This was contained in a statement signed by the Director, Public Affairs of the commission, Alhaji Awwalu Salihu, made available to newsmen in Abuja. The statement said the commission had become aware of a pirate radio station transmitting seditious and divisive content contrary to the provisions of the Nigeria Broadcasting Code and law. It assured the public that it was working in conjunction with security forces to track the source of the broadcast. It urged the public to ignore the inflammatory content of the broadcast and continue to work toward a strong, united and prosperous nation. Governor Udom Emmanuel of Akwa Ibom State has lauded the state chapter of the All Progressives Congress (APC) for accepting that elections truly took place in the state on April 11, 2014. This was contained in a release signed by his Chief Press Secretary, Mr. Ekerete Udoh and made available to newsmen. The governor, who was reacting to a call by the opposition party in the state that he should publicly declare his assets and the debt profile of the state called on the party to join hands with him in moving the state forward. According to the release: “Our attention has been drawn to the Press Release by the APC dated June 23, 2015 with the above caption. Let me, on behalf of the 5 million people of Akwa Ibom State thank the All Progressives Congress (APC) for finally agreeing that elections did take place in Akwa Ibom State on April 11, and that Udom Emmanuel of the PDP was massively and overwhelmingly voted into office as the governor of our dear state. With this acknowledgement, I hope the APC can now join hands to build our state and support the people-centric programmes of the Udom Emmanuel administration.” The release noted that “shortly after Governor Emmanuel was sworn in, he hit the ground running and to show a total dedication to his campaign promise of rapid industrialisation, he has already set up a technical committee for the realisation of the Ibom Deep Seaport, made up of thorough-bred professionals, with the deadline for the completion put at 2018. He has also visited the moribund Peacock Paint factory at Ikot Ekan, Etinan Local Government Area and will soon constitute a team of experts to advise the government on the revitalisation of the industry.” It added: “Technical committees on Foreign Direct Investment (FDI) and Agriculture and Food Sufficiency will soon be constituted. In two weeks, an additional 20 wattage would be added to the system, which would further stabilise power supply.” It also stated that “it appears the APC is more interested in manufacturing issues, most of which defy logical analysis. A Federal High Court in Abuja has sacked a member of the House of Representatives, Idu Emeka Godwin, representing Onitsha North/South federal constituency from the House. The court on Thursday ordered the Independent National Election Commission (INEC), to withdraw the certificate of return issued to Idu Emeka Godwin and to issue a fresh certificate of return to Lynda Chuba-Ikpeazu, after holding that she was wrongly substituted. The court held that Chuba-Ikpeazu was the authentic candidate of the Peoples Democratic Party (PDP) at the April 11, 2015 election. Justice Adeniyi Ademola who gave the order while delivering judgment on a pre- election suit filed by Chuba-Ikpeazu also ordered the National Assembly, specifically, the House of Representatives to swear in the plaintiff as a member of the House. Chuba-Ikpeazu who won the Peoples Democratic Party (PDP) primary election conducted on December 7, 2014 had in the suit challenged her substitution with Idu Emeka Godwin by the party. Delivering the judgment, Justice Ademola said that Chuba-Ikpeazu having been listed as candidate of PDP for the 2015 general election for the House of Representatives following her emergence as the winner of the primary election, should not have been substituted. The court held that the substitution would have been valid only if the plaintiff voluntarily withdrew or died. He agreed with the submission of the plaintiff counsel that it was not lawful for INEC to have accepted the name of PDP candidates for the election, other than that approved by the National Working Committee. The plaintiff in her affidavit in support of the suit had said that she and other aspirants participated in the primaries conducted on December 7, 2014, at the instance of the National Executives but were disappointed when an order of the Federal High Court compelled INEC to publish the list of candidates produced by a factional state executive of PDP. She further averred that the Court of Appeal upheld their appeal against the ruling and struck out the suit. But INEC failed to reflect her name as the PDP candidate and that when she approached the PDP they could not offer any tangible explanation for her substitution. Responding to the growing calls for the impeachment of Osun governor, Rauf Aregbesola, a group known as the Asiwaju Grassroots Foundation, has urged the Speaker of the State House of Assembly, Najeem Salaam, to disregard a petition from Justice Folahanmi Oloyede. Oloyede had petitioned the State Assembly to impeach Aregbesola, on the grounds of alleged financial recklessness and the inability of the state to pay its workers’ salaries. In a letter dated June 24, 2015 and signed by the AGF coordinator in Osun State, Adeboye Adebayo, the group, implored the Speaker to ignore the petition because “Aregbesola has made meaningful achievements.” The letter read in part, “Mr. Speaker, you know that before now, workers’ salaries, pensions and other emoluments were being paid as and when due, including car loans and 13th month salaries. “Things began to go the other way when financial meltdown hit the country through the mismanagement of the national economy by the President Goodluck Jonathan-led government and it is worthy of note that it was Aregbesola that first raised the alarm about the impending financial crisis. “Benue, Bayelsa, Rivers, and Delta states also owe workers. So, it is not Osun State that is battling with this alone. It is due to financial recklessness and mismanagement by the Jonathan government. Governor Okezie Ikpeazu of Abia State has announced the slashing of his salary and travel allowance by 50%. Ikpeazu, who disclosed this Monday at the Government House Umuahia, while swearing in the state’s new Head of Service, Dr. Vivian Uma, said he was deeply pained by his administration’s inability to pay salaries of workers as at when due following the dwindling federal allocation. He said he had decided to personally identify with the suffering workers and would not lift the self imposed austerity until the salaries and allowances owed workers were cleared. Some workers, especially those in the parastatals, as well as pensioners are being owed up to six months salaries. The Governor, who is yet to move into the Government House, Umuahia, promised “to do everything possible” to systematically defray the arrears of workers’ salaries. He called on political appointees to follow his example, stressing that there is need to cut down the cost of governance. Meanwhile, he congratulated the new Head of Service on his appointment which he described as a milestone, saying that the appointment is part of his government’s desire to rejig the civil service. He charged civil servants in the state to be more proactive for the challenges ahead. The Governor also charged the new HOS to fashion out innovative ways of doing things, especially in terms of increasing the Internally Generated Revenue of the state. In his acceptance speech, Dr. Uma promised to introduce new changes for efficient service delivery, adding that discipline and sound ethical conduct will be enthroned in the service under his watch. An election observer group, Youth Initiative for Advocacy, Growth and Advancement, YIAGA, has said that the April 11 gubernatorial election in Akwa Ibom state did not take place in approximately 70 percent of the state. The group described the eventual results of the election, as declared by the Independent National Electoral Commission, INEC, as a fraud. The group also said the election was marred by several cases of violence and intimidation across the state. The group, which stated this at an interactive session with journalists in Lagos on Wednesday, said that some electoral officers, the police and other security personnel were complicit in the abuses. The interactive session was also attended by the All Progressives Congress governorship election candidate in Akwa Ibom State, Umana Umana, who was defeated by Peoples Democratic Party’s candidate, Udom Emmanuel. “It is safe to say election was only held in one or two local governments in Akwa Ibom as against the make believe massive turnout and favourable result declared in favour of the PDP Candidate Udom Emmanuel. It was reported that slight voting took place in Etinan, the few places that were set up had no result sheets while voters were allegedly teargased in several parts of Uyo and Akwa Ibom in general,” the group said. Speaking further the group said, “In a place on Oron road in Uyo, we saw one of the white buses belonging to the state being used to convey snatched ballot boxes and we have that on video”. The observers also said that there was no collation of results in Akwa Ibom but surprisingly, election results were announced at 4:58p.m. the next day and 92% of the votes were given to the PDP candidate. Addressing journalists, Mr. Umana said, “I wish to tell the world that election did not take place in Akwa Ibom on April 11. What we had was enthronement of the candidate imposed by ex-Governor Godswill Akpabio”. “Take for instance in a state like Lagos, results were announced as they trickled from units. That way, the winner and the loser gradually knew what to expect at the end of the day. But in our case, people were intimidated. In cases where it looked like election would be conducted, security agencies fired tear gas claiming some persons were unruly. This happened in a unit where an 82-year-old woman was also waiting to exercise her right. “She and others were not only disenfranchised, a case of human rights abuse could also be established. So, what went down and what we witnessed in Akwa Ibom is far from cheering,” he added. Mr. Umana said he was willing to use all legal means to have the election result upturned. Abia commences demolition of illegal structures JUNE 18, 2015 : STEPHEN UKANDU Governor Okezie Ikpeazu of Abia State has said he is set to commence the much expected demolition of illegal structures in Aba, the commercial nerve centre of the state. Ikpeazu in a statement issued by his Chief Press Secretary, Mr. Godwin Adindu, called on members of the public whose structures were illegally sited to dismantle them or have them demolished by government task force. The statement read in part: “The Government of Abia State is, by this notice, informing all property owners in the Aba metropolis and the general public that, in line with the government’s commitment towards the rebuilding of the city of Aba, which necessitated the establishment of the Aba Urban Renewal Office, the agencies of government will commence a demolition exercise of all structures, property, stalls and shop which encroach into the road, seven days from this announcement. “The properties to be demolished include, but not limited to, buildings on service lanes, illegal shops, illegal fences and such other structures that constitute a blockade to the free flow of traffic and drainage. “You cannot make omelet without breaking eggs. If we must have the Aba city of our dream, we must be ready to make the utmost sacrifice. “Government therefore call on all concerned to take appropriate measures before the arrival of the bulldozers.” Aba has suffered from perennial flooding due to its table landscape according to experts who have severally recommended demolition of structures obstructing water channels. But no administration in the state seemed to have mustered the political will-power to do the needful which, according to a government source, will affect over 100,000 buildings. A 27-year-old trader, Lucky Bassey, has been arrested by the police for allegedly raping his neighbour’s daughter, Ruth (pseudonym) in the Bariga area of Lagos State. Both the suspect and the victim live in the same house on Akilo Street where the incident happened. PUNCH Metro learnt that the 12-year-old victim was using the toilet penultimate Monday, when the suspect forced the door open and subsequently raped her. Their correspondent was told that the victim’s mother observed that she could not walk properly after she left the toilet. She interrogated Ruth, who told her mother that Bassey had raped her. The matter was reported at the Bariga Police Division and the suspect was subsequently arrested. Ruth, a primary six pupil, told the police that Bassey had sex with her while standing. She said she could not tell how long the sexual assault lasted, but in the end, the suspect threatened to deal with her if she told anyone. She said: “I was in the toilet on Monday, May 25, around 8pm, when I heard a knock on the door. I told the person at the other side that I was using the toilet. But brother Bassey forced the door open and closed my mouth to stop me from shouting. We were both standing when he raped me. He said I should not tell my mother about it or he would deal with me.” The mother told PUNCH Metro that she observed that after she left the toilet she could not walk properly. She said it aroused her curiosity and she interrogated her daughter for information. “I called her and asked what happened to her. She told me that Bassey raped her.” She said she reported the matter at the police station, leading to the arrest of the suspect. After the rape, Ruth bled for a week. She was reportedly rushed to a general hospital in the state where she was treated before the bleeding stopped. The result of some tests conducted on her, which was sighted, stated that there was a forceful penetration into her private parts “which affected her clitoris and labia majora.” The victim’s mother said Bassey’s family members had been asking her to forgive the suspect. “We are both from the same village in Calabar, Akwa Ibom State. We also live in the same compound in Lagos. His people have been asking us to forgive him. Even our landlady has also begged me. But I have told them it was no longer within my power and that the government has taken over the case. I don’t know why it will be my daughter of all people that he will do this to when there are many prostitutes out there that he can have sex with.” However, the suspect denied raping the victim. He said: “I don’t know what she is talking about because on that day, I did not enter the toilet as she claimed and I did not rape her.” The Police Public Relations Officers, Kenneth Nwosu, when contacted, confirmed the incident. The kidnapped Regent of Akungba Akoko in Ondo State, Princess Oluwatoyin Omosowon, has been rescued by security agents. Omosowon was reportedly rescued on Tuesday by a combined team of police and State Security Service. The regent and three of her aides were, on June 2, 2015, abducted by gunmen while on their way to attend an event at the Federal University of Technology, Akure. Two of her aides had regained their freedom, leaving the regent and one other aide in the custody of the kidnappers. Though the details of the event were still sketchy as of the time of filing this report, a family source, Mr. Adesuyi Clement, told our correspondent on the telephone that the regent was rescued somewhere in Edo State by security agents. “I can confirm to you that she has been rescued somewhere in Edo State by men of the State Security Services and the Police. The President in turn is said to have requested legal advice on the five bills which include the Office of the Financial Ombudsman Bill 2015, National Convicts and Criminal Records Bill 2015, Electronics Transactions Bill 2015, Whistle Blower Protection Bill 2015 and the Nigerian International Financial Centre Bill 2015. All five bills were among the 46 rushed through the Senate on June 3, the last day of sitting by the 7th Senate. The sources, however, would not say to what degree the Osinbajo-led committee of legends in law has gone on the issue, but it is expected that the committee would prod the President to give his assent to the bills. Osinbajo has generally been expected to lead the administration’s efforts in justice sector reform and the identification of the five bills in the initial campaign against graft is believed to be in that direction. The five weapons The Whistle Blowers Protection Bill sponsored by former Senator Ganiyu Solomon “seeks to provide for the manner in which individuals may, in the public interest, disclose information that relates to unlawful or other illegal conduct or corrupt practices of others; to provide for the protection against victimisation of persons who make these disclosures.” Senator Solomon first presented the bill to the House of Representatives where he served in 2007 but the bill did not get the expected legislative and executive endorsement until the concurrent passage by the Senate and the House of Representatives. The bill defines the nature of an impropriety that qualifies for disclosure, the procedure for disclosure and the protection that would be given a whistleblower by government agencies. It aims to give some measure of protection to individuals who give out information on alleged malfeasances in government to security agencies. The Electronic Transaction Bill, 2011 was sponsored by a former member of the House of Representatives, Uzoma Nkem-Abonta provides the legal framework for electronic transactions in the country. The bill especially becomes relevant for security agencies in the wake of increasing transition of the country from a cash-based economy towards a cashless economy facilitated by electronic channels. The Electronic Transaction Bill, when signed by the president, is expected to facilitate e-government services and promote transparency in the transaction of government businesses, including procurement and sales of goods and services. The Nigerian International Financial Centre Bill, aims to produce three separate agencies, namely, the Nigeria International Financial Centre Authority (administrative body); Nigeria Internal Financial Centre Regulatory Authority and the Nigeria International Financial Centre Judicial Authority. The effect of the three agencies would be to position properly the country at the centre of global finance and as such attract international finance into the economy. The Office of the Nigerian Financial Ombudsman, 2015 which was also passed by the Senate on June 3 seeks to establish the Office of the Nigerian Financial Ombudsman, as an independent body charged with the responsibility of resolving financial and related disputes in the Nigerian financial services sector. The establishment of the Office of the Financial Ombudsman is also expected to lead to efficiency in dispute resolution in the financial services sector. The Convicts and Criminal Records Bill, 2015 aims to among others ensure a proper documentation of convicts and criminals for the purpose of keeping a record of criminals in the country. He is to realign all the anti-corruption agencies into frameworks that can deliver. He would have to look at whether the EFCC, ICPC and Special Fraud Unit are not doing conflicting jobs. What is important is that first of all, he must have the political will, strengthen the anti-corruption agencies, he should also fund them. He should also give the anti-corruption agencies independence to go after anyone, who is found wanting without fear or favour.” “We need new strong laws, the laws to tackle corruption now are weak, they are also duplicating and confusing and sometimes, the laws are wrong. So, sometimes, we need simple laws that will state who is a corrupt person.” Continuing, the legal luminary added: “What is important is the political will, strong institutions, allow these institutions to work independently and finally, give them the money to work. Once you have these four things in place, it is very easy to fight corruption. But when you now have an agenda, then, there is a problem. Short, who is the Chair of the Extractive Industries Transparency Initiative (EITI) arrived in the country on Monday on a three-day working visit. She is expected to hold talks with President Buhari on the implementation of the independent reports of the Nigeria Extractive Industries Transparency Initiative (NEITI) The Meeting which is also expected to provide the International Chair the platform to brief the President on the importance of integrating the EITI principles in his economic policy agenda as obtainable in resource rich countries of the developed world, is also seen as a global endorsement of President Buhari’s commitment to good governance, transparency and accountability Buhari had listed the implementation of the findings and recommendations of NEITI Audit Reports as a priority within his administration’s 100 days in office. The executive secretary of NEITI, Zainab Ahmed, had said last week that over $7.5 billion between 1999-2011 still needed to be recovered from oil and gas companies in Nigeria. "The amount represents clear cases of underpayments, under-assessments of taxes, royalties, rents...which have not been adequately addressed in the past," she said. NEITI has suggested selling the state oil company's stakes in producing joint ventures to fix its budget woes, a call echoed by many in the new administration, as well as scrapping the expensive and graft-riddled fuel subsidy. The government relies on oil sales for the bulk of its revenues but there has been little oversight of how these are handled. Central bank governor Lamido Sanusi was sacked under former president Goodluck Jonathan after he said that up to $20 billion in oil revenues between 2012 and 2013 had not been remitted to the government by the state oil company NNPC. Buhari said he would re-examine this allegation. Ahmed also said NEITI audits showed that some $11.6 billion of dividends between 1999 and 2012 from the government's investment in the Nigerian Liquefied Natural Gas (NLNG) company were not remitted by the state oil company. "NNPC was unable to provide any evidence that the funds were remitted to the federation as required by law," she said. NNPC said the issue of reconciling accounts had been raised at a previous Inter-Ministerial Task Team and would be discussed at one this week. The team was designed to implement NEITI's findings. NEITI has also said the sale of eight oilfields to NNPC's upstream arm in 2010-2011 should be reviewed, as they were sold at $1.85 billion of which only $100 million was remitted to the federation account in February 2014. Before his sacking, Sanusi also criticized some of these deals for being awarded non-competitively to companies that supplied no services. The International Chair is at the head of a delegation of a special implementation Committee set up by the World body EITI, drawn from 50 member-countries. The EITI boss is also expected to visit the NEITI Secretariat and observe a Meeting of the Inter Ministerial Task Team (IMTT) set up by the Federal Government to implement the findings and recommendations contained in the NEITI Audit Reports. Nigeria joined the EITI in 2003, began implementation of its principles and established NEITI in 2004. Ohanaeze Youth Council, OYC, has urged President Muhammadu Buhari to ensure that Geometric Power Limited commenced generation and distribution of power in Aba, Abia State. The group in a statement signed by the National President and National Secretary, Mazi Okechukwu Isiguzoro and Mazi Okwu Nnabuike Emmanuel, respectively, called on the President to investigate why the Geometric power plant in Aba was still being frustrated from generating and distributing power to Aba and its environs. OYC reminded Buhari that Geometric power had the capacity to end the problem of epileptic power supply in Aba and environs, stressing that the importance of power in the economy of the city could not be overlooked. The group accused Enugu Electricity Distribution company, EEDC, of sabotaging the effort of the company to commence operations in the city. On the constitution of his cabinet, the youth group urged Buhari to shun partisan considerations and see the entire nation as his constituency and appoint patriotic Nigeria who would help him fulfill his dreams for the country. The youth group urged the President not to restrict his choice of aides and ministers to the nomination of state governors, accusing the latter of always recommending people who would serve their interests. A human rights group, Centre for Human Rights and Social Justice (CHRSJ), has called on the two anti-grant agencies, the Economic and Financial Crimes Commission(EFCC) and Independent Corrupt Practices and other Related Offenses Commission(ICPC), to begin the investigation of all financial transactions of the Osun State government since Mr. Rauf Adesoji Aregbesola assumed office in November, 2010. The rights group made the call on the heels of Aregbesola’s inability to pay the workers’ salaries for seven months now due to alleged mismanagement of allocations that accrued to the State from the Federation Account. President Muhammadu Buhari on Wednesday assured Nigerians that he would do all within his powers to ensure that they do not regret entrusting national responsibility to him by electing him during the March 28 Presidential election. He said his administration was capable of fixing the nation’s problems. Buhari made the submission in an address he delivered to members of the Nigerian community in Niger during his visit to the country. A copy of his speech was made available to journalists in Abuja by his Senior Special Assistant on Media and Publicity, Mallam Garba Shehu. Buhari told the Nigerian community that his government is just coming on board and is still in the process of setting out appropriate modalities on how to actualise its agenda of revamping Nigeria as contained in the manifesto of the All Progressives Congress. He noted that Nigerians voted for him based on the party’s manifesto. He however urged them to exercise patience because the task of rebuilding Nigeria is an arduous one. He reiterated his position that to ensure accelerated development, his administration would concentrate on challenges of insecurity, near economic collapse, pervasive corruption and power shortages among others. Buhari said, “I want to reassure you that we are going to tackle these challenges head on. “Nigerians will not regret that they have entrusted national responsibility to us. “We must not succumb to hopelessness and defeatism. We can fix our problems. “However daunting as the task to surmount these challenges may be, they are by no means insurmountable. “There is now a national consensus that our chosen route to national development is democracy. To achieve our objectives we must consciously work to improve the democratic system.” Buhari also assured them that his government would be resolute in ensuring that the country’s name is raised higher.
