No doubt... there can be conditions that will prevent her from having full citizenship despite being born in South Africa. But are there such conditions? If there are none .. then she should win her case. If they are determined to deport her ... then they can add the conditions to make them do so legally.
PS
Just read a comment from JaceBlaze stating there is no birthright law. Interesting ... a game changer to our discussions ... followed it up and came up with this below. My opinion now? It can go either way ... depending on the required evidence she has ... mainly proof of birth ... and proof that she lived in the country continuously since birth. Her lawyer has to know this ... and I guess he has the evidence and is moving forward with confidence. With the mother's shady past .. I can see the problem being if the documents presented as proof are legit. The case can go either way
It's a little more complex than what you are stating above. Being born in South Africa does not confer "automatic" citizenship like in the United States. There are additional "conditions" to be met as you have discovered, however in my time in South Africa, I have witnessed some cases in courts similar to Chidinma's case with verdicts that surprised me.

I really don't want to divulge how those went but suffice to say, I would expect any good attorney to argue her case vigorously given several peculiarities and incidents involved in her predicament.

If you want to know more about South African citizenship you can peruse through the below

All South Africans are on the same page - black, white, ANC or DA, educated or uneducated.

SA is known globally for high crime and unemployment rates - something has to change.

The country needs serious change, we don't care what you say.
Not all of them are on the same page with what we are seeing on our screens and on social media with the harrassment of foreigners.

Tell the truth Randdigital. I can post many South Africans who are speaking against these things.

It's more of a cosmopolitan city compared to the rest of S.Africa. She can blend in there easily as long as she stays far away from "some" areas.

One more time: South Africa does not do birthright citizenship
If you studied law then go back and tell them to withdraw that degree of yours and throw it in the trash. An embarrassment to learned folk by you standing on such an over simplistic view of citizenship in your country.

I am still waiting for an answer on how you acquired your citizenship Jaceblaze?

Were you born to exiles in Mozambic, is that why you dislike foreigners so much?

Busayo Saka has every right as a British citizen just as Chidinma do have rights in SA, if anything happens to Busayo Saka in the UK tomorrow she has every right to seek redress in a competent court of law and so does Chidinma. That doesn't affect their Nigeria roots in any way.
Saka's case is very very different.

Isn't this a discussion forum? What does the law say that prevents her from being South African? If you can't say then you should be quiet and not engage.... making headlines with no details to follow up.
She has grounds to challenge it but there are some aspects of the law that can be argued against her as well.

It will come down to the interpretation of the law that governs the "conditions" in which she can claim citizenship.

Let's ring it out loud one more time so another future japajerian from Makoko doesn't get any ideas:

South Africa does not do birthright citizenship
Yes, circular reasoning produces cognitive dissonance.

"South Africa does not do birthright citizenship because we just don't do it.

on this basis, I declare, you are not a citizen by "birth" Jace.

I just wanna make sure we don't sway off track:

South Africa does not do birthright citizenship
Yes with the key words being "unconditional" versus "specific conditions."

This is why laymen who just read the immigration act and constitution for the first time shouldn't be commenting or making sweeping statements.

We leave that to the lawyers and immigration experts.
CelebritiesRe: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by seppuku:
JaceBlaze:
South Africa does not do birthright citizenship
Its cognitive dissonance. The technicalities too difficult for you. I understand my Brada. That's why people like Jacinta qualify as your leaders.

"South Africa does not offer unconditional birthright citizenship; citizenship is primarily granted based on parentage (jus sanguinis), not solely by being born in the country.
Current Legal Framework
Under the South African Citizenship Act of 1995, any child born to at least one South African parent automatically receives citizenship at birth, regardless of the child’s place of birth

This reflects the principle of jus sanguinis (“right of blood”) rather than jus soli (“right of the soil”), meaning that citizenship is inherited from the parents rather than granted simply by being born in South Africa

Children born in South Africa to foreign parents do not automatically acquire citizenship. Instead, they may claim South African citizenship later, but only under specific conditions: the child must have been registered at birth, lived in South Africa until reaching the age of majority, and submit a formal application to claim citizenship

This process ensures that citizenship is not automatic for children of non-citizen parents.

Before 2013, South Africa allowed a form of conditional birthright citizenship children born in the country to at least one permanent resident parent were automatically considered citizens at birth

.However, the Citizenship Amendment Act of 2010, effective from January 1, 2013, curtailed this policy. Now, children born in South Africa to non-citizen parents only acquire citizenship if they would otherwise be stateless, and citizenship claims require a formal application after"
CelebritiesRe: Chidimma Adetshina Heads to Court to Challenge Deportation From S.A (Video) by seppuku: 3:41pm On Jul 17
JaceBlaze:
South Africa doesn't do birthright citizenship
You do know that there was a period children born to Legal residents within the country were accorded citizenship by birth right?

You do know that children born in the country designated as stateless acquired birthright citizenship right?

You do know that there was a clarification of children born outside the country to a South African citizen being "redesignated" as South Africans by birth ( birthright citizenship) and not by descent, right?

Like I said leave these things to the immigration experts and ready your constitution properly cause your hate for any other person claiming to be "you" will blind you from common sense.

Looting and benefiting from the business they didn't create or have financial inputs.
Bros make dem leave South Africa for South Africans. Lets draw the line and move on. Deep down inside they do not believe other Africans are like them kinda like "they not like us" FBA stuff going on in the US.

south africa is not like Nigeria where records are bad. If she cannot prove that she was born in SA and with her mother circumstances of fake identity. Then SA can legally deport her. What kind of name is chidinma adetsina too . Keep whining
I don't think there is a dispute currently with her place of birth and as far as her name is concerned you should also be asking what kind of name is Segun Arinze?

South Africa does not do birthright citizenship baba, this girl is not and will NEVER be a South African. And why should a fraudster be rewarded a citizenship?

And as for "there's nothing anyone can do about it" ...I don't know about that,I really don't know.prior to 30th of June that was the tune and attitude of most illegal aliens, little did they know reality is about to hit different. All that tough talk changed drastically.
Jace Jace Jace.

You must read your immigration law very well. This is why we leave such matters to expert immigration lawyers to handle and not uneducated South Africans who are just reading their constitution for the first time.

If its a cut and dry case, She would have been gone by now.

I wonder what her lawyers are arguing are the grounds for her stay in SA.

Hmmmmm?

What is your issue with the way Ghana is run? You want to tell Ghanaians how to run their government? Is the current South African governmnet better than the current governmnet in Ghana? It is a shame that South Africa is going down but people like you can't see it. Your economy is not growing, your officials are corrupt. very corrupt and you are talking abou croynism and nepotism in Ghana? grin

Mahama giving the gold mine to his brother is better than giving it to a south African company.
Their best friends the Ghanaians have turned against them. They were using them to spite "Nigerians" not knowing that everyone's see's them the same.

Now Ghana is the one ruining their reputation.

SMH.
