PoliticsRe: Jonathan Is Now President by vigasimple(m): 4:26pm On Feb 10, 2010
Our constitution is NOT the problem, it is those that are trying to interpret it that are the problem

I think PDP is a disgrace to this country.

David Mark using unsubstantiated  BBC Radio Hausa service to admit as notice of going on medical vacation of a President of 140  million people, that is more than 7 weeks after the President has disappear.

If, Yar A'clueless is well enough to do a radio interview, he is well to phone the speaker of both Houses, do a video conference an update Nigerians about his health, and write or officially informed Nigerians of him being on Medical leave.

It is either the President is unable because of incapacity or he is just contemptous. Either way, impeachment should have been the right way, and it will be for the President to provide medical reports of his situation.

I just think that we are being fed with loads of rubbish, and until we decided enough is enough and VOTE OUT PDP IN EVERY POSITION, THEY WILL CONTINUE TO DO THIS.

By the way, as our constitution stands today, only the FEC and possibly the court can declare Yar A'dua unfit and for the VP to become President or Acting.

NASS can impeach, they do not have the power to make anyone Acting President. ( AGF idonkia may be a fool but he is right on this).

What NASS should have insisted on is for the President to write a belated letter after nearly 80 days to say that he is on Medical vacation or face impeachment within 7 days, then the letter will have suffaced either forged or not.

Nigeria will hail thee.

Now that the burden of Yar A'do nothing name of politics have been relieved and no longer the President until he actually comes back and write a letter, then the breeze has blown and fowl yarnsh is out.

Jonathan does not need to announce Aondoakaa's sack at the FEC Meeting. That will be very ceremonial and dignifying. Give him one more opportunity to put up is boneheaded show at the FEC meeting on 17/02/2010 (next week) and then advice him on Wednesday evening to submit his resignation first thing on Thursday morning.

Just advice him after the FEC to submit his resignation letter First thing on Thursday Morning.

If he does not, you give him the Friday treatment. Sack him 4:00pm of Friday.

By Monday morning the Nation would have gotten used to life without Aondoakaa.

I do not think Jonathan should use his first FEC meeting to display anymosity.
Old boy, we need to hire you on behalf of Goodluck to chop any need that need chopping, and maybe throw them into the Atlantic as you wish. I like the Friday treatment without an option of Thursday resingnation. AGF Idonkia do not need to be dignified, he is a shameless man, and should be hounded out in shame.

I think AGF Idonkia is on cheap drug made from combination of Ibori stolen money and burukutu from Benue state otherwise he will mind his language.

I am very certain now that the man did only manage to go to a night law school where he was reading law books upside down.

His statement are fully loaded for a chief law officer, libel/defamation , and aiding and abetting 'a known criminal' if he is suggesting Mrs. Akunyili has done something wrong, why don't you prosecute her?

I know why, he can't even prosecute Ibori's and co. All he can do is rule of law and due process nonsense to chase away our only government and politicians thief catcher- the only and one RIBADU.

AGF Idonkia would have been in jail by now if RIBADU is at the EFCC, that is why the do nothing, cluelesee, offshore President connive with AGF idonkia to fire RIBADU through the back door and threathen the guy's life to make sure he stay in exile.

Idonkia judgement day will be here soon, once Goodluck is properly seated.

@ Mckren

Both your posting above is excellent, and I hope Goodluck Jonathan take a deep sleep, survey the atmosphere and do the right for his country as you have suggested transparently.

He should also keep an eye on the Armed forces. He should take a trusted ex Military Chief as Defence special adviser to advise him on the Army, because the North are capable of anything when it comes to Presidency and political powers.

If they can murder MKO Abiola, they will do it to anyone who does not understand how the military works. OBJ knew them and was able to deal with it for his own security and well being of the country.

That said, PDP as a party will not allow anyone to do anything serious to move the country forward unless you have the mettle, spine, nerves of steel and conviction to do the best.

I personally think that YAR A'CLUELESS is dead long ago ( brain dead and on life support against medical advice), and his kitchen cabinets are just looking for a joker but that never happens. True those kitchen cabinets are not as powerful as they pretend or held out to be.

No body prefers a dead Yaradua to a Jonathan. What people like me is advocating for is obedience to the Laws with which we have agreed to live under. The difference between a civilized society and a unstable one is obedience to the laws, no matter if you agree with it or not.

The Jews held their Torah  which was the Law that regulated their society sacred, and it helped then organize their society for thousands of years.

Also most western Nations hold their laws sacred and every citizen is held accountable to those laws. Here Laws are treated with disdain and the Laws are interpreted according to Tribal, religious, ethnic, class or even personal interests. Such societies cannot survive.

The Nigerian constitution is almost a carbon copy of the American constitution, especially the sections dealing with succession, so why had the type of problem we are having never occurred in the US.
If the US president should disappear for one week without informing anybody, he would be impeached immediately.

wirinet:
Thank you my brother, my people are ever ready to accept pandol in place of Panadol. Declaring Jonathan acting president (unconstitutionally), means we still have a president (and a first lady), even though Yaradua did not tell us he is on holidays - he is simply AWOL.
Even though I am Lawyer, I always prefer someone with commonsense, all the above has said is common sense as to the proper interpretation of the Law. Most of the confusion is started by Yar A'liar aided and abetted by AGF idonkia.

It is shocking, if in the 21st century we are still unable to do simple thing rightly, and we then yarn our mouth as giant of Africa. This are the occasion one is truely ashamed to be a Nigerian.

Region/tribal/religion or not, the NORTH are the problem of this nation. They were doing this simply to hold on to power they have never managed anything well in this country.

FEC can declare the President unfit ( and should have), and VP sworn in as President. VP is already acting as President according to the law but he was not being obeyed as such.

NASS should simply impeach a President for gross misconduct for not obeying the constitution he swore to defend and who has not make provision for emergency knowing fully well his health situation to hand over to his vP until he gets well.

The courts should have invoked S.145 to say that the President in absence of his letter of vacation/medical has vacated his office. He was qouted to have spoken to the BBC Hausa world service but cannot write to inform NASS of his medical vacation and when he si likely to come back. It is called contempt.

After 3,7 or max 14 days when there is no formal letter from Yar A'dua, it should have been taken to abdicate his position, end of the story. The nation need CIC and security

I need a Lawyer to explain to me if the Senate has powers to declare the Vice president as president, and under what section of the constitution can we find such powers. I know the National assembly (senate + House) can impeach a president and the Vice automatically takes over, but the senate alone declaring someone acting president? i honestly do not know.

From my unlearned point of view, i thought the vice would be acting immediately the president informs the senate and the house that he would be indisposed. I do not think the senate can make someone acting president, especially when the president had not informed them officially that he is indisposed. So if the president comes back, the senate would just declare the acting president as vice again to enable Yaradua assume the presidency.

You are absolutely right

What they need to do is either impeach the President or liase with FEC to declare him incapacitated following a medical examination.

The resolution i expected the senate to have passed is a motion for impeachment on the grounds of "gross misconduct" as they are empowered to do according to section 143 in the constitution and not accepting a hoax unverifed BBC interview as a replacement for a medical vacation letter as demanded by the constitution

This resolution is likely to be overturned or manipulated in the courts under Mr AGF's evil supervision

The battle is not over yet
The politicians are just confusing everyone. There is a diffrence between political solution and a legal solution. There can be  legal solution but not a plotical one, but it is better for the two to co-exist.

The law require the President to transimt letter to NASS when he is going on vacation or medical to allow him gain his post whenever he comes back. The VP automatically becomes the acting President and commander in chief even f he does not transmit the said letter. It was to protect the President status and not the reverse.  It is like an employee takeing vacation or on medical, for him to come back to his job, he must inform his employers. Yar A'dua on this account is guilty of gross misconduct for not doing that and an impeacheable offence.

Goodluck is the Acting President since the Yar A'dua left in a hurry. It was simple plotics that such has not happen. PDP usual politics cum northern cabals.

Secondly, it is only the FEC that can declare President fit ot unfit, and they shoul have done it with medical report and all of them speaking with the President because it is their constitutional duties not duties owed to Yar A'dua because he appointed them. The did not have a medical report nor have they spoken to him in well over 65days before they had a meeting and said that he is a fit person. absolute liars and dishonest people.

1. Replace AGF Aondoaka with Odein Ajumogbia SAN quickly (Aondoakaa has misdirected the Nation enough)

2. Replace NSA Sarki Mukhtar with Gen. Muhamed Abdulahi (Former Chief of Staff to Presidency) or Gen Andrew Owoye Azazi (former Defence Chief, thats if he is interested). Sarki Mukhtar has been busy with unholy activities lately.

3. Ojo Maduekwe to be replaced by Donald Duke

4. Bring El-Rufai into the cabinet if you can probably as Energy Minister to drive home the IPP project.

5. FCT Minister Adamu Aliero should also be shown the way and probably replaced with someone like Adamu Muazu

6. Abba Ruma can remain as Agricultural Minister but he must be badly relegated in the scheme of things.
Yayale Ahmed for VP
Your analysis is quite good, and I hope that Goodluck will read or get this from good sound advice and not be docile now that he is effectively the C-I-C.

Even the uselsess court that say there is no vaccum, of course there is one.

Absolutely spot on.

PDP IS THE PROBLEM OF NIGERIANS. 12 YEARS NOTHING TO SHOW FOR IT, VOTE ANY OTHER PARTY AND LET US GET RID OF PDP EVERYWHERE.

By the way, Goodluck Jonathan may even be worse tha YAR A'CLUELESS. By S.145 of the Nigerian constitution, he is actually empowered to act as Acting President but because AGF Idonkia is a lying buffon, he has not been advised properly. Assuming Yar A'liar has died several weeks ago then we would't have any CIC, and the country wandering aimlessly, and control by some small cabal.

For political reasons only, that is why the NASS vote matters, even the FEC did not have a medical report to conisder.

S.145 suppossed to protect the President position, since he has not asked for it, he is deemed to have abandon his office, and therefore should be impeached, or whoever did not handover letter ( assuming one is written/forged including the supplementary budget) should be tried and go to jail.

VOTE OUT PDP EVERYWHERE IN THE COUNTRY, VOTE ANY OTHER PARTY OF YOUR CHOICE. THEN WE WOULD GET RESPECT FROM OUR 'LEADERS' AND OUR FUTURE WILL BE BETTER.

Your vote is the only way you can amake a statement of your intention known. why do you think people are fighting over party's nomination ticket? why do you think 47 candidates try to contest under the PDP? because they see it as their meal ticket.

Once, we the people, the owner of the authority and mandate refuse the PDP and any incumbent non performing government to return back to power, the new government will take note and make sure they deliver on their promises and manifestos, that is how democracy works all over the world, Nigeria contrary to the myth, is not an exception.

ASk yourself one question, why PDP must be voted out, and I will also give you more reasons,

In 12 whole years of ths PDP led administration and the amount of billions of dollars spent on electricity, we still don't have 6,000 Mw, even if they do 500MV every year we would have 6,000mw for over 140 Million people by now.

I have said it that AGF idonkia has not read nor understood the constitution of Nigeria, and I am surprised that our legal experts have not even picked this up.

Goodluck is being too 'careful' when it is evident that the North is just taking Nigerians for a ride. YAR A'CLUELESS is not coming back to office because he has not even protect himself by provision of the s.145, therefore he has derelict his duties whether sick or not. He was 'signing' supplementary budget on his sick bed without informing NASS of medical vacation. Jeez

Other members of the FEC just take oath to serve Yar A'dua and their own pocket. The issue is very simple, temporary handover until the President is hale and hearty.

The plot thickens, ISA JAGUDA the son in law of the President ( and Turai favourite and choice for VP ? ) Goodluck must have a food taster because the plot would be to kill Goodluck and YAR A'DUA family continues in 2011 via Isa Jaguda, the one who does not believe in Nigeria that his wife went to give birth in the USA to obtain American citizenship. In any other country except Nigeria, Isa JAGUDA would automatically be disqualfied because that what is called nepotism and lack of patriotism, but in Nigeria, anything goes. ( since his father in law also went to Saudi for Medical)

There is something seriously wrong with the North and the office of the Presidency despite the facts that they have held that office more than 35 years of our independence and they have not perform.

The south should seriously be thinking of their relationship with the North.

Let me remind everyone of history here, when Murtala was assasinated in 1976, OBJ was the next in line, the Military tried but because of TY Danjuma did not suceed to put another Northerern, they then draft the elder Yar A'dua, Sheu Musa Yar A'dua to be OBJ second in comand despite the fact that TY Danjuma is third in line. They claimed they don't want two christians.

That was how OBJ and the YAR Adua family started, and Sheu Yar A'dua did support OBJ even though he knew fully well that OBJ will have to handover to another Sheu (Shagari), so he is not unduly bothered, so when Sheu Yar A'dua died , the only compensation OBJ could give is to pass power to the younger Yar A'dua, Umoru musa Yar A'dua who is a not a leaders, and a do nothing President. But can you blame him, he has a very poor health.

The story continue in circle.  The south should rethink this project called NIGERIA , because it appears that when it comes to the Presidency, it is an AREWA Nigeria.  He who has hears let him hear, I have said my own.

There is a saying in Nigeria.

A TRICKY PROBLEM REQUIRES A TRICKY SOLUTION

Nigerians,  I have found answer to our dishonest and dishounrable 'leaders and politicians'.  We should organise ourselves constituency by constituency and vote all the incumbent out and AVOID VOTING PDP   even where they are the opposition.

The whole idea is to say to politicians that power ultimately belongs to the people ( and not to godfathers and  any party) because PDP as a party is the most useless entity in the world and YAR A'CLUEELESS has shown enough contempt and disregard for us, the citizens, and by 2011, they will have been in office for 12 years with nothing to show for it.

I do not belong to any party but the whole idea is to stop PDP, and vote for anyother party that will deliver in any state and at the Presidential election. It will not matter because even when we have Yar A'do nothing, a liar, an offshore President, we have not seen him for over 70days, and the country is still running on lies, so we should accept another 4 years of exprimenting with any other party  or parties since the devil has not deliver in 12 YEARS and if they are in office another 60 years as they wanted will simply replace their children with themselves whilst Nigerians suffer.

what have we got to lose, remember the word of a depression time American President FDR ' we do not have anything to fear but fear itself'

YOUR CONTRIBUTIONS ARE WELCOME, we need to give Nigeria a brand, before we try to rebrand her, Dora Akunyili is now seeing the light.

over to you Good Nigerians, what are your own suggestions which are practical and workable to take control of our own lives and government?

I think we better concentrate our efforts ön how to improve in your financial status and comfort than waste your time on d useless nation and its so called politians or representatives! Excuse me pass jare.
The above statement shows the thinking of an average Nigeria who want to continue to be taken for granted and a ride. The sole reason why there are government is to provide enabling enviroment for any citizen to thrive. Your hardwork without adequate infrastructures and security will amount to nothing.

Nothining good can come from a nothing good dishonourable members of National assembly of jokers and comedians of a government led by Offshore President Yar A'do nothing .  Majority of those members nearly 80% are PDP, so it is the party and godfathers (iincluding cabals) that thy are answerable to and not Nigerians.

If, you all recall that a lot of them are asking to be given the party ticket unoppossed to support the government because 'they have won' once they have PDP ticket.

They are all their to serve themselves and not any constituent.

I have a solution to that though, Every person in each constituent should mobilise people to vote anyone who stand on the platform of PDP and vote even APGA, PPA or whatever party as a protest so that the people power can be established. Vote out all incumbent and anything PDP. we Nigerians would have sent a good message to Politicians.
PoliticsRe: Dora Akunyili Drops A Bomb :-the Cabinet Must Stop Lying To Nigerians About Pres by vigasimple(m): 1:22am On Feb 04, 2010
If she was sacked then it is their loss, the woman will have redeem her image, the North are mini evil, they never love Nigeria except for the oil.

I wish Dora Akunyili never work for those people in the first place. OBJ bad as he may be, loves Nigeria, and appoint competent hands like Dora Akunyili to the rightful job NOT as Minister for Misinformation.

Let us see the lists of people who have not spoken with Yar A'liar.

VP
Foreign Minister
Information Minister
Presidential spokesman - Segun Adeniyi

and almost the entire cabinet for over 2 months.

Not only is the man Yar A'do nothing is insane but brain dead. Not knowing the importance and impact of a leader on the country as a CIC is a dangerous as a mental patient you will get.

I knew YAR A'LIAR way before anyone from the day he promised emergency on power within 100days to all the less Hajj trips and 'business trips' to Germany. marrying off his daughters to Governors and politicans.

Akunyili need her sanity not a dead end job. you can see how gloomy is Goodluck, the cabal want to force him to resign so that they can put another Northener on top of the ticket not only now but also in 2011.

Good ridance to bad rubbish

PoliticsRe: The Fashola You Dont Know by vigasimple(m): 12:53am On Feb 04, 2010
We like the Fashola that we see, and good luck to the Fashola you see. If, and only if, the other governors in the country and your yeye offshore President does half of what the guy is doing, the country may well have being a better place today.  Remember 7 pointless agenda and visionless 2020.

Let us encourage the doers to do more and not simply demonise them for political gains
