I had to park on the other lane inward Lagos Island to view what was causing the curiosity of many motorists that have equally parked thus causing a long stretch of traffic towards stadium.

It was not a very pleasant sight seeing the mangled cadaver of the soldier.

I honestly pray that the opening on the bridge that caused this accident will not cause a bigger one.

It's a sad commentary on our maintenance culture in this country and the carelessness and recklessness of those saddled with the responsibility of maintaining those bridges.

RIP to the officer that has become part of the statistics of death on that bridge.

This is sad news. Any way reckless driving of LAGBUS driver is becoming unbearable, they drive like a mad man.
No one is above the law, motorcycle had been banned on highways, why riding one?

Dont mind them, blaming the Bridge for all the accidents.
Granted, the Bridge is dilapidated but common sense should tell us that when you approach a dilapidated bridge, YOU SLOW DOWN.

From the accounts given, the Bus was OVER-SPEEDING and the Driver could not control it. Period.
The Okada Soldier was just on the side of the BUS when this happened and he pinned the Bike and its driver to the Railings, slicing him into two.

l wish the Soldier was a lil-bit more cautious and give a wide-berth to those crazy drivers.
Thats what l do whenever l see them nearby.

The way these LAGBUS drivers started out, especially when thy had this "dedicated lane" was as if they are now Demons and will crush anything in their path!
When you have AREA-BOYZ high of Sheepe and Opaa-eyin soaked in Warri Alcohol driving such long Vehicles, now that is a toxic and explosive mixture!

My Sympathy goes to the family of that soldier.

However, the matter of the Driver being at fault remains a matter of Jurisprudence. Lets assume that the allowed speed limit on that road was 90Km/hr and the Bus driver hit that pothole at that exact speed;

1. Would we blame the driver for hitting a pothole that shouldnt have been there in the first place?!

2. Do we blame the driver for losing control of his vehicle as a result of an 'Anormaly' in the road?!

3. Do we blame the driver for killing a Pedestrian or Motor cyclist that shouldnt have been on that road at all as a result of point number 2 above?!?!

4. How do we say the driver was reckless?! What if he lost control as a result of a burst tyre?! Would we still balme him for killing a motorcyclist as a result of something beyond his control?! What if it was a vehicle that lost its tyre rod Like most Hondas, Do we blame the driver as well?!



Finally:: It will biol down to a matter of he said|she said.. The driver can maintain that he wasnt speeding.. [b]And any judge will agree. Its like a case of knocking down a pesdestrian crossing the express road in Nigeria.. The matter is simply adjudged 'manslaughter' and its normally settled with the Police asking you to please assist in the burial of the deceased.[/b]

It is a Driver's "duty of care" to always be in control of the vehicle you're driving.: Irrespective of whether it is raining, there is pot-hole, Pedestrian crosses a major road, e.t.c., YOU the driver of a Vehicle is responsible for whatever damage your vehicle causes, due to LOSS OF CONTROL. End of story!

Do you run over a child crossing a road (instead of using a Pedestrian bridge) and claim its not your fault?
Why then are you called a "trained Driver" or do people just wake-up and start driving a vehicle?

You should continue to reduce your speed to match the prevailing conditions.
Note: Speed limits are "advisary".... You can go below it but you should NOT EXCEED IT.


Accidents have happened at 180Km/H, at 100Km/h and even at 40Km/H before now, depending on the "prevailing conditions".
If speed limit is 120Km/H on an express road, l bet you know you have to slow down to say 80Km/H if it is raining? .... and even 50Km/H, if the road has pot-holes and it is raining at the same time, huh?

I lost control of my vehicle on a Sunday morning years ago when a speeding vehicle came from behind and cut in front of me so hard that I swerved and braked so such that my car went into a spin out... Luckily, it was a sunday and the road wasnt as busy.. Had it been otherwise, I would be dead or I would have killed someone..

Blaming the driver for loss of control of a Vehicle due to a pothole on a 'HIGHWAY' is like blaming the Pilot of an Aircraft for Turbulence as a result of a strong air pocket.. grin

The loss of control is only important here for one reason:: The Cause of that Loss of control.

What caused this loss of Control?! Driver Error Like sleeping on the steering, over-speeding, bad over-taking, reckless driving, e.t.c?!
NO!! The driver as far as I know was driving as he should on a highway. (Because the so called eye witness in a court of law will not be able to prove beyond reasonable doubt that the bus was over-speeding.. Except he|she had a speed gun or a speed camera.. Now any loss of control due to;

1. Mechanical Failure (Not borne out of negligence)

2. Unforseen conditions (Like Weather, ditches, sizures and co )

4. An act of God..

Cannot be blamed on the driver.


Again, If the speed limit on a road says 100 Km/hr and a driver doing that exact speed suddenly comes upon a pothole that he isnt aware of on that road, would you say the accident was caused by OVER SPEEDING on the part of the driver or would you blame it on the Unforseen pothole that appeared out of no where with no warning sign?!

If a child gets killed crossing THIRD MAINLAND BRIDGE for example, what kind of case would you bring against the driver?!

lottoe: Tragedy struck on Monday on the Funsho Williams Avenue bypass, Surulere, Lagos State, after a yet-to-be identified soldier was crushed to death by a LAGBUS, one of the buses in the state mass transit scheme.

Commuters plying the bridge could not help but watch in horror as the mangled body of the soldier was cut into two by the bus.

Eyewitnesses said the  victim, who was riding a motorcycle, was also carrying a woman on the back seat. The passenger was reportedly flung away by the impact of the collision.

She was said to be in a critical condition and had been taken to an unknown hospital in the state.

It was further learnt that the bus driver, after seeing the extent of the damage, removed his uniform and fled the scene.

The vehicle passengers also took to their heels to avoid reprisals by soldiers.

A mechanic, Taiwo Akindele, said the accident was caused by the bad state of the bridge.

He said, “The accident happened around 7.30am. It involved a red LAGBUS with number ‘30’ written on the body. It did not have a number plate.

“The driver was on top speed, not knowing the bridge was dilapidated. As he approached a bad spot on the bridge, the vehicle began to swerve dangerously towards the left of the bridge.

“But the driver turned the steering and the soldier, who was on a motorcycle, was pinned to the railing of the bridge. As the bus driver strived to control it, the bus dragged the soldier and cut through his bowel. He died on the spot.”

Akindele added that other soldiers arrived at the scene around 10am, while their presence caused panic in the area.

A Lagos State ambulance, which came to evacuate the deceased, was reportedly chased away by the angry soldiers.

A source said, “The whole place was filled with heavy military presence. Everybody was afraid. The soldiers later called in their own vehicle to carry the corpse. They were armed and looked menacing.”

He said the accident also drew the presence of members of the Federal Road Safety Corps and policemen.

A trader under the bridge told our correspondent that there had been four of such accidents within a space of three months due to the condition of the bridge.

Our correspondent observed that two connecting slabs of the bridge were almost pulling apart which usually forced drivers to move slowly when they got to the point.

Around 2pm, another tragedy was averted when a petrol tanker belonging to AP, and marked XA 273 AUG, broke down after the driver’s compartment caved in.

The driver had applied the brake when the incident happened. He was however able to escape without much injuries.

A resident who pleaded anonymity said, “This is not the first time we will be witnessing accidents here. We all are afraid for our lives.”

Another resident, Biodun Falola pleaded with the government to do something about the bridge which had become a death trap.

The Managing Director of LAGBUS, Mr. Babatunde Disu, confirmed the incident to our correspondent on the telephone, adding that the driver had been handed over to the police.

He said, “He only ran away as a safety precaution. We have since handed him over to the police for further investigations.”

The Police Public Relations Officer, Ngozi Braide, when contacted, said she was in a meeting and would get back to our correspondent.-punch newspaper online

BTW...I don't know what you mean by dilapidated bridge....the problem with the bridge is that the expansion joint has already expanded beyond a tolerable limit thus leaving a huge gap between two joints.

Even if you pass on all those counts (including that you were driving at a "common sense speed" at that point, you will still get a Driving ban, at the least.... and if you breach it, you still go to jail. wink wink

Yes Mr Aboki, a bike has every right to be on that road. it is a road and bikes with a stipulated engine capacity can travel on that road. There is this warped thinking in naija that bikes should be driven on the pedestrian walkway instead of the roads. That bus driver probably didn't deem that bike rider as a legal road user. I have seen people shout at bikers to leave the road cos they are driving a vehicle.
same way truck drivers feel all cars should leave the highway for them cos they are driving a truck. that is very sad.
