A Federal High Court on Friday in Abuja nullified the Certificate of Return issued to 10 lawmakers on the platform of the Congress for Progressive Change (CPC) representing Katsina State in the National Assembly.

Justice Gladys Olotu, while delivering judgment, held that the lawmakers must vacate the seats to pave way for the winners of the 2011 National Assembly elections from the state.

Olotu said that INEC lacked the powers under Sections 68 (1) and 75 (1) of the Electoral Act to withdraw any certificate of return from candidates who validly won an election.

HOUSE Members:
*Hon Ahmed Kaita
*Hon Salisu Salisco

The Senators along with eight members of the House of Representatives from the Katsina State’s CPC that benefited from the fraud must vacate their seat immediately.

NAN further reports that the plaintiffs, who are to benefit from the judgment, are Abdu Yandoma and Ahmad Sani, who contested the Katsina North and Katsina Central Senatorial Districts’ elections respectively.

The rest are Murtala Isa, Muntari Dandutse, Musa Salisu, Aminu Ashiru, Umar Katsayal, Muhammad Tukur, Tasi’u Doguro, and Abdu Dankama.

"INEC lacks the powers to cancel, nullify, review, withdraw, void, and invalidate either directly or indirectly, the certificates of return validly issued to the Plaintiffs consequent upon their winning the election.

"The plaintiffs, who were the candidates that contested and won the April 9, 2011 National Assembly elections, were duly issued certificates of return by INEC within the stipulated seven days allowed by law.

"Evidence before the court shows that INEC’s Returning Officer in the elections purportedly withdrew the certificate of returns and issued fresh ones to people who did not contest the elections.

"INEC acted illegally by withdrawing the certificates of return and going on to issue fresh ones to those that did not contest elections,’’ she said.

The plaintiffs had asked the court to nullify the certificates of return INEC issued to the defendants and order that the lawmakers vacate their seats in the National Assembly.
