The People’s Democratic Party (PDP) in Taraba state has protested the Supreme Court’s ruling which removed Emeka Ihedioha of the PDP as governor of Imo state.

The state chairman of the party, Mr. Victor Bala Kona, while addressing newsmen in his office in Jalingo, on Sunday said the alleged injustice by the apex court under the CJN Tanko Mohammed showed that the court is no longer the last hope of the common man in Nigeria.

Bala Kona also described it as “utter desecration of judicial tenets and value culminating in the Supreme Court manufacturing votes and donating to the APC gubernatorial candidate, Mr Hope Uzodinma against the mandate of Imo people who elected Ihedioha as their governor.”

According to the PDP chairman, the issue at stake is not about Imo state but about the future of Nigeria and democracy as well as future elections. He vowed that the PDP will take all necessary steps to prevent a reoccurrence of Imo injustice in Sokoto, Kano and Plateau states.

The leadership crisis rocking the All Progressives Grand Alliance (APGA) took a new twist with the claim of the embattled National Chairman of the party, Dr. Victor Ike Oye, saying his purported removal should be ignored. Daily Trust reports that a former National Vice Chairman of the party, Chief Edozie Njoku, told newsmen in Abuja that he has been pronounced the new National Chairman of APGA after a judgement by an FCT High Court. Njoku called for reform of the electoral system to include electronic voting and transmission of results in 2023 elections and beyond. It will be recalled that Chief Njoku had been involved in a long legal battle with Dr. Oye since their convention shortly before the 2019 general elections in Imo state.

When contacted, Chief Oye said, he was not aware of any court removing him as the National Chairman of the party, saying such report should be ignored. “I am not in town; I am not around. But such reports should be ignored,” he said. When asked to comment on his withdrawal of the case in the court, Oye said he ordered the withdrawal as he sees no reason why the case he instituted should continue.

However, Njoku said, “the electoral process in Nigeria has to be reformed; we need electronic voting and electronic transmission of results.” He said, “Earlier at the court where my leadership was reaffirmed, Oye’s lawyer was in the court and he pleaded that Oye is ready for reconciliation.

This is to show that our party is ready to move further.” He said that his leadership will focus on rebuilding the party to realize the objectives step up by the founding fathers of the party. According to him, the party would woo back the likes of former governor of Anambra State, Mr. Peter Obi and the first national chairman of the party, Chief Chekwas Okorie, among others. “The most important thing is reconciliation.

I am not one of those that say we would expel this person or that person even if you are the biggest enemy of the party, we would try and bring you back because in that your ward, you are very important. “If you have committed the greatest sin against the party, since it is not a criminal offense against the country, we would try and talk with you and bring you back so that we would be brothers again,” he said.

The decision of some State governments to increase the Right of Way (RoW) charge for telecommunication lines by 1,200 percent may force the telecom operators to increase the prices of data and calls, sources have said. The Right of Way charges by states are in contradiction to the resolutions reached by the National Economic Council (NEC) in 2013.

NEC had set up a Committee comprising state governors and ministers to review multiple taxations in the telecommunications industry. The Committee after consultations harmonized the taxes applicable to broadband related activities. The Committee agreed to the uniform RoW charge of N145.00 per linear meter of fibre.

In October 2019, the Minister of Communications and Digital Economy, Dr Isa Pantami, wrote to the Governors, drawing their attention to these resolutions and soliciting their support towards realizing the National Digital Economy by fast-tracking the deployment of broadband infrastructure to provide internet access across rural areas. Despite this, the state governments have gone ahead to increase the charges on Right of Way beyond N145.

A top official of one of the telecom companies told our reporter yesterday that the only option left for the operators is to increase call and data tariffs noting that the governments were insensitive to the plight of operators. Another operator who also spoke on condition of anonymity said gains of the telecoms sector were being reversed by overzealous officials.

Meanwhile, the minister yesterday frowned at the state governments’ disregard of the RoW charge agreement. “We received with dismay the decision of some states of the Federation to increase the Right of Way charges in disregard of the resolutions reached by the National Economic Council (NEC)’’, he said in a statement. He said it was disheartening that some states have decided to disregard these resolutions and have, in some cases, increased the RoW charges by over 1,200%.

This will no doubt, he said, impact negatively on the efforts being made by the Federal Government. “We are therefore calling on all State Governors, especially those that have made public their decisions to increase the RoW charges, to reconsider these decisions in the interest of Nigerians as well as for the socio-economic growth and development of the country. “We also draw their attention that these decisions, if implemented, will result in an increase in the costs of operations of the telecoms operators which will naturally be passed to the consumers,” Pantami said.

Governor Abubakar Sani Bello of Niger State yesterday said his party, the All Progressives Congress (APC), lost his ward during the local government election, “because of imposition of candidate”. He made the assertion while addressing the newly elected local chairmen at the closing of a 3-day retreat held for them in Kaduna.

He said it was due to the wrong candidate imposed by ‘some people’ in his ward in Kontagora, that the APC failed to secure the councillorship position, stressing that if he, as the state governor let it be, why then would the chairmen not swear in the councillors from the opposition. Bello said imposition of candidates often led a party into losing elections and also forced some candidates to abandon it and run on a different political party platform.

Governor Bello therefore urged the chairmen to settle their political differences, adding that divergent political views would always arise and create challenges in the discharge of their duties with their vice chairmen and legislators. He said APC does not only represent change but also stands for fairness, fair play and justice.

He deplored the refusal of some local government chairmen to swear in their vice and councillors, saying such action is wrong and against the rule of law. “The rule of law is key. For those of you that have deliberately or mistakenly refused to swear-in councillors because they come from opposition party that is wrong,” he said.

The National Industrial Court sitting in Jos on Monday dismissed a suit filed by Alhaji Garba Umar, former Deputy Governor of Taraba, seeking N236 million as gratuity and pension. Delivering judgment, Justice Kenneth Amadi, dismissed the suit for lacking in merit. News Agency of Nigeria (NAN) reports that Umar was appointed deputy governor on Nov. 12, 2012 by late Gov. Danbaba Suntai, following the removal of Alhaji Dani Abubakar-Danladi by the State House of Assembly.

Justice Amadi held that no State House of Assembly has the power to fix gratuity and pension for former Governors and Deputy Governors other than the National Assembly as contained in sections 124(1)(5), 210 and 32(d) of the 1999 constitution (as amended). The judge said that the “words” of the Supreme Court that “Alhaji Sani Abubakar-Danladi remained the deputy governor of Taraba.

”The Supreme Court on Nov. 21, 2015, was very clear and unambiguous. “The (words) need no further interpretation to find their meaning except to hold that at all material times, Abubakar-Danladi remained the deputy governor of Taraba while the claimant (Garba Umar) in this case was never the deputy governor of that state.

“The period when Abubakar-Danladi was purportedly removed was held to be a period of interruption in his office. Any invitation to read any other meaning or connotation to the holding of the Supreme Court aforesaid amounts to an invitation to commit judicial rascality.

“I am bound by the decision of the principle of stare decisis,” the judge declared. X-raying sections 32(d), 84, 124(1)(5) and 210 of the 1999 constitution (as amended), Justice Amadi said: “it is not in dispute that the power granted to the state house of Assembly to provide for pension and gratuity is a mere directory or permissive power which is not mandatory.”

“Therefore it is very clear that a house of Assembly in Nigeria lacks the power to fix any amount in remuneration to its past Governors and deputy governors; as pension or gratuity unless the Revenue Mobilization Allocation and Fiscal Commission (RMAFC) has first of all determined any amount in pension and gratuity.

“Since RMAFC has not fixed any amount as pension and gratuity to past Governors and deputy governors in Nigeria, any law made by the state house of Assembly granting same to past Governors and deputy governors is therefore null and void. “To that extent, I hold that the Taraba State Governor and Deputy Governor’s pension Law, 2015 is null and void. “In all, the claimant’s case is completely lacking in merit and it is hereby dismissed, “ he declared.

On the counter claimed filed by the state Government for the refund of all salaries enjoyed by the claimant while in office for two years and payment of N80 million as general damages, the judge struck it out as being “statute barred” and awarded no cost to either side. NAN reports that the former deputy Governor (Umar), through his Counsel, M.M. Nuruddeen, SAN, prayed the Court to compel the Taraba Government to pay him N236 million being his unpaid gratuity and pension while in office between Nov. 14, 2012 and Nov. 21, 2014.

Umar, who was later sacked from office via a Supreme Court judgement of Nov. 21. 2014, claimed that the demand for N236 million was in accordance with the Taraba State Governor and Deputy Governor’s Pension Law, 2015 passed by the State House of Assembly on May 15, 2015. The Supreme Court in its judgment in Appeal No. SC/416/2013, declared that Alhaji Sani Abubakar-Danladi, who was impeached, remained the deputy governor of Taraba State and was reinstated with immediate effect.

Challenging Umar’s claims, the Taraba Government, through its Counsel, led by Mr Chris Abongaby, argued that by virtue of the Supreme Court judgment, Umar was not entitled to any gratuity or any retirement benefit “since there was no lawful and valid record that he (Umar) ever held or exercised the office he claimed.”

The government, which asked the court to dismiss the case for lack of merit, further prayed the court to rather compel the former deputy governor to refund to it all monies paid to him as salaries during the period he served as Acting Governor and deputy governor and N80 million as general damages. “The Supreme Court has declared Alhaji Dani Abubakar-Danladi as bonafide deputy governor therefore Alhaji Garba Umar ‘s suit is an abuse of court process and should be dismissed. “

Alhaji Garba Umar must be made to tender a public apology to the people and government of Taraba State for the undignified and unlawful seizure and usurpation of office of deputy Governor/Acting Governor contrary to law and decency of the demand of constitutional democracy,”Abongaby said. (NAN)

Vice President Yemi Osinbajo has assured Nigerians that the Federal Government would continue to recognise the sacrifices of the men and women of the nation’s armed forces. A former governor of Zamfara State, Senator Ahmad Sani Yarima has declared interest to contest for the presidency come 2023. Yarima, an All Progressives Party (APC) member disclosed this yesterday in Bauchi while speaking with newsmen shortly after he paid a condolence visit to a famous Islamic scholar, Sheikh Dahiru Usman Bauchi over the death of his wife.

He said that various political groups from different parts of the country had approached him to contest for the presidency. “And by the grace of Allah, I will contest for the seat in 2023,” he said. Yarima who served as governor for eight years and senator for eight years, said if elected in 2023, he will fight poverty, create job opportunities and address the infrastructural gap in the country.

“The APC has set a standard of producing a presidential candidate through direct primaries and by the grace of Allah I will contest the primaries. People will look for a candidate that has something to offer for the country, a common man will not look for money but will look for what I can offer to the country,” he said. He commended President Muhammadu Buhari for his fight against corruption and security challenges, urging him to do more to address poverty and unemployment.

Lower amounts of revenue might be available for sharing by the three tiers of government through the Federation Accounts Allocation Committee (FAAC) in the coming months as the cost borne by the Nigerian National Petroleum Corporation (NNPC) to subsidise petrol has increased by about N17 per litre, Daily Trust reports. Subsidy on Premium Motor Spirit (PMS), otherwise called petrol, rose to N38 per litre on Monday, according to figures obtained from the Petroleum Products Pricing Regulatory Agency (PPPRA). Subsidy or technically, under-recovery, averaged N21 per litre in December 2019, the data showed.

The latest increase comes just as oil prices on Monday climbed above $70 a barrel for the first time in four months. The rise in the price of oil followed fears that the US airstrike that killed Iran’s top military commander may trigger retaliation and disrupt global oil supplies. Rising tensions between the U.S and Iran have caused considerable turbulence in the oil markets.

Daily Trust reports that whenever there is a surge in oil price, the expectation is that Nigeria will earn more dollars from crude exports but because the country imports the bulk of petrol it consumes and sells below the market price, NNPC which is the sole importer of the product for Nigeria, incurs billions in subsidy (under-recovery) daily. The PPPRA figure showed that PMS landing cost increased from N162.91 per litre in December to N164.13 on Monday just as the open market price for the commodity soared to N183.50 on Monday, compared to N182.28 in December.

The latest increase shows N38 per litre difference which NNPC currently incurs. PPPRA estimates daily NNPC under-recovery (subsidy) at over N1.2 billion. It means that on a daily basis, over N1.2bn cannot go to the treasury for sharing to all the states. Daily Trust reports that heavy subsidy burden in the past have contributed to NNPC’s failure to meet its obligation to FAAC thereby leaving federal and state workers including contractors without salaries or pay for months.

FAAC is made up of the 36 state commissioners of finance including officials of federal revenue generating agencies who gather in Abuja monthly to share monies earned the previous month. The major revenue generating agencies include customs, FIRS and NNPC and remittances by the NNPC form the largest chunk of the monies shared at FAAC but NNPC remits funds only after deducting expenses including subsidy (under-recovery) on petrol.
