Three Men To Die By Hanging For Stealing N50,000 In Kwara by BrAkingNews: 1:30pm On Dec 22, 2013


The Supreme Court upheld the death sentence given to three men for robbing a woman of N50,000 at gun point.
The convicts, identified as Kayode Babarinde, Akeem Haruna and Yusuf Nurudeen, had earlier been sentenced to death by hanging by the Kwara State High Court and the Ilorin Division of the Court of Appeal.
The three convicts were charged before the Kwara state High Court in Ilorin on a two-count charge of conspiracy to commit armed robbery and armed robbery contrary to section 97 of the Penal Code and Section 1(2) of the Robbery and Firearms (Special Provisions) Act Cap. R 11 Laws of the Federal Republic of Nigeria.
The trio was alleged to have robbed Mrs. Ruth Alabi of the sum of N50,000, threatening her with a locally made pistol at Baba Oloya Street, Jebba, on August 18, 2007.
Each of the accused persons pleaded not guilty to each count of the charge.
The high court found each of the accused persons guilty as charged on each of the counts. They were sentenced on September 26, 2009, for two years of imprisonment on the count of conspiracy and death by hanging on the count of armed robbery.
Dissatisfied with their conviction and sentence, the trio appealed to the Court of Appeal in Ilorin, but their appeal was dismissed.
Still dissatisfied, they appealed to the Supreme Court.
In a lead judgment delivered by Justice Kudirat Kekere-Ekun, their appeal was found to be unmeritorous and was therefore dismissed.
“I find no reason to disturb the said finding and conclusions of the lower court. In effect the appeal lacks merit and is hereby dismissed,” the Justice said.

What would have happened had the woman resisted and started shouting for help?

The judgement is for Armed Robbery and not necessarily the amount involved.

Life is too precious to be wasted.

So goes for all those threatening to go up in arms against others just for being different (ethnicity/religion or political orientation) for any reason known to them.

Ok, this is SERIOUSLY ANNOYING.

Every single time you people post this, we get the same inane comments about 'leaders who stole billions walking free'.

Guys, can you PLEASE reason like educated people?! It's been pointed out OVER AND OVER that the penalty for ARMED ROBBERY is death. No stories, no excuses.

It matters not if you steal a N500 recharge card or N50000. As soon as you use a lethal weapon to rob someone, it's the death penalty. Do you know how many people have died in the process of these armed robberies?


Here's a thought. If you want to rob, don't carry a weapon. That way, you don't get hung or shot if you're caught.


Repeated again for clarity because in the next few months, some crazy person on Nairaland will make another post about someone sentenced to death for stealing Beans with a locally made pistol:

If you rob someone with a lethal weapon, the punishment for this (according to the Nigerian law) is DEATH.

This is Nigeria and the offence of Armed Robbery carries a Death penalty,so fellow nairalanders,stop being childish in ur comments.

I still find it very difficult to belief whether are Nigerian Judges were trained under the same law code curricula and also re-trained with the same terms when called to bar.

The only thing wrong here is your disturbing lack of common sense.

The Nigerian penal code calls for DEATH PENALTY on Armed robbers. The 'government looters' that stole billions were not charged to court with the same offence of Armed Robbery. Simple as that.

Whether you steal N500 recharge card or N500000, the penalty for Armed robbery is death.

China sentence any individual to dead on conviction of embesslement. Today China's economy is the second largest, on their way to becoming the largest economy by 2019. Nigeria on the other hand celebrats corruption with her lobsided laws. i don port.

It is definitely scary to come in contact with an armed robber as they may take your life instantly, however, corrupt leaders also take the lives of their citizens, albeit indirectly.

Its almost like trying to kill a chicken(lol), one could take a knife straight to its neck, which would be very gruesome. Or one could starve the chicken to death, which is a more indirect method of killing, and less gruesome.

We can all agree that most corrupt actions taken by corrupt politicians often lead to the death of citizens mostly indirectly through starvation, poorly executed projects and so on.

So you see, you really can't say that armed robbers deserve worse than corrupt politicians, if anything, they deserve the same.

You cannot prescribe the death penalty for corruption when it occurs at so many levels, and when in very many cases it has no lethal consequences for others. A school bursar embezzling money meant for a classroom block will not kill anyone, for example, and has zero potential for lethality.

Your personal antipathy to corruption is laudable, but it does not matter in this discussion. Until there's a change in the penal code, anyone who goes to rob with a lethal weapon does so with the knowledge that it is death if caught. They thus deserve that fate.

Yes the law is the law, but I guess they (corrupt politicians) would never introduce a law even half as harsh for corrupt leaders for fear that they might be caught in the mix.

You are right though that one can't throw an umbrella over all corrupt practices, and insist that they all lead to the demise of the citizens. It would just be nice if cases of corruption that led to the loss of life either directly or indirectly could face a harsh penalty.
