A lot of Land sale adverts and posts have swept off the internet by self acclaimed Estate agents and companies with juicy offers and cheap prices. In the circumstance, prospective buyers are in a bid to procure the land unverified. May i relate with you that once you make your payments, the estate companies with default land documents then move to the next available victims, leaving you to engage in unwarranted expensive court litigation. Before you engage in a landed transaction, make sure you secure the attention and legal advice of a real estate solicitor to help in negotiation, search, verification, and probably proper execution of your final documents. Dont be appeased by a mere receipt as its inadmissible in court as a proof of title to land. Though the lawyer will charge his professional fees, but its quite unquantifiable to the subsequent loss you will incur on the entire land, when you have realised the land is fake.

This information is very wrong. A deed of conveyance and deed of assignment mean the same thing. They both convey title to a purchaser. There is no difference between the names. The difference is just nomenclature when titling the name of each document and the particular purpose the documents are being drafted for.

Secondly a deed of conveyance is not given to a purchaser for a temporary performance of an action on a land. Once you convey, assign or transfer a property to another, it is permanent and comes either in the form of freehold or fee simple. Any document that provides for a temporary performance of an action in land cannot be a deed of assignment, transfer or conveyance. Rather it would come in the form of a deed of sublease, lease or rent.

Well we r most guided, learned senior. However, in situations where there is transfer of land as gift or family partition, I humbly believe Deed of transfer applies. To my mind, I consider discrepancies in between the duo.

No sir. Every deed of Assignment is still deed of conveyance, but not all Deed of Conveyance is Deed of assignment. Every deed of transfer is a Deed of Conveyance as well, but every deed of Conveyance is a Deed of transfer. A deed of Conveyance can be for the temporary performance of an action on a land, which is not absolute transfer. A deed of transfer is not same as deed of Conveyance as well. We lawyers know how applicable they are in respective circumstances.

There's this land I want to get in a developing area in Osun state, after concluding the price with the family I was told the document I would be given is just a receipt.

my question goes thus:
1. is that the only document I should receive?
2. if not what are the documents am supposed to collect from the family?
3. if am not given a survey of the land by the family how do I know it's not a govt land?
4. a Powerline is close to the area, what's the govt required distance to leave from a Powerline to the said land?

Abule-Ado is behind Festac along Badagry expressway.
The real reason I want to sell the land is because the omoniles are reselling peoples lands. Mine is fenced in front and at the back remaining the sides. I was told that if anyone trespasses on the land or damage any of the 5 coach high fences I can sue for malicious damage.
I have family receipt, deed of assignment and survey plan.

Ok. Owing to value attached to lands in Nigeria, u may still retain it and develop it for personal use or commercial purposes.
