Politics / Atiku Failed To Prove The Existence Of Server – Buhari, Apc by Wisdom58(f): 1:44pm On Aug 21, 2019
President Muhammadu Buhari and his party, the All Progressives Congress (APC) on Wednesday made their final submissions before the Presidential Election Petition Court (PEPC) in the petition by Atiku Abubakar and the Peoples Democratic Party.

Atiku is contesting the result of the Presidential election which was held on February 23, 2019.

Their lawyer Wole Olanipekun (SAN), accompanied by Alex Izinyon (SAN) and others made the final submission on behalf of Buhari, while Lateef Fagbemi (SAN) led the team of lawyers that spoke for the APC.

Olanipekun, in his final statement, urged the court to dismiss the petition with substantial cost, arguing that the petition was worthless as the petitioners had failed to present any reasonable evidence to support their claim.

For instance, he noted that the petitioners failed to show where the server they claimed existed was located.

Also, Fagbemi argued that all issues the 3rd respondent (APC) raised about Atiku’s qualification to contest for allegedly not being a Nigerian by birth, were not challenged by either Atiku or the PDP.

“On the qualification of the 1st petitioners (Atiku). In spite of all we put before the court, they provided nothing to the contrary.

“What we need is minimal proof. Nothing was put forward in the petitioners’ written address to counter this. And, I must commend them, because they have nothing to offer. In that respect, the 3rd respondent has discharged the burden on that. The issue of the 1st petitioner’s non-qualification is effectively dealt with in our written address.

“To fault INEC’s position, they have the burden to show substantial non-compliance. They failed to do this. The implication, therefore, is that there was substantial compliance with the Electoral Act in the conduct of the last presidential election,”‎ Fagbemi said.

Politics / Revolutionnow: Court Declined To Order The Release Of Omoyele Sowore by Wisdom58(f): 11:46am On Aug 21, 2019
The Federal High Court in Lagos, on Tuesday, declined to order the release of Omoyele Sowore and other persons in connection with the RevolutionNow protest.

Sowore was picked up by the Department of State Services, DSS, for calling for the RevolutionNow protest.

The presiding judge, Justice Nicholas Oweibo, on Tuesday, declined to release Sowore until the court has heard from the Federal Government, Department of State Services (DSS) and the Inspector-General of Police (IGP).

He ordered the DSS and IGP to appear before him on September 4 to show cause why Sowore and other protesters in detention should not be immediately released.

The judge also ordered Lagos-based lawyer, Mr Olukoya Ogungbeje, who filed the ex-parte application seeking the detainees’ release, to put the IGP and DSS on notice, The Nation reports.

Ogungbeje, who said he participated in the #RevolutionNow protest but was barred along with other people in Lagos from carrying out their constitutional right, filed the application on behalf of himself and other participants.

He prayed the court to declare as “unconstitutional and illegal police clampdown on the protesters and the arrest of Sowore by the DSS.”

He also sought an order for the immediate and unconditional release of those arrested and detained.

Joined as respondents in the application where the Federal Government, the DSS and the IGP.

Giving reasons why the arrested persons should be immediately and unconditionally released, Ogungbeje said, “There has been a grave constitutional infraction committed by the respondents against the applicant and other persons who engaged in the peaceful protest for good governance in Nigeria.”

The lawyer said he was deprived of his constitutionally-guaranteed right to peaceful assembly and association and the right to freedom of expression.

“On the 3rd of August, 2019, the convener of the protest, Mr Omoyele Sowore’s residence was forcefully invaded and put under siege; he was arrested, whisked away and detained in the detention facility of the 2nd respondent (DSS).

“Mr Omoyele Sowore has not committed any offence known to law to warrant the infringement and likely infringement of rights by the respondents.

“By engaging in the peaceful protest, the applicant and other persons have not committed any offence known to law to warrant the treatment meted out to them by the respondents and their agents,” Ogungbeje said.

Politics / More Evidence As INEC Official Claim He Transmitted Election Results To Server by Wisdom58(f): 6:55pm On Jul 12, 2019
An ad-hoc official of the Independent National Electoral Commission, INEC, Olufemi Ogunrinde, has said he transmitted results of the 2019 presidential election to a server of the Commission.

Ogunrinde made the disclosure while being cross-examined by Muiz Banire, counsel to the All Progressives Congress, APC, at the presidential election petition tribunal sitting in Abuja.

The witness informed the tribunal that the results were transmitted through the smart card readers.

“All I know is that the presiding officer brought the form EC8C and I put in the information on the smart card reader which I transmitted to the server,” he said.

On if he had seen the server, the INEC ad-hoc official said no, but was told about its existence by the Commission’s official.

The 2019 Peoples Democratic Party, PDP, presidential candidate is challenging the authenticity of the last election which saw President Muhammadu Buhari emerging winner.

Politics / Zamfara Guber: Tribunal Rules In Petition Against Election Of Gov. Bello Mutawal by Wisdom58(f): 6:42pm On Jul 12, 2019
The Zamfara Governorship Election Tribunal on Friday dismissed a petition filed by Alhaji Zayyanu Salisu of the Action Peoples Party (APP), challenging the election of Gov. Bello Mutawalle of the PDP.

Justice Fatima Zeberu, dismissed the suit, following a prayer by the petitioner’s counsel, Mr Obed Agu and Prof. Agbo Madaki.

Zeberu dismissed the petition after counsel for the INEC and PDP, raised no objections.

The judge dismissed the suit with no: EPT/ZM/GOV/2019.

NAN reports that Salisu’s petition is challenging INEC’s decision to issue a certificate of return to Mutawalle on the grounds that he (Mutawalle) was not qualified to stand for the election having not “been educated up to the school certificate level or its equivalent,” as stipulated in the 1999 Constitution and the 2010 Electoral Act.

He argued that a report by the Evaluation and Accreditation Division of the Federal Ministry of Education, dated 28 December 2018, had stated that the Trade Certificate relied on by the first respondent as evidence of educational qualification for the election was not a school certificate.

The petitioners, however, prayed that the tribunal declares that Mutawalle was, at the time of the election, not qualified to contest the election held on March 9, for the office of Governor of Zamfara.

They further asked that the tribunal orders the 3rd respondent, INEC, to conduct a fresh election to the office of governor of Zamfara State.

INEC had, on May 27, issued a certificate of return to Mutawalle of PDP in line with the Supreme Court judgment of May 24,, which sacked the initial purported winner, Idris Shehu, of the All Progressives Congress

Politics / INEC Fails To Defend Akinlade’s Allegation Over Alleged Award Of Votes To Abiodu by Wisdom58(f): 4:20pm On Jul 09, 2019
The Independent National Electoral Commission on Tuesday failed to defend the allegation levelled against it by the candidate of the Allied People’s Movement in the March 9 governorship election in Ogun State, Adekunle Akinlade that it allegedly awarded votes to the Governor of the state, Dapo Abiodun.

INEC told the Election Petition Tribunal sitting in Isabo, Abeokuta, during the hearing of the petition filed by Akinlade against the victory of Abiodun, the governorship candidate of the All Progressive Congress, that it had no witnesses to call to counter Akinlade and his party, APM’s claim.

The Commission, who is the first respondent in the petition was expected to open its defence on Tuesday against Akinlade, who had accused it of awarding “illegal votes” to Abiodun during the election in the state.

The commission’s counsel, told the Justice Yusuf Halilu-led Tribunal that it would not call any witness against Akinlade and the APM.

The development prompted the Tribunal to ask the second respondent, Abiodun, to open his defence; but, his counsel begged the Tribunal for an adjournment on the ground that he was not prepared.

The Tribunal, therefore, adjourned the proceeding till Wednesday, July 10 for Abiodun to bring his witnesses to the Tribunal to begin his defence against Akinlade’s petition.

Politics / How Drones Helped Us Raid 18 Kidnappers’ Camps –army by Wisdom58(f): 3:58pm On Jul 09, 2019
The 32 Artillery Brigade of the Nigerian Army in Akure says it has raided no fewer than 18 camps of suspected kidnappers in the last one month with the help of its newly acquired drones.

The News Agency of Nigeria (NAN) reports that the brigade launched two drones on June 21 to fight kidnappings and other related crimes in Ondo and Ekiti states.

Brig.-Gen. Zakari Abubakar, the Commander of the brigade, made this known while speaking with NAN on Tuesday in Akure.

He said: “On my assumption of office on March 28, 2019, I discovered that cases of kidnapping, robbery, herders and farmers clashes and others were on the increase in Ondo and Ekiti States.

“I discovered that one of the advantages the criminals have is the thick forests that abound in the two states.

“We first established an anti-kidnapp squad which recorded a lot of success. But anytime the kidnappers took their victims to the thick forests, it became very difficult to comb the area.

“There is no way we can perform effectively without the help of technology because the two states have thick forests which the criminals are using as their hideouts.

“So, the drones have helped us tremendously in our operations within one month that we launched it in the two states.

“As at now, 18 different camps had been raided and the arrested suspects had been handed over to the police and other security agencies for proper investigation and prosecution.”

Abubakar, who attributed the success of the operations to the support of the duo of Lt.- Gen. Tukur Burata, the Chief of Army Staff, and Maj.-Gen. Okwudili Azinta, GOC, 2 Division, Ibadan, said the army was ready to make Ondo and Ekiti free of crimes.

The brigade commander also said that the cooperation of other security agencies had aided the arrest of kidnappers.

“We know that there is no where they can hide with the technology we are using now and  their days are numbered.

“The only thing that we need is the cooperation of the media and politicians to support the army’s vision and goals,” he said.

Politics / INEC Under Pressure To Tamper With Kaduna Election Materials – PDP Alleges by Wisdom58(f): 5:21pm On Jun 30, 2019
The People’s Democratic Party (PDP) In Kaduna State on Sunday alleged that, the Independent National Electoral Commission (INEC) was under pressure to tamper with election materials  in the March 9th, 2019 governorship elections in the state.

The allegation was contained in a statement by the party’s Publicity Secretary in Kaduna State,  Abraham Alberah Catoh.

According to the opposition party, ”We have received credible information that the Independent National Electoral Commission (INEC) is under intense pressure to tamper with election materials used for the conduct of governorship elections on 9th March, 2019 in the State.

“We are drawing the attention of the world, Nigerians and the people of Kaduna State in particular, to note the attempt by the ruling All Progressive Congress (APC) and the government Of Kaduna State Tyo coerce INEC into tampering with electoral materials.

“In as much as we do not want to question the integrity of INEC, we wish to state that the eyes and ears of our teeming party faithfuls/sympathizers are wide open in all INEC offices spread throughout the 23 local government areas of Kaduna State and the State INEC Headquarters.

“We advise INEC not to do anything that could tamper with the fragile peace reigning in the State, as any attempt to do the bidding of undemocratic external forces will be resisted by the public whose mandate was earlier stolen.

“Please note that while we would not want to say anything on the petition before the Tribunal, we wonder why the people, who claimed to have won the governorship elections, would be putting pressure on INEC to tamper with the voting materials in their favour.
