Court Lifts Ubah's Suspension, Orders PDP to Accept Him as Flagbearer

The Federal High Court sitting in Abuja friday reversed the suspension of Senator Andy Uba, his brother, Chris Ubah from the Peoples Democratic Party.
This is as another Federal High Court in Port Harcourt, Rivers State issued a fresh order for the Independent Electoral Commission (INEC) and the Peoples Democratic Party (PDP) to receive the result of the Mr. Ejike Oguebego-led faction of the party which declared Senator Andy Uba winner of the PDP primaries in the state. Justice R.A Mohammed lifted the suspension at the resumed hearing of the case filed by the Ubahs and three others.
Chris Ubah is a member, Board of Trustees of the PDP, while Andy presently a senator is aspiring to run for the office of the Anambra State Governor on the platform of the PDP. Other members of the party who had their suspension lifted by the court are: Benji Udeozor, Ejike Oguegebo, and Anthonia Nwakwu.
The order for the PDP to recognise Uba as the dully nominated flag bearer of the party was sequel to a complaint of the lead Plaintiff Counsel, Mr. Jude Nnodim that despite an earlier order of the court for Uba to be taken as the flag bearer of PDP in Anambra State, the party went ahead to issue certificate of return and filed the name of Tony Nwoye as the party flag bearer in the election.
A miffed Justice J. Nganjiwa who had on August 28 restrained INEC and PDP from recognising the outcome of the primaries conducted by Emekayi faction after listening to Nnodim, asked Oguebego faction to submit the result of the primaries to INEC and PDP. Inspite of the defence mounted by counsel to PDP, Mr. Tagbo Ike who explained that Uba and others were suspended for failing to honour an invitation and therefore had nothing to do with refusing to obey the court, the judge was not persuaded, insisting that whether a court order was right or wrong, it had to be obeyed. The court order lifting their suspension will be in place pending the determination of their case. Justice Mohammed gave the order after the counsel to the PDP, Chief Clems Ezika asked for an adjournment because he was just served with the originating summons in court earlier in the morning. The lawyer told the court that going by the rules of the court he had three days to respond. He prayed the court for an adjournment so as to enable him respond to the processes. However, counsel to the plaintiffs, Taiwo Abe opposed the application for adjournment stating that the respondents had despite the pending court action, gone ahead to suspend the plaintiffs. In his ruling, Justice Mohammed held that the cause of adjournment was that the order to come and show cause was not served on the counsel. He further held that a party who had been invited to come and show cause could not go ahead to carry out an act which would render the order of the court an academic exercise. The court noted that the first defendant (PDP) had shown to be over reaching the court order adding that any action that had a colouration of sanction against the applicants was a deviation from the court order. The Judge ruled: "I thereby make an interim order suspending the suspension of the plaintiffs from the party pending the determination of the motion on notice." He consequently, fixed September 5 for hearing of the motion on notice

B4 Anambra gubernatorial elections no one heard anymore from these Uba brothers. Now it is by the corner and these Uba brothers don't want us 2 hear word. The one that was in the senate what bill did he pass while there? He was just bench warming like Ngige and they all want to come and govern Anambra. Hmm, Anambrans be wise!!!
The Uba brothers would relegate that state in2 stone age, if elected. A word is enof 4 the wise.
