I guess you don't have to contact the embassy. Get a lawyer to do an appeal for your application. Then re-apply and state your purpose this time around then wait on the lord.

I stl like ur spirit of sportsmanship despite all d blames of misrepresentation cast on u.. afterall u have a choice to disclose all ds or not, someone else wld not ve and u stl answered everyone’s question despite dey doubted u used an agent.

My advise appeal tru another application and make everything clear dt it was an oversight and someone helped u out.. dey gave u an option to reapply if u can present further clarification..

Wen is ur USA interview, u can apply to another country if u stl ve time or have ur baby here.. gdluck

Thank you nonkala. I am already using the service of an immigration lawyer to appeal and also re-apply myself. I pray all work out well. My interview is coming up soon for USA.

Purpose of visit was clearly the first ought they had against her application. Then not being truthful about her birthing plan in Canada was another aspect, let's not forget she said she was being called in for an interview with specific request made of her for her US birthing payment proofs. It turns out from the interview she misrepresented in the aspect of her purpose of visit, and then, a previous US visa refusal. I however will ask @Temi231, was this refusal recent?

Refusal was 2 years ago apart from 221g letter that i got recently.

Canadian visa officers are quick to give you the five year ban for misrepresentation when you answer that particular question wrongly, in most cases they give you a letter to explain/an interview in your case, before they make a decision or just sent you depending on the officer's discretion.

Also, I want you to know that this is a case of misrepresentation, it's not just as easy as you think, even the USA embassy might be aware of your ban.

I would advise you to wait your ban for five years, you can reapply, and try to explain yourself, but it would be hard, because you had a previous opportunity.

To everyone else, filling out a Canadian visa application form is different from other countries, I would advise people do it themselves and be sincere, from inception, Canadians are thorough.

Yes oh. I have been refused before reason of not enough ties( Not Nigeria) so I re-applied in Nigeria and I was given within 2 minutes.

I actually don’t believe any agent part of the story, she most likely did it all by herself (I understand the palpable fear enveloping the visa application process/environment for birthing at the time). Using an agent is almost an impossible mistake to fall for by someone with such US experience as her, coupled with nairaland experience of hers and the sensitivity of her situation at the time. Trying not to be unnecessarily adding to her wahala really, that was why I left out that part. I just believe it is not entirely over for her yet, let her give it a push to possibly get the ban off at the least....

Omobendel24, I actually used an agent. Not that I want pity from anyone but for everyone to learn from my experience. In fact, I can call out the agent I used and I will even dm you to discuss further.

I am an advocate of always telling the truth but when the agent convinced me that this is the way they do it I just let them did it the way they wanted to do it. But I have my learnt my lesson in a bigger way.

This is an eye-opener for everyone. Please always review your application diligently. Yesterday night, I actually did a diligent review of the application submitted for me and I noticed where they asked the question of "If you have been refused entry before to another country you should declare but the agent picked NO for me and I too did not take cognisance of it.

Well, I will re-apply again as you advised even if they won't give me but I would let them know its an honest mistake.

Guys, always try and do it yourself. All that these agents want is your money. Once they get alert, they do anyhow.

You only mentioned you were going to give birth after the VO asked so you were witholding material facts. So what would the basis of your appeal be if I may ask?

I guess you should Google or read about what misrepresentation meant according to Canadian immigration law before putting all your fact on declaring purpose.

Sure, that is not what was being referred to. Rather, it was the withholding/concealing of vital information which in this case was about her Canada birthing plans. But then, the 221(g) matter - I repeat, a technical refusal - was what was being talked about during the interview when the VO mentioned a US visa refusal lately, remember the info cross checking/sharing thing, that’s it, not any innocent question as the OP is presuming....

My pain now is, why are Nigerians always like this? I praised her very much in my heart when she said she was declaring, I understood quite alright that was huge, but alas she didn’t! How do you mean an agent? Please, I give up.

Finally Temi231; just like the Americans have technically refused you, so the Canadians have banned you for 5 years (no confusion in this). But I still say give it a shot, be as clean as you can be, and as convincingly too, you have a ban to wriggle out from. It is not over, still very much explainable. All the best!

See her post here. She already knew better as to why it was important to declare of intentions to give birth in Canada with her first application.

She also mentioned that giving birth in Canada should not be a do or die affairs.

My mistake was I didn't later filled the application myself cos I was too busy. But the deed is done.

Í acquiesce to this, she has been banned, but a window is left open for her to "appeal with justification" so to speak. My advice will be give it the best shot possible, do everything in black and white, let them see you clearly and adjudge thenceforth.

@Temi231: address their concerns; the 221 (g) - technical refusal - matter with them as though you were dealing with the Americans, explain the "misrepresentation" issue of not declaring childbirth with all that you've got. Just try, let it be on record you did your best, I believe you will very likely get results!

Thznk you omobendel. On my status page, it actually shows Refused not banned.

But on appeal, how do I go about that? The VO asked me an innocent questions which I feel that US didn't refuse me because I am scheduled for another interview which he asked for the date.

So I wonder where that was coming from?

Basically have all your work documents,financial records,birth correspondence and itemized bills with zero balance ,proof of ties to Nigeria

Thank you. I just put others and others in the reason for travel. But the embassy is not Nigeria sha. It is well. I feel they just want to see if I paid all my bills because I stated my first child is US citizen and I also attached birth certificate too. Anyway, I go show appearance. Will update you guys if there is anything. Also, they requested only for one document which is receipt of my last birth in the state.

Just trying to be sure you are not making a mistake or to confirm too if there’s a change in the Dropbox process. You submitted your passport to them for renewal already (Dropbox direct) but it however was returned back without visa and you were asked to schedule an interview appointment with them (221(g) refusal, technically), abi? Or it’s something different you are talking of? Like you haven’t submitted your passport but you are being asked to submit your passport?

I haven't received my passport up till today. Don't even know what they want from me. No email, nothing. Anyway, I have scheduled for interview hoping I should receive an email to pick up my passport.

Yes. I don't understand what you mean by Dropbox direct or refusal but what I was trying to say was when I did Dropbox it later asked me to schedule interview and to do this, the date are restricted. I only saw 5 different days listed and you can't choose beyond that.
