I I thought the chief justice of the Federal High Court requested his legal team to officially communicate their request to have the Justice Binta Nyako recuse herself from the case and tender evidence or valid justifications of her compromise or reasons for asking her to recuse herself.
She recused herself because of the harassment, challenge and indiscipline of Nnamdi Kanu in her court. However, on returning the case file to the Chief Justice, the chief justice pointed her to the fact that the reasons she recused herself from the case are baseless until a proper justification is made by her or by the legal counsel of Nnamdi Kanu.
Hence the case file will be returned to her.
The onus is on Kanu's legal team to request and justify the court to move the file away from Justice Binta Nyako. |

Eriokanmi: There was a federal law on abortion. I remember what happened on the 22nd June, 2022 where the Supreme Court overturned Roe v. Wade. Roe Vs Wade was a federal law, which was upheld by the then SC judges on abortion which was also included in the constitution decades ago. The SC was approached in 2022 and it was overturned, giving the state the rights to either ban or uphold it as you've said above.
Now, the Trump's deportation order wasn't in any way close to this and as such, can't hold water in some states. They may or may not comply. That's my point. If the Chicago police are saying they'd not comply, trump can't force them to do otherwise.
Again, Trump's executive orders can't be meant to be a SC judgement which subjects it to questioning and jettisoning by state's laws. Before becoming binding up to the SC, it has to pass through their assembly in the form of a bill. Remember he did same in his first term but Biden administration struck it off? Even as of then, some states didn't comply. These analysis are very applicable to this situation. I am expecting to see the laws of USA tested in the courts and the judiciary will decide a lot of matters with respect to Trump's Executive Orders. |

dkidd: Not true...They must comply with federal laws on issues relating to civil rights, employment and law enforcement procedures etc so they're not completely autonomous They report to the state authority, not federal. They will comply with every federal laws except if there is a state law that contradicts the federal law or a state law requires additional or different objects or items. This situation is often rare. |

Ojuntana: The main point is their insistence on not turning in information. That they cannot do if asked to They can be asked to hand over a case file if the federal institutions like CIA or FBI are interested or also on that case. But they may not cooperate officially in cases that they have no information about or cases they are not investigating. Remember that this matter is about immigration, the police is not an immigration authority in the USA. The state of Chicago that employed them also indicated that the government is unwilling to cooperate so you can't blame them. |

However, Kanu is digging his hole and charting his path to jail. He will not escape it because other judges that will potentially handle his case are seeing what he has been trying to do to one of them. Can you imagine that Kanu unruly harassed and interrupted her in her court and requested that she should recuse herself from his case. She complied but the honorable CJN declined and asked Kanu's team to make official their justification and evidence for such accusations against the Judge but till today, I am not sure they have filed it. Now Kanu is pushing a campaign of calumny against Justice Binta Nyako again. Why? Even Tinubu will not be able to save Kanu. |
