Thanks for at least moving away from the illegality you were touting previously, as we have now both agreed that only 1 proclamation is needed and they other lawmakers can be sworn in by the Clerk or Presiding officers later.

As to why they didn't attend plenary, the question will be: Were they invited to be sworn in? Did they attempt to be at the HoA complex and were prevented? Were they refused being sworn in?

The answers to the above will help the court to determine if their seats are vacant or not, but for now, until the courts determine otherwise, they are valid fully elected lawmakers of the Edo State House of Assembly.
Well, there are political explanation to the questions you raised in your second paragraph. These law makers bluntly refused to come for a subsequent swearing in because they had a hatchet plan that will no longer materialize because they had planned to elect a speaker within themselves so as to control the governor as wished by their sponsor(Oshiomole). And since the 10 previously sworn law makers had already elected a speaker, the subsequent members felt useless. Words are that they relocated to Abuja to stay with their sponsor who could no longer control the governor until now. I guess after about 3yrs, they just remember that they have seats that must be occupied in Edo state house of assembly.

people you failed to swear in you are telling them they are absent how. Before you attend any preceding in the house you must be inugurated. Do you know that as of that time they don't have a seat in that house? How can you go for sitting while you don't have a seat? Mr lawyer can you sit without having a seat in your office?
No wonder Obaseki is messing up because this are the types of lawyer that are advising him.
Mr lawyer let me educate you that any student that is not registered and given a class in the school, cannot be accuse of been absent from school.

I am happy we both agree the constitution has not been violated.

The proclamation is only issued once, as a proclamation is about the COMMENCEMENT OF THE LEGISLATIVE TERM, it has nothing to do with inauguration.

Cast your mind back to 2015, PMB issued a proclamation and the PDP members of the Senate with Saraki were inaugurated, and Saraki was appointed Senate President while the majority APC members of the Senate were having a meeting with the President.

Did the President issue a second proclamation for the other members to then be sworn in? Of course he didn't as a proclamation is only issued once, and once the legislative activities have commenced, other members can be sworn in by the Clerk or the Presiding officers of the House.

So clearly, the other members do not need a proclamation to be issued by Obaseki before they can be sworn in, and that is also what the court said.
You must understand that the federal law makers didn't absent themselves from legislative business. And of course they didn't just wake up one morning to resume after a long time, to impeach the Senate President when their seat are in contention before the courts. The Edo state law makers didn't help themselves in this case. What even stopped them from doing all these shortly after their inauguration? These law makers have slept on their rights and the court may no longer take them serious, hence the court of first instance has already rule their seats to be vacant. Well, no matter how we try to analyse these issues here, it will certainly not be very clear who is on the wrong side of the law! But I think the court will not be pleased with the political dimension of this case.

Are you aware that they have been absent for more than 181 days and by so doing their seat is vacant??
Politics › Re: 17 Edo Lawmakers Insist On Sitting by Sermwell(m): 4:52pm On Aug 12, 2020
Akainzo:
Since you are a lawyer, let me take you up on your stance.

By the constitution, they are elected members of the House of Assembly.
By the constitution, until a competent law court declares their seat vacant, they remain elected members of the House of Assembly.
By the constitution, if a High Court declares their seat vacant, and they appeal at the Appellate Court, they remain elected members of the HoA.

Now to the issue of inauguration.
By the constitution, a Governor issues a proclamation of the House TO THE CLERK OF THE House of Assembly.
By the constitution, it is the Clerk that inaugurates or swears in members of the House of Assembly AFTER the proclamation.
By the constitution, the Governor has done the proclamation, and 10 members were sworn in earlier.
By the constitution, the clerk/House has now sworn in the other 14 members of the House of Assembly.

Please, do let me know which part of what I enumerated above is the illegality that you are referring to.
So the governor issued a proclamation for the swearing in of the other 14 members?? He has already done that for the swearing in of 10 members in which other members were absent(for whatever reasons) and subsequently refused to partake in any legislative business of the state.
Now my question to you is that.....is the governor required by the constitution to issue proclamation twice?
And by what proclamation was the subsequent 14 members sworn in?

inec declear them members but they must be given seat by the Clark of the house before they can have a seat in that assembly complex.
So INEC is now the court of law? I know you are reasoning from a layman's point of view, but as a lawyer, I'm putting it to you according to law. The court is yet to decide on their membership of the house, and whatever they are doing now is shrouded in illegality....and they all know it....but they are fooling the masses to argue nonsense.

can you declear vacant seat for somebody that is not inugurated? As of that time they don't even have a seat, so which seat are you declaring vacant? Their seats can only be declared vacant after their inauguration.
Anyway, some of you are children and ignorant of the law.
so now that they have not been inaugurated, why are you calling them members??

Dididrumz:
The Nigerian of Nigeria!!!!!
##########

I run a manufacturing business and a trading business.
The biggest challenge in my manufacturing business is not power, or infrastructure, the biggest challenge is getting honest staff.

Everyone we hire appears to be on a mission to steal as much as possible. Inflated invoices, recording less than the actual number of units produced.

The worst part of it all is that all the fraud we've uncovered is not done by a single person, it's usually many staff who collude with each other, from production, to sales, to finance, even top management. There was a year I overhauled the Management 3 times in a year.

But I've found a solution, I now use Indian Management Team. So competent, so honest and so straightforward. I thought they were expensive at first with all the visa fees, accommodation, house staff, but now that losses due to staff theft have been reduced to a minimum, and efficiency increased, the Indian Management has turned out to be cheaper than the previous Nigerian Management.

Now, all sensitive positions involving money go to Indians. Nigerians are only allowed in non-sensitive positions. I used to criticize companies like Dangote Group that hire so many Indians when there are many unemployed Nigerians, but now, I understand their decision.

My biggest challenge in the trading business is the same, getting honest staff. The form of trading occurs in the open market, and involves staff having access to huge sums of money running into a few millions. I know how much I pay to security companies to provide escorts for the staff, not to prevent robbery, but to ensure that the staff go straight to the bank to deposit the money after the day's sales and not disappear with my money.

This money spent on security companies is even enough to be declared as profit. We have to spend on CCTV, biometric scanners and other things that wouldn't not be needed if staff weren't looking for the slightest opportunity to steal.

It got so bad at a point that my main criteria for employing staff was no longer conpaetency but honesty. At least, competency and skills can be learnt, but once you're dishonest, you're dishonest.

We always complain of the economy and how they are no jobs. I know people abroad who would have loved to set up job creating businesses in Nigeria but they can't because they can't get any trustworthy person to run it.

I know people in Nigeria with so much money, they want to start factories and other job-creating businesses but they can't because they are occupied elsewhere and can't get any trustworthy person to run the business.

So instead of investing in the real sector and creating jobs, they'll just buy treasury bills, while the thieves are shouting no jobs.

Many big businesses would have been born in Nigeria if we could engage in partnerships, but we cant because you can't trust anyone. This is one advantage the Indians and Lebanese have over us in Nigeria. They can pull resources together and do mega-business, unlike Nigerians that because only one person must do everything since we can't partner, end up with small, tiny businesses.

Start a poultry and they will be stealing your eggs. Some will even go
ahead to be killing the chickens so that they'll be allowed to take them home.

Start an entertainment/viewing/game center and they'll be pocketing
your money. On the days you're around at the business, the money
realized will be x10 of the money realized when you're not around.
Because they're eating your money.

Lease out a vehicle to a driver to use and watch as he'll finish you.

Start a restaurant, the same thing will happen. More than half of the
total food ingredients will end up in their personal kitchens.

Even ordinary provisions shop, they will find a way to steal.

You'll see them with that their evil, wicked saying "na where person dey work, na there e dey chop, na e make dem dey callam workchop/workshop"...... Just imagine, justifying theft at work.

And you'll see these people point their crooked fingers at politicians when they're not any different. I usually say the reason most Nigerians haven't stolen billions of government money, is simply lack of opportunity.

Nigerians are the problem of Nigeria. Our Nigerian Nigeria............
This is quite expository!! You are absolutely right about this!!
