Everyone has a right to sell their properties. Buying from the Estate companies is also good. One good advantage is that it saves you the cost and charges frm the Omoniles.

Traditional history means how your fore Fathers got the land and for how long. Though it wl be necessary if the land is subject to court proceedings. For the purpose of sale, all you need to do is to convince the buyer that the land is free from acquisition and dispute. You can also ask that he do personal research on it.

Have you reported to the sellers. Have you gotten a lawyer to act for you? Did you put anyone in charge sir?

I just returned to the office after an hectic time in court yesterday. Not quite long i arrived, three clients walked in and were asked to exercise little patience for me to freshen up to attend to them. I finally attended to them, and what brought them in was a petition against land grabbers. They bought 2acres from the Omoniles in 2012 and purchase receipt was given. To their greatest surprise, they discovered same lands were re-sold to a third party by the same sellers. I carefully observed that there are cautions and conditions at the bottom of the receipt stating that land buyers who fail to develop same land within 6months shall forfeit same.

The fact remains that most of us don't knw our rights. Once u buy a land, it is permanently yours, whether or not u develop it, though it's advisable that you develop or make concrete demarcation as earliest as possible because of encroachment like this. However, we advise that you ask relevant questions before you pay. Involve your lawyer to look into every document, else the consequences may be unbearable.

I can see many estate companies in bids to sell their properties to prospective buyers, are putting up promos and bonanza attached to the sales. At this juncture, sufficient care and caution is needed before you pay. The price and value of a property remains unwaivered. Be careful of promo. Some companies sell properties, and give extra plot in addition as bonanza, yet innocent buyers wl rush ahead to pay. Though some may appear real, but carry your solicitor along the purchase. In addition, some estate companies and property agents have recorded negative history in several transactions. They are either known for selling lands with fake documents or their company is not registered. A woman called sometimes ago to report an estate company which sold a land and she later found out that the land is being encroached by another person who claims same was sold by the same estate company. After she first reported to the company and demanded for refund, the company agreed, but only decided to pay her 80% of the entire sum. This are evil tactics employed by many estate companies to defraud buyers. We urge you to carry your lawyer along for investigation or call us.

Why do we investigate the veracity of lands before pay.

��The law entrusted all lands in the state into the governor. This includes urban and developing areas. In that regards, the state government takes advantage of the provision in such a way that many lands in the state are subject to acquisition, unknowingly to land buyers. Most of the properties we seek to buy are situating on government land, and prospective buyers risk its purchase without thorough verification, until demolition notice is issued by the government without Compensation. Compensation is only issued if the land if the land is previously free from acquisition.

��Most lands we seek to buy though free from acquisition, are subject to court pending litigation. This arise where two parties are fighting over a portion of land or properties. The law is that where there is a dispute over a property, all parties are to maintain 'status quo', meaning that until the court finally decides the true owner, any buyer who pays for the land, only does that at his own risk, and the amount is forfeited. So it's advisable to check whether there is a dispute over the land.

��Lands own by families or villages cannot be sold in absence of the family head, community leader, or other principal members of such family or community. Even though the land belongs to the family, the family head must acknowledge its negotiation and sales or else it shall be void. So we should verify the availability and consentof the principal owners of the land.

��Though some people have the right to sell, yet the documents may either be fake or incomplete, and in the circumstance, the real owner takes the advantage of the buyer's ignorance by reselling to different subsequent buyers. Many present fake C of O, Fake gazette, fake receipt and Survey plan. Before you pay, request for all land documents, though with the help of a lawyer or licensed surveyor(in case of survey plan).

��The documents may be real, but unregistered. In that regards, involve a lawyer to carry out requisite checks at the Land Registry.
