LAGOS — The Nigerian Governors Forum (NGF) is proposing a bill to amend the constitution that would incorporate amendments to the existing revenue sharing formula. Governor Chibuke Amaechi, Chairman of the NGF who disclosed this in a session with journalists has also disclosed the commitment of all governors in the country to conduct local government council elections as a way of sustaining the democratic system of governance at the grassroots. While noting ongoing anti-corruption efforts by federal anti-corruption agencies, the Rivers State Governor noted that all the efforts would amount to failure so long as federal level which controls more than half of the federation account is not brought into searchlight. The session with Amaechi in Abuja was against the background of the fourth anniversary of his first inauguration on October 26, 2007 following the Supreme Court judgment that validated him as the Peoples Democratic Party, PDP gubernatorial candidate in the April, 2007 gubernatorial election. Asked on the agitation for a change in the present revenue formula by some governors, he said: “We are working with the President in that regard. Currently what we have done is that we are pursuing constitution amendment. The Governors are meeting in that regard, we have met up to some point. “We are bound to hold a second meeting and by next week or thereabout, we should hold a second meeting to conclude on all the issues and send a bill, a private member’s bill on the amendment of the constitution to the National Assembly.” Asked on the specifics of the proposed constitution amendment, Amaechi refused to reveal but subsequently hinted at an amendment of the revenue formula. “What we are saying is that we have a position. We will articulate that position in the next meeting we have and then come up with an amendment bill and send to the National Assembly.” Governor Amaechi, however, disclosed the commitment of all Nigerian Governors to ensure complete implementation of democratic system of governance at the local government level. In that direction he said that all Governors had resolved to ensure that local government council elections are held in all the states of the federation. “At the Governors Forum we have resolved that in the next few months Governors who have not conducted local government council elections should endeavour to do that and all Governors are very willing to conduct elections. Lagos has just finished their own.” Asked on his assessment of the anti-corruption battle being waged by federal anti-corruption agencies, Governor Amaechi speaking in metaphor said: “So, if the EFCC is serious about fighting corruption they should focus on the 52% and once they can stop corruption in the 52%, then they have passed. Even if they stop corruption in the 26%, they have not passed .” “For EFCC to investigate 26% they have to take transport from here (Abuja) to the state they are going to, they have to book accommodation and they have to do everything possible to look for the 26% including going to London, going to Abuja looking for the 26%.” “Now, even taxi can take them to the 52%. They abandon the 52% completely and begin to look for the 26% that is located in Rivers State, Sokoto or Lagos or Imo. You have no need to vilify the Governors. If you are serious about corruption, eliminate corruption in 100% of the economy or if you cannot, focus on the 52% because if you succeed in the 52%, what have you done? You have passed!” “If you make 100% of the 26%, you have still not passed your exam, it is a re-sit. That is the argument. We are helpless victims of the ruling class who have always wanted to be Governors.” http://www.vanguardngr.com/2011/10/revenue-formula-governors-propose-bill-to-amend-constitution/ |

Ever since the Arab spring started in December 2010,a particular question has been coming to my mind frequently which is North Africa countries like Egypt, Tunisia, Morocco, Algeria and Libya part of Africa(Black) or Arabs nations geographically or politically. Reasons for my question: 1. North African countries people don’t look black but more of Arabs, speak and write Arabic language officially. 2.When UN wanted to authorized a NO - FLY – ZONE in Libya it seek the support of Arab League and not African Union before NATO started air attack on Libya 3. All North African countries are Islamic nation unlike other African (Black) countries with a mix of many religions officially. 4. No Egyptian, Tunisian, Moroccan or Algerian was killed by the rebels because they all look alike but Nigerians and other Blacks were killed because it was alleged that they were mercenaries of Ghadafi but no Arab mercenaries was killed 5. Whatever happens in North Africa is replicated in other Arab countries e.g,the Arab spring started in Tunisia and now it is in Syria, Yemen, Bahrain and others but in no other African (Black) country. 6. Ghadafi wanted to be King of Kings in Africa because other Arab countries isolated him especially Saudi-Arabia. Your candid answers will enable me understand who North African people are because each time I try, I end up more confused. |

An Abuja high court sitting at Apo, yesterday, declined to quash the 17-count criminal charge that was preferred against the former Speaker of the House of Representatives, Mr. Dimeji Bankole and his erstwhile Deputy, Usman Nafada Bayero, by the Economic and Financial Crimes Commission, EFCC. The court okayed the duo for trial on the premise that the proof of evidence tendered against them by the anti-graft agency, established a nexus between them and the offence they were alleged to have committed. Ruling on two separate preliminary objections raised against the trial, the presiding judge in the matter, Justice Suleiman Belgore, yesterday, said he was convinced that the accused persons have explanations to give pertaining to an alleged N40 billion loan scam that culminated to their arraignment on July 13. EFCC had in the substantive charge before the court alleged that the accused persons, being entrusted with House of Representatives’ Account No. 00390070000018 with the United Bank of Africa, Plc and the Overhead Account of the House of Representatives with First Bank of Nigeria, Plc, properties of the Federal Government of Nigeria, dishonestly used the accounts to obtain loans totaling to about N40 billion. It equally accused them of breaching public trust by agreeing to approve the allowances and ‘running costs’ of members of the 6th session of House of Representatives, in violation of the approved remuneration package for political, public and judicial office holders by the Revenue Mobilization Allocation and Fiscal Commission, as well as, the extant Revised Financial Regulations of the Federal Government of Nigeria, 2009. The said crime which they allegedly committed contrary to section 97(1) of the Penal Code Act, Cap 532, Laws of the Federation of Nigeria (Abuja) 1990, is punishable under section 315 of the same Penal Code Act. Dismissing their request for the charges to be quashed as lacking in merit, the high court yesterday maintained that it has the requisite jurisdiction to try them over the matter, even as it gave the prosecution the nod to call witnesses against them on November 21. “The accused persons are facing trial on allegations bothering on conspiracy, theft and breach of public trust. They were leaders of the House of Representatives at the material time the subject matter of litigation before this court arose and they participated in all the activities relating to the secured loan. “The 1st accuse is alleged to have given approval for it. Having gone through the proof of evidence before me, it is my view that there is sufficient link between the two accused persons, the witness statements and other relevant documents before this court. “The cause of justice will be better served if this case proceeds to trial. This application is therefore lacking in merit and is hereby dismissed. The charge cannot be quashed and it is not quashed” the judge held. Justice Belgore equally dismissed contention of the former Speaker that the EFCC was bereft of the statutory powers to delegate authority to a private legal practitioner to prosecute offences created by or under the Penal Code Act in any court of law, without firstly securing the FIAT of the Attorney-General of the Federation, AGF. “Is FIAT a sine-qua-non for a private legal practitioner to prosecute? I make bold to say no. Under section 174 of the 1999 constitution, any person can initiate or undertake to prosecute with or without the FIAT of the AGF. “The office of the AGF no longer has the monopoly of prosecution and any legal practitioner has the right of audience before any court of law in the country so far such practitioner is found worthy in accordance with the Legal Practitioners Act, he has the constitutional right to prosecute a criminal matter in court. “However, the only caveat is that the AGF has the power to take over the proceeding at any stage before judgment is delivered and determine whether to continue or discontinue with the case. “In the instant case, the AGF is still in office and has not taken over the matter from the EFCC. I hold that Mr. Festus Keyamo is legally qualified to prosecute this case and therefore the application by the accused applicant failed”, the judge held. Ruling on another application by the former speaker seeking the disqualification of the EFCC lawyer from the case on grounds that, Keyamo ab-initio wrote petitions against him whilst he was still in power, the trial judge relied on a Supreme Court decided case law in Fawehinmi V. Akilu, reported in the 4 NWLR, 1987, and held that for a prosecutor to be able to prove his case effectively, he ought to show elements of bias against the accused person. The judge said the accused persons should not worry over the perceived negative disposition of the prosecuting counsel towards them, saying the only bias that is of significant consequence in a criminal proceeding is that of the judge. According to him, “a prosecutor need not be completely free from bias once he accepts the brief of the matter, I cannot see from any decided case where either the apex court or any other court for that matter, said the prosecution must be unbiased.”. Immediately the rulings were delivered yesterday, EFCC told the trial court that it intends to call five witnesses against the accused persons. Consequently it was given one clear week starting from November 21, just as the judge expressed his determination to deliver judgment on the matter before December. It would be recalled the Bankole and his deputy had approached the court begging it to quash the 17 count charges against them. They had challenged the competence of the suit, contending that no court has the jurisdiction to try them over actions they perfected while exercising their powers as the speaker and deputy speaker of the lower chamber of the legislature. http://www.vanguardngr.com/2011/10/n40bn-scam-bankole-nafada-lose-bid-to-stop-trial/ |

ATLANTA — A Nigerian woman was sentenced Thursday to more than 11 years in prison for enslaving two young women from her country to work as servants and nannies at her home, forcing them to cut her lawn by hand and beating them ruthlessly when they crossed her. Bello was convicted during a weeklong trial in June of luring the two women to her suburban Atlanta home with promises of sending them to school, then dashing their hopes by forcing them to work demeaning chores and beating them with wooden spoons, shoes and cords when they didn’t heed her orders quickly. "Any human trafficking crime is shocking, but the facts of this case were particularly shocking. She tricked them into coming to the U.S. and then not only enslaved them but seemed to be gratuitously cruel," U.S. Attorney Sally Quillian Yates said after sentencing. "It goes beyond just being a crime. This was disgusting." The two women were both enslaved separately, but their cases mirror each other. The first victim, identified in court papers as "Laome," travelled from Nigeria to Bello’s place in October 2001 when she was 17 years old. She managed to escape after more than a year when another woman concealed her in the backseat of her car and sped away. Prosecutors said Bello then travelled to Nigeria for a second victim, "Dupe," who arrived at Bello’s place in November 2004 when she was about 20. She also was enslaved for more than a year, fleeing after she squirreled away $60 to hail a taxi that took her to a nearby Methodist church, where pastors helped her to freedom. Both women told prosecutors that Bello beat them for not cleaning her home, smacked them when they talked back, and hit them when they didn’t rush quickly enough to her daughter. One of the women secretly snapped a picture of the bloody lip she suffered from a beating with a disposable camera she hid, and the photo became a key piece of evidence at trial. The women were forced to bathe using a water bucket and often ordered to eat spoiled or mouldy food even after cooking Bello a hot meal, prosecutors said. Once, Laome said, Bello made her eat her own vomit. They were also kept busy with endless chores, washing their clothes by hand in a bucket and cutting her yard by hand even though a lawnmower and washing machine sat untouched nearby, according to court records. If they dared speak of leaving, or even contacting their families in Africa, Bello threatened to turn them into police for being in the country illegally. "She said if I left I would go to jail. I didn’t have any money, I didn’t know anybody and I didn’t know any English," Laome said after the hearing. Defence attorney Suzanne Hashimi told the judge Bello grew up with an abusive family, a father who scorned her, and a mother too poor to support her. She was sexually abused and forced to have an abortion, she said, and even though Bello was sent to school in London she never recovered from the trauma. LONDON (AFP) – The head of the company that makes BlackBerry smartphones admitted Thursday he could not say when its services would return to normal after three days of outages, but said progress was being made. Mike Lazaridis, the president and founder of Canada-based Research in Motion (RIM), used a video message to apologise to the millions of BlackBerry users worldwide who have been starved of instant access to emails and messaging. The firm said services in Europe, the Middle East, Africa and India were returning to normal, although disruptions remained in the United States and Canada — which first experienced problems on Wednesday — and Latin America. “Since launching BlackBerry in 1999, it’s been my goal to provide reliable real-time communications around the world. We did not deliver on that goal this week, not even close,” Lazaridis said in a video on the RIM website. Speaking on the fourth day of disruptions, which the firm has blamed on a backlog of emails caused by an initial technical failure, he said: “I apologise for the service outages this week. We’ve let many of you down.” Lazaridis added: “I’d like to give you an estimated time of full recovery around the world, but I cannot do this with certainty at this time. For those of you affected I know this is very frustrating. “We’re doing everything in our power to restore regular service levels, and we’re working tirelessly to restore your trust in us.” He said BlackBerry services were now “approaching normal” levels in Europe, the Middle East, India and Africa, although an earlier RIM statement said that problems persist in the Americas. “Service levels are also progressing well in the US, Canada and Latin America and we are seeing increased traffic throughput on most services, although there are still some delays and services levels may still vary amongst customers,” said the statement, posted online at 0430 GMT on Thursday. RIM said on Wednesday that an initial technical failure had prompted a build-up of messages in its network, triggering a cascade of problems around the world that affected many of the firm’s 70 million subscribers. “It is a backlog issue,” RIM software vice president David Yach said, ruling out any rumours of sabotage or hacking. The technical failure reportedly took place at the company’s British hub in Slough, a town west of London. RIM claimed on Monday the issue had been resolved, but the glitches spread, sparking outrage from BlackBerry users worldwide. The problems represent a PR nightmare for RIM, which has faced weaker sales of the BlackBerry compared with smartphones made by Apple or those running Google’s Android software. The timing is particularly bad ahead of Apple’s launch on Friday of the latest iteration of its top-selling smartphone, the iPhone 4S, in key world markets. Major Asia-Pacific markets such as Australia, Japan and South Korea have been unaffected for the most part, but irate users in China and India have reported widespread outages this week. Much of the anger has been caused by a lack of information about the problems, which Lazaridis acknowledged. He promised to update users more frequently through its websites and social media channels. Although RIM reported an improved service in India on Thursday, Manoj Bhoj, a marketing executive in India’s financial capital Mumbai, complained of a “communication gap” from the Canadian company. “We have to update clients with reports and haven’t been able to do so. I just hope it doesn’t happen again,” he said. There was less sympathy towards RIM from some commentators on microblogging sites in China. “The BlackBerry is junk. Forget it, I’ll use an iPhone,” BlackBerry user Hun Lingshi wrote. http://www.vanguardngr.com/2011/10/blackberry-chief-cannot-give-date-for-service-resumption/ |

The idea of opening Almajiri schools in the northern part of the country may seem to be a good idea in the face of it, but the reality is that this project may not be the ultimate solution to this problem which has proven to defy solution for decades. One of the reasons why this has continued to show its ugly face was that we have been fighting the smoke and never attacking the real fire. Almajirci is accepted in Islam, but the way it is being practiced in Nigeria is wrong. Learning the Islamic religion is a must for all Muslims especially the young ones, but one does not have to leave their domain to be able to obtain this knowledge. The major part of the country that produces Almajirai is the North-western states of Kebbi, Sokoto, Zamfara, Kano, Katsina, Jigawa, Kaduna, Bauchi and Gombe. Literally, one can say it is within the Hausa-speaking states. One hardly finds a Kanuri, Fulani, Nupe, Gbagyi or the other Muslim ethnic groups involving in the activities of these young children roaming the streets begging in the name of acquiring Koranic education. The truth must be said and necessary remedies applied to this somewhat ugly situation. Islam does not promote poverty. Why is it that only the Hausa blind, leper, an amputee, a cripple and poor person that roam the streets of this country from North to South? Other Nigerians have persons of similar disabilities, why don’t they occupy the bridges of our cities like the Hausas do? It is a shame to notice the contingents of beggars together with the so-called Almajirai at various cities and towns causing ugly spectacles. On a closer scrutiny of some of these beggars, it would be seen that some of them are not as poor as they pretend. It is a fact that some states in the southern part of the country have established institutions to train such youngsters, then why not make it universal? The federal government is sending some youngsters even overseas to train and integrate such people so as to turn them into useful citizens in the land. We have a Ministry of Niger Delta, is it probably time to have a ministry of Northern Destitute and Almajirai? The end product in all cases is to turn some youngsters into useful members of the society. Now, having identified the source of the problem, in the case of almajiri, the immediate solution is for the states where this problem is paramount to commence administering the medicine. The first step is to apply what two former Northerners of blessed memories kept hammering to our ears but which all concerned, the elites, traditional rulers and religious leaders always refuted. Late Mallam Aminu Kano and late General Hassan Usman Katsina said “Kowa ya koma gidan ubanshi” (Everybody should go back to his father’s house)—referring mainly to these roaming streets or Almajirai. It is common knowledge that no father will send his children begging in his village, no matter how poor he may be. Thus parents must be held responsible for the upbringing of their children and the states administrations must, as a duty, ensure the educational requirements are met as being propagated under the Universal Free Primary Education for all, irrespective of ethnic or religious bias. State governments, as responsible administrations, being elected by the citizens of their states, owe it a duty to ensure that equal opportunities are provided for all citizens in their states. So, instead of creating special schools at different locations to cater for the teeming army of Almajirai from the affected states, repatriation of these young Almajirai and the destitute to their states of origin should be embarked upon and, where necessary, together with their Mallams. After necessary compilation of their names and numbers in the affected towns and villages, the states must as a matter of urgency open up more classrooms to accommodate them for formal education so that they have an even playing field with the rest of the citizens in their states. It is at this stage that special classes must be operated to cater for those considered over-age under the normal entry system. Those considered too old for primary education should be trained under the Adult Education system (Yaki da Jahilci). Thereafter trade schools should be opened so that the products of the system can be gainfully employed as useful citizens. While the central government must come into the transformation stage, the affected states must, however, shoulder the initial responsibility of the repatriation and rehabilitation. Traditional leaders and senior Mallams need to educate the parents of those roving Almajirai that the era of sending young men to Gabas (East) to learn the Koran has gone. It is a fact that there is no village in Hausaland where one will not find a Mallam to teach all the children of that village the necessary Koranic education while they are being properly guided at their parents’ homes. The Mallams who are now roaming with the Almajiris can follow the children to their villages and be employed by the states as Islamic teachers in the expanded primary schools. Begging is anti-Islamic, except under very extreme and special conditions which when scrutinised, less than one per cent of the present beggars in our midst will qualify as beggars. It is a shame that after all the efforts made by our northern founding fathers to bring the region to compete with the rest of the country, we are still being classified as a group of beggars, because of our lack of moral courage to right the wrongs. Some of us who mixed with the rest of our colleagues from the south are still being considered as privileged few because we had the opportunity to have proper upbringing and are both educated in both Boko and Islamic systems in the then Elementary and Middle schools. Northern region was an area that even the invading British found with administrative system under the Sokoto Caliphate that they did not find necessary to change much of at that time. Boko which was concocted from the English word ‘book’ (Boko) was taught side-by-side with Islamic religion in all the then Elementary and Middle schools which we all attended, a system that got some of us to where we are today. It is time we wake-up to our responsibilities, but certainly not by creating another class out of the present ugly situation. Although one must not pre-empt the findings of the panels investigating the recent crisis after the last elections, one may find that the Almajirai and their types were fraudulently used to fan the embers of the carnage. One wonders how to identify the Almajirai that qualify to be enrolled into the proposed schools in the first instance, and what certificate do they come out with and where do we employ the ‘graduands’. Time has come for the necessary actions to correct the ills of the past. All hands must be on deck and no pointing of fingers at individuals. To educate the young northern elements and wipe out begging is a task that must be done, and the time to start is NOW. ABUJA – The Power Holding Company of Nigeria,PHCN, has announced plans to shut down five power plants across the country, a plan that will drastically reduce the present state of power generation. The announcement, which was made, yesterday, by the company may likely hurt the Federal Government’s ambition to attain about 5,000 megawatts of electricity by the end of December. Few weeks ago, government celebrated the achievement of over 4,050 Mw, marking the highest quantum of electricity generated in the history of the nation. PHCN, in a statement, said it “regrets to inform its esteemed customers nationwide of the notice received from Nigeria Gas Company Limited,NGC, of the planned shutdown of Shell Petroleum Development Company, SPDC, Utorogu and Ughelli East Gas Plants, Oben, Sapele and Ogharefe gas plants of Saplet and Pan Ocean for maintenance purposes. “This will be for seven days, commencing October 11, 2011.” The maintenance, according to NGC, will lead to complete shutdown of Geregu, Sapele, Ughelli, Omotosho and Olorunsogo power stations throughout the period, thus resulting to a cut back in generation of over 1400Mw. It added that, “This loss of generation will entail minimal load shedding in many parts of the country. “We, therefore, appeal to our valued customers and other stakeholders for understanding and support, while assuring that power supply situation will considerably improve once gas supply is restored to these stations.” http://www.vanguardngr.com/2011/10/blackout-looms-nationwide-as-phcn-plans-to-shut-5-power-plants/ |
