Introduction Proving that the 2019 Presidential election was substantially non-compliance will be very difficult for Atiku & the PDP. Based on this awareness, the legal counsel of the respondents came to the Tribunal with a lazy strategy. Their plans were to avoid cross examination, to explore technicalities, to prevent server inspection and to discredit petitioners’ evidences. As you read through this thought-provoking thread, you will discover how the legal counsels of the petitioners were able to spring a surprise and weather the storm through the following strategies: 1. The various issues for determination were reordered. 2. Some issues for determination were merged. 3. Submission of new academic qualifications for Buhari was rejected. 4. Arguments that Buhari’s qualification issue was a pre-election matter were rejected. 5. Summary of wrong computation of votes in 11 focal states was tendered. 6. False information in Buhari affidavit were re-emphasized 7. The inec server result. 8. The inec server distraction. 9. Plan B (Inconclusive Elections). 10. Conclusion 1. Reordering the issues for determination One of the things that delighted my heart was the way the petitioners’ legal counsel reordered the issues for determination starting with the most brutal ones. Take for example the issue of Buhari’s non-qualification was presented as the first issue for determination followed by the submission of false information to inec. This was a brilliant move by the legal counsel of Atiku & the PDP. 2. Some issues for determination were merged. In order to reinforce the strength of the petitioner’s final written address, some issues were merged together. The issues of non-qualification and false information were argued together so as to weaken the defence counsel of the respondents. Also the issues of electoral corruption plus non-compliance were merged as well. Thus, the respondents made the mistake of addressing one of the merged issues and abandoning the other, which is equally as important. 3. Submission of new academic qualifications for Buhari were rejected The 2nd respondent tried to bring in more credentials that were not listed in Buhari’s resume and in his form CF001 but their efforts were checkmated. Atiku’s legal counsel posited that any fresh qualifications that were not contained in exhibit P1 (Form CF001) is unnecessary to the questioned election and can not be allowed in determining Buhari’s qualification as at the time of the election. See page 7, paragraph 3.15 of petitioner’s final address to Buhari. 4. Arguments that buhari’s qualification issue was a pre-election matter were rejected While the respondents argued that Buhari’s qualification issue was a pre-election matter thus statute barred, petitioners’ counsel rejected this position. Atitu’s lawyers argued that failure to fulfil the conditions relating to qualification as stipulated in section 131(d) of the constitution is a valid ground for questioning an election. The case of Dingyadi & Anor versus Inec (2010) was cited where the Supreme Court held that non-qualification is a ground for questioning an election in an election petition. See page 6, paragraph 3.10 of petitioner’s final address. 5. False information in Buhari affidavit were re-emphasized The respondents tried to be crafty by arguing that the petitioners failed to prove that Buhari submitted false information in his affidavit. Consequently, Atiku’s legal counsel reminded them that Buhari’s witness had already reinforced the petitioner’s evidence and that the respondent did not even contest the adduced evidence. Sadly for Apc, inec & Buhari, they did not call a single witness or provide any evidence to prove that the information in his affidavit is true, which means that they have agreed that the information is false as alleged. 6. Cambridge versus WAEC result The discrepancies between the Cambridge result and the waec result were also highlighted. One result showed 6 subjects while another showed 8 subjects. The petitions’ counsel went on to conclude that both results are not reliable. Besides, both results bear a strange name (Mohamed Buhari). Sadly, the respondents did not explain the discrepancies and one of their witnesses also confess that the Cambridge document is not a certificate during cross examination. 7. Wrong computation of votes in 11 focal states The votes of APC were inflated by 5.98 million at the various stages of collation. Also the votes of the PDP were inflated as well by APC riggers just to cause confusion and give an impression that both parties rigged the election. The petitioners consequently argued that a readjustment of the result will show that PDP won the election with a margin of over 200,000 votes. Atiku’s legal counsel cleverly brought in this conclusion @ the eleventh hour through a statistician who analysed all the result sheets and compared them with what INEC announced. The respondents did not respond to this allegation because it was an ambush and they were helpless. 8. INEC server result All the 3 respondents did not lead any evidence to disproof the server result adduced by the petitioners’ counsel. This is a big plus for Atiku and the PDP because were a party fails to lead evidence in his pleading, the pleading is deemed to be abandoned. Also, the respondent assertion that e-collation & transmission were prohibited by the electoral act was rebuffed by the petitioners. The respondents were reminded that section 52(2) of the 2015 electoral act as amended had removed the restriction on electronic voting. 9. INEC server distraction The noise and controversy generated by the server also created sufficient distraction to the respondents’ team, especially INEC. While the Atiku Team were busy proving other grounds of their petition, the respondents were struggling on how to deny the existence of the server. As part of their lazy strategy, rather than disprove the contents of the server, they took the bait of denying the existence of a server, only for them to admit it later at the close of the case. This threw their credibility into the gutter. 10. Plan B (Inconclusive Elections) Another brilliant move by the petitioners was to throw in an alternative prayer to declare the elections as inconclusive and order a rerun. They established that the actual total number of void/rejected votes was higher than the difference between Atiku and Buhari, thus, INEC ought to have declared the elections as inconclusive. The respondents had no answer to this. This was like a Plan B, so that even if the respondents’ team found any technicality to rely on, the case would be salvaged. 11. Conclusion From all indications, the petitioner’s counsels have done very well and the 2019 election is very likely to be the first Presidential election that will be reversed by our Judiciary. Many will argue from a lazy perspective that it has never happened before and so the electoral fraud of Buhari will survive judicial scrutiny. Well, that it has never happened before does not mean it will not happen one day. Yaradua almost lost at the Supreme Court in 2008 due to a minor issue (non-serialized ballot papers). However, the issues with the 2019 Presidential election are multi-dimensional and the evidences are stronger. The technology was consequently used and the outcome revealed that Buhari lost. Ironically, Inec tried in vain to dump the result but it was too late, a brave anonymous staff of inec downloaded the result and forwarded it to Atiku for a looming post-election litigation. The possibility that Atiku will win is very high given the avalanche of evidence he has to proof his appeal. Definition of terms —Soft copy of the presidential result The aggregated result of all the polling units across Nigeria sent via a smart card reader (SCR) to a backend belonging to inec for automated processing. —Backend Backend is a computer system which consists of a server, a database and an application. —Front end Frontend is that part of a computer system or application with which enables user-friendly interaction with a computer system. —Digital evidence Digital evidence is defined as information and data of value to an investigation that is stored on, received or transmitted by an electronic device —Whistle blower A whistle blower is a person, who could be an employee of a company, or a government agency, disclosing information to the public or some higher authority about any wrongdoing, which could be in the form of fraud, corruption, etc. A point by point rebuttal to the subject matter (why Atiku is not coming) 1. Atiku’s Server Argument is a SCAM Note that Atiku is not in court to argue about the meaning of a server but he is in court to proof that he won majority votes that were cast in the just concluded 2019 election. To prove his point, Atiku has presented digital evidences to the tribunal which comprises of the following: A. Soft copy of the presidential result obtained from the backend server of INEC. B. Total number of accredited voters via the smart card reader (SCR). The above evidences were obtained from a whistle blower who is a staff member of inec but wishes to remain anonymous. The soft copy result of the presidential election serves as a powerful evidence which shows that Atiku got 18.35 million votes while Buhari and the other contestants got 16.7 million votes and 1.3 million votes (others) respectively but excluding Rivers State data. Note that digital evidences are very difficult to falsify or destroy because it will leave a trail / footprint unlike paper evidence which could be altered / falsified. The total number of accredited voters is another strong evidence Atiku has presented in his petition to reinforce his appeal that he won the election. INEC said only 29.3 million Nigerians did accreditation but data obtained from the backend server belonging to INEC shows that more that 37.6 million people did accreditation. This means that over 8 million votes were depleted and this further gives credence to Atiku’s appeal that his votes were reduced from 18.35 million to 11.26 million (-7.09 million). Also note that Buahari’s votes were reduced from 16.7 million to 15.19 million (-1.51 million). This was deliberately by APC & INEC just to confuse investigation. 2. it does not matter whether INEC has a Server since the law does not recognize it From a direct point of view, the electoral law does not recognise the server & the smart card reader but from an indirect point of view, the law does not prohibit INEC from modernising, upgrading, automating and determining how to conduct the election (Section 52(2) of the electoral act 2010). However, what is most important regarding the Atiku’s petition is that he has evidence to show that he won. It is only mischief makers that are twisting the narrative. 3. The Law recognises Form EC8A, signed by agents, collation officers. Yes and nobody is contesting that fact. 4. Due to network connectivity issues, INEC could not have transmitted results This is not true. Virtually every part of Nigeria has been covered by GSM infrastructure. Secondly, it was INEC that instructed their officials to transmit polling unit result to the backend server. 5. No lawyer, arguing an election petition case will make an argument based on Servers Atiku’s petition is built on 5 pillars: —That buhari did not score majority of the vote cast. —That buhari’s election is invalid by reason of corruption, before & during the election. —That buhari does not possess the required minimum qualification. —That Buhari lied under oath about his credentials thus committing as offence know as perjury. —That the 2019 election did not fully comply with the 2010 electoral act. Like I said earlier, Atiku is not in court to base his argument about the meaning of a server but he is in court to proof that he won majority of votes cast in the just concluded 2019 election. The most potent evidence remains the information in the backend server belong to INEC. 6. No party agent authenticated any results on a Server post-voting and the counting of votes Blame INEC for not allowing collation agents of the various political parties to view details of the election results, transmitted from the polling units to the backend server of INEC. The original plan was to allow political party agents have viewing access to the frontend of INEC computer application at the various state collation centres but after Buhari lost, INEC did a detour by dumping the earlier plan. Their servers were deliberately short-down, thus preventing collation agents of political parties from viewing, authenticating and re-confirming the soft copy result with the hard copy result. 7. Illegal & unauthorised access to a Server is a crime under the Cybercrime Act? In the context of the 2019 election, nobody (PDP & Atiku) had committed any Cyber-crime. It was a whistle blower who blew the whistle and gave Atiku the required evidence. Again, it is the inec chairman who has committed a crime by conveying false election information to all Nigerians. 8. The server result presented by Atiku is extremely ridiculous. Statistical research methods such as correlation analysis will show you that the results obtained from inec backend server is more statistically logical than the one which was announced by Professor Yakubu Mahood. How can peaceful regions like the s/west, s/east and the s/south have a low turnout ratio than the n/east? The turnout ratio in the n/east was about 44% while the INEC result gave the s/west, s/east & s/south an average turnout ratio of 29%. Borno State for example has more voters that Anambra. 9. Atiku’s 400 witnesses are far too few to prove or disprove anything It is not the quantity of witnesses but the quality that matters. Kindly note that 4 international observer group from America and EU had already said the election was badly conducted. With just 200 witnesses + video evidences + international observer statements and publications + newspaper publications + statistical evidences among others, I am optimistic that Atiku and his team of lawyers will proof that Atiku is the true winner. 10. The Borno election results The Borno election result need to be further investigated. So far, about 3,500 exhibits have been submitted at the tribunal regarding that state. This goes to show how bad the 2019 election was. To me, I will classify Borno, Yobe, Kano & Zamfara as the Head Quarters of Election corruption Centres in Nigeria. Zamfara and Kano states both have 11,000 exhibits against them at the tribunal pertaining to electoral malpractices. Conclusion The inability of inec to justify Buhari’s victory so far gives credence to Atiku’s appeal that he is the true winner. The server evidence remains a nemesis to APC / INEC / Buhari. Every right thinking person with good education knows that the result which inec announced on 27 Feb are not genuine. Historically, Buhari was never a popular aspirant until Bola Ahmed cleaned him up, funded is campaign and then used the media to re-brand his image. After the election, a lot of people became wiser. Buhari's incompetence became apparent and he lost many followers. In the South South and South East, Buhari's tactless approach to the issues of Niger-delta development, ethnic marginalization and the agitation for Biafra did him more harm than good. In the South west, Buhari's open declaration that he does not support restructuring also decimated his popularity. In the North central, Buhari's inability to curb the herdsmen/farmers clash also made him to loose followers. In the North, Atiku had quality politicians who assisted him in winning decent votes across the North west and the North east. The names of these politicians include: Kwankwaso, Sule Lamido, Ahmed Markafi, Nnamadi Sambo, Aliyu Babangida, Tabunwal and many more. asanwafo: @ Asanwafo, Historically, Buhari was never a popular aspirant until Bola Ahmed cleaned him up, funded is campaign and then used the media to re-brand his image. After the election, a lot of people became wiser. Buhari's incompetence became apparent and he lost many followers. In the South South and South East, Buhari's tactless approach to the issues of Nige-delta development, ethnic marginalization and the agitation for Biafra did him more harm than good. In the South west, Buhari's open declaration that he does not support restructuring also decimated his popularity. In the North central, Buhari's inability to curb the herdsmen/farmers clash also made him to loose followers. In the North, Atiku had quality politicians who assisted him in winning decent votes across the North west and the North east. The names of these politicians include: Kwankwaso, Sule Lamido, Ahmed Markafi, Nnamadi Sambo, Aliyu Babangida, Tabunwal and many more. So based on the above, every right thinking person will tell you that buhari lost. Please find below, details of how Nigerians voted. SW 3.310 - Buhari (53%) 3.012 - Atiku (47%) Winning margin 298,000 (Buhari) SE 1.515 - Buhari (33%) 3.237 - Atiku (67%) Winning margin 1.722 million (Atiku) SS 1.22 - Buhari (29%) 2.94 - Atiku (71%) Winning margin 1.72 million (Atiku) The winning margin would have been more if votes from Rivers state were available. NC 2.34 Buhari (44%) 2.99 Atiku (56%) Winning margin 0.65 million (Atiku) NE 2.62 - Buhari (51%) 2.55 - Atiku (49%) Winning margin 70,000 (Buhari) NW 5.72 - Buhari (61%) 3.69 - Atiku (39%) Winning margin 2.03 million (Buhari) Total no of voters per region NW 9.41 m NE 5.17 m NC 5.33 m SW 6.32 m SE 4.74 m SS 4.16 m South – 15.22 m North – 19.91 m South – 9.2m (Atiku), 6m (Buhari) Atiku won in the south with a margin of 3.2 million. The winning margin would have been more if votes from Rivers state were available. North – 9.23 m (Atiku), 10.68 (buhari) Buhari won in the North with a margin of 1.45 million Total accreditation = 37.6 million Total voided votes = 1.23 million Total votes cast = 36.4 million Winner / Atiku = 18.35 million 2nd place. Why Buhari is afraid of Onnoghen Justice Onnoghen was one of the 3 Justices who called for the cancellation of the 2007 election and asked INEC to conduct a new election within 90 days due to non-compliance with the 2006 electoral act and other irregularities. Atiku was too sure that buhari will rig hence extra efforts were deployed towards the gathering of evidences for post election litigation. While INEC spent almost 3 days doing their collation, Atiku also quickly did his own collation as well. Buhari ought to have known better that it's impossible to rig without being caught because we are in a digital age. As I speak to you, atiku has a compilation of how the election was rigged state by state and local government by local government. These compilations were done by auditors, mathematicians, statisticians and other forensic experts. Buhari and others rigged the election in several twists and turns so as to confuse investigation but the server result has uncovered how they rigged. Buhari's votes were inflated by 260,000 in the north west, 619,000 in the north east and 112,000 in the north central. However, kindly note that buhari's votes were reduced in the south by 2.59 million. This was deliberately done to confuse investigation. On the other hand, Atiku's votes were reduced by 3.3 million in the north and 3.79 million in the south. While Atiku's aggregate votes were reduced by 7.09 million, Buhari's aggregate votes were reduced by a net sum of 1.59 million (2.59m - 0.991m = 1.599 million). Conclusion Atiku's evidences are so powerful to the extent that the INEC chairman is even hiding vital electoral result sheet despite court orders which permits Atiku to inspect those results. So just be rest assured that Atiku will reclaim his mandate within 12 months. As you can see, but Buhari and Osinbajo can not celebrate because it is a temporary victory. Thanks for reading. PrecisionFx: Before the election, atiku already had the south east, the south south, the north central and half of South West and north east in his pocket. Rabiu kwankwaso, markafi, sule lamido, sambo, tabuwal and others delivered 33% of north west to atiku. Hence atiku was sure to win. |
