerian vice president’s office depends upon the duties delegated by the President. What are the things Vice-President Osinbajo cannot do in Buhari’s absence? Appointments: With the Presidency operating as one, the Vice-President cannot make any appointments of any sort as the Act establishing most government agencies and departments state expressly that “the President shall appoint.” Even the Vice-President’s personal staffers are appointees of the President, but are only seconded to his office. The then Vice-President, Goodluck Jonathan, made this clear in 2009 when he refused to swear in the Chief Justice of Nigeria, Justice Aloysius Katsina-Alu, when President Umaru Yar’Adua was on medical leave in Saudi Arabia. It was eventually the outgoing CJN, Justice Idris Kutigi, who inaugurated his successor. Fire appointees: It will be recalled that Osinbajo had fired the acting Director-General of the Department of State Services, Lawal Daura, in August last year while Buhari was in London on vacation. Osinbajo was able to do so because he was acting President and could thus exercise the full powers of the President. But with Buhari’s refusal to hand over to him this time, Osinbajo cannot fire any appointee even if they’re found wanting. He will have to wait for his boss to return. Osinbajo also cannot reshuffle the cabinet or sack ministers. Sign bills: On June 12, 2017, acting President Osinbajo signed the 2017 Appropriation Bill into law and the budget was born. Buhari, who had been on medical leave for over 40 days at the time, had handed over power to his deputy to act in his stead. Now that the National Assembly has pass the budget, Nigerians will have to wait for Buhari to return next week for the budget to be made law. Order the military: Buhari, apart from being the head of the executive branch of government, is also the commander-in-chief of the armed forces. Put succinctly, Buhari is the only civilian that the military takes orders from. It was for this reason that Jonathan could not summon a security meeting until he was made the acting President by the Doctrine of Necessity in 2009. With the escalating security situation in the country, Osinbajo can only watch. Write the National Assembly: Unlike the United States where the Vice-President is also the Senate President, Nigeria’s Vice-Presidents have never really had any dealings with the Office of the Senate President except when the Vice-President is acting as the President. During his time as acting President between 2016 and 2018, Osinbajo wrote to the Senate many times. For instance, in 2016, he wrote to the Senate to confirm Justice Walter Onnoghen as the CJN. He also wrote the Senate to confirm Ibrahim Magu as the chairman of the Economic and Financial Commission. Osinbajo also cannot forward bills to the National Assembly. Declare war/state of emergency: Section 305 of the Constitution states expressly that only the President can declare a state of emergency or war. Femi Fani-Kayode, former Aviation Minister has reacted to the release of Zainab Aliyu, the Nigerian student detained in Saudi Arabia for alleged drugs trafficking. Fani Kayode, in a tweet on Tuesday commended Buhari for the timely release of the Nigerian student. He said “Securing the release of Zainab from execution in a Saudi prison is a great achievement by @MBuhari.She was due to be executed for a crime she never committed. “Buhari saved her life by intervening and for the first time in 4 years I am proud to be a Nigerian! Welcome home Zainab.” DAILY POST had reported that Saudi authority arrested Zainab over alleged drug trafficking. It would be recalled that Buhari had directed that Abubakar Malami, the Attorney-General of the Federation and Minister of Justice to immediately intervene in the case of Zainab.
