What does the constitution or decorum says about a very sick person who is unable to perform his duties over 14/30days. If the President is unable or unwilling to write a letter and the NASS cannot get a medical report on the President state of health, is in't the best options is to commence impeachment proceedings within 30days of such disobedience to the constitution ( exhibit 1 is the fact that he did not write to NASS or he was unable to write). I will suggest an amendment to the constitution wherein If the VP is unable to contact the President for 24-48 hours following medical emergency to report it to NASS and take temporary charge. The citizens of this country were left exposed security wise during the absence of the President. FEC are unelected men/women who wield serious power especially the President's kitchen cabinet, and that is not right.

I think Justice Abutu is on drugs made from Nigerian stlen money to say that only the President have powers to change what ann acting President by operation of the law can change. So, in effect the President can come back and reverse all that the Acting President has done whilst away. Nigerian Vice-President Goodluck Jonathan can perform all presidential duties while the country's ailing leader is away, a judge has ruled.
But he would need a formal transfer of power to become official head of state, according to the Federal Court ruling.

It is the first of four cases aiming to clarify who rules while President Umaru Yar'Adua is away. He has been in a Saudi Arabia hospital since November.

Ministers and the lawyer who brought the case said they were satisfied.
But some critics want to see Mr Jonathan become official head of state.

Correspondents say the issue is so sensitive because of the ruling party's system of alternating power between north and south.

While Mr Yar'Adua is a northerner, Mr Jonathan hails from the south.

Northern powerbrokers may be reluctant to see a southerner take over officially before the next scheduled presidential election in 2011.

Justice Daniel Abutu said Mr Jonathan would only be legally regarded as "acting president" if he had received written instructions to do so.

Christopher Onwuekwe, the lawyer who brought the suit against the government, said he felt the judge had upheld his case.

He said he went to court only to confirm that the vice-president had the power to carry out the functions of the president.

He said there was now no justification for the other three cases - due before court on Thursday - to go ahead.

In one of the cases, rights lawyer and activist Femi Falana wants all decisions taken by the cabinet during the president's absence to be annulled.

In another, the Nigerian Bar Association is demanding that he hand over power formally to Mr Jonathan.

And a rights group wants Mr Yar'Adua declared "missing".

In his first public remarks since falling ill, Mr Yar'Adua told the BBC on Tuesday he was in constant contact with his deputy.
He said he was recovering and hoped to be able to return to Nigeria to resume his duties.

Doctors say the president is suffering from acute pericarditis - inflammation of the lining of the heart.

He also has a long-standing kidney complaint.

This country is full of lies and deceits.  I have a very good reasons to beleieve that the Plaintiff or Applicant in this case is an agent of the  
YAR A'USELESS government who want to bring a case to score ' a victory' and stop the other proceedings. Apart from the fact that  
AGF I Donkia is the representatives of the people even though appointed by YAR A'CLUELESS and also appoint WAYOZIRI who is also from Benue to EFCC and this Judge Dan Abutu, you can begining to see the connection.

They knew with Falana, NBA and SNG case YAR A'DO NOTHING is a goner. In any event the man has not done anything for nearly 3 year and FEC or NASS will not impeach him because they benefit from the chaos.


If there are no power vaccum, then Budget should not be taken abroad to be sign, CJN should have been sworn in by Jonathan, he should have called Obama on the 25th December 2009 and take decision rather than wait or refer to Kingdom of Saudi Arabia as if that is the capital of Nigeria.

The question for the court should be that once a President or a governor stay out of his jurisdiction for more than 28days should be considered to have abandon duties and his authority goes to his /her deputy and such must be sworn in as Acting until such a time that he/she can retake the office if he comes back, because If YAR A'ABSENT did what he did when he was a Governor in Kastina state he can remain 6months, 6 years outside the country. That is not what our constitution envisaged

The Useless govt will appeal, and I hope they go staright to the Supreme court, and Supreme court makes a ruling, and that will set precedent for the future of this country.

PS: I was priviledged to listen to the purported BBC interview of 'Yar'adua' and he said he would soon come back home to perform his duties. Am quite surprised to hear him speak like someone that has a sense of responsibility about the office he held. If for 1 day u were unable to come to work in a structured organisation for a few days you would have to communicate in writing or verbally to mgt (the people to whom u are accountable). Yaradua's 'i dont care' attitude and lack of respect for and an insult to140 million nigerians was evidenced in the callous manner he left his shop, the choice of medium that he chose to speak after keeping mum for 50days. 2. At the time of going or more days and weeks later when he is unable to resume duty not handover to deputy even up on till now after 50days when he is unsure when he will come back

3. No medical evidence of either alive or health condition, how much longer will the 'treatment' takes as it has aleady taken 50days

4. Terrorism on 25th December - did not speak to any of his foreign counterpart around the world up on to this minute

5. Allegation of Forged signature on Supplemantary budget

6. Telephone selected people to call, less than 10 out of 150million Nigerians

7. Publication of date of death etc

8. Protest march all over the world starting in Abuja from today

9. All of a sudden telephone call and wishing 'Super Eagles good luck' in a game of football.
