Apply to the County Court.

With all the evidence you have (formal report to the police, council, removed door and furniture), you will get your deposit refunded plus the legal cost of filing with the County Court (£380 or so) plus added compensation.

You don't need a lawyer.

As soon as she receives a Court summon, she will be eager to settle out of court.

My brother, i dont have the keys to the house after she changed it.
Now almost everytime i come back i have to stay outside for 1 to 4 hours until someone from the house is leaving or going inside then i follow up to enter.

Its crazy, the room is also cold with no furniture anymore as she took everything out.

You cant believe what this woman did to me on Sunday with her kids..
They came on Sunday to make mockery of me, with her two little kids of 4 to 6 years i guess..
All where insulting me and telling me how stupid I am and how I sleep in such room, man this kids where throwing insult on me with there mother to the extent that the kids later told the mother that am now looking like a depressed person that she should pity me..

It's really crazy what kind of person the woman is..
I recorded everything without her knowing my phone was on recording...
I really don't want to see this woman get away with all this act she did but I have to find somewhere else to keep my head and have a good sleep..
I have paid for a place now but I still want to collect my deposits and if possible sue her for not registering the deposit on a scheme.
Please if anyone can guide me on how to go about it, I will really appreciate it..

Using your deposit is the only solution....... Assuming your rent is £100 pw, stay for 7 weeks..........

Guys I have decided to move out and have my peace of mind.
But my problem now is that the landlord have decided that she will not give me my deposit.
Please what are the best and fast legal way I can use to get my deposit back from her?

Also she didn't register it on any deposit scheme, how do I go about it please.
Travel / Re: Living In The Uk-life Of An Immigrant (part 3) by UniqueDext: 5:40pm On Nov 24, 2023
Am sure she didn'tregistermy deposit.
Please do you know how i can follow up with deposit scheme if she failed to put it inthescheme?
Ralphlauren:

What did the police say?

Have you had a call or email response from the council regarding your complaint?

Have you contacted the charity, shelter?

She's obviously operating an illegal HMO hence why she's pretending to live in the property with her family.

I'll suggest you don't pay her the rent or pack out until she returns the door back to its hinges.

Do you know if she registered your deposit with an approved deposit scheme?
Travel / Re: Living In The Uk-life Of An Immigrant (part 3) by UniqueDext: 5:38pm On Nov 24, 2023
I already told her to fix my door and i will send her the money but she refused.

Please who know how i can go with the deposit scheme report claim please..

I have decided to go ahead and pay her, but I will pursue the deposit scheme option as it seems like dealing with civil issueslike this is kinda complicated.
toughest007:

Why haven't you paid her? Your initial post noted a few days late and till date you are yet to pay her!

You have established how horrible she is, but I'd suggest you just pay her and see how things progress. Was she this horrible before or after you delayed on your rent?

Two wrongs can never make a right!!!
Travel / Re: Living In The Uk-life Of An Immigrant (part 3) by UniqueDext: 1:23pm On Nov 24, 2023
Bro am not sure you understand.
Even yesterday i told her to come and fix my door and give me the house keys that I will pay her once did is done.
And this woman in front of me told me that am stupid and who do I think I am to tell her that..

The police just don't want to get involved but they are asking me to find a way to involve them if she break any criminal laws then that's where they can start to build up a case against her.

Viruses:

This is what I was trying to say, but it seems the guy has taken it upon himself to teach the landlord a lesson. I would leave the fight for another person except I get strength for reserve.

If you know houses that have been reposesed because of tenants refusing to pay you go approach this issue differently.
Travel / Re: Living In The Uk-life Of An Immigrant (part 3) by UniqueDext: 1:18pm On Nov 24, 2023
She didn't register my deposit to start with..
Secondly this morning i was with a lawyer about this issue and the woman came to the house and start moving my properties outside and the lawyer instructed me to call police immediately which I did..
They started CAD and ask me to start coming back home that police is coming.
Only for me to get a call few minutes later that the police won't be coming again as this is a civill matter & dispute with my landlord. Am still trying to get hold of a legal person who know how to handle this sort of things.

Yesterday I told the landlord to fix the door and give me the keys and I will pay her.
And this woman declined and said am a stupid person and who do i think I am.

The lawyer also instructed me to call shelter emergency number and report this.

Update on this issue
Today the landlady worked into my room and was like today your leaving my house and was trying to move my stuffs outside..
Immediately I picked up the phone and called the police, she started to denying that she's not throwing me out of the house..
Now what happened is that she came with her kids and trying to claim that this is her house and I have contacted the Council housing department already about her visits but I would like to know if there is any legal way I can deal with this please.

This woman thinks that I meant be scared or I don't know the law in UK, which is the reason she has been doing all this..
I can tell you that all the other tenants who has lived in this house have issues with her and that's why they leave.. including the ones that moved out from my room before I move in.. everyone 100% has issues with her and she always treating to remove their door but never did because she's also scared of what they will do to her..but in my case, she things I can't do anything because am quiet guy.
4 months ago he made new tenant who just came to the UK to go out midnight at 1AM to pay house because the person told her he has it in cash and will send it to her tomorrow when he go to bank, but this woman insisted that he must pay the money that night otherwise she will come and remove he's door...

He has always treating to remove tenant doors but never went ahead to do it until now,she did it to me..

Please I would like to know how I can take this case to court, getting lawyers and anyway I can deal with her for all the abuse and harassment.

Have you followed Ticha's advice regarding reporting to the council and checking if your landlady has a HMO licence (if the property meets HMO criteria)?

You need to inform the council ASAP. if she has the audacity to remove your door, the next thing she might do is cut off electricity or hot water supply.

She's a rouge landlord and needs to be taught a serious lesson.

Sent you a mail request now boss

Is this Landlord an African?
I doubt any Britico person that knows the law will dare do this?
Tenancy Ombudsman will not take it lightly with her.
In fact, from what she has done, you can live in that house rent-free for 4 months.
What temerity !!!!. Please don't be scared. Just keep record of all conversations and stand your ground. YOu are not an illegal immigrant.

Form S8 has to be issued to eject a defaulting tenant from a house. The process alone take several weeks/month. With Her removing your Door, She doesnt have the mouth to even approach the court. Haaa... She will beg you before you pay the next rent.
Please if you need help to deal with this Nigerian woman, consult me. I get small energy for this kind thing. People who brought their oppresive nature from Nigeria and refused to be weaned off it.

I have contacted Shelter and filled the application and everything..
Now waiting to hear from them.

Thank you so much
Ticha:

Okay few things here -
1. Contact Shelter - they're a better bet than CAB who most likely will refer you to Shelter. Shelter also has a very huge hard on for Landlords especially rogue ones
2. Do some background work yourself. Is the house a HMO? If 3 or more separate persons so you, your friend and one other person not directly related live in the house, it automatically makes it a HMO. Is that the case?
3. Is it a selective licensing area? You can easily find this from your council's website. If yes, your landlady needs to have a licence and have it displayed in the house, the house will need fire doors and a host of other things. If she doesn't have this, then she's in deep dodo. Each council also publishes a list of all HMO landlords in the area, you can search for it this way as well.
4. If it's not a selective licensing area, she still needs to meet the regulations for a HMO so again Shelter and the council.

By her behaviour, I am sure she's skirting the edges of the law in many ways. Keep every communication you have had with her via text, email, WhatsApp etc. Gather evidence to show she does not live there as she may claim you are lodgers and she lives there as well.

Unless your contract explicitly states that you are not allowed to have guests (that cannot be upheld anyway), you can totally have a guest which is what your friend was till money started changing hands for his stay. Once extra rent has been asked for, then your friend also has a tenancy there.

So you have a 2 pronged approach - use Shelter to your advantage and report to the council's housing department.

This is why she did it. She knows the police more than we do. The police are hanging on by their fingernails. Even murders go unsolved nowadays.

So sorry you have to deal with this .is the house still habitable for you over the weekend?if not you may want to book a hotel and keep the receipt. Then call citizens advice on Monday. She must be taught a lesson. What a vile creature. She must have been an agbero at home. How did she even carry the door ? Tueh

No, she does not live in the house

Already called police , they referred me to citizens advice.
Unfortunately CA doesn't work on weekends
Zahra29:

Does the LL also live in the house? Ie. It is her main residence even if she's not there all the time?

If so then it's likely that your status is that of a lodger and not a tenant. Important distinction because a homeowner can rent out 1 or more rooms in their house to lodgers, but lodgers typically have very few legal rights compared to a tenant. For example, there is no legal requirement to protect a lodger's deposit, there is no standard notice period to evict a lodger and a lodger does not have the same privacy rights e.g. the landlord is allowed to refuse them having a lock on their door.

Have you reported to the police ......
Travel / Re: Living In The Uk-life Of An Immigrant (part 3) by UniqueDext: 7:46am On Nov 18, 2023
I didn't seek her permission to sublet,

I knew that if we had to be two people in the room that i will have to pay higher price,

my friend moved in after i have already paid last month rent, due to the fact that he just arrived UK and my plan was on the next payment i will pay the new rent for both of us,
i discussed this with her last week before this issue started and we agreed that i will pay the increased rent for both of us,
The day i was supposed to make this payment was the day she came to the house and Change our house key (afternoon time) trying to lock me outside.

Less than 48hours after changing the key she came back and remove my room door, at the moment my room is open and no privacy for me.

Lexusgs430:

This your matter don get complications........

Did you seek LL permission, before you sublet .......

Did you sign any tenancy agreement........

Your starting point, head to your nearest police station and make a complaint..........

Rented directly from Landlord through flatshare website

Your LL don buy market...... 😁

Did you legally rent this apartment.......
Travel / Re: Living In The Uk-life Of An Immigrant (part 3) by UniqueDext: 7:28am On Nov 18, 2023
To answer your questios, i rented the house through flatshare where the landlord posted the room.

I called her through the contact available on flatshare , we discussed price, i then go ahead and made the payment to her account.
No contract was sign...
Details and proof are available on chart though.
rayralph:

Before you take any step,

Did you rent the flat legally ?

Do you have signed tenancy agreement ?

Did you inform the LL before taking in a room mate ?

Kindly ensure you’ve followed all due process prior before renting the apartment, so you don’t burn your hands

No, i rented the house directly from her.
Also my deposit was sent to her account.

This landlady (Nigerian o) 2 months after i moved into her house, my room key broke and i cant open my room that night, i called her to please give me spair key she has but this woman denial having any spair keys for my room , later that night at 12am she sent someone to come and lock the other room that was vacant because i meant go there and sleep that night..

I ended up sleeping in the kitchen this should November/December last year.

Behold today the same key she claims not to have , is what she was trying to use to open my door this afternoon, unfortunately I was inside sleeping and I have left my keys on the door , so she can't put her key from outside..

Tell me if this is not wickedness
dustydee:

Your landlord is wrong to have done that. Make sure you document this. Take vidoes and pictures of what she has done.
She agreed for you to have a room mate by increasing the price so no issue there. Did you rent the house via an agency? If so, contact them and make a formal complaint (use email). Also, make sure your £700 deposit was depositted with the deposit scheme. If not, na she go pay you. Let's wait for oga Lexusgs430

Please what's that agency that I can report my landlord to please..
My landlord just came to my house and remove my room door because am owning her rent which I told her she will receive within 3 days time. Now my room does not have any door and it wild open.
Rent was due on 15th & on same date she came in & change the outside door key that give access to our flat thus locking me out of the house and just today 17th she came again to remove my room door..

Please I want to know if there is any way I can sue her or claim damages before this woman is very wicked and does anything she wants, thinking that there's nothing I can do because am new to UK.
I have been in this house for over a year and I pay all my rent in full & on time but this one I ask her to give me sometime which was because my new roommate have not been paid yet from he's work & I don't have full money to pay for the new house rent as the rent was increased because we are two.

PLEASE HOUSE I NEED YOUR HELP.
