Hello World & Nigeria

Every year on this day millions of people across South Africa and the world dedicate 67 minutes of their time to help better their communities in their small way. I urge you to do the same.

Today would have been an icon's birthday. That is Nelson Mandela. He spent 67 years of his life fighting for a better and just world. You too can dedicate a small fraction of your day to doing small and meaningful good deeds for others. Help paint a school, visit an orphanage, clean your street or donate to a good cause. Just do something that will make you and others feel good, and leave a lasting and positive impact.

Dorischuks:
A witness called by Atiku Abubakar and the Peoples Democratic Party(PDP) before the Presidential Election Petition Tribunal (PEPT) has said that his claim that Atiku is a Nigerian by birth and was qualified to contest the presidential election were information he got from his father.

The witness, Mohammed Hayatu, who claimed to have retired as a Customs official, said his father is dead.

Hayatu said he also learnt part of Adamawa Province was one part of Northern Cameroon, until the plebiscite of 1961 which brought it back to Nigeria.

The witness said, Jadda, where Atiku was born was never part of Cameroon.

Earlier, another petitioners’ witness, Magdiel Samaki, who said he was a Nigerian Ambassador to Romania, said he could not recall history relating to the plebiscite conducted in Northern Cameroon in 1961

Emelcee:
Mohammed Lebo, Deputy Political Editor, Abuja

The All Progressive Congress (APC) in Akwa Ibom State has polished up plans and might move any moment from now to file an application at the Tribunal seeking to compel the Chairman of the Tribunal for National and State Assembly elections Justice Jennifer Mbalamen Ijohor to step down with immediate effect.
This Newspaper gathered that the plan which is a product of the advice handed to the APC by the "Powers above" is meant to serve as additional effort to stir up ill-will against the tribunal chairman in a bid to stampede her to relinquish her seat as chairman of the Tribunal.
Our source who is one of the chieftains of the APC in Akwa Ibom State disclosed that some bigwigs of the party who are deeply interested in the case met on Monday night to deliberate on the issue and rose with the decision to file a strong-worded application before the tribunal stating their discomfort with the chairman of the tribunal and demanding her to recuse herself from presiding over cases at the tribunal.
The submission of the Application, it was further gathered, will be followed by a heightened media campaign which will amplify the message that Justice Jennifer Ijohor is not objective enough in the discharge of her duties as chairman of the tribunal.
This plan to file an application seeking to compel Justice Jennifer Ijohor to step down as chairman of the tribunal is coming just a few days after the All Progressive Congress in Akwa Ibom had frontally accused the tribunal chairman of bias, insisting that she has a strong family relationship with a PDP stalwart, and so, there is a clear conflict of interest in her work as the Chairman of the Tribunal.
The APC in a Press Conference addressed by the State Chairman of the Party further insisted in their accusations that the cases which have so far been dismissed by the tribunal were done out of bias against the APC.
But the Peoples Democratic Party (PDP) in Akwa Ibom State in sharp response has siad the fears expressed by the APC on the standing of the chairman are transparently lacking a strong foundation in both facts and law., reminding the APC that there are different laws enacted for the adjudication of election petition matters before the tribunal, which must be followed stricto sensu and failure to do so, usually attracts consequences.
The PDP in a Press Conference addressed by the Publicity Secretary Comrade Ini Ememobong in Uyo on Monday also drew the APC's attention to the fact In Amaechi v. INEC, the court of Appeal held inter alia that failure to comply with procedural steps, which ordinarily could be waived in a civil matter, will be fatal to the petition.
"Additionally, in the cases mentioned by Mr. Okopido, the petitioners(APC and their failed candidates) failed or neglected to apply for Pre-trial forms which is in contravention of the provisions of the extant Electoral Act and the consequence is trite- the petition must be dismissed, same being incompetent." The PDP maintained at the Conference.
The PDP further insisted that a careful observation of the issues raised by the the APC will reveal that the APC is blaming the judge(who incidentally is not sitting alone )for their woes. The PDP wondered how the judge is responsible for the omission by APC counsel to comply with the provisions of the law governing election petition.

Politics › Re: Apc's Attack On Tribunal Chairman Is A Rape On Judiciary - TME by WonderManly(m): 7:53am On Jul 16, 2019
AlhajiUmani:
APC'S ATTACK ON TRIBUNAL CHAIRMAN IS A RAPE ON JUDICIARY - TME

A famous group in Akwa Ibom State, the Mandate Eyes (TME) has described the recent blackmail attack on the chairman of the election petition tribunal in the state Justice Jennifer Mbalamen Ijohor by the leadership of the All Progressives Congress (APC), and the call for her removal as a rape on the judiciary and an attempt to bring the judiciary into disrepute.

The group said that it is baseless and irresponsible, the alleged affinity of the tribunal chairman with the Peoples Democratic Party (PDP) in the state in their failed attempt to arm twist the tribunal for favourable judgement.

In a statement issued by the group in Uyo and signed by it's Coordinator, Mr Ernest Akpan and Secretary, Mr Joseph Okon and made available to journalists, the group particularly mentioned that attitude of the APC chairman, Ini Okopido smacks a drowning search of any available straw to clutch in an make mischief.

The group further condemned in strong terms, the APC launch of a median blackmail and campaign of calumny against the tribunal chairman and some members of the panel.

The TME maintained that the latest attack on the tribunal chairman and members of the panel in Akwa Ibom is obviously the last resort by the APC to hoodwink the tribunal and members of the public having seen their imminent defeat at the tribunal as their cases lacks substance, hence they are dead on arrival.

TME wondered where the chairman of the tribunal and members of the panel should be blame here when actually, APC had dead cases before the tribunal like in most cases, the petitions were even filed after the expiration of the allotted 21 days provided by the law.

The statement reads in part, "the inability of the APC to file applications for pre-hearing within the stipulated 7 days, in most their cases, after the reply by the respondents is certainly not the fault of any of the tribunal judges. In most cases, the petitions were even filed after the expiration of the allotted 21 days provided by the law, so did it require any further arguments to clearly affirm that those cases were dead on arrival and were only awaiting final mass burial?
That explains the series of defeats the party has so far suffered in the respective national and state assembly elections petitions so far thrown out for want of diligent prosecution.

Another trend which Okopido has failed to tell the public is that only one or two persons were possibly contracted to manufacture witnesses and construct statements for them. In most cases, witnesses have come to the dock and disown statements purportedly signed by them. For example, on Saturday, a witness in the matter involving the Esit Eket/Ibeno state constituency on sighting the statement 'he wrote', denounced it and was discharged from the dock without being allowed for cross examination. Another witness last Thursday, during the governorship petition tribunal, showed a voter's card with a name different from the one that signed the witness statement. Outside these discrepancies, the entire charade have been a sham, with almost the same statement repeated for all the witnesses. Is that also the fault of any member of the tribunal panel"?

The statement further reads, "the candidates of the party have shown little or no interest in their respective cases, simple logistics needed are no longer available. This could only be applicable in a situation when they already know that their cases are possibly lacking in merit. Last week, the Independent National Electoral Commission, INEC had to come out to beg the petitioners to come and get the election materials they had applied for, to use in prosecuting their case, which required little money for photocopies to be produced. Is this also the fault of the tribunal judges? Why are they still seeking amendments of their petitions, to plead for new witnesses when they have not even used a third of those they earlier penciled down?

What rulings would APC have expected any other judge, even if such a judge was sent from the Hague, given the poor foundation they have laid for their cases? We expected to listen to Okopido criticizing, backed with substance instead of whipping sentiments and crying wolf when there is none. He should desist from continuous vilification and intimidation of the tribunals. Does he and his band of losers think that Their lordships will depend on millions of tears and petitions in the media, to base their judgements, as opposed to the available facts before the tribunals?

From the vitriolic outburst by Okopido and his party, we see nothing other than a meaningless attack on the judiciary, and a breach of the fundamental principle of respect to the sanctity of the judiciary. Following from their previous ploy to relocate the tribunal to Abuja, comes this latest scheme to blackmail and coerce the judges.

It is on the strength of these that we call on the police to immediately arrest Ini Okopido and charge him to court for sub judice, sedition, defamation and hate speech. We also call for the immediate arrest of all those involved in the publication of these seditious materials, which tend to instigate some disgruntled elements against certain members of the judiciary.

We recall that this is the same pattern of mischief which they earlier instigated against the state INEC Commissioner, Mike Igini, despite the widely being commended for midwiving the most credible poll ever conducted in the state. We finally call on the respective elections petition tribunal panels sitting in Uyo, to remain focused and unperturbed in the discharge of their constitutional responsibilities, and to ignore the ranting and ramblings by the habitual noise makers".

Politics › Re: Nobody Can Decide For Buhari When To Name Ministers- Tony Momoh by WonderManly(m): 7:43am On Jul 16, 2019
hisexcellency34:
Temidayo Akinsuyi, Lagos

Prince Tony Momoh, a former Minister of Information on Monday, said only President Muhammadu Buhari can determine when to assemble his cabinet as the Chief Executive Officer of Nigeria.

Speaking in a chat with Daily Independent, Momoh, who is one of the national leaders of the ruling All Progressives Congress (APC), also said the constitution which stipulates that the President should appoint ministers from all states of the federation did not prescribes any timeline with which he can do it.

“What the President said was that he was under tremendous pressure to release the ministerial list. Are you aware of the constitutional procedure? The president is the chief executive in the executive arm of government and the buck stops on his desk.

The President appoints ministers. He sends the list to the National Assembly that clears them and sends the names back to the president to assign portfolios to them. The constitution never said he must appoint ministers within a day or 30 days after his inauguration. So, the buck stops on his desk.”

When reminded that President Cyril Ramaphosa appointed his cabinet just 96 hours after he was inaugurated, Momoh said Nigeria is not South Africa.

He said, “And so? Are we South Africa? Is Buhari the same as Ramaphosa? Do you that African National Congress (ANC) is more than 100 years old? We are just marking 20 years of democracy here”.
