Now she's saying she met the friend at airport when she was about to go to her hotel in London and her friend decided to accommodate her for 2 weeks and when the 2 weeks completed she herself decided to spend more than 6 weeks and her friend was happy with it. Like i said i have do some research on the internet there is no such requirement on Eu national family member accept my personnel document as her husband who is the sponsor to provide evidence that show i am residing in italy and exercising my Eu treaty right by been self employe in the state.You should have stated that your wife is in Nigeria. Well, she doesn't need to present any document except her own national passport and birth cirtificate, every other document and financial sponsorship details must come from you |

But if her residence permit does not indicate her being a spouse of an EU citizen, then she is required to present her marriage certificate to the airline and she will be allowed to travel with you or to meet you: She needs to be at the check-in desk early to allow the airline staff enough time to make inquiry and verify your situation and location... She can visit you in Italy without a visa, but the Italian immigration officers would need to be assured that you are already in the country, a simple phone-call is sufficient to verify your presence. If you want to save the stress, you can return to the UK and then travel with her to Italy, and she will have the same privilege with an EU citizen and be treated as such. The Republic of Ireland and the UK are the only countries that require a visa from an EU spouse, and the visa (bearing the Eu Treaty Rights remark) is issued free of charge |

Now, in order to use any document that is issued by an EU member state in another EU country, that document must be endorsed with apostile, and any document that carries apostile is recognised in every EU country Or are you talking about a Nigerian document that has been legalised by a Schengen embassy, and you intend to use the document in another Schengen country? If that is what you mean, there should be no problem because, any documentation that passes through, and is certified by a Schengen country is valid in every Schengen country |

Thank you[/quote]Except her previous visa carried a remark that explicitly stated the number of days that she was allowed to stay in the country, in that case, her subsequent refusals are as results from the violations of the visa conditions: and this violation attracts a temporal ban. But if the visa was issued with the standard terms and conditions, then she wasn't refused those subsequent visas because she stayed in the UK for more than (the declared) two weeks since in reality, she had not violated any rules nor did she breach her visa conditions by staying for six weeks. She was refused the visa because, she had not convincingly explained why she stayed in the UK for that long and what she was doing during the time; therefore, in absence of such explanation, the visa officers have reasons to suspect her intentions since they were not satisfied of her previous activities whilst in the UK. Change of circumstance is an acceptable reason to stay in a country for longer than intended, but yet, embassy and Immigration officers reserve the rights to question the circumstance: Know that a Visa Officer works with a person's budget and measures it with the person's income and then weighs it with the balance in the person's account before making a decision. So, if an applicant who is not too rich is applying for a visa with the intention to stay (let's say) one week, the visa officer might consider approving the application, but if the person eventually stayed for (let's say) four weeks, it is reasonable for the visa officer to want to know what the person was doing in the UK with insufficient fund, this will definitely call for an investigation. Another reason for her application refusal is the use of (uncle) sponsor who seemingly does not stand to profit anything by her leisure travel to the UK. |

If it is from the UK, you don't need to "legalise" it, all you need to do is to have it endorsed with apostile and that will make it a valid tender in every EU state. But if it is from Nigeria, you have to also get it endorsed with the certificate of authentication from the ministry of foreign affair or a Nigerian Embassy before it can be used for international purpose: but i am not sure of the N100.000 fee or whether the fee is particular to the embassy of Italy |

(she just renewed/changed to a fresh one due to her new marital name)Your "total balance of N1.5m" doesn't look too great for an all family 10 days trip to the UK, that would most likely result in a refusal. What will you live on after the trip, and what would you return home for if you have no money to sustain you in Nigeria? I'm sorry if my opinion disappoints you. |
babyspice: I would just like to add that if an invitation is made out to his wife its ok because i was in the same situation a few years ago. I was NOT employed at the time but my hubby was able to prove in our application that he would be able to foot the entire bill and proved we had ties to the UK. Even though i have family in the UK and on paper i would have been considered a flight risk. The onus is on the main Applicant to furnish enough genuine evidence that he has a stable, consistent and sustainable income to make the trip and for normal living expenses.I meant "individual" visa as I highlighted with brackets: you need to be in an employment for at least one year in order to be eligible for (self sponsored) visa application. And of course it is acceptable if your spouse is your sponsor |
