A friend went to verify a property for her clients in Osun State and before she got there, the clients have paid unknowingly that there was acquisition. After she tried to visit the seller and pleaded for refund, the entire money was refunded with apology. Though securing a money paid may not be easier, because the seller would have spent the sum instantly, yet some may go ahead to refund you. A woman bought a property from an estate company in Lagos, and two years after discovering defect in the property, she went to complain to the company and the estate company agreed to pay 80% as a refund.

�Plead for Accommodation: This exists where the land is under compulsory acquisition and the present owner needs it for farming purpose. The amount involved is overwhelming and it's currently practised in Ogun State.

�Opt for negotiation: This exists and arises where the buyer approaches and plead with the other party for release of the property. Though instances of such is rare as the other party may insist on additional payment before the property is dispensed with. A good example of this is the Land Grabbers.

�Go to court: This is mostly practised everyday. This arise mostly where it is believe that the property is sold fraudulently by families or individual. It also arises where there are existing deeds of Assignment. Some don't have deed and yet they succeeded in the transaction. I am currently handling some.

� Report to Police Station: Even though, police have less power on land matters, they can still attend to matters bothering on malicious damage.

NOTE that it is not advisable to resell a property with defect title to another unsuspecting innocent party, in order to avoid further dispute which pay incur unexpected expenses.

I just returned to the office after an hectic time in court yesterday. Not quite long i arrived, three clients walked in and were asked to exercise little patience for me to freshen up to attend to them. I finally attended to them, and what brought them in was a petition against land grabbers. They bought 2acres from the Omoniles in 2012 and purchase receipt was given. To their greatest surprise, they discovered same lands were re-sold to a third party by the same sellers. I carefully observed that there are cautions and conditions at the bottom of the receipt stating that land buyers who fail to develop same land within 6months shall forfeit same.

The fact remains that most of us don't knw our rights. Once u buy a land, it is permanently yours, whether or not u develop it, though it's advisable that you develop or make concrete demarcation as earliest as possible because of encroachment like this. However, we advise that you ask relevant questions before you pay. Involve your lawyer to look into every document, else the consequences may be unbearable.

LEGAL GUIDE TO BUYING PROPERTY IN LAGOS.


STEP 1 – DECIDE ON A BUDGET AND LOCATION
Buying a property is a big step involving a substantial long-term financial commitment, so think hard about what you can afford. Also, if you intend to live in the property, then you need to be sure that it is in a location you are happy at and can be for a very long time. Once you decide on a budget and location, then you are good to go and you can move on to the next step.

STEP 2 – HIRE A COMPETENT LAWYER
Not all lawyers are experts in property transactions. It is not enough that you hire a lawyer, yes all lawyers have some idea about property law, but there are some issues which someone who is not a specialist in property matters would easily miss.

STEP 3 – LOOK FOR THE PERFECT (OR ALMOST PERFECT) PROPERTY
Once you hire a lawyer, the next step is to begin the search for properties which match your budget and location. At this point, you can engage the services of an estate agent, the estate agent will look for properties which match your criteria, create a shortlist for you, and then organise for you to view the properties shortlisted. Your lawyer can also assist you in recommending a trustworthy estate agent, if your lawyer is involved in many land transactions.

STEP 4 – INVESTIGATING THE SELLER
This stage is where your lawyer begins his/her work fully, the lawyer will conduct the proper searches, ask the right questions, and request for the right documentation to determine if the person you are speaking to about the property in Lagos, is the real owner. This is EXTREMELY important especially when the property in question is family land.

STEP 5 – INVESTIGATING THE PROPERTY
At this stage, your lawyer will also play a big role. The lawyer will conduct the relevant searches and examine the appropriate documentation to ensure that the property is free from any encumbrance or pending litigation, that the property is not the subject of any Government acquisition, and that the property is not subject to any overriding interests

STEP 6 – VIEW THE PROPERTY
At this stage, if you have confirmed that the person you are dealing with has title, and the property is free from any issues, then you should visit the land to physically inspect it. At this stage you want to ensure that the land and the environment meet your expectations. It is also advisable to conduct a site visitation with a registered surveyor who will look at the survey plans and advise on the property as well.

STEP 7 – NEGOTIATION
Here both the buyer and the seller have satisfied themselves that the deal can proceed, it is now a matter of agreeing on an acceptable price for the land. Your lawyer will be very instrumental here as well, as the lawyer will also be able to give you a solid indication of what future liabilities will exist for you (stamp duty fees, other government fees).

STEP 8 – DOCUMENTATION
If the negotiation goes well and the offer is accepted, then your lawyer (and the seller’s lawyer) can move to the stage of drafting and negotiating all the completion documents. In land transactions in Lagos, there are 3 main documents – the contract of sale, the receipt, and the Deed of Assignment. The lawyers will deal with this, and ensure that the interests of both parties are addressed.

STEP 9 – COMPLETION, EXCHANGE & POSSESSION
At this stage, the buyer and the seller have signed and exchanged contracts, and the buyer is now in possession of all the original title documents and transfer documents. The purchase price of the property has also been made at this stage. Once all that is complete, the buyer becomes the owner of the property and can take possession

STEP 10 – POST-COMPLETION
Once the buyer has taken physical possession of the property, the next step is to file all the necessary documentation with the appropriate government authority and then commence the process to obtain Governor’s consent of the transaction. Once Governor’s consent is obtained a Certificate of Occupancy is issued, and the property transaction is then complete.

A Nairalander wanted to buy a property at Ikorodu, and a friend recommended a seemingly good & affordable site for the purchase. The owner of the site is a surveyor who got the land from a family. We visited the location for inspection and I requested the copies of the title documents be forwarded to me via WhatsApp for proper checks and conclusion; moreover my new client was ready to pay. After going through the layout of the property, it shows the following outcome:

�the layout he sent doesn't has a name of the purported surveyor that prepared it.
�the signature of the surveyor is essential in any document like this, but it's not there, not even a date or number.
�The description of the site and area is not there.
�If the family gave the surveyor (who is now the owner and the seller) the property in exchange for work done, there is no deed of transfer from the family to the surveyor.

Land transactions in Nigeria has outgrown the era of seeing & paying alone. We need thorough investigation and checks. There are certain factors guiding land transactions in Nigeria, especially before you pay.

1. Before a party can sell land to another, the consent of the Governor of such State is required. However, a property with an initial C of O needs no governor's consent, because both documents originate from the State government. Simply put, C of O and Governor's Consent have the same effect. But where the owner of a land with C of O sells same land to another person, such subsequent buyer must process his application for Governor's Consent. This is because the initial C of O carries the name of the previous owner.

2. Under the law, a person under the age of 21 (twenty-one) cannot be granted a Statutory right of occupancy. This implies that a C of O or permission to own land cannot be issued to a child below 21 years.

3. Without the approval of the National Council of States, a non-Nigerian cannot be granted a right of occupancy. This implies that a non-Nigerian cannot be given license to own land in Nigeria, except with the written approval of the Council of State.

4. Where a land belongs to a community or family, the consent of the family head or community head must be obtained before there can be a valid sale. Any sale of family or community land without the consent of the head of that family, such a sale is invalid. Any sale of community land without the consent of the Community Head, shall be set aside.

5. Covenant in a lease may also restrict the sale and transfer of land. For example, if a property is leased/rented, the written tenancy agreement is to the affect that, you are not permitted to sell the property leased to you.

6. The law also state that, any land owed by a Nigerian Coal Corporation cannot be sold except with the written permission of the Federal Minister in charge. This implies that, for example, before we purchase any property belonging to a Federal agency like NNPC, the consent of the Minister must be sought and obtained, else the sale wil be invalid even after you build on it.

7. Town planning laws may also restrict the sale of certain lands where the purposes for which they are intended to be used are contrary to the purposes of town and planning laws. For example, an industrial place designated for such industrial purpose should strictly be abided to rather than using it for something else like residential or religious purpose.

8. In Lagos, the law states that the sale of any land which the Lagos State government has marked for road construction shall be in nullity. This means that once a land is marked for road purpose, such land is not permitted to be sold for use.

9. Doctrine of ‘ Lis Pendis’ : This means that once a land matter is in court between two parties, no one is allowed to sell/buy such land until the case has been concluded and final judgement is given.

In this regard, I urge you to carry out your due investigation and search before purchasing any property in Nigeria.

Most Nigerians are taking the risk, but it backfires at them when the government want to use it. Imagine a land on which a house has been built for ages and the government brings bulldozer or marks it for demolition. You can't fight the government and win in most land cases, especially where the property was initially under compulsory acquisition. Majority of Nigerians wl still go ahead to buy it.

That's very unprofessional. I'm really sorry for that. Let me ask this question. Did you appoint him to obtain any money from any of your tenants? If no, please arrest him for misrepresentation. If yes, are you sure you're not owing him any arrears? If you're not, then this is the best way to go:

1. Terminate his appointment as your lawyer.
2. Request in writing, a letter to refund same money within a particular time.
3. If he defaults, report him to police or disciplinary committee of NBA. NBA is an association of lawyers in Nigeria. There is a branch in your state.
