The Economic and Financial Crimes Commission on Thursday night arrested the former Anambra State Governor, Willie Obiano at the Murtala Muhammad International Airport Lagos.

He was arrested at about 8.30pm.

This development is coming hours after Obiano handed over to Charles Soludo, who is the new governor of the state.

He was on his way to Texas, USA when operatives intercepted him. It can also be recalled that his wife, Osodieme Ebelechukwu was in the news earlier today for fighting with Bianca Ojukwu, wife of former Biafran warlord, Dim Odumegwu Ojukwu.

Obiano has been on the EFCC's radar for a while now over allegations of fraud and embezzlement.

Embattled Police Chief, Abba Kyari has claimed that the National Drug Law Enforcement Agency, NDLEA has been assisting drug dealers to bring in Cocaine into Nigeria.

This newspaper earlier reported that Kyari and four other police officers under the IRT were arrested in February for attempting to bribe an NDLEA officer with $61,000 to facilitate the release of seized cocaine.

POLITICS NIGERIA learned that Kyari made the claim in a N500 million fundamental right enforcement suit marked FHC/ABJ/CS/182/22.

The disgraced police officer accused the anti-drug agency of assisting drug peddlers to ship in Cocaine into the country. He also stated that he was ‘framed’ by a disgruntled officer of the agency after he went to demand compensation for the whistleblower that gave information that led to the arrest of a suspect.

An affidavit filed by Kyari’s brother, One Mamman Nur, rehashed the claim stating that drugs were being shipped in from Ethiopia with the ‘knowledge of NDLEA officers’.

Narrating the entire situation in the suit, Kyari stated; “That on that fateful day, the suspect as usual shipped drugs (cocaine) from Ethiopia to Enugu Airport. The officer of NDLEA cleared him within the airport, then officer of FIB-IRT arrested the suspect with the help of an information.”

“That before the informant accepted to work with the officers of FIB-IRT, they both had an agreement to compensate the informant.”

“That officers of FIB-IRT, having noticed that officers of NDLEA were the ones clearing the said suspect with his drugs (cocaine), they immediately took the suspect to NDLEA and also reported those officers involved in the act.”

“That instead of the NDLEA to handle the matter accordingly and bring their officers involved to book, they decided to frustrate the informant, thereby refusing to compensate the informant.”

“That it was at this juncture that the attention of the DCP Abba Kyari was called, who because the NDLEA officer involved is his friend, decided to intervene for the purpose of compensating the Informant.”

“That the NDLEA officer who refused to compensate the informant was the one who framed DCP Abba Kyari up on a trump-up allegation that he was trying to bribe him.”

“That the agent of the Respondent declared the Applicant wanted because of a mere allegation that he was trying to bribe an NDLEA officer without sufficient proof.”

“That the Nigerian Police Force, based on the allegation of the Respondent arrested the Applicant on February 12, 2022, and handed over to the NDLEA.”

Kyari’s bail hearing comes up on March 28th at a federal high court in Abuja.

The letter that was conveyed signalling Buni's transfer of power to Sani Bello is fake and backdated.

Section 82(1) of the new Electoral Act 2022:
Every registered political party shall give the Commission at least 21 days' notice of any Convention, Congress, Conference or meeting convened for the purpose of "merger" and electing members of its executive committees, other governing bodies or nominating candidates for any of the elective offices specified under this Act.

The Black Law's dictionary defines "shall" as
"As used in statutes, contracts, or the like, this word is generally imperative or mandatory

The Supreme Court also defined the word "shall" means.

When the word “shall” is used in a statute it connotes the intendment of the (legislator) that what is contained therein must be done or complied with. It does not give room for manoeuvre of some sort, or evasiveness. Whatever the provision requires to be done must be done, and it is not at all negotiable…” (Muhammadu Buhari v INEC, 2008) per Aloma Mukhtar, JSC (at the time)


The APC CECPC had written to INEC on Feb 02 to hold its Convention on Feb 26, 2022. Due to certain issues, the same APC CECPC wrote to the same INEC on 21st February, 2022:

“Notice for the conduct of zonal congresses”

“This notice supersedes our earlier notice for the National Convention referenced APC/NHDQ/INEC/019/22/14. This is predicated on the evaluation of our party Constitution.”

“In furtherance to Article 85 of the Electoral Act, 2010 (as amended) and compliance with Section 12(6) of our party Constitution, we hereby write to notify the Commission that our great party, the All Progressives Congress has scheduled to hold its Zonal Congresses on Saturday, March 26, 2022.

“Kindly arrange for your officials to monitor the exercise accordingly. While hoping to receive your co-operation, please accept the assurances of our highest esteem,” the notification letter read.

When the issue of adjustment is brought forward, we then x-ray the meaning of supercedes:

The Black Law's dictionary (11th ed.) 2019 define supersedes as: “[t]o annul, make void, or repeal by taking the place of.”

The letter of Feb 02 has therefore been voided. (That counters the adjustment argument)

Let us see S82(5):
Failure of a political party to notify the Commission as stated in Section 82(1) shall render the Convention, Congress, conference or meeting invalid.

NB: This Section 82(5) was not in the old Electoral Act 2010, that was why parties did it the way they liked.

In the old Electoral Act, there is no punishment when you don't inform INEC...in this Electoral Act, Section 82(5) has been added.

The Supreme Court stated in Abegunde v Ondo House of Assembly (2015) that fractionalization or division of a Political Party at any of its chapters (Ward, LG, State, Zonal) other than the National body of the Party is not a prerequisite for defection.

Only a division at the National Chapter of the Party can be a criteria for defection.i.e. to all persons not covered by Section 308.

Eg: nPDP, R-APC, etc.

So, the truth is that the National Assembly & SHA lawmakers are on borrowed time.

There are procedures of how a chairman can be removed and if it's not done that way then whatever you are doing becomes a nullity and you risk not presenting candidates in the next election

A Federal High Court in Abuja has ordered the Ebonyi State Governor, Dave Umahi and his deputy, Eric Igwe, to vacate their seats as the sitting governor and deputy respectively, on grounds that the Peoples Democratic Party (PDP) won the election on March 2019 and not its candidate.

Having defected to the All Progressives Congress (APC), Governor Umahi and his deputy cannot transfer the mandate of the PDP to the APC.

Citing section 221 of the constitution, Justice Inyang Ekwo ordered the PDP immediately send names of replacements to INEC so that fresh elections can be conducted.

Justice Ekwo also ordered the Independent National Electoral Commission (INEC) to cease from recognising Umahi and Igwe as the governor and deputy governor of the Ebonyi State.

The Federal Government has given its seven-person committee a deadline to conclude renegotiations of the 2009 Agreements reached with the Academic Staff Union of Universities (ASUU).

The committee which is chaired by Emeritus Professor Nimi Briggs, pro-Chancellor, Alex Ekweme Federal University Ndufu-Alike, has three months to conclude the renegotiation with ASUU.

Other members are Pro-Chancellor, Federal University, Wukari, Arc. Lawrence Patrick Ngbale, who represents North East; Pro-Chancellor, Federal University, Birnin Kebbi, Prof. Funmi Togunu-Bickersteth, representing South West and Pro-Chancellor, Federal University, Lokoja, Senator Chris Adighije, representing South East.

Also on the team are Pro-Chancellor, Federal University of Technology, Minna, Prof. Olu Obafemi from North-Central; Pro-Chancellor, Kano State University of Science & Technology, Prof. Zubairu Iliyasu, representing North West; and Pro-Chancellor, Niger Delta University, Wilberforce Island, Mathew Seiyefa from South-South.

The committee is expected to review the draft proposed FGN/ASUU Agreement, and has the following Terms of Reference:
a. Liaise and consult with relevant stakeholders to finalise the position of the Federal Government to the issues in the draft proposed FGN/ASUU Renegotiated Agreement;
b. Renegotiate in realistic and workable terms the 2009 Agreements with other university-based unions;
c. Negotiate and recommend any other issue the committee deems relevant to reposition the NUS for global competitiveness; and
d. Submit proposed draft agreements within three (3) months from the date of inauguration.

Justice Emeka Nwite of the Federal High Court, Abuja on Monday adjourned the trial of Abba Kyari and six others till March 14.

Mr Kyari is expected to remain in the custody of the National Drug Law Enforcement Agency until he reappears in court at the adjourned date for his bail hearing.

Mr Kyari, before his suspension, was a former Deputy Commissioner of Police.

Those arraigned along with Mr Kyari include Assistant Commissioner of Police ACP Sunday Ubua, Assistant Superintendent of Police ASP Bawa James, Inspector Simon Agirigba, Inspector John Nuhu, Chibuinna Patrick Umeibe and Emeka Alphonsus Ezenwanne.

In court on Monday Mr Kyari pleaded ‘not guilty’ to the eight drug trafficking-related counts brought against him by the NDLEA.

While the other four senior police officers also pleaded ‘not guilty’, the two civilians in the trial – Chibuinna Patrick Umeibe and Emeka Alphonsus Ezenwanne – pleaded guilty to counts five, six and seven.

Shortly after the defendants entered their plea, the NDLEA, through its Director, Prosecution & Legal Services, Joseph Sunday, applied for trial date and for review of facts in respect of the defendants that pleaded ‘guilty’ to the charge.

The NDLEA equally told the court that it filed a counter-affidavit to oppose the release of Kyari and the other four former members of the Police IRT, on bail.

The defence counsel, Kanu Agabi, while arguing that the charge against the defendants contained bailable offences, urged the court not to accede to request for facts in respect of Umeibe and Ezenwanne as it will be prejudicial to his client for facts of the case to be reviewed and decision reached on it, while the trial is still subsisting.

He noted that both Umeibe and Ezenwanne were also mentioned in some counts in the charge that involved Kyari and the others.

Justice Emeka Nwike therefore adjourned to March 14 to hear the bail application.

Suspended police officer Abba Kyari on Monday pleaded not guilty to drug trafficking charges brought against him by the National Drug Law Enforcement Agency (NDLEA).

The NDLEA had filed eight counts of hard drugs trafficking against Mr Kyari, who is also wanted in the United States for his relationship with convicted fraudster, Ramon ‘Hushpuppi’ Abbas.

He was arraigned on Monday along with six others before Justice Emeka Nwite of the Federal High Court, Abuja.

Mr Kyari, before his suspension, was a former Deputy Commissioner of Police.

Those arraigned along with Mr Kyari include Assistant Commissioner of Police ACP Sunday Ubua, Assistant Superintendent of Police ASP Bawa James, Inspector Simon Agirigba, Inspector John Nuhu, Chibuinna Patrick Umeibe and Emeka Alphonsus Ezenwanne.

While the other defendants also pleaded not guilty to the charges when read to them, the sixth and seventh defendants, pleaded guilty to counts five, six and seven.

According to the NDLEA, Mr Kyari, between January 19 and 25, dealt in 17.55 kilograms of cocaine.

He is also being charged with obstruction of justice through attempted bribery of NDLEA officers.


See below the full details of the eight counts brought against Mr Kyari and his alleged accomplices:

Count one: “That you DCP Abba Kyari, ACP Sunday J. Ubua, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu, all male, on or about the 19th to 25th January 2022, at the office of Inspector-General of Police (IGP) Intelligence Response Team (IRT), Abuja conspired amongst themselves with ASP John Umoru (now at large) to deal in 17.55kilogrammes of cocaine and thereby committed an offence contrary to and punishable under section 14(b) of the National Drug Law Enforcement Agency Act, CAP N30 Laws of the Federation of Nigeria 2004.

Count two read: “That you DCP Abba Kyari, ACP Sunday J. Ubua, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu, all male, Adult on or about the 19th to 25th January 2022, at Abuja within the jurisdiction of this Honourable Court dealt in 17.55kilogrammes of cocaine without lawful authority and thereby committed an offence contrary to and punishable under section 11(c) of the National Drug Law Enforcement Agency Act, CAP N30 Laws of the Federation of Nigeria 2004.

Count Three: “That you DCP Abba Kyari, ACP Sunday J Ubua, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu, all male, all male, Adult on or about the 19th to 25th January 2022, within the office of the Inspector-General of (IGP) Intelligence Response Team (IRT), Abuja, within the jurisdiction of this Honourable Court conspired amongst yourselves and with ASP John Umoru (now at large) to unlawfully tamper with 21.35 kilogramames of cocaine seized from Chibunna Patrick Umeibe and Emeka AlphonsEzenwannne in the custody of the Inspector-General of Police (IGP) Intelligence Response Team (IRT), by removing and disposing 17.55 kilogrammes of the cocaine and by substituting same with some other substance and thereby committed an offence contrary to and punishable under section 14(b) of the National Drug Law Enforcement Agency ACT CAP N30 Laws of the Federation 2004.

Count Four: That you DCP Abba Kyari, ACP Sunday J Ubua, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu, all male adults on or about the 19th to 25th January 2022, within the office of the Inspector-General of (IGP) Intelligence Response Team (IRT), Abuja, within the jurisdiction of this Honourable unlawfully tampered with 21.35 kilogramames of cocaine seized from Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwannne in the custody of the Inspector-General of Police (IGP) Intelligence Response Team (IRT), by removing and disposing 17.55 kilogrammes of the cocaine and substituting same with some other substance and thereby committed an offence contrary to and punishable under section 16 of the National Drug Law Enforcement Agency ACT CAP N30 Laws of the Federation 2004.

Count Five: That you Chibunna Patrick Umeibe, male adult and Emeka Alphonsus Ezenwanne, male adult on or about the 19th January 2022 at Akanu Ibiam International Airport, Enugu Nigeria, within the jurisdiction of this Honourable Court without lawful authority imported 21.35kilogrammes of cocaine and thereby committed an offence contrary to and punishable under section 14(b) of the National Drug Law enforcement Agency ACT CAP N30 Laws of the Federation of Nigeria 2004.

Count Six: That you Chibunna Patrick Umeibe, male, adult; and you Emeka Alphonsus Ezenwanne, male adult on or about the 25th January 2022 at Akanu Ibiam International Airport, Enugu, Nigeria within the jurisdiction of this Honourable Court without lawful authority imported 21.35kilogrammes of cocaine and thereby committed an offence contrary to an punishable under section 11(a) of the National Drug Law Enforcement Agency ACT CAP N30 Laws of the Federation of Nigeria 2004.

Count Seven: That you Chibunna Patrick Umeibe, male, adult; and you Emeka Alphonsus Ezenwanne, male adult and one IK, now at large, on the 25th January 2022, at Akanu Ibiam International Airport, Enugu, Nigeria within the jurisdiction of this Honourable Court knowingly possessed 21.35 kilogrammes of cocaine and thereby committed an offence contrary to and punishable under section 11(d) of the National Drug Law Enforcement Agency Act Cap N30 Laws of the Federation of Nigeria 2004.

Count Eight: That you DCP Abba Kyari, on or about 25th January 2022, at a restaurant on Port Harcourt Crescent, Area 11, Garki Abuja, within the jurisdiction of the court, attempted to obstruct the Agency and its authorised officers in the exercise of their duties by offering the sum of $61,400.00 USD (sixty-one thousand, four hundred United States of America Dollars) to a senior officer of the Agency as inducement to prevent the testing of the
17.55kilogrammes of substance used to replace the cocaine seized from Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwanne and thereby committed an offence contrary to section 23 and punishable under section 49 of the National Drug Law Enforcement Agency Act Cap N30 Laws of the Federation of Nigeria 2004.
