The court of appeal has set aside the ruling of a federal high court in Lagos which ordered the Independent National Electoral Commission (INEC) to electronically transmit election results in the state.

In March, the Labour Party (LP), its governorship candidate in Lagos, Gbadebo Rhodes-Vivour, and 42 other house of assembly candidates filed a suit marked FHC/L/CS/370/2023, seeking an order of mandamus compelling INEC to comply with its regulations and guidelines which made provision for electronic transmission of results.

Peter Lifu, a Lagos federal high court judge, granted the reliefs sought.

The judge further compelled INEC to hire impartial, qualified, and dependable logistic companies that are not partisan in the distribution of election materials.


Aggrieved by the high court’s decision, the All Progressives Congress (APC) sought leave to appeal the ruling.

In its appeal, the APC submitted that INEC has discretionary powers to determine the mode of transmitting election results.

The party also submitted that the judge wrongly assumed jurisdiction to hear the matter as the suit ought to have been filed before the federal high court in Abuja

They also argued that the court was wrong to have refused an application for joinder filed by the Social Democratic Party (SDP, adding that the matter before the lower court had far-reaching consequences that affect all registered political parties involved in the 2023 general election.

‘INEC CAN AMEND OR VARY ITS REGULATIONS’


Delivering judgment on Friday, a three-member panel of the court of appeal led by Abubakar Umar agreed with the submissions of the APC.

The court held that Section 50(2) and Section 60(5) give INEC “very wide discretionary powers” to determine how it transmits or transfers election results.


“As I had demonstrated earlier in this judgment, the Electoral Act gives the 43rd respondent (INEC) discretion on how it carries out its assignment including how it transmits or transfers the result of election from polling units,” Umar stated.

“With due respect to the learned judge, an order of mandamus cannot be granted to fetter a discretion.”

The appellate court held that although the lower court premised its decision on the provisions of Clauses 37 and 38 of INEC Regulation and Guidelines, the Electoral Act gives the commission flexibility to “amend or vary” its regulations.

“It is my considered view that the power to make a regulation or guideline necessarily entails the power to amend or vary it,” Umar said.

The judge held that not even the allegation that INEC breached its regulations during the conduct of the presidential poll can justify the order of mandamus issued by the lower court “because that is an issue for the election tribunal”.


LP ABUSED COURT PROCESS’

The appellate court also described the suit as an abuse of the court process.

The justices said they took cognisance of a judgment in a suit marked FHC/ABJ/CS/1454/2022, delivered in January by Emeka Nwite, a federal high court judge in Abuja.

In the suit, Nwite, while delivering judgement, held that INEC is at liberty to specify or pick the method of transmitting election results.

Having previously filed a suit and obtained judgment at the Abuja federal high court, the appellate court held that the party ought not to have filed a similar suit bordering on the same issues in Lagos.

“It is difficult for Suit No: FHC/L/CS/370/2023, which gave to this appeal, to escape the label of abuse of court process,” the judge said.

“I said so because the objective of the suit is to compel the 43rd respondent (INEC) to adopt a particular way of transmitting or transferring the result of election in Lagos state.

“This objective is not in any way different from what the objective the 1st respondent wanted to achieve in Suit No: FHC/A133/CS/1454/2022.”

Consequently, the appellate court resolved the issues in favour of the APC.

“I hereby make an order setting aside the judgment of P.O. Lifu delivered on the 8th March 2023 in Suit No: FHC/L/CS/370/2023,” Umar held.

“In its place, I make an order dismissing the suit i.e. Suit No: FHC/L/CS/370/2023 in its entirety for being an abuse of court process. Parties shall bear their respective costs.”

Meanwhile, the appellate court noted that the respondents did not file any brief or join issues in the appeal despite proof that they were served with the appellant’s brief.

If INEC provided the "top copies", Obi would provide his agent's copies and show that the results were modified and that he won. But they didn't so as to frustrate the petition, and in so doing, their own CTC of results from IREV is now enough to show that they didn't comply substantially with the guidelines.

Over 7m votes are under question now.

Don't mind the ignorant people. Those 18000 copies have hard copies. They assumed that INEC rely on what the corpers snapped and uploaded to calculate their results. The problem is some don't even know

The Federal Inland Revenue Service (FIRS) says it generated N5.5 trillion as tax revenue in the first half of 2023.

In a statement on Thursday, Johannes Oluwatobi Wojuola, special assistant on media and communication to the chairman of FIRS, said the figure is the highest tax collection ever recorded by the service in any first six months of a fiscal year.

Giving a breakdown of the tax revenue, Wojuola said the service achieved 88 percent of its target from oil revenue and exceeded its target for non-oil tax.

“Tax revenue collected from the oil sector from January to June 2023, stood at N2.03 trillion, as against a target of N2.3 trillion; while non-oil tax collection stood at N3.76 trillion, as against a target of N2.98 trillion,” he said

“The service collected a total of N1.65 trillion tax revenues in June 2023. This sum is the highest tax revenue collected by the service in any single month.”

Commenting on the revenue inflow, Muhammad Nami, executive chairman of the FIRS, was quoted to have attributed the performance to improved voluntary tax compliance enabled by the automation of FIRS’ tax administrative processes.

“This is a good head start as we work towards meeting our target for the year. And it was achieved despite stubborn headwinds such as the impact of the currency redesign and the 2023 general elections on the economy in the first and second quarters of 2023,” Nami said.

This half-year performance was achieved as a result of improved voluntary tax compliance by taxpayers, the continued improvement of automation of our tax administration processes, including the updated VAT filing processes; as well as our dogged engagement with stakeholders in both the formal and informal sectors of the economy.

“We believe that the performance in the second half of the year would be better considering the continuing improvement to our tax administration processes and positive impact of the current government’s policies on the economy.”

In 2021, the FIRS said it generated N6.4 trillion as revenue.

Out of this figure, according to the agency, company income tax stood at N1.896 trillion, petroleum profit tax was N2.008 trillion, and value-added tax (VAT) was at N2.07 trillion.
But checks by TheCable showed that the petroleum profits tax declared by FIRS at the federation accounts allocation committee (FAAC) meeting was N1.2 trillion and not N2 trillion.


This showed a discrepancy of N800 billion in the FIRS’ data.

The defense did not tackle the issue of results manipulation in Rivers, Benue, Imo, Lagos etc. and how the court should resolve it. If the petitioners profer their own solution, the hands of the court would be tied. They focused on the use of electronic transmission/transfer Vs manual transmission/transfer. That's not the issue of the petition but rather whether IREV should be used in case of disputes of election results. They did not even mention BVAS report.
What efforts did the petitioner made to tackle the issue if Rivers? You want the defense to open up in areas the petitioner failed?

Simon Ekpa, a self-acclaimed disciple of Nnamdi Kanu, detained leader of the Indigenous People of Biafra (IPOB), has responded to a statement made by Peter Obi on the sit-at-home directive in the south-east.

The proscribed separatist group introduced sit-at-home to demand the release of Kanu who is being detained by the Department of Security Services (DSS).

Ekpa had declared a total lockdown in the south-east geopolitical zone from July 3 to 10, instructing members of the proscribed group to interrupt business activities and prevent people from carrying out their daily work.

In a statement on Thursday, Obi, the presidential candidate of the Labour Party (LP) in the last elections, described the sit-at-home directive as the handiwork of a criminal enterprise, noting that IPOB has “publicly denied issuing such directive.”

“Also disturbing is the continued disruption of business and social activities in the South East region over the Sit-at-Home directive purported to be coming from the Indigenous Peoples of Biafra, IPOB, when the body has publicly denied issuing such directive,” Obi had said.

“What is going on in the south-east therefore is essentially a criminal activity that must be nipped in the bud, with all hands being on deck, security agencies, and the people alike.”

Reacting to Obi’s statement in a terse tweet, Ekpa said the former governor of Anambra has now become the spokesperson of the separatist group.
