Jonathan offers $12 billion to governors to sustain loyalty – Activist alleges
Nigeria’s embattled President, Dr. Goodluck Jonathan, has secretly authorised the release of a whopping $12 billion to loyal state governors as a way of retaining their support, a social crusader has alleged.
Barrister Emeka Ugwuonye, a lawyer and activist who leads the Due Process Advocates (DPA), made the allegation in a letter which he wrote to a friend abroad in which he painted a graphic picture of Nigeria’s current travails. A portion of the letter exclusively published hours ago by News Express reads:
“There is really no end in sight and with each new day, we witness signs of grave and gathering crisis. The apparent break-up of the Peoples Democratic Party (PDP), with several PDP Governors decamping to the new party greatly undercuts President Jonathan’s long-standing preparation to win the next Presidential elections. That only means that the President would get more desperate. And how would that manifest? I have it on good authority that in the past one week the President signed or authorized the payment of 12 billion dollars to the PDP Governors that are supporting him. I had tried to know exactly what that money was meant to achieve. And it seems these were payments that would go to these Governors individually. In other words, this was not some allocation to their states. Obviously, the President had to do this to keep these Governors from turning their back on him as others have done. If the President is doing this to keep the Governors loyal, he must be doing a lot more dangerous things to try to remain in power. There would be a lot more happening and more money being moved to loyalists as vast war chest to fight to stay in power.”
In an interview with News Express, Ugwuonye, who last week returned to his United States base after spending months in his native Nigeria, insisted that the information is authentic, saying: “I got it from a very credible source.”
Efforts made by News Express to get the Presidency’s reaction were futile as presidential spokesmen Reuben Abati and Doyin Okupe did not respond to text messages sent to them seeking their reaction to the allegation.
President Jonathan has been embattled in the past few months following stiff challenge from a hostile opposition, which now controls 11 of Nigeria’s 36 states under the banner of the newly registered All Progressives Congress and, lately, from seven rebel PDP governors working in concert with former Vice President Atiku Abubakar.

Mr. Ugwuonye, who practiced law in the State of Maryland, has proved to be a bad lawyer, but perhaps an even worse gambler or mathematician who chose the risk of a $1.55 million check in exchange for monetary damages that could rise to $6.2million.

He also stands to lose his professional licence and even personal liberty.

Last Friday, Nigeria achieved a significant milestone in its war against corruption and looting of public funds.

But the war and the victory were on foreign soil in faraway Washington DC, where United States District Court Judge Barbara Jacobs Rothstein announced a default judgement against Emeka Ugwuonye in a case that has lasted over five years.

The judge found Mr. Ugwuonye liable on all claims made by the Embassy of Nigeria in Washington DC, and awarded the Embassy monetary damages in excess of $2 million.

Mr. Ugwuonye’s troubles in the United States with the Embassy, his former client, concern diversion of $1.55 million proceeds of tax refunds in a real estate transaction in Washington DC he undertook for the Embassy.

Mr. Ugwuonye, who practiced law in the State of Maryland, has proved to be a bad lawyer, but perhaps an even worse gambler or mathematician who chose the risk of a $1.55 million check in exchange for monetary damages that could rise to $6.2million. He also stands to lose his professional licence and even personal liberty.

In the five years in which Mr. Ugwuonye has been defendant rather than counsel in a State of Maryland courtroom, he has suffered loss after loss, including even the very companies he used in the real estate transaction on behalf of the embassy, for failure to pay property taxes.

He has forfeited, at least twice, ECU Associates PC, the firm he used in some of the real estate transactions. Originally incorporated in July 1999, the firm was forfeited in October 2006, following which Mr. Ugwuonye incorporated ECU Law PC with the State of Maryland between January and March 2007.

Between April and June 2007, Mr. Ugwuonye somehow revived ECU Associates PC to receive money from the Nigerian Embassy for shady real estate deals, but he would eventually forfeit the company to the State of Maryland, like ECU Law PC.

In October 2009, Mr. Ugwonye sued various Nigerian citizens and reporters who questioned his sale of the properties and handling of the tax refunds. He lost all those cases.

He has also remained suspended from practicing law in Washington DC and New York jurisdictions after the state of Maryland suspended him for mishandling cases involving some of his clients.

Filing a motion for default judgement on May 23, the Embassy asked the judge to compel Mr. Ugwuonye and his firm to pay $6.2 million in restitution and additional costs, as follows:

· $1.55 million in base compensatory damages;

· Prejudgment interest on the tax refund in the amount of 6% per annum commencing on November 20, 2007;

· Punitive damages in an amount equal to two times the total compensatory damages, inclusive of prejudgment interest;

· Post-judgment interest in accordance with 28U.S.C. § 1961; and

· Such other relief as the court may deem just and proper.

Evidence presented to demonstrate the scope and severity of Mr. Ugwuonye’s fraud in the matter and his contempt of the Court’s procedures and orders included documents showing that he recovered the tax refund on the Embassy’s behalf, lied to the Embassy concerning the whereabouts of the funds, and proceeded to use the funds for his personal benefit.

But as had been the pattern, Mr. Ugwuonye was absent at the hearing, having filed a 3:00 a.m. motion requesting an indefinite continuance of the case.

“He did this clearly fearing vigorous questioning and simply failed to appear, in the process further exasperating the court,” said a lawyer for the Embassy who noted that Mr. Ugwuonye’s absence was particularly glaring in light of the court’s scheduling order which cautioned him not only to be present, but also prepared to respond to [the] Plaintiff’s allegations.”

US Judge Dismisses Ugwuonye’s Suit Against SaharaReporters

Judge Peter J. Messitte, a United States District Judge, has dismissed a defamation and invasion of privacy lawsuit filed in 2009 by Nigerian-born controversial attorney, Emeka Ugwuonye, against Sowore Omoyele, the founder of saharareporters.com.

Sowore was represented by notable free speech attorneys, Laurie Babinski and Bruce Brown at the law firm of Baker Hostetler in Washington DC. The two lawyers are part of the pro-bono network of the UK-based Media Legal Defence Initiative. Mr. Ugwuonye represented himself.

In a ruling dated November 20 but officially released this morning, Judge Messitte declared that Mr. Ugwuonye’s claims in his lawsuit lacked merit.

The judge consequently granted Mr. Sowore’s motion for a summary dismissal of the lawsuit.

Mr. Ugwuonye filed the lawsuit following a series of investigative reports by SaharaReporters to the effect that he had improperly withheld $1.5 million in IRS tax refunds to the Nigerian embassy in Washington DC. The funds in questions were tax refunds to the Nigerian embassy from transactions in which the embassy sold off some of its real estate holdings. Since Mr. Ugwuonye had represented the Nigerian embassy in the transactions, the refunds were given to him for transfer to his clients.

Instead, Mr. Ugwuonye kept the money, claiming that the Nigerian government owed him for legal work he did for other government functionaries.

Nigeria’s former attorney general Michael Aondoakaa has since denied that the government owed any outstanding fees to Mr. Ugwuonye.

Mr. Ugwuonye’s original lawsuit named several defendants, including former Nigerian ambassador to the US, Oluwole Rotimi and Professor Mobolaji Aluko. However, Judge Messite penalized Ugwuonye for suing Aluko in the US District court instead of a state court and then dismissed the case against Professor Aluko. The judge also dropped the case against the former ambassador because he could not be served the summons. The court then focused on Ugwuonye's case against SaharaReporters.

In a 15-page memorandum accompanying his ruling, Judge Messitte extensively quoted various legal principles to support the dismissal of Mr. Ugwuonye’s lawsuit. The judge stated that summary judgment “is warranted when a party fails to make a showing sufficient to establish the elements essential to the party’s claim and on which the party will bear the burden of proof at trial.”

Judge Messitte also declared that Mr. Ugwuonye’s failure to respond in a timely manner to queries administered on him by the defendant amounted to admission that “each statement he alleged to be defamatory was in fact substantially true and made without malice.”
