If you had in the past provided answers to any of the questions I asked in our last exchange, perhaps I missed it. For instance I didn't see where you answered why tiling work upstairs were done much closer to when the contract was finally terminated, whereas project had been abandoned since May. If it has been answered already, then I will gladly rule that point out of order. I talked about too many gaps in timelines given by yourself and next. What was your exchange like in June? What were the excuses given? Were they justified? What happened in July? What were your WhatsApp chats like? August, and then September?

The person who recorded the video was the person who plastered the atrium which was supplied by rockofagesaluminum.

It was after this that screeding and tiles was installed on the atrium wall.

Even the atrium window space was an error that had to be corrected too which almost led to wasting the window constructed by RockOfAgesAlumi.

@RockOfAgesAlumi was on site when different people (Both artisans and vendors) were complaining about how you owed them and has refused to pay them claiming I was yet to release money to you (Story for another day).

I am not here to contest who can type longer. Refund my money you spent on yourself!

For instance next cited that you did tiling of roof walls in September or so, something he wasn't contracted to do and was a prerequisite for installing roofing sheets. But when you came up initially to tell us project was abandoned since May 8, you didn't tell us these, and when he brought that to you here, you did not respond to it. Next's citations still did not add up to me though as there were too many gaps in dates unaccounted for. I can only judge from information willingly supplied by you both.

The QS; I wonder if you had contracted with him initially to be fully involved as your project manager that you had to take recommendations from him to terminate the contract. The QS was the right person to play mediatory role here since you consulted with him first when the fall-out started, but... At this point you were already agitated. Then came review of contract sum versus work done and agreement on an amount to refund. Since QS was involved in the initial bid selection, he should have been in better position to bring to figures a near accurate amount that was due. But his quote which was clearly overbloated from evidence supplied here had to be reviewed a number of times. It makes me question his competencies or if this was a deliberate sabotage. He was asked to show proof here but ignored.

These are bygones. What is important now is that you recover your money, and I hope your contractor comes up with it real quick.

Afterthought: You say you are willing to take 2M from the 2.45M quoted by QS. Now I wouldn't know why you easily conceded 450k, but next showed estimates here on how he feels he is only due for a little over a million. I notice you haven't really contested this yet. Why?

Quote what N3xt posted here as his estimates that you think supercedes what I posted including that of the QS, let's see what actually looks like a real estimate.

While at it, tell us if this is why I am yet to get ₦1 or why he spent what I paid him to get materials which you and your likes have been avoiding.

It is not about sweat or no sweat. I am not happy with the outcome you have suffered. I have severally asked him to refund you in good faith. But it is not about what we wish, the law is very clear, if payment is made for a contract and the contract is not performed, then there is a breach of contract. Breach of contract lawyers are taught in law school is a civil wrong and not a criminal wrong.

If you allege crime, you need to proof that his action was criminal and his intention was criminal, you need to specify which aspect of criminal law he breached. if you cannot prove all three your case will fail. It is far easier to prove breach of contract and claim damages.

I am sure you have a lawyer, run the above by him.

You have a lesser hurdle to pass to prove that you suffered a breach of contract than to prove that he intended to and actually committed a crime against you.

In any case if you go the criminal route, rarely will restitution be ordered, it is between the state and him and if you were to win, criminal penalties await. With a civil case, restitution will be ordered.

Is it not restitution that you want?

If you pay me to build you a house for 1 month and I do part within 3 weeks, then drag the rest for months to the extent that you now decide to terminate the contract thereby asking for the remaining money you paid me only for me to go mute on you, what's that called?

The QS mishandled this situation. He bares much of the blame for this outcome but is not man enough to come out and defend his actions in the open.

I repeat he been unable to defend his professional decisions when called to account publicly.

You decided to speak carelessly about your clients and raised a mob against you. What you asked for you got.

There is a big difference between what constitutes a crime in the eyes of the law and what ordinary men consider to be crime.

If N3xt is guilty of anything, it is a civil wrong and not a crime, I speak for the current issue with the client and not for the past of which I have not had the time to review.

It would also be the course of wisdom to suspend any and all posts on nairaland until you sort out this mess, which is very bad for you brand.

You need to formally apologize to your client and to the community for how you handled this. If you had been humble, this matter would have been treated differently, you tried to play arrogant.

I've followed up with this issue closely, accessed objectively, and haven't found you guilty of fraud, YET. The 'yet' is subject to your commitment to refund somehow his money as soon as possible.

There is a bandwagon effect on this thread. I've noticed the people brandishing the words 'fraud' and 'scam' about are the same old people, their loyalists, and those who can't think for themselves.

This fall-out has been blown momentously out of proportion and you n3xt share a part in the blame for failing to nip the situation in the bud when you could.

I won't fail to note my perception of what the QS' role is in all these. He has chosen mostly to play the silent card, a wise tactic when your decision is being called to question. To me, he created bad blood where there was none, and heightened fears where they should have been assuaged.

P.S: I've seen all the threads created about brabus, read every one of them, and do acknowledge he has erred in the past.

Some time last year, Somehow and Brabus struck a deal for the construction/supplies of building/building materials and the deal went south.
Brabus has agreed to a refund of ₦1 million and some change but up until today he has made no payment because he claims not to have any money as his funds are tied up in other sites.

Did I get any part wrong?

He was contracted for a building project in February to be completed by the 8th of May, another contract was entered on the 7th to be completed on the 21st of May.

97.5% payment was released to him (All in advance) for contract 1
100% funds released to him for contract 2.

As at 25th of September, none of the contracts were completed (4 months after they were to be completed). He was sacked and asked to handover which he never did.

Lies, abandonment of work, disregard for standards in later stages of the contract were all part of the reasons he got sacked.

A QS valued work done against work undone. Came up with the difference, he disputed the valuation which was modified up to 4 times.

Last valuation was put at ₦2.45m (refund) but I asked that he refunds ₦2m on or before the end of 1st week of Jan 2022.

Up till now ₦1 hasn't been paid back. Note that the money I paid him were all in advance because he claimed he needed to buy all the materials needed. None of the outstanding amount with him was used to buy any material because none is on site.

This points to the fact that he deceived me into paying him in advance and never used the money to buy the building materials he took the monies for.

He has been said to have done similar stuffs before and there are numerous threads on NL against his person and actions.

Kindly go through the construction section to see more.

Type his IDs into the search buttons to see a number of fraud related complaints against his person.

Allowing him to keep using NL to perpetuate his fraudulent acts can be termed to be abating his atrocities.

The current mod on this section is inactive and at least 2 new mods are needed here.

In addition : We have been correcting some of the errors he made while still on the job which is costing me extra money at the moment apart from the cost of the delays. (Time value of money).

2 mods (active) are needed here, I am currently in talks with @Seun Osewa, but the more people contacting him on this issue, the faster he acts.

(2) His IDs, IPs and can be permanently banned so that 5 years later, he wont be left to resume again. (His case can be solved permanently both online and offline if others are willing to act as I am currently doing.

I actually did, hence my resolve to releasing funds in stages.. Unfortunately Nigerian factor (rise in cost of materials) changed that because I didn't want him to fail based on the change in cost of materials.

Secondly, I consulted a professional to scrutinise all the bids I got and he got picked based on his "packaging".

All in all, I'm currently handling the issue offline and at the same time working on the permanent solution so that no else can ever fall for any of his gimmicks even if he uses new sets of IDs or borrow from some of his accomplices on this thread that I have been able to identify.

5 years ago, no one worked on a permanent solution to that plague, this time around, the plague is going to be handled once and for all on this Forum.

It's just a matter of time.
