If ownership was given, the question was that against who? Was the defendant duly served with the court processes? If duly served, was there an order for execution of judgement? If yes, were the Omonile licensed to execute the judgment? Go on appeal or sue the parties for trespasses. You can make a petition to the Commissioner. Thanks. |

Litigation: Such properties could be subject to court litigation, where aggrieved parties fight over. The new law guiding lands under litigation is that any other person who buys such land has bought case for himself. Such a person will be joined in the trouble. Suretyship: Several land sellers have stood sureties and guarantors for indegent and bankrupt persons in court wherein the photocopies of the property documents have been deposited in court. The implication of this suretyship is that in case there is a failure, the properties will be forfeited. Several buyers have bought Properties which have been used to stand sureties. Public acquisition: Most properties are on the government compulsory acquisition/Commitment. Such acquisition could be for future road construction, farming, public structure. One seller, Multiple buyers: This is most prevailing factor in Lagos and Ogun State. Thorough inquiries should be made, especially among the neighborhoods and original documents should be requested for. Immediately the copies of the documents are secured, proceed to the requisite land registry or court to make your findings. Once the properties are purchased, go ahead to perfect your title immediately. Ownership of land is not determined by the first to pay, but the first to perfect title. MY TEARY MOMENT ON BIG BROTHER NAIJA FINALE: Seeing Big Brother wishing Mike and Mercy a final goodbye, They walked out of the door. All that was left was an empty space as the camera panned through the lounge to the kitchen, the bedroom and to the garden. The soft music played alongside the camera movement and i became emotional. We saw their names on the wall, their footprint left for time to deal with. I saw all the things they fought each other for. The 26 housemates left the chair they once dragged, they left the throne and special room meant for the Head of House They left the kitchen and all the food they were hiding. Water bottles, wines and soft drinks littered everywhere. The battles they all fought during their arena games and weekly task neither made sense or rather was a total waste of time as the lights went off one after the other. Behold the darkness. It dawned on me, this is what the last day would look like. Someday all these things we killed each other for will be left behind and we will face the real deal. We will all leave the earth no matter how we decide to keep it. As prepared as the Housemates were, for every time a name is mentioned, they become scared of the unknown. They had to reassure themselves to be strong and focus because they don't know their fate. God is superior & someday he will take back the earth he created. How to Get Building Plan Approval in Lagos State. The Lagos State Physical Planning Permit Authority (LASPPPA), a parastatal under the Ministry of Physical Planning and Urban Development is in charge of Development Permit in Lagos State. Your land must have a Certificate of Occupancy (CofO) before your building can be assessed by the appropriate authorities. �Step One: Get Architectural Drawings, Building Plan and Survey Plan. Contact a certified architect that is aware of Lagos State building plan approval peculiarities to prepare a design and plan for you. Tips: Ensure that the rooms are cross ventilated. Room sizes must not be less than 3m x 3.6m. Ensure that the scaling is properly done. Use legible lines. �Step Two: Get Demand Notice from the District Officer and Make Payment. Send your architectural drawings, building plan, title documents and survey plan to the district office for assessment and vetting after which it will be marked for approval. After getting an official government assessment and endorsement of your design, you’ll be required to pay a fee which is calculated based on your proposed design. Pay the fee at the bank. Carefully read and follow the instructions on the Payment Advice. Tips: The Payment Advice contains the Revenue Code and Agency Code that you will use to fill the bank teller. Avoid paying into a wrong account or using a wrong code Avoid time wastage due to the issuance of a receipt. Paying cash is faster than paying with cheques. Use any bank with fast internet connectivity. �Step Three: Confirmation of Receipt at the Accounts Department of the District Office. The accountant at the Physical Planning office will log on to LASG system to confirm your payment. Tip: Don’t wait until last minute to confirm your receipt because internet connection might be slow or unavailable. �Step Four: Inspection by the District Office A team from the District office will inspect your site to be sure that your land and other attributes of the building corresponds to what you have in the documents you presented. The Site Inspector, Charting officer, Architect and Site Engineer will write their reports. A difference in land size or other attributes presented on the plan and the actual land attributes could lead to problems. Tips: Clearly indicate the beacon numbers as shown on the survey plan on block work on the site. Monitor them so that they don’t visit the wrong site. �Step Five: Submission of Documents The following documents are required for building plan approval in Lagos State: �5 sets of Architectural Drawing. �5 sets of Mechanical and Electrical Drawings (If applicable). �5 sets of Structural Drawing and Calculation Sheets. �5 Copies of Survey Plan and 1 original. �Certified true copy of the Certificate of Occupancy/Consent (Title Document). �Confirmation Letter from Lands in Lieu of Consent (if applicable). �Letter of supervision from COREN registered engineers for the structural drawings. �Environmental Impact Analysis Report (if applicable). Soil Test report (if applicable). �Site Photographs. �Development Levy receipt. �Evidence of payment of assessment fees. �Land Use charge, Tenement Rate receipt or sworn affidavit in lieu of tenement rate. �Evidence of payment of ground rent (if Applicable). �Copy of Demand Notice for current year ground rent (if applicable). �Clearance Letter from L.U.A.C. (if applicable). �Clearance letter from Housing, Fire, Transportation, and Drainage (if Applicable). �Copy of Confirmation letter from NTDA (if applicable). �2 Passport Photograph of Applicant(s). �Electronic tax clearance of applicant (with a copy of last payment receipt for tax). �Copy of certificate of incorporation (if the applicant is a company). �Two directors tax clearance (if the applicant is company name). �Evidence of Pay as You Earn of the company. (If applicable). �Copy of most recent company tax clearance. Tips: �Ensure that you have all the necessary documents, especially tax and structural drawing papers, to avoid unnecessary delays of the approval process. �Ensure that your tax papers are up-to-date as tax verification will be done at LIRS. �Generally, for bungalows or one-storey buildings, you can get your building plan approval within 6 weeks if you have complete documents. Also, your Architect, Surveyor or any other knowledgeable member of your building team can help you get your building plan approved. walexpal:Alright. My advice goes thus. There is a Lagos State Property Protection Law, which prevent the omonile frm unlawful encroachment. Where there is an encroachment, victims of land grabbers must immediately do a petition addressed to the Attorney-General, with attention to the Coordinator, Lagos State Special Task Force on Land Grabbers. Such petition must include all the details, facts and photocopies of valid title documents in relation to the land in question as well as accompanied their complaints by an Affidavit/Declaration with a passport photograph. Police have limited power in land matters ooo. My opinion. |
