Reacting to the report which has continued to gain traction in several social media platforms, Senior Special Adviser to the CJN on media, Mr. Awassam Bassey, described it as false news. “I really don’t know where they got the information from. So many media men were here earlier with cameras over the same report. But what I can tell you for now is that there was no such thing. It is false news”, Bassey told Vanguard. Meanwhile, many social media users that shared the story had attributed it to a post that originated from the former Minister of Aviation, Chief Femi Fani-Kayode. Fani-Kayode had in the said post, asked President Muhammadu Buhari to immediately call off EFCC from Onnoghen’s residence. He wrote: “Why have the EFCC surrounded the home of CJN Onnoghen and why are they seeking to arrest him? “These people want Nigeria to burn! Buhari call off your dogs before it is too late! “This is a democracy and not a gestapo state! In the name of God let this madness stop.” The CJN is currently enmeshed in a legal battle with the Federal Government over the propriety of a six-count charge that was preferred against him before the Code of Conduct Tribunal, CCT, following his alleged non declaration of some of his assets. Aside allegation that he failed to disclose his assets as prescribed by law, FG, in the charge that was filed by the Code of Conduct Bureau, CCB, accused the CJN of operating foreign back accounts. The prosecuting agency alleged that contrary to relevant laws regulating conduct of public office holders, the CJN, maintained a domiciliary foreign currencies account that comprised of Dollars Account, Pound Sterling Account and Euro Account. FG’s plan to arraign him on the said charges was stalled on Monday following refusal of the CJN to appear before the Justice Danladi Umar’s led three-man panel tribunal to take his plea. Rather, Justice Onnoghen, whose travail was branded “a political witch-hunt” by the major opposition party, the Peoples Democratic Party, PDP, challenged the jurisdiction of the CCT to try him on any of the allegations. He is contending that FG failed to abide by existing judicial precedent as encapsulated in a recent Appeal Court decision in Nganjiwa v Federal Republic of Nigeria (2017) LPELR-43391(CA), to the effect that any misconduct attached to the office and functions of a judicial officer, must first be reported to and handled by the NJC, pursuant to the provisions of the laws. He argued that only after the NJC has pronounced against such judicial officer could prosecuting agencies of the Federal Government proceed to initiate a criminal proceeding. Consequently, placing reliance on a recent decision of the CCT on a similar charge FG lodged against another Justice of the Supreme Court, Sylvester Ngwuta, the CJN’s legal team, maintained that FG’s decision to sideline the NJC, stripped the tribunal off its jurisdiction to entertain the instant case. Shortly after the CCT panel fixed January 22 to hear the CJN’s objection to his trial, the Abuja Division of Federal High Court, in a counter move, issued an interim injunction that forbade the tribunal from taking further steps in the matter, stressing that all the parties should maintain their status quo. The court in the ruling that was delivered by Justice Evelyn Maha further slated Thursday to hear two separate suits that two groups lodged to challenge the CJN’s trial. Whereas the first suit marked FHC/ABJ/CS/27/2019 was filed by incorporated Trustees of the Centre for Justice and Peace Initiative, the second case marked FHC/ABJ/CS/28/2019 was lodged before the court by the Incorporated Trustees of the International Association of Students Economists and Management. Cited as Defendants in the suits were the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, Chairman of the CCT, Danladi Umar, the National Judicial Council, the Inspector-General of Police, Mr. Ibrahim Idris, and the Senate President, Dr. Bukola Saraki. Anambra commences review of court rules It will be recalled that EFCC had in 2017, said it was not investigating the CJN. Prosecutor wants service of case to be done at most this week to Justice Walter Onnoghen since he said it wasn't properly done initially. But Defence Counsel Olanipekun says that's too short. He is asking for 28th of January for proper service and resumed hearing. Case adjourned to Tuesday January 22nd 2019 for proper service and appearance of Justice Walter Onnoghen in case of FG vs ONNOGHEN. We would like to state that soldiers of the Nigerian Army along with elements of Nigeria Police Force and other Security Agencies were indeed at Abuja and Maiduguri offices of the publishing company to invite the staff of the company over its lead story on Sunday Trust publication, which divulged classified military information, thus undermining national security. In it, the newspaper made disclosed details of planned military operations against the Boko Haram terrorists. The disclosure of classified security information amounts to a breach of national security and run contrary to Sections 1 and 2 of the Official Secrets Act. It afforded the Boko Haram terrorists prior notice of our plans and giving them early warning to prepare against the Nigerian military, thus sabotaging the planned operations and putting the lives of troops in imminent and clear danger. We would like to state that the invitation of those responsible for divulging military plans was done with the best of intention in order to make them realise the import of such acts to our national security. We therefore advice all, particularly journalists, not to worry but engage in their responsive reportage and to be professional as the Nigerian Army has no intention of muzzling the press or jeopardising press freedom. We however, wish to enjoin further that they should eschew jeopardizing national security in their reportage. We would not tolerate situation where a publication would consistently side with terrorists and undermine our National institutions. Melaye approached the court through his lawyer, Nkem Okoro of the Mike Ozekhome (SAN) chambers, for the enforcement of his fundamental human rights. The court had subsequently fixed today for the hearing of the ex-parte application filed together with the enforcement of his fundamental human rights’ suit. In the ex-parte application, Melaye prayed the court for an interim order of the court directing the police to vacate his residence and remove all blockades in front of the residence and allow his family and political associates to have access to him. He also sought an order restraining the police from further threatening his life or putting his life in jeopardy pending the determination of the substantive suit. He further sought the order of the court restraining the police from further arresting him, pending the hearing and determination of the substantive suit. However, the judge, Justice N.E. Maha refused the application and ordered an accelerated hearing of the substantive suit. The matter was thereafter adjourned to January 14. It is on record that the Police investigators submitted a Letter of Invitation dated 23rd July, 2018, signed by the Commissioner of Police, Kogi State Police Command addressed to the Clerk, National Assembly, Abuja, inviting Senator Dino Melaye to report on 26th July, 2018 at 1100Hrs at the Kogi State Police Command, CIID, Lokoja to answer to a case of Criminal Conspiracy and Attempted Culpable Homicide against him under investigation in the Kogi State Police Command. The claim by the Senate President in the Media that the Police did not submit a letter of invitation to the Clerk of the National Assembly is therefore incorrect as can be seen on attached letter with acknowledgment stamp of the Clerk, National Assembly, Abuja “24 JUL 2018“. Despite this, Senator Dino Melaye bluntly refused to report himself to the Police till date. 4. For avoidance of doubt, attached to this Press Release are the copies of pictures of the shot Police Officer, Sgt. Danjuma Saliu, the Police Invitation Letter addressed to the Clerk of National Assembly, Abuja and the Medical Report from the Federal Medical Centre, Lokoja, Kogi State, confirming the admission of Sgt.
