The Supreme Court has struck out a suit filed by the Bayelsa state government over the disputed Soku oilfield belonging to Rivers State.

The apex court said by seeking for it to make Judicial pronouncement on a matter that the Court of Appeal has not even ruled on, the Bayelsa state government was liable of abuse of court processes.

Bayelsa State government had approached the Supreme Court after a Federal High Court in Abuja ordered it to refund the 13 percent derivation it had received over the years from disputed Soku oilfield, to Rivers State.

At the resumed hearing of the matter on Tuesday, Justice Ngwuta, who led a panel of 7 justices, wondered why the Bayelsa State government decided to file a suit at the apex court, whereas steps were being taken to challenge the judgement of the Federal High Court at the Court of Appeal.

Justice Ngwuta observed that the Bayelsa State government was jumping the gun and its action was tantamount to abuse of court process. He asserted that there was no way the Supreme Court can make pronouncement on a judgment that was given by a Federal High Court when the appellate court has not done so.

He explained that the Supreme Court does not have jurisdiction on a matter relating to a High Court. To this end, he directed the Bayelsa State government to take its grievances to the Court of Appeal.

It was on the basis that the counsel to the Bayelsa State government, Kemsauode Wodu, applied for a formal withdrawal of the suit and it was struck out by the Supreme Court.

It will be recalled that Justice Inyang Ekwo of the Federal High Court, Abuja, while delivering judgement in Suit Number FHC/ABJ/CS/984/19,filed by Attorney-General of Rivers State against the National Boundary Commission, based on documents from relevant government agencies , had declared that the Soku oilfields belong to Rivers State.

Ekwo had noted that the failure and refusal of the National Boundary Commission to rectify the admitted mistake in the 11th edition of the administrative map of Nigeria since 2002 which erroneously showed St Batholomew River instead of River Santa Barbara as the interstate Boundary between Rivers and Bayelsa States ,was a breach of commission’s statutory duty and a flagrant disobedience of the order of the Supreme Court contained in its judgment delivered on 10/7/2012 in Suit Number SC. 106 /2009.

The judge explained that the continued reliance on the said defective 11th edition of the administrative map of Nigeria by the other government agencies/statutory bodies, particularly, the Revenue Mobilisation , Allocation and Fiscal Commission and the Accountant General of the Federation in the computation of revenue accruable to Rivers State from the Federation Account has resulted in the continued unjust denial of derivation funds accruing from the Soku oil wells situate within Rivers State to the detriment of the State Government.

Justice Ekwo then directed that notice be served of the decision of the Court on the Revenue Mobilisation, Allocation and Fiscal Commission and the Accountant General of the Federation.

The judge said the National Boundary Commission cannot unilateral delineate boundaries between Rivers State and Bayelsa State after the Supreme Court judgment on the matter and also dismissed an objection to the suit raised by the National Boundary Commission because it lacked merit.

Brazil and Barcelona great Ronaldinho revealed on Sunday that he has tested positive for the coronavirus.

The World Cup and Ballon d'Or winner was set to attend an event at Belo Horizonte's famed Minerao stadium, but said in a video on social media that he would not go.

"I have been in [Belo Horizonte] since [Saturday], I came to participate in the event ... I tested positive for COVID. I am well, asymptomatic, but I will not attend. We will be together soon, big hug," Ronaldinho said.

Ronaldinho and his brother and manager, Roberto, spent time in Paraguayan jail in March and April, before being allowed on April 9 to move to a four-star hotel in Asuncion while under police custody. The brothers had entered Paraguay on March 4 with false passports that had been given to them as gifts.

They were released in late August after reaching a plea deal that included fines of $90,000 and $110,000, respectively, for Ronaldinho and Roberto.

We the good people of Ugbobi are calling for a repressive attention of the Government at all levels to the precarious situations ravaging us as a people.

The Super Eagles of Nigeria played a friendly game with Algeria and they were defeated by a goal to nil in the highly competitive friendly game.

The match started exactly 7:30pm and an early goal from Algeria sealed the game. At the start of the game, Algeria dominated the match and it took them just six minutes to find the back of the net as Ramy Bensebiani put the away team in front.

Despite the Super Eagle's starting eleven, they were not able to level the scoreline before the halftime break.
Despite the fact that most Nigerians did not watch the match due to the "EndSARS" protest that seemed to have taken the attention of many, some of them shared their displeasure as Nigeria lost their first competitive game in 2020.

Nigerians took to twitter after the final whistle to rate some of the players. A particular twitter user attacked the former Arsenal player, Alex Iwobi over his poor performance tonight, describing him as a flop. He also advised him to retire the way Odion Ighalo did.

Another twitter user ala blasted the coach for his wrong substitution which made Nigeria not to score a goal. Others also said Nigeria lost due to poor communication among the players.

Students of Delta State Polytechnic, Ozoro, have slammed the management for asking students to pay N5, 000 COVID-19 fee on their return to campus.

Recall that schools were shut for months due to the COVID-19 pandemic but were recently reopened in Delta State for academic activities.

At the time of filing this report, a massive protest is ongoing as the aggrieved students shut the main entrance to the campus, saying that the institution will remain shut until the directive is reversed and withdrawn.
Addressing the protesters, Dio Oghale Emeka Rex, President of the Senate, National Association of Polytechnic Students (NAPS) said that they were not asking for a reduction but a total removal.

He said: “They tried to implement the directive in the College of Education, Warri but it was reversed when we took our protests there.


“I wrote to the Ozoro Polytechnic management but they rejected our letter. Students need palliatives and do not need to be told to pay N5, 000.”

According to him, students will only pay if staff are asked to pay times three of the N5, 000 they are asking students to pay.

Meanwhile, attempts by the police to appease the students failed as they vowed to pressurize the management to reverse this decision.

BREAKING: NNPC: Buhari appoints Magnus Abe, Lawal, Umar, Attah, others into new board

President Muhammadu Buhari has approved the reconstitution of the Board of the Nigerian National Petroleum Corporation (NNPC).

This decision was reached after the expiration of the term of the board members appointed in 2016.

Members of the new Board are:

Mohammed Lawal (North West), Tajudeen Umar (North East), Adamu Mahmood Attah (North Central),
Senator Magnus Abe (South-South),
Dr Stephen Dike (South East),
and Chief Pius Akinyelure (South West).

This was contained in a brief statement signed by the President’s Special Adviser on Media and Publicity, Femi Adesina and made available to DAILY POST on Saturday.

The statement added that the new board will be in place for three years

When I was a kid I heard the stories of a supposedly mystical creature / animal called the 'Bush Baby' that was seen only at night and always cry like a real crying baby.
