Good afternoon house, long post alert!!!

My journey to getting SP started in August 2020 and has now ended in praise to the glory of God. I will be detailed in this post hoping that someone can learn from it, same way I learnt a lot from other people's post on this platform. To the gurus @frankrobbn, @justmellow and others, I hail oh...
See timeline below:

1st Application
- Submitted on Aug. 28th 2020
- Biometrics done on Sept. 2nd 2020
- Refused on Sept. 12th 2020
Resaon: Purpose of visit
In gcms note: VO stated the following:
1. Study gap (despite the fact that I'm studying an MBA with a specialization in Professional Sales and Business Development) and I have over 10yrs of work experience in the business field, out of which about 7yrs is in sales/business development till the time of the application.
2. Age which was 34 at the time
3. Fact that I got a US tourist visa in Jan. 2017, had a child in the US with the visa in Jan. 2018 and my visa renewal was refused in Oct. 2019. Na so dem write oh and no be sey I owe money oh, all relevant documents were provided and I visited the US in June 2017 before having the baby there in 2018 but as Trump no gree renew the visa in 2019, wetin we go do?

2nd Application
- Submitted on October 28th 2020 (This was before I received the gcms note because I was trying to meet up with January 2021 start date but thankfully, the issues raised were already addressed with proper documentation because I had joined this platform by then. Thanks to all the gurus). The only document I didn't add was "Change of Intent" email that I sent to the US Embassy in Nigeria after I decided to use my tourist Visa for child birth.
- Upfront medical passed on Nov. 20th 2020
- NSE request letter received on Dec. 1st 2020
- NSE requests submitted on Dec. 13th 2020 (used this opportunity to include the left out document and carefully explained it in the brief LOE submitted with the request.
- Refusal letter came on January 24th 2021
Reasons: purpose of visit, ties to Canada, financial status/assets, language test.
Gcms note stated the following:
1. Application pre-review comments stated that I had a child in the US and my visa was not renewed afterwards, hence, my intent to study was in doubt. I was livid seeing this because an application had just been wrongly judged even before going through the facts and documents provided.
2. The VO's comment was practically thesame as the pre-review comment so it became clear to me that the refusals were purely based on bias because of the child birth in the US and the visa renewal refusal - see wetin Trump cause.

By this time, I knew it would take more than a re-application to tackle and clear the bias. I needed to do more so I decided to do a JR.

- JR commenced in March 2021
- My lawyer had 30days to file all documents
- All documents submitted by April 2021
- IRCC correspondence had 30days to respond
- Response letter received in May 2020 and stated that they will not do any filling but they retained the right to file if the Judge decides to hear the case. (Sounded like they were trying to buy time but I didn't find it funny at all).
It was a long wait before the Federal court judge responded

- Sept. 15th 2021 - Judge responded that based on documents provided in the application, he can't understand why the application was refused and scheduled a hearing for Dec. 8th 2021.
- IRCC correspondence conceded upon receiving the judge's response, requested to settle out of court.
- They decided to set aside the refusal decision, reopen my application and have another VO review it. I'll also be allowed to submit updated IMM forms, LOA and any other documents I deemed fit to support my application.
- At this point, my lawyer advised that I should pay a substantial part if my school fees if not all and I did that.
- Also, I had renewed my UK visa for 2years while in JR process cos I was planning a vacation and I included this to show that I do not have any immigration issues. Also added (as argued by my lawyer in her submission) that the US refusal was based on the then US government's ban on African countries including Nigeria and not because I did anything wrong.
- This time, I didn't submit an LOE to explain my conditions but a statutory declaration with bullet point to address every concern/explain every point and it was notarized and sealed by the Canadian lawyer.

Application reopening timeline:
- Profile update on Sept. 30th 2021
- Request for updated documents on Nov. 3rd 2021
- Documents submitted on Dec. 1st 2021
- Medical request received on Dec. 8th 2021 (exactly 1 week from the date of submission)
- Medicals done on Dec. 20th 2021
- Medicals passed on Dec. 29th 2021
- PPR received on Jan. 12th 2022
- Passport sent through DHL to VFS Lagos on Jan. 20th 2022 (I was out of the country when I got the PPR, submitted as soon as I returned)
- Received 4 emails on Jan 24th 2022 confirming receipt of my documents in VFS Abuja office and confirming it's been sent to IRCC office
- Conterfoil and LOI dropped on Jan. 26th 2022
- Also received 4 emails confirming that my decision envelope is ready for collection on same 26th
- Received a mail confirming that my decision envelope has been received by VFS Lagos on Jan. 28th 2022
- DHL delivered my passport in the morning, today Jan. 31st 2022.

N.B: Compare the responses on Jan. 24th 2021 and Jan. 24th 2022. In exactly 1 year, I was smiling about something that got me worried and angry. Stay with God regardless of your current situation, He is too faithful to fail and He loves us too much to ignore.

All thanks to God, it has ended in praise...

I did my JR from Nigeria and I believe it's thesame for others who do JR. I only hired a Canadian lawyer with the help of an old friend of mine in Canada. It was all phone calls, WhatsApp and emails and all thanks to God that it all worked out.

I believe it's better for the money to remain in his account and he should write a letter of sponsorship signed by him to demonstrate his support for your intended study plans. He can provide his account statements to support the letter. This also shows that you have support back home.

Well said @ Legacyedition.

I went through JR and honestly, I'm glad I did. Especially when it became obvious from comments on the 1st and 2nd refusal gcms notes that the refusals were based on unfounded bias which were majorly:
1. US visa refusal after child birth (note: all fees were paid and evidence provided as part of supporting documents). The refusal was simply as a result of the then US government strict immigration rules/ban especially against African countries at the time, of which Nigeria was one of them but the VO made it sound as though I did something wrong which lead to the US Visa renewal. I had to debunk this bias so a JR was needed.

2. My educational progression. My course is an MBA and my specialization is completely in line with my career path. So a refusal based on this reason made it very clear that the VO's decision was not based on documented evidences set before him/her.

The above amongst other comments like, I already have a child didn't just add up for me cos how does having a child stop a woman from furthering her education if she so wishes to do so.

The handwritings were very clear and my lawyer did a wonderful job of addressing every single bias in a very punchy manner, I was excited when I saw my case file and yes I learnt alot.

In the end, the judge stated that he/she does not understand why my application was refused based on the documents provided and scheduled a hearing. They conceded after seeing the decision of the judge and thank God it has ended in praise.

It was quite a wait of about 9 to 10 months (plus the impact of covid) but everything picked up pace from the time they conceded and I'm glad that all the bias have been cleared out and my record is clean. God kept me through that waiting period oh cos it wasn't easy.

I said all the above to say that, if you can afford a JR with an assurance that the submitted application was well put together and based on your lawyer's advise, then go for it. There's little or no trust for us, hence, the low approval rate. This makes it important for us to push back when a decision is clearly bias and unsatisfactory.

I will still share my timeline soon. Na busy busy dey delay am.

The rate at which nairalanders discourage JR is unfair . Seems we are not concerned about incoming generations and those behind us. We need to end this our suffering and smiling way of life.

Indians and other countries held them by the balls for many years via JR. Today, the new generation are enjoying it. Reduced flimsy excuses, increased approval rate, 2 weeks study permit timeline. Judicial review also expand your knowledge of immigration laws, discover abnormalities. Make you work true it with your lawyer.


Most of the reasons stated to refused Africans are unreasonable. Which judge mostly insult them before sending them for a re-determination.


Truly, JR is not for the faint hearted, filled with uncertainty, anxiety, cost etc, But has so many advantages for the incoming applicants as far as Africa is concerned.


If you have the money for JR, please go for it. Be the voice to your country , be the voice to the voiceless Africa.


Most unreasonable reasons we celebrate, promote and made our own immigration law can't stand the test of JR. E-G


Career progression

Something like having Masters and going for ordinary diploma is Canada.

Based on the Canadian immigration law, there's no place given to Visa Officer's to decide students career. Your career progression is left for the school to decide, if school decided to give you letter of acceptance, it's none of Visa Officer's business to comment on your progression or qualifications for the course. A federal court rule below on that.


Secondly , I disagree with the Respondent’s argument that the decision is otherwise reasonable. Having reviewed the Applicant’s educational plan myself, it is clear that at no point does she ask for career counseling advice. Yet this Visa Officer apparently fancied the opportunity to assume the role of career counsellor and opine that the Applicant’s intended studies in Canada would not enhance her work for her brother. Such extraneous considerations make it obvious that the Visa Officer engaged in an unreasonable review of the evidence.


This is straightforward and clear. The judge called that unsolicited career counseling



Proof of fund

Below is IRCC’s own study permit guidelines



Students are required to demonstrate financial sufficiency for only the first year of studies, regardless of the duration of the course or program of studies in which they are enrolled. In other words, a single student entering a four-year degree program with an annual tuition fee of $15,000 must demonstrate funds of $15,000 to satisfy the requirements, and not the full $60,000 which would be required for four years. Officers should be satisfied however that the probability of funding for future years does exist (i.e., parents are employed);




Proof of employment is enough to demonstrate next year tuition fee. Whereas, someone was refused here in September for not having funds for whole course.

This person actually showed 150,000CAD balance in his father's account. Cost of whole course is less than 50,000CAD plus living expenses.



Third party sponsor (uncle) , personal assets, establishment in home country



Below is a Federal court of Canada rule on that.


In my view, the Officer’s finding that the Applicant had insufficient funds to support his studies is not justified in light of the uncle’s signed declaration and evidence indicating his financial stability and willingness to support the Applicant, including his commitment to offer the Applicant employment once he completes his studies.

[22] I also agree with the Applicant’s submission that the Officer’s reasoning that his uncle’s funds could be withdrawn at any time is speculative and that the Officer arrived at this conclusion without providing a rationale. This is a ground for setting aside the decision (Huot v Canada (Citizenship and Immigration) 2011 FC 180, at para 26).



 I also disagree with the Respondent’s argument that it was reasonable for the Officer to find that there is little incentive for the Applicant to return to Mauritius after his studies. As the Applicant’s counsel argued during the hearing, the Applicant has provided elaborate reasons about his intention and ability to study in Canada. The Applicant has also been transparent that he is not wealthy, but has taken steps to secure the financial assistance of his uncle.

[28] As the Applicant’s counsel rightly noted, the Applicant is fortunate to have an uncle who is willing to fund his studies in Canada so that he may obtain credentials that are highly valued in Mauritius. It is uncontroversial that many students often rely on family members to help fund their post-secondary studies. Here, the Respondent attempts to assert otherwise, seemingly on the grounds that the Applicant comes from a less affluent background. This reasoning is absurd and perpetuates stereotypes about those who consistently face barriers to accessing higher education. The Applicant has clearly demonstrated that he has secured the funds to finance his studies. The fact that he comes from a lower-income background should not preclude him from seeking out and accessing educational opportunities.

[29] I find that the Officer failed to take into account the totality of the evidence before them and came to an unreasonable conclusion.

I have been waiting to post the above comment here since September 2020 when I started following this thread. I read many positive stories and the negative ones too but thank God I kept my faith alive and never got tired.

I'm sharing this today to further encourage someone, anyone, never give up.

After 2 rigorous application processes becos SP application be like project, 2 refusals, 1 Judicial review, 2 medicals, 3 admission deferrals and finally PPR!!! It's all to the glory of God oh, the God of NLP #NextLevelPrayers wey no dey fail. My God is good and kind to me indeed.

Thanks to all the gurus in the house who selflessly give of themselves to provide timely and useful information to everyone on this platform. @frankrobbn1, thanks for never getting tired of answering so many questions, God bless you BIG. @justmellow, thanks a million and thanks to everyone that suggested that I should go for a JR when my second application was refused based on the comments on the gcms notes, you guys solidified my confidence. Thanks to @Myspace for sharing her JR journey/testimony here, it encouraged me in my waiting period through the journey cos I read her post over and over again, lol.

I was so so happy guy got my ppr today.

I just want to post on here so as to motivate anyone whose still waiting for ppr or whose about to submit the application.

WHAT GOD CANT NOT DO DOES NOT EXIST. God has been wonderful to me.

Am 40years no BSC no other qualifications apart from weac result and neco. But I put everything in Gods hand before I submitted my application.

I got my admission August 8 but defer my admission to Jan 10,2022 because I couldn’t meet up to submit my application for September intake.

I finally submit September 20, 2021
Biometric September 27,2021
That’s when the waiting started
November 19,2021 I finally got medical request
Because no booking space I got booking to December 7,2021
December 11, 2021 my medical was updated to passed.
December 13,2021 I was sitting watching movie on my iPad when I got the message for Correspondent letter and Ppr

I don’t waste time I went to send my passport first before I start to send this message.

What I will say is don’t let anyone discourage you in anything you want to do in life. Try and fail it’s better than not trying at all.

When I wanted to apply people keep saying am old for diploma course at the age of 40. But I don’t get discouraged at all. I decided to gather all the documents myself.

Exactly, I applied alone and used them as home ties.
When I was approved, I travelled to get my sin and permit then applied for them.

In my loe explained how my spouse has his business and will be coming and going as his business can be managed virtually and also
Said that the reason why I needed my baby was because I’m a new mum plus ppd taking a toll on me.

I also addressed how I still have siblings and family to go back to and how my studies will help his business.
I used our land and incomplete building as ties to show we r not absconding from our country. I added how he can’t leave his business for an extended stay in Canada.

I’m certain the person’s loe didn’t address hometies or simply wasn’t wrtitten well.

Ignore people living in Canada , when I wanted to apply for my family, it was the same fear and stories that it will be misrepresentation until I spoke to eddyossam and he said it won’t be as intentions can change.

If you later apply for family , you must still prove hometies, that’s where a good loe comes in.

Because of how toxic “living in Canada “ thread is, I don’t go there, I rather make my mistakes and learn on my own than go there to receive insult.

I had to go check what they were saying and I didn’t expect anything different.

Yes I did. I had proactively booked for a January date since I didn't know when IRCC will request for it and slots were scarcely available. But as it is, IRCC has now requested that I submit a medical report within 30 days.

So I just really need to get this sorted asap becuase even Qlife is not giving a favourable date.

Hello to everyone and the gurus in the house.

I am new to this UK thread and I need a quick clarification as I am about to submit an application to renew my UK standard visitor visa for 2years.

I resigned my job in Dec. 2020 for personal reasons and I got 2 refusals from Canada for study permit application(1st refusal in Sept. 2020 and the 2nd in Jan. 2021. The 2nd refusal is currently undergoing a judicial review.

My hubby is the primary applicant as his parents are British citizens residing in the UK and we plan to visit them this summer. He is also the sponsor of the trip

My questions are:
1. Is it advisable to apply for a 2years UK visa renewal or I should just do 6months again? Considering the refusals and the fact that I'm currently unemployed but I have very good savings and I am not sponsoring my trip?

2. Should I indicate on my application that the 2nd refusal from Canada is undergoing a judicial review? If yes, what document(s) do I need to provide as proof?

After my graduation from Unilag I went for my Masters in UK COVENTRY UNIVERSITY precisely I came back job hunting started no job but later I got one shaaa it's owned by Lebanese and you know their story na so I left
So thereafter someone I called her someone cuz she isn't my friend but a foe which I need to eat with with a longgggg spoon mentioned about DUBAI that she has connect to get job but I will sort the person to help with the job in all I have her 70k not knowing nothing was done anyways I headed for DUBAI luckily for me my brother's wife brother stays and works in DUBAI so no accommodation problem now where the job na for where only for her to send me a message on WhatsApp she said and I quote

Mehn I cried for 3days and reported the matter to God with prayers and fasting so I kukuma use my 3months for Dubai relax and came back

So someone told about me Canada work permit they have their partner they will look for job long story short they submitted the application without some documents oo very shabby people they didn't include LMIA or LMIA EXEMPTION LETTER .My Application was refused based on Four reasons.Family ties in home and CANADA I nor get anyone there oo, Employment prospects, LMIA and Insufficient funds

So I told the guy you haven't rendered any services let's try study permit and it's both of us that will sit down and strategize it so he has someone who writes SOP for him so he told them to write my SOP while me I gather all other documents by myself ONLY

My mum has a business which is registered with all business documents every every. The plan is am coming back to take the position of BUSINESS DIRECTOR

All landed properties and lock up shops receipts
Reference letter from her Association backing her Financial capability and saying she is the CEO nah weavons my mama dey sell so they have association at Tradefair complex she was one of those that contributed to build the place so she was compensated with lock up shops in return
Reference letter from Multipurpose society in my church backing her Financial strength
Letter of support very strong one in the letter she said she will make sure I come back as AGE IS NOT ON HER SIDE ANYMORE to take over the business
Letter of Sponsorship a very strong one showing the relationship between mother and daughter

Confirmation of funding : Here we said the company will be giving me 2m as study grant but it's nit free as I will come back to resume as business director so that's a home tie too that they will give once I submit my visa to the finance department and the other part when they confirm my ID card from my school.NOTE I didn't submit the company's account cuz I don't have it but if you have Submit it we have different GRACE and a well packaged SOP-3Pages only.Bank reference letter from my bank also

THE SIGNS AND THE TESTIMONY
I had submitted my application before I came to naira land so I didn't submit my mom's statement as my sponsor only my statement so I was worried so I decided I would raise webforms to send it
Now in one of her savings account no too much funds there so I told her we need to raise funds to add to it so I plan submitting the statement let's say Monday NSE Request came in that same Monday I say yes very good
So Wednesday before the Monday we started calling her tenants that are owing her for that month to pay that she needed money for something one we didn't call him he just sent it my Mom was planning on calling him but she was ready to send it he had already sent it
The remaining people sent it without argument the money was complete on Saturday so on Monday My mom sent out to the bank to print her statement so I can send it through webform as she was in the bank NSE request came in I just called her mama come back ooo we will go together the next day to print the mybank certificate so we went printed mine, my mom's own and the one with her fixed deposit it was generated for one year up to the time the money was fixed.
That was the first sign
Second sign I had a dream that I was complaining to someone that I need to get response from IRCC so the person was encouraging me that I should send the documents that my application will be approved on JANUARY 3RD I had that dream twice I woke up and said God is this a confirmation.

STEPS OF FAITH
1st Sunday of this year I sowed a seed towards my application and gave a offering higher than what have been giving before and told God I want a miracle on this
My church declares 3days prayers and fasting every beginning of the month I don't miss any of it and when I want to break by 6pm I only ask God for one thing my visa approval only when he grants it we will ask for other things-OLIVER TWIST ask for more
January 1st I wrote Four requests I want God to do for me this year visa approval being number one every Sunday I take it to the altar to present it to him
Midnight prayers from 12am I told my mom mama no sleep till I get results join me in this and truly she doesn't sleep she prays till like 2am.
Ending of this month my church declares 5days prayers and fasting I joined them I finish am
When my BVL came in 2nd of February I started another 3days again and concluded yesterday.PPR dropped today
God saw all these sacrifices and won't fail me oo
I made 3convenants with GOD this is personal I won't state it am fufilling one tomorrow in church
Finally brethren give it all it takes GOD is not a man that he should lie

Am graduate of FINANCE 2.1, Masters in FINANCIAL MANAGEMENT (MERIT) yet I nor see job for here
I applied to the University of Winnipeg ADVANCED BUSINESS MANAGEMENT (POST-DEGREE CERTIFICATE) [/b]that's the name of the course.My SOP was well tailored to that I even said I will be coming to establish NGO in my community to conduct business projects etc for the female youths especially the ones who couldn't afford fee for proper education college and grants will be granted to the participants as part of the company's corporate social responsibilities and would invite prospective collegues in Canada,UK and Dubai to partner in this Project

Sorry for the delay. If you have the resources and time you can appeal your case(you have a strong case), but if you don't want to go that route you can reapply again (upon receiving your gcms note) with the same documents.

When you told me this news . I was so sad because I understand the effort and sacrifice one puts into this application. It’s not easy

Your application is far better than mine . That begs the question of how this VOs reason. It takes the supernatural work of the almighty .

I will suggest you wait for the gcms notes to come out and let’s see what happens. You can as well send the LOE for review and let’s see what we missed.

Please don’t give up ,I can’t imagine how hard it will be to apply again but just do it for the good life and extra benefits that comes with it

There is nothing to add to your reapplication other than letter of explanation to tackle whatever reasons they gave for the refusal after you received your gcms. You will be surprised how fast you next application will get approval
