PropertiesThread With Caution On Government's Land by Treash(op): 1:27pm On Mar 27, 2019
Every land in Nigeria is subject to governor's trust, except in rural environment. Most pple unconsciously build homes, edifice and permanent structures on lands subject to government acquisition. The effect of this leads to subsequent demolition notice by the government without Compensation after many years, then shocks and depression set in. The question is, are the government justified in refusing compensation? Yes. That is why you need to verify the true title of the properties, whether land, estates or companies you are buying or contact us. Many properties are on sale because they are on lands subject to acquisition. Land victims of such wl always exist, but you are to decide whether to join them or not.

PropertiesThe Cheapest Site In Ogun State To Buy Properties. by Treash(op): 10:59am On Mar 27, 2019
Ogun State is a place where you can buy and resell at higher profits. Especially cooperative society, individual, companies, and associations can jointly buy in acres at cheaper rates and make profits if they want to resell.
Therefore, acres of land are ready for sale at Atan, Ota, Ogun state. #1,200,000 per acre, not negotiable. It's a new developing site.

PropertiesHow To Serve Quit Notice In Lagos State by Treash(op):
The Lagos State Tenancy Law 2011 provides that parties can provide for how a notice to quit can be given in the tenancy agreement, however, when there is no such provision, the law provides that:-

a week’s notice for a tenant at will.
one (1) month’s notice for a monthly tenant
three (3) month’s notice for a quarterly tenant
six (6) month’s notice for a yearly tenant.

It’s important to note that when the tenancy is for a fixed period (e.g. one year) and such period has expired but the tenant refuses to give up possession, if the landlord intends to recover possession, he shall serve a seven (7) days written notice of his intention to apply to recover possession, without the 6 months statutory notice. Such notice will be classified as properly served when handed to the tenant in person; to an adult residing on the premises; by courier to the address or posting same on a prominent part of the premises.

Upon expiration of the 7 day ultimatum, if the tenant still refuses to give up possession, the landlord may file a claim for recovery of possession against the tenant in the magistrate court or high court where the premises is located.
A court can also order possession if the tenant is in arrears of rent; has breached any covenant in the agreement; where the premises is required for personal use by the landlord and where the premises requires substantial repair. A court shall also have power to make an order for possession upon proof of facts that; the premises is used for immoral or illegal purposes; has been abandoned; is unsafe and constitutes a danger to the public or the tenant simply constitutes a nuisance.

CrimeLegal Age For Sex In Nigeria. by Treash(op): 5:49pm On Mar 20, 2019
For the purposes of determining the legal age of sexual consent, we shall be relying on the provisions of the Child Rights Act (2003). However, we must understand that the in 2003, Nigeria adopted the Child Rights Act to domesticate the Convention on the Rights of the Child. Although this law was passed at the Federal level, it is only effective if State Assemblies also enact it.
To date, only about 16 of the country's 36 States have passed the Act. The Act aims to promote and protect the rights of children and it is quite important that other states in Nigeria yet to adopt same do so in the interest of the children of that state.

With regard to sexual intercourse with children, the Act provides in Section 31, that-

(1) No person, shall have sexual intercourse with a child.

(2) A person who contravenes the provision of Subsection (1) of this section commits an offence of rape and is liable on conviction to imprisonment for life.

(3) Where a person is charged with an offence under this section, it is immaterial that—
(a) the offender believed the person to be of or above the age of eighteen years ; or
(b) the sexual intercourse was with the consent of the child.

Invariably, it doesn't matter whether or not the consent of the girl child was sought before sex. The age bracket will be well considered.

PropertiesRelevant Places Where Land Search Can Be Conducted. by Treash(op): 5:04pm On Mar 20, 2019
Search at the Lands Registry
The Land Instrument Registration Law of each State establishes a land registry for the State, where documents relating to land within the territory are kept, and it varies from one State to another.

Search at the Corporate Affairs Commission (CAC).
This is necessary where the vendor or past owner is a company incorporated under Companies and Allied Matters Act. Apart from the searches at the land registry, there should be a further search at the CAC to reveal whether or not there is an encumbrance or any charge whatsoever on the property.

Companies are required to file annual returns or report yearly with the CAC which is always accompanied with a company’s financial statement; the financial statement will reveal the company’s assets including lands(where there are any) as well as any negative issues on the land.

To be continued...

PropertiesLegal Restrictions Attached To Lands In Nigeria. by Treash(op): 12:59pm On Mar 17, 2019
There are certain factors guiding land transactions in Nigeria, especially before you pay.

1. Before a party can sell land to another, the consent of the Governor of such State is required. However, a property with an initial C of O needs no governor's consent, because both documents originate from the State government. Simply put, C of O and Governor's Consent have the same effect. But where the owner of a land with C of O sells same land to another person, such subsequent buyer must process his application for Governor's Consent. This is because the initial C of O carries the name of the previous owner.

2. Under the law, a person under the age of 21 (twenty-one) cannot be granted a Statutory right of occupancy. This implies that a C of O or permission to own land cannot be issued to a child below 21 years.

3. Without the approval of the National Council of States, a non-Nigerian cannot be granted a right of occupancy. This implies that a non-Nigerian cannot be given license to own land in Nigeria, except with the written approval of the Council of State.

4. Where a land belongs to a community or family, the consent of the family head or community head must be obtained before there can be a valid sale. Any sale of family or community land without the consent of the head of that family, such a sale is invalid. Any sale of community land without the consent of the Community Head, shall be set aside.

5. Covenant in a lease may also restrict the sale and transfer of land. For example, if a property is leased/rented, the written tenancy agreement is to the affect that, you are not permitted to sell the property leased to you.

6. The law also state that, any land owed by a Nigerian Coal Corporation cannot be sold except with the written permission of the Federal Minister in charge. This implies that, for example, before we purchase any property belonging to a Federal agency like NNPC, the consent of the Minister must be sought and obtained, else the sale wil be invalid even after you build on it.

7. Town planning laws may also restrict the sale of certain lands where the purposes for which they are intended to be used are contrary to the purposes of town and planning laws. For example, an industrial place designated for such industrial purpose should strictly be abided to rather than using it for something else like residential or religious purpose.

8. In Lagos, the law states that the sale of any land which the Lagos State government has marked for road construction or demolition shall be in nullity. This means that once a land is marked for road purpose or demolition, such land is not permitted to be sold for use.

9. Doctrine of ‘ Lis Pendis’ : This means that once a land matter is in court between two parties, no one is allowed to sell/buy such land until the case has been concluded and final judgement is given.

In this regard, I urge you to carry out your due investigation and search before purchasing any property in Nigeria.

PropertiesCauses Of Structural Collapse Of Buildings In Nigeria. by Treash(op): 10:52am On Mar 15, 2019
Structural Design Handled by quacks.

Building designs are usually handled by qualified structural engineers who are normally trained and certified by relevant professional bodies like NISE and COREN. This is a fundamental aspect of every building and construction process. Absence of these means a lot can go wrong from the very beginning and cause structural damages that can lead to lost of life and other un-intended consequences.

Absence of soil test.

The importance of soil test in any building and construction activity cannot be over emphasized. Soil test enables the builders to determine soil strata, foundation type and where to lay the foundation for the building proper.

Places like Lagos has swampy grounds and many estates are built on recovered grounds a. These means that the foundation of such buildings needs to be strong and carried out after a proper soil test.

Absence of this have led to many avoidable building collapses that we have witnessed in this part of the world in recent times.

Lack of adherence to building specification by personnel.

Every building and construction projects normally have sets of design specifications that the professionals ought to adhere to. Some of these design specifications includes architectural design, M and E design, structural design and the survey plan.

Adhering to the specifications contained within these documents, will ensure that the building comes out exactly the way it should and is not subjected to abuse by future builders.

The use of sub-standard building materials.

This is a very important factor which is all about actual implementation of all that’s contained within the building and construction design documents.

The lure of short cuts and greed to make quick gains, has lead to the upsurge in the use of sub-standard building materials by building contractors which has contributed to great extent in the recent upsurge of building collapses that we have witnessed in this part of the world. The above can be checkmated through the implementation of proper quality control by project site supervisors.

Professional negligence.

Professional negligence hinders work progress, causes improper documentation, non-compliance to all necessary requirement and ultimately compromises standards.

By professionals, we mean the builders, the town planers, the estate surveyors, the architect, the engineers and the quantity surveyors who are trained and are directly involved in the entire construction process.

What if everything from the design and materials needed for the projects are all in place and then the workers find’s themselves making one mistake to the other? normally due to absent of trained /skilled professionals and proper synergy between all involved in carrying out the building process. Synergy between building professionals, will bring to reality the ideas of the client. It will also ensure proper checks and balances require to carry out proper work and that workers in the lower end of the construction process, uses the right materials and in the right ways .

Bad construction practices.

All that we have listed above so far, amounts to bad construction practices it now left for Building professionals to adhere to the standards of the industry and for the industry regulators to do their job, in ensuring that every building and construction projects in this part of world, follows all the rules within its book. Doing this will not only ensure we all live in safety, but save the nation of needless and preventable lost of life’s that we witness on a daily basis in this part of the world.

Essence of Caveats on Properties sought to be sold

A lot of Land sale adverts and posts have swept off the internet by self acclaimed Estate agents and companies with juicy offers and cheap prices. In the circumstance, prospective buyers are in a bid to procure the land unverified. May i relate with you that once you make your payments, the estate companies with default land documents then move to the next available victims, leaving you to engage in unwarranted expensive court litigation.
Before you engage in a landed transaction, make sure you secure the attention and legal advice of a real estate solicitor to help in negotiation, search, verification, and probably proper execution of your final documents. Dont be appeased by a mere receipt as its inadmissible in court as a proof of title to land. Though the lawyer will charge his professional fees, but its quite unquantifiable to the subsequent loss you will incur on the entire land, when you have realised the land is fake.

For further enquiries, contact any of your lawyers or you can rather reach us on 08068088866.

Christians are very good at throwing away that part of the scripture that don't favour them and embracing those that favor them.

Whatever happened to 1 Corinthians 14:34 "Women should be silent during the church meetings. It is not proper for them to speak. They should be submissive, just as the law says"..

These days them no just dey talk.. They even dey climb pulpit..

So, my question to the pastors in the house goes thus.. Why do we Christians choose what to obey and what no to obey from our book of instructions
You are wrong. Women are also to preach in church. The Bible says "Your sons and daughters will prophesy" Joel 2:28.

LEGAL GUIDE TO BUYING PROPERTIES IN LAGOS.

STEP 1 – DECIDE ON A BUDGET AND LOCATION
Buying a property is a big step involving a substantial long-term financial commitment, so think hard about what you can afford. Also, if you intend to live in the property, then you need to be sure that it is in a location you are happy at and can be for a very long time. Once you decide on a budget and location, then you are good to go and you can move on to the next step.

STEP 2 – HIRE A COMPETENT LAWYER
Not all lawyers are experts in property transactions. It is not enough that you hire a lawyer, yes all lawyers have some idea about property law, but there are some issues which someone who is not a specialist in property matters would easily miss.

STEP 3 – LOOK FOR THE PERFECT (OR ALMOST PERFECT) PROPERTY
Once you hire a lawyer, the next step is to begin the search for properties which match your budget and location. At this point, you can engage the services of an estate agent, the estate agent will look for properties which match your criteria, create a shortlist for you, and then organise for you to view the properties shortlisted. Your lawyer can also assist you in recommending a trustworthy estate agent, if your lawyer is involved in many land transactions.

STEP 4 – INVESTIGATING THE SELLER
This stage is where your lawyer begins his/her work fully, the lawyer will conduct the proper searches, ask the right questions, and request for the right documentation to determine if the person you are speaking to about the property in Lagos, is the real owner. This is EXTREMELY important especially when the property in question is family land.

STEP 5 – INVESTIGATING THE PROPERTY
At this stage, your lawyer will also play a big role. The lawyer will conduct the relevant searches and examine the appropriate documentation to ensure that the property is free from any encumbrance or pending litigation, that the property is not the subject of any Government acquisition, and that the property is not subject to any overriding interests

STEP 6 – VIEW THE PROPERTY
At this stage, if you have confirmed that the person you are dealing with has title, and the property is free from any issues, then you should visit the land to physically inspect it. At this stage you want to ensure that the land and the environment meet your expectations. It is also advisable to conduct a site visitation with a registered surveyor who will look at the survey plans and advise on the property as well.

STEP 7 – NEGOTIATION
Here both the buyer and the seller have satisfied themselves that the deal can proceed, it is now a matter of agreeing on an acceptable price for the land. Your lawyer will be very instrumental here as well, as the lawyer will also be able to give you a solid indication of what future liabilities will exist for you (stamp duty fees, other government fees).

STEP 8 – DOCUMENTATION
If the negotiation goes well and the offer is accepted, then your lawyer (and the seller’s lawyer) can move to the stage of drafting and negotiating all the completion documents. In land transactions in Lagos, there are 3 main documents – the contract of sale, the receipt, and the Deed of Assignment. The lawyers will deal with this, and ensure that the interests of both parties are addressed.

STEP 9 – COMPLETION, EXCHANGE & POSSESSION
At this stage, the buyer and the seller have signed and exchanged contracts, and the buyer is now in possession of all the original title documents and transfer documents. The purchase price of the property has also been made at this stage. Once all that is complete, the buyer becomes the owner of the property and can take possession

STEP 10 – POST-COMPLETION
Once the buyer has taken physical possession of the property, the next step is to file all the necessary documentation with the appropriate government authority and then commence the process to obtain Governor’s consent of the transaction. Once Governor’s consent is obtained a Certificate of Occupancy is issued, and the property transaction is then complete.
