ayusco85: Apportioning blame won't wake the dead. Fix the damn bridge and arrest the driver. Why did he fled the scene if he aint guilty?
So that the angry Soldiers will lynch him? He did the right thing!

Ridding bike or not, this Lagbus drivers are animals.. you need to see dem drive like they gat immune for accident.. they are no different from the old moluwe drivers..

(Soldiers will surely) deal with some drivers before the day run out..

There nigerian soldiers always behavin lyk a robot nd think they ar always a version above the normal citizens. . .must everythin involvin them must be chaotic

What do you expect them to do ?

The driver is very lucky. Some of these Lagbus drivers are very rough. They don't observe traffic rules.

Do you live in Nigeria?.. if not, have you ever lived in Nigeria??... I suppose all the passengers of the bus who also fled the scene are also guilty?

Mr Aboki:

Everyone in this order;

Soldier:
Commited suicide by delibrately putting himself in harms way. If it wasnt a bad bridge, it might as well have been a burst tyre or failed brakes, or even braking suddenly.. THE SOLDIER SHOULDNT HAVE BEEN ON THAT BRIDGE RIDING A BIKE

DRIVER::
Has the least blame.. We dont know the speed he was doing for sure. If the road was bad, anybody could have fallen victim. He tried to control the vehicle and had the Bike not been riding on that bridge illegally, he would have brought his vehicle back under control after hitting that section on the bridge without any casualty..

GOVERNMENT:: Eko oni ba je o!! Fashola is truly working.. grin Working on killing as many Lagosians via road accidents as possible.. grin

FINALLY:: Lets not attribute this to bad driving.. The Driver was not responsible for the pothole being there. Anybody could have hit that pothole.
gbam.. Case closed, next news please.

Mr Aboki: Is a Bike supposed to be on that road for starters?!
some type of bikes are allowed to ply the route, anyway u knw how soldiers can be: feeling like bosses. RIP soldier

May his soul rest in peace... Atleast this would draw fashion's attention to the dilapidated bridge, and make provision for repairs... I just hope the soldiers won't lash out like mad dogs and punish innocent citizens

Re: LAGBUS Crushes Soldier To Death In Lagos Yesterday by Xano(m): 10:16am On Sep 24, 2013
Mr Aboki:

He fled out of fear.. Abi you dont know Nigeria again?! Talkless of a matter where the dead person now happens to be a soldier..

If this were a sane country, the guy would not have run..
The Biker seems to be a fault because from the looks of that picture, that road is not one on which bikes are allowed to to ply on.
The max the driver would face would be manslaughter.. And I doubt he would get any jail time.
you are not a lawyer. You don't know how many count charge the driver will be charged with. Murder(manslaughter),attempted murder, bodily harm, reckless driving, damage to property, etc

Re: LAGBUS Crushes Soldier To Death In Lagos Yesterday by otokx(m): 10:24am On Sep 24, 2013
The government should close the bridge down and have it repaired while the family of the soldier should be treated like the colonial masters that are being paid about 9 million naira for the next 20 years even though they are aged 81 - 106 years.

The Driver sabbi code of conduct of nigerian soldiers, if he diid not run, he would have been dead and possible accompany by some of his passengers, that's why passengers fled too

Xano:
you are not a lawyer. You don't know how many count charge the driver will be charged with. Murder(manslaughter),attempted murder, bodily harm, reckless driving, damage to property, etc

1. Murder?! - I think not.. This case lacks the Mens Rea & Actus Rea for it to be murder. For murder to occur, These two elements must be there.

2. Manslaughter - Thats all that this is.. And not all manslaughter cases carry jail time.

3. Attempted Murder - Of who?! The passenger I guess?! Well.. That charge wouldnt stick. You have to prove that the Drivers intent was to kill the passenger as well, and that would be an uphill task for any prosecutor to prove.

4. Bodily Harm:: Hmmm... Again, How do you prove this. He didnt go out of his way to harm them They just so happened to be riding ILLEGALLY on a road that they werent meant to be on, thus getting involved in an accident Assuming gthey were not even responsible for the driver hitting that pothole in the first place

5. Reckless Driving: I believe that this charge is for the Dead soldier and not the driver...

6. Damage to Property: Thats for the BRT|Lagos State government to bring against the dead soldier..

Just in case you are thinking of more chrages to bring against the Driver:

7. Hit and Run:: This one might stick.. But the driver would have a good defence if he turns himself into the police willfully..

FINALLY: The driver is inncent of all charges except 'Hit & run" as it is an offence to flee the scene of an accident in Nigeria.. Other than this, he is clean. The Soldier knew what the risks were for riding on a road illegally and paid the ultimate price. He would have been charged to court if he didnt die from the accident. The passenger should also give thanks go Olisa bi na igwe for her life..

And No. I'm not a lawyer.. Just an Aboki.

He was wrong to be riding a bike on a road upon which bikes are banned. The bus driver was however at fault according to eyewitnesses, for not been more careful thus leading to the loss of a life.

Reptyle:

Well Said...

However, the matter of the Driver being at fault remains a matter of Jurisprudence. Lets assume that the allowed speed limit on that road was 90Km/hr and the Bus driver hit that pothole at that exact speed;

1. Would we blame the driver for hitting a pothole that shouldnt have been there in the first place?!

2. Do we blame the driver for losing control of his vehicle as a result of an 'Anormaly' in the road?!

3. Do we blame the driver for killing a Pedestrian or Motor cyclist that shouldnt have been on that road at all as a result of point number 2 above?!?!

4. How do we say the driver was reckless?! What if he lost control as a result of a burst tyre?! Would we still balme him for killing a motorcyclist as a result of something beyond his control?! What if it was a vehicle that lost its tyre rod Like most Hondas, Do we blame the driver as well?!

Finally:: It will biol down to a matter of he said|she said.. The driver can maintain that he wasnt speeding.. And any judge will agree. Its like a case of knocking down a pesdestrian crossing the express road in Nigeria.. The matter is simply ajudged 'manslaughter' and its normally settled with the Police asking you to please assist in the burial of the deceased.
Re: LAGBUS Crushes Soldier To Death In Lagos Yesterday by geeez: 11:06am On Sep 24, 2013
Why are Nigerian military personnel always like this? Chasing an ambulance that came to evacuate the corpse

They always go about their business like they are superior to the rest of us

You need to see the way they drive recklessly against traffic and on BRT lanes. Even the governor of Lagos State doesn't drive around in a siren but every Major in the NA wants to drive in a convoy of ten cars blaring horns and sirens at everyone else

In other climes, the military are the ones in the vanguard of development with intelligent officers that come up with engineering and scientific solutions to help better society. What stops them from executing a research in traffic management or coming up with a scientific solution for security management, or even being the ones to respond in disaster areas with their own ambulances, helicopters and fire trucks.

I'm sure if a LASTMA official had tried stopping the soldier from riding on the bridge, he would have created a scene and got his fellow men-in-green-lynching-for-no-reason-accomplices, to beat them blue

Because he will be dead by now if he didn't... Even d passengers ran away, cos if the khaki boys met them there, it will be a case of "PACK THEM ALL!!!"

For a driver that plies the said route routinely day in day out not to know about the said bad spot? Are you like really serious? Have you seen these lagbus drivers in action before? I bet not!!!

Please dont bet... You will lose your money.

Its one thing for BRT drivers to be known to drive as fucktards.. Its another thing for a Driver to lose control due to a bad patch on the road, causing him to 'ACCIDENTALLY' crush a Soldier on a bike that shouldnt have been there in the first place..

Secondly.. How did you come to the conclusion that he plies that route daily?!

Why couldnt he have just started work on that day?! Or he just got assigned a new route that day?! Or he was just negligent enough to forget about that pothole that day Cos we sometimes do?! Or in trying to dodge the Motorcycle, was forced into the pothole?!

Yes!! I AM SERIOUS!!
