The Nation reports that the Activist-lawyer, filed a suit against President Muhammadu Buhari for appointing the Asset Management Corporation of Nigeria (AMCON) board without seeking the opinion of the senate. Adegboruwa said that the August 19 appointments were all blatant violation of the relevant statute setting up the agency.

Adegboruwa referred to Section 10(1) (C) of the AMCON Act 2010 which provides that the board, consisting of three executive directors nominated by the Central Bank of Nigeria (CBN) in consultation with the Minister of Finance, must be appointed subject to Senate confirmation. He is however seeking a declaration that the President cannot appoint anyone as Executive Director of AMCON without complying with Section 10(1)C of the AMCON Act 2010.

The lawyer is however asking for an order “nullifying, annulling, voiding, cancelling and invalidating the appointment of the Executive Directors of AMCON by the President.” He also wants to obtain an order of perpetual injunction restraining the persons purportedly appointed by the President from functioning or further parading themselves as AMCON’s Executive Directors.

This is not the first time Ebun-Olu Adegboruwa will file a suit against the president. About a month ago, the activist lawyer urged the federal high court in Lagos to force president Muhammadu Buhari to appoint his ministers or resign as president. The lawyer prayed the court to determine whether or not by the virtue of section 147(1) and (2) of the 1999 Constitution, the president is not obliged to appoint ministers upon his swearing in and oath of office since May 29.

Coupled with some other charges I didn’t and still do not understand, is the #18,000 development fee which was part of the reasons Obafemi Awolowo University management increased its school fees, counting some months behind us. The development fee is a scam or what?

A closer or let me say my personal review of the exorbitant and “holy gholistic” increment of fee early March last year; looking through the estimation given by the management, one out of the 17 listed estimate, I kept on fixedly gazing at the number 15 on the list, then the question that kept on heaping round my thought as ant heap round a cone of sugar was development of what?. An obviously pellucid reason for this question is, so far, the condition OAU has been during the time normal fee was been paid is still what we are now, NO CHANGE!!!, hence my question again, development of whathuh. Well, consoling myself, it was probably meant for building a new giant Senate building so these set of inconsiderate management can continue relaxing in air conditioned offices while we keep on swinging in our erratic and nothing to write home about welfare condition? We’ve had enough patience for our management to make sense but still they prefer our parents hustling to pay them.

It may interest you to know that, the said estimation was as a result of the protest, which saw to the reduction from 74,000 to whatever we have now, is this really not a scam? As far as am concerned, no development whatsoever has been implemented by the management, I may be wrong with evidence, after swindling over 5000 2013/2014 fresh students of #18,000 development levy, and now 2014/2015 set were inevitably victims. Let’s say approximately 12,000 students paid, #18,000 in such folds, that will be a total of? I leave that to the mathematicians to rack brains about. Or maybe my definition of development is what I’m inferring from? Lest I fall a victim of erroneous conclusion.

Let me linguistically analyze the word “development”, or probably what the management mean. Is it what my dictionary defined it to be or what? Well, here is what I have according to lexicographers;

Development is : the act or process of growing or causing something to grow or become larger or more advanced.

Sequel to the above definition, is it then justifiably right, based on the condition of our hostels, lecture halls, that the management have satisfied the above definition of development? To which #18,000 was attached to? I see the word development as used by the management as a canopy to hide their somewhat exorbitant fee, if so, I believe this canopy needs to be fixed before another set of fresh students will be made to pay such canonized fee. Obviously,this situation needs some changes,some trenches need some cutting,some pillars need erecting and the flooring needs some scrubbing.

Ibrahim Lamorde, chairman of the Economic and Financial Crimes Commission, EFCC, has stated that currency declaration by travellers out of Nigeria amounted to $12.058 billion in three years.

He made the disclosure in Abuja at the opening ceremony at the opening ceremony of a five-day inter-agency training programme on, Cross Border Financial Investigation organized by the United States Department of Homeland Security.

It was organised for officers of the Nigeria Police Force, NPF; Nigeria Immigration Service, NIS; Nigeria Customs Service, NCS; National Drug Law Enforcement Agency, NDLEA, and the EFCC..

Lamorde said currency declaration in 2012 was $9.9 billion. In 2013, it dropped to $1.324 billion as Nigeria stepped up surveillance at the airports.

“There was a further drop in 2014 as currency outflows recorded an all- time low of $807,585,061.70″.

He called for improved financial intelligence gathering by the anti-graft agency and other law enforcement agencies in the country to check flow of illicit funds, if the war on terror must be won.

“A reputable strategy to fight insurgency is to deprive the insurgents of funds, because there is no dispute that illicit funds movement across borders fuels organized crimes, including terror attacks and insurgency in Nigeria,” Lamorde said.

According to him, “There is an urgent need to strengthen our financial intelligence architecture to enable us effectively monitor cash trails and check illicit cash flow to organized criminal gangs.”

“Up till now, the major concern in the fight against insurgency is on how the insurgents fund their operations within the sub-region.”

“While tremendous progress has been recorded in strengthening the Anti-Money Laundering Regulations and the Compliance Regime in Nigeria, monitoring the movement of cash outside the financial sector, remains a major challenge, because of Nigeria’s predominantly cash-based economy,” he said.

The EFCC boss, also applauded the commitment of the United States government in assisting Nigeria surmount its contemporary challenges through institutional development.

“it is gratifying that this programme is coming a few weeks after the historic visit of President Muhammadu Buhari, to the United State, where he and President Barack Obama pledged to deepen the cooperation and friendship between our two countries”.

Lamorde who said he had always considered the United States as a dependable ally in the fight against economic crimes and corruption in Nigeria, explained that the record of partnership between the EFCC and major US institutions, such as the Department of Justice, Federal Bureau of Investigation, FBI, United States Postal Inspection Service, United States Secret Service, among others, bears testimony to this.

He said the EFCC has benefitted from many training programmes organized by US agencies in Nigeria, Ghana, Malta, Botswana and the United States. He however described the impact of such exposure on the operations of the Commission as invaluable.

He said while tremendous progress has been recorded in strengthening the anti money laundering regulation and compliance regime in Nigeria, monitoring the movement of cash outside the financial sector, remains a major challenge, considering that Nigeria is still predominantly a cash-based economy.

His solace is however in the fact that the EFCC, in collaboration with the Nigeria Customs Service and the National Drug Law Enforcement Agency, NDLEA, have in the last few years taken very bold step to check illicit movement of cash across our borders; where operatives stationed at major international airports across the country have intercepted millions of dollars in cash, which were not declared to customs by their owners.

Deputy Chief of Mission, United State Embassy, Maria Brewer said that the training programme will expose participants to new trends and techniques in combating economic and financial crimes. “Since economic and financial crimes is a global phenomenon, the training will focus among others, on taking away proceed of crime, because when you take away the money, you take away why people do crime”, she said.

Other dignitaries at the opening ceremony included, Benjamin Bryan, acting director, International Narcotics and Law Enforcement US Mission Abuja; Steve Robinson, Attaché, Department of Homeland Security Investigation, DHSI; T. A. Hundeyin, Deputy Comptroller General of Immigration, who represented the NIS boss, and Alhaji Hamisa Lawal, Commander of Narcotics, who represented the NDLEA boss.

Highpoint of the ceremony was the donation of a high-tech counting machine to the EFCC. Brewer, who made the presentation on behalf of the US government, said that it was one way, in which the President Barack Obama-led administration, planned to assist the EFCC and the country at large in fighting corruption.

IBB Speaks On Buhari’s Move To Recover Stolen Funds

The former military president General Ibrahim Badamasi Babangida (retd) has thrown his weight behind President Muhammadu Buhari in the fight against corruption.

General Babangida, who spoke in an interview with newsmen yesterday, August 16, to mark his 74th birthday said President Buhari has the capacity to recover Nigeria’s stolen funds, Leadership reports.

He said: “My boss, President Olusegun Obasanjo created a similar strategy and, to be fair to him and his government, he made a lot of recoveries when he was in office; so we should support this present federal government in what is trying to do, to achieve the same objective.

“If he is resolute, I believe he will achieve some degree of stolen funds.

“You talk about oil theft, I am sure President Buhari is resolute to stamp out all those and to bring to book all those who have tampered especially in stealing our oil.”

Babaginda also exonerated President Buhari from blame on the waves of attacks by Boko Haram since he assumed office. He said that the war against the insurgents was difficult because it was not a conventional war where the military could test their full strength.

He said: “I think there is a general misunderstanding of the whole concept of insurgency; you can call it anything – instability, guerilla war, terrorism. We are not fighting a regular army where you can confront them with sheer use of force and weapons to overwhelm the enemy; no, we have gotten a small trained army whose tactics is to inflict maximum casualty on its so-called enemy, inflict casualty on him when and where he least expects it.

“The army is not fighting a conventional war; that makes it exceptionally difficult. They (Boko Haram militants) blow our bridges; they go as far as blowing up barracks and so on; this is an unconventional war. I think the soldiers are trained for it and they know this is the sort of thing they do. I think the public should be educated about this unconventional war.”

Babanginda also supported the move by President Buhari to negotiate with Boko Haram.


He said: “Unfortunately the president got it right. He said he will talk to people who are credible, who have been identified as some of the leaders of the insurgency but, so far, apart from one or two names, we do not hear any other name. I don’t think the government will like to talk to a vacuum, to talk to people who are not worth talking to, as far as these issues are concerned. So the government is right in being careful to identify and talk if there is anything to talk about.”

According to Babangida, the Peoples Democratic Party (PDP)’s failure in the last election was a hallmark of democracy.

He said that the people were determined to vote the PDP out and they did it peacefully.
