honeyoluwatoyin: hi guys, am directing my iss to @justwise and @visjustice and all other gurus.... firstly lemme tell you little about me so you dont get confused. am a trader i visit dubai quarterly, a mother but not married and also presently serving my country...my cousin invited me for her graduation ceremony lastyear nov so I used my dad as my sponsor cos i got all the document a week after i got back from dubai and i didnt have much in my personal account and i had to submit the application before i enter nysc camp in nov lastyear. i submitted.The reasons for your refusals is not "silly", but reasonable. Ok, your dad owns the company, and you are using the company's bank account statement as evidence of finance: but can you say the benefit that your travel to the UK would be to the company? Please, accept my sympathy. Now, i want you to understand that my response is not an attempt to show superior proficiency in the English language, and that i gave a serious thought to it before i thought it nice to assist you in the little way that i can. Understand also that everyone makes errors in both written and spoken English, and that even those born in England do make serious blunders as well, therefore, i do not want you to feel embarrassed as this response is by no means intended to make you look bad. With these explanations given, i want to remind you that such letter (intended for an embassy) is supposed to be a formal one, and therefore, it is very important to make it as close to perfect as possible because, you do not want to give a negative impression that would cause a disdain to your calibre... Now, as much as i like to advise you that your circumstances do not seem to be suitable for a visa application given that the nature of job that you do and the method of salary/commission payment is highly suspicious and questionable, and therefore, it is utterly unacceptable according to the embassy's rules. But if you insist on your (vain) struggle, well... I have managed to make some corrections even though i too might be horribly wrong in my supposed amendments: Please, observe the highlights in Green The Entry Clearance Manager, British Deputy High Commission. Lagos. Reference Numbers: Lagos/xxxxxxx and Lagos/xxxxxxx Dear Sir/Madam, LETTER OF RECONSIDERATION I xxxxxxxxxxxxxxxxxxx with my brother xxxxxxxxxxxxxxxxxxxx applied for Entry Clearance to the United Kingdom to attend our late brother’s funeral , he passed away on the 13th of June 2014 after suffering (from) a rare kind of cancer. In 2013, we were denied the right to travel to the UK to see him when he was critically ill , and recently , we were denied visa again to see his body and to pay him our last respect. Our mum has been so depressed since the demise of our brother , and our father who passed away on the 9th of May 2014 , and now, our grand mother just passed away on the 19th of August 2014 . In this time of our bereavement, we need to be with our mother. She has been having nightmares and crying every night. According to her doctors in the uk, she suffers high blood pressure, she needs us to be by her side to mourn these losses. Please find below the explanations in brackets for the reasons of refusal: The Entry Clearance officer refused our applications majorly on the reasons of being refused the UK Visa when we applied in 2013 as family members of an EEA national. (We can now boldly say that our circumstances have changed, we are now gainfully employed. We live more comfortably and we do not need the financial support of our parents) The ECO doubted the relationship between us and our late brother (that is heart breaking) The ECO stated that in our previous application , we did not name him as our brother when given the chance to list the, ‘EEA national and other family members’. (This is not correct; in our previous application in 2013, we did name him as our brother, he had a permanent residency in the UK, we also mentioned he was critically ill at that time. To prove this, I have provided a copy of that application form. In addition, pictures of family ties while we were growing up together in Nigeria were provided, also a copy of our brother’s birth certificate which is similar to mine was provided). The Second reason was that we did not demonstrate that we are in receipt of our stated salary : (that made me feel so disappointed at the decision of the Entry Clearance Officer, It is stated in my employment letter (which I provided) that my salaries and commissions are paid in cash, sometimes my employer owes salary and commission over a period of time, and sometimes they pay me in cash or pay a lump sum of money into my account). The Third reason, the ECO considered our past circumstance and concluded that we would not be able to afford this trip without a third-party's financial support. (I do not understand what the ECO meant by this, in our application , we stated that our mum will be the major sponsor of this trip. I have provided genuine proofs to show that there are enough funds available from our mother , and in addition, my personal bank statements. More also, I have a better life here in Nigeria, I have two lovely kids in Nigeria who are still under seven years. Therefore, i do not intend to remain in the UK) The Fourth Reason of refusal was similar to the reason above. In the light of this, (We provided the tenancy agreement of my mum’s accommodation in the UK which we will be staying for the period of this short visit) Please spend a few moments looking into my underlying facts that may make you reconsider the decision. I hope my appeal will be looked into on compassionate grounds. I am only a phone call away should you require additional documentation which will assist you in reversing the original decision. (i) Provided a letter from my employer stating the mode of receiving my remunerations. Danito2: Hi fres bros......i got refuse recently becos i didnt demonstrate correspondence to my uk sponser,shes my friend.and the second one is that i state in my intro letter that am a student of kings college buh i didnt state the state and finish of the course i am doing so he is not satisfy that the course i am doing is strong tie for me..second one is i attach my fathers statement business accounts and personal accounts,the money in it was about290,000 naira,but the officer said he is not satisfy becos he dont see the origin of the fund in my accounts...buh right now i am apply again,my uncle is a miner gold miner and he got redunancy recently last month so he has been paied abt 58,000usd into his accounts last month which show thats AGA redunancy shown on the bank statement will they think its money lodgement?and my uncle is on redunancy can he sponser me what documents do i need from him now?shuld i attach my daddies business statement and personal statement to attach it as joint?and with the first and second reason how should i do the correction?thanks for ur time big bro please i need help.Are you serious? Everything is wrong with your application and the circumstances surrounding it: observe the highlights, they are awful blunders. Please, there is no need to ask how to correct them because, i can't see that possible at the moment as you don't seem to have any serious reason to want to travel to the UK except that you want to "jand" that's to "check-out from Naija" |

Things are easier when done orderly, it is better to take your time to get everything organized than to try to outsmart the system. Man, if you don't declare your marriage NOW, and you manage to get a VISA by declaring yourself a single man, you will get yourself into a very serious regrettable trouble that would give your wife no reasonable ground to fight for you. Danito2: Thanks your advice help.buh is utility bill okay to prove his resident,because his tenancy agreement shows only 1bed room bangalow,maybe the office will say there is no room for me,or what do u think,will the utility bill helpHe can't accommodate you as he doesn't have enough rooms in his apartment therefore, it is irrelevant to talk about tenancy agreement. |
Danito2: Yeah have got all the list of the requirements of the visa u posted.i got the invitation from my uk sponser very good letter and also passport page proving shes citizen..buh she hasnt sent me her tenancy agreement or any utility bills,buh she said i should send the two of them only its enough.guys what do u think guys,is the invitation letter and the passport biodata page enough for me to add my supporting documents?The two documents that she gave you would be enough if you are lodging in a hotel, but if you intend to stay with him in his residence, that is whe you need these other stuff |
basica7000: pls moderator permit me to derail from d the thread.....The reason that you gave here is satisfying enough to convince the immigration officers, just explain same to them with your onward flight ticket evidence and you should be fine. |
3sha4lyf: My take, put all the relevant docs u have, back them with supporting docs from the German host, include ur previous works or any previous awards, (German embassy may not require too many documents but you might want to highlight past and previous awards and achievements or the likes in your additional info section). I think you should be fine. All applications are delay with in their own merits so, just tidy your side well. You might wanna start by listing docs you already have from your sponsor. Hope this helpsNot a bad suggestion, but remember that the rules are the rules, and they are there to observe. Germany is a Schengen country, and therefore, it observes Schengen regulations which requires that a business must have tax compliance certificate, and also that a bank statement must have at least 6 months old transaction records. Even if they give him grace in respect to the deficient bank statement, I don't see how he can get through with a business that hasn't complied with tax regulation: a business which is apparently registered in a hurry to get a visa. |

nickson03: Tourist visa cnnot be appeal i agree with you on that, but a family visit visa can be appeal on ground of human right base on article 8 right to family life and private life when you husband is british or family like husband,wife,son who are british. like i said i have sppken to the court and they said my wife appeal is a gaurantee to visa and i do not need to resubmit any document revaluation because i am british and our son is british also and because the appeal was allowed under article 8 of the immugration rulr which righ to private and family life. Pls note these article only apply to british citizen who wife or husband was refuse a visa .Does a UK citizen need to fulfill the financial requirement (ie £18.600) in order to bring his spouse to the country? What if he losses his job after the initial application (while on appeal process) would he still be eligible to bring his spouse to the UK? Or, what would happen if the immigration authority learns that his circumstances have changed for worse, would his spouse still be given the visa even though he wins an appeal? Well, it is possible that the embassy would issue the visa on the merit of the original documents and circumstances in assumption that they remain same and valid, but in the even that they find out that your circumstances have deteriorated, they reserve the RIGHTS to deny the visa. Search the forum and see that there are numerous cases of people who got refused after winning an appeal. Look, I'm not trying to discourage you, I am only trying to warn you against loosening your guard thinking all is done and dusted: so, I say, it is reasonable for you to still prepare yourself to the requirements as you may just be disqualified even though you won the appeal. |

nickson03: i want to correct that statement of winning appeal is not a guarantee of issuing a visa. if winning an appeal in court is not a gaurantee there would have been no need of appealing eco wrong decision in court. the Eco or ECM does not have the power to hold court decision if they refuse to appeal the judge decision for allowing your allow. if they did not appeal to the upper tie tribunal they have no choice to issue the visa even the home secretary has power to up hold court decision. especially when they visa is family visiting visa wife visiting her husband and son who are british or husband visiting his wife the eco or ecm does not have such to up hold the visa if they fail to appeal the court decision and they cannot ask for wife or husband to summit document for revaluation when the visa is family visiting visa. eco can ask for revalaution document if the visiting visa is for tourist purpose but not as family visa that is been sponsor by her british husband or wife. to make my finally correction of your statement for the avoidance of doubt i have called the court where my wife appeal was allowed to ask if the winning of appeal is gaurantee of visa. i have been told by the court that if the judge allowed your appeal is a gaurantee of visa will be issue to my wife if they fail to appeal the decision. i have also spoken to the home office they also said that winning an appeal is a gaurantee that visa will be issue to my wife if they did not appeal the decision but in case the home office has refuse to appeal the judge decision and they will called my wife to come and collect her visa and that i should allow 12week from the date of the appeal being allow.You are wrong, my friend, have you never seen that or heard about a person who got refused after winning an appeal? If family VISIT or SPOUSE visa application was refused by an ECO on the ground of unsatisfactory proof of the credibility of the family member relationship, and you aappealed it, and then in 6 months time, you won the appeal, What did you win? You did not win the automatic RIGHTS TO BE GIVEN A VISA, you only won the credibility of your claimed relationship which enables the claim relationship to be allowed: in such case, the embassy may demand that you resubmit your application with the current and up-to-date supporting documents and then, reevaluate your circumstances to be satisfied that you still meet the requirements for the visa sought. They are not going to approve your visa based on (let's say) a previous bank statement which is now out-of-date, you would be required to provide current documents. By the way, you can't appeal a tourist visa |

Imeobong: Hello house, Please I need advice, we (Myself & Family) applied for a UK Visa, (already we have a 2 years US visa). My bank account balance is in 8 figures and my monthly earning is in 7 figures and we were denied because according to them they could not confirm our hotel reservations in UK. But this is not true as the reservations we made through booking.com is still valid.You did not state the visa category that you applied for nor did you give adequate information to work with. However, I do not recommend you waste your money to a lawyer because, I am not sure that the application is one that requires a lawyer's service. Please, provide more information and I'm sure you can get free help here rather than paying away N50k (for something that you can do for free) |

nickson03: my wife was refuse a uk visiting visa last year the eco stated that he/she was not satisfy that my wife was a genuine student of delta state university. however, i took the matter to tribunal court. we won the appeal in favour. i have received the determination from the court the judge has allow the appeal. the promulgate date of the appeal is 1 Agust. now my question since we have had our appeal allow by the court who long will it take to issue the visa to my wife or how long will it take for the british embassy to issue the visa or called her to come to collect her visa. pls advise.Be advised that winning an appeal does not guarantee the issuance of a visa, she may have to resubmit her application and be reevaluated according to her current circumstances especially if it is not a spouse visa application |

Well, they don't have to become UK citizens before they can invite you to visit them, they are eligible to invite you if they hold the appropriate visas or resident permit, You may be able to get a tourist visa if you satisfy the requirements especially if you can prove that you have a considerable obligation to return to Nigeria for, but bear in mind that you can only remain in the UK if you condescend to become an absconding fugitive and become an illegal alien. |
damsamty16: They wrote on it that it is valid from july30 to august 15..does it mean it was a 6months visa with 2weeks stay.And if I want to renew can I get someone in UK to invite me base on visitation and if yes sir,can I request for 2years or normal 6months?What "they wrote" on it is called Remark, but the visa should be valid for 6 months howbeit, you can only be in the UK for a period not exceeding 2 weeks according to the remark. And sure, you can get someone to invite you to visit, but then, you need to meet the requirements for a tourist visa, and also, you need to satisfy the visa officer on the need to issue you a 2 years visa. |

damsamty16: Good day wonderful people and oga justwise and vicjustice I hail you sir's.I was granted a UK visa july 30 to go for a scout jamboree event with a scout members of 16 from Nigeria..Our commander held our passport with him because he was the one incharge so we couldn't check our visa to know the duration of the visa until we got to heathrow.I felt so sad to see that I was given just 2weeks visa because ever since I have been following this thread I have never heard anybody post anything about 2weeks visa.with hope and faith I was able to get my mood back.The visa expired this month August 15 and I came back to Nigeria August 12.Please I need help on what to do if I want to renew my visa.I think the visa was a 6 months visa with a 2 weeks duration of stay. Well, renewing a visa depends on the valid reason that you are applying for the renewal. |

You applied for a visa, and you got an email saying that your visa has been processed and is ready for collection, and yet, you are asking if it is good or bad (that your visa has been processed). I thought you were wrongly using the word EEA because, I imagined your spouse to be a UK citizen. You actually missed a golden opportunity while you were in the UK, but now, it is going to be an uphill struggle. Yes, it is your best choice to go to Spain: and from there, you can apply for the EU treaty rights visa to move to the UK. This visa is issued free of charge with no much requirements: but you would first need to hold a Spanish residence permit this would depend on the eligibility of your husband as he does not currently reside in Spain. |

Put our call records and everything in the application which they didn't question,and the manager told my husband he's ready to write a letter detailing he works there and he's ready to put his mobile number apart from the office landline.thank you so muchOut of curiosity, why did you have to call his workplace (manager) when you can get the information from himself, or is it the case that you don't have a real knowledge about your spouse's activities?
