Governor Amaech'si Budget Presentation Illegal -rivers PDP by Nobody: 5:17am On Jan 08, 2014
RIVERS State governor, Rotimi Amaechi, on Tuesday, presented a N485.524 billion 2014 budget to the state House of Assembly, which held its maiden sitting of the year in a temporary chambers within the Government House complex.
The House of Assembly, which had 23 of its 32 members on seat, however, passed the budget into law, after a few hours of deliberation on it.
But the state chapter of the Peoples Democratic Party (PDP) has rejected the budget, its presentation and passage by the House of Assembly, describing it as an illegality and vowing to use legal means to stop its implementation.
Presenting the budget, Governor Amaechi told the lawmakers that N368.43 billion of the budget estimate, representing 75.88 per cent, would be devoted to capital expenditure, while N117.09 billion, representing 24.12 per cent of the budget, would be for recurrent expenditure.
Giving a detailed breakdown of how the proposed budget would be funded, Amaechi said the state expected to get N241.243 billion from the federation account; N92.420 billion from internally generated revenue; N33.5 billion from sales of assets; N100 billion from proposed loans; N6.983 billion and N0.660 billion from the World Bank credit and the European Union (EU) grant respectively.
“Honourable Speaker, with due consultations with relevant stakeholders within and outside the public service, we are proposing an aggregate budget of N485.524 billion for the year 2014.
“This is N4.797 billion (0.98 per cent) lower than the 2013 budget of N490.320 billion. The focus of the budget will be on completing ongoing projects in health, education, roads, transport, power, water and agriculture and other critical infrastructure.
“Capital and recurrent provisions are N247.573 billion and N237.950 billion respectively. Our capital to recurrent ratio is 76:24 for the financial year 2014, as against 70:30 achieved as of September in the outgoing year,” he said.
Speaking further, the governor said by this proposal, government was expected to meet salary, overhead and debt service obligations from recurrent expenditure, adding that out of the amount proposed for recurrent expenditure, N66.96 billion was for salaries, while overhead got N23.34 billion.
Amaechi also informed the legislature that the state was unable to meet the 2013 fiscal year target as a result of shortfalls from Federal Government’s allocations, which the central government had attributed to increase in oil theft in the Niger Delta.
Before commencing deliberation for the day’s sitting, the Speaker, Honourable Otelemaba Dan-Amaechree, said the assembly decided to continue with its legislative duties in makeshift chambers.
He then called on the deputy house leader, Nname Ewor, to move the motion to designate the makeshift chambers as the chambers of the Rivers State House of Assembly, after which the deputy house whip, Irene Inimgba, seconded the motion.
Moving the motion, Ewor said “as it is common knowledge that on July 9, 2013, there were few events that took place in the hallowed chambers of the Rivers State House of Assembly and in that circumstance, our computers and a few other items in the chambers, including the entire complex, were destroyed.
“As a result of this, our chambers are not ready for use because the executive arm of government will have to undertake a holistic repairs and renovation of the complex.
“In this circumstance, I move that this auditorium be designated as a temporary sitting place of the Rivers State House of Assembly, until such a time that the executive would finish with the renovation of the permanent assembly complex that will enable us to carry on with our legislative business. I so moved.”
Justifying the sitting of the legislature outside the chambers of the assembly complex on Tuesday, deputy speaker, Leyii Kwanee, said the rule of the assembly only required that a temporary place be designated to house the legislature, in such circumstances as could prevent the use of the complex.
On the hurried nature of the passage of the budget, Kwanee said time was of the essence in the matter, adding that the decision to move with speed in passing the budget was in the interest of the people of the state.
“What the rule of the house requires of us in this circumstance is to designate a place to serve the purpose and that was what we have done.
“We designated the place where the governor came to meet with us to present the 2014 appropriation bill. You will recall the incidence of recent years, how we have made attempts to resume our duties and the great persecution we have been subjected to.
“You were here when police would not allow us access into the hallowed chambers of the Assembly complex, you were here when we conducted a mock session and how police came after us, shooting at us and teargasing us, we did all that at the great cost of our lives.
“You are also aware of the recent mindless, murderous attacks on structures of institution of democracy. Should we fold our hands and not do what we have been elected to do? We have passed the bill and I believe as we speak His Excellency, the governor, should be assenting to it,” he said.
However, the state PDP condemned the action of the assembly for sitting to accept and consider the 2014 budget within the walls of the Rivers State Government House, alleging that the legislature was compelled by Governor Amaechi against its will to sit in the Government House.
[b]Speaking at a press briefing at its secretariat in Port Harcourt, on Tuesday, the state chairman of the party, Felix Obuah, described the development as a criminality that would not be allowed to go unchallenged.
“The attention of the Rivers State PDP has been drawn to the illegal presentation of 2014 budget at Government House, Port Harcourt, right inside Governor Amaechi’s office, outside the hallowed chambers of the Rivers State House of Assembly.
“The PDP describes the action to present the 2014 budget outside the hallowed chamber of the Rivers State House of Assembly as illegal, criminal and of no effect. The PDP assures Rivers people and, indeed, the generality of Nigerians, that the illegality cannot be allowed to stay in Rivers State.
“Therefore, the illegal budget presentation at Government House today cannot stand the test of time. Therefore, we reject the budget presented by Governor Amaechi today. The budget is illegal, presenting it outside the hallowed chambers is also illegal and of no effect. The budget will not see the light of the day,” he said[/b]

Those who designed the constitution envisaged that the 3 arms of government will check each other.

When the legislature sits and pass bills in the bedroom of the executives, under the supervision of the executives then democracy has failed. The legislature has sold their independence. At the end of the day the populace will suffer as what ever bill is passed will just be through paddy paddy arrangement between the executives and the legislators for their personal benefits.

No surprise anyway, recently we saw a speaker of one of the states kneeling before one of the 'progressive' governors.

So they can as well pass bills in the governor's bedroom.

Can't Obuah's PDP criticize constructively based on the content of the budget presented?
In fact the PDP at the federal level should emulate Amaechi with the 74% capital expenditure and 26% recurrent budget!
Madam Okonjo should as a matter of urgency go to Rivers for a lesson in Public Finance!

You mean okonjo should emulate Amaechi in his folly? God forbid. Rivers state is among the highest receivers of fund from the federation account yet Amaechi is planning to take 100 billion naira loan this year and also planning to sell the assets of the rivers people this year for 33billion.

My question is how much loan did people like diete spiff and melford okilo take to build rivers state. Amaechi is planning to bankrupt rivers in the midst of plenty

How can there be checks and balance if there is no money? Did those that designed the constitution envisage that the Federal Government would prevent the State Assembly from sitting using the police?
If the legislature is prevented from passing bills at the state assembly complex, then the governor's toilet might as well become an alternative venue.

So what is your suggestion over the 2014 budget? That Rivers state should go without a budget for 2014? You want the state to be grounded for the whole year? You do not want civil servants to receive their salaries? even the judiciary to which you people will run to will need the budget to operate at all.

You people are ready to cut every rivers state indigene's face to spite amaechi's face.

Amaechi's real problem is with these riff raffs called GDI and Felix Obuah PDP....yes they expelled him when they apparently lacked the powers.....he left PDP for them for the APC now PDP has suddenly become the opposition party in Rivers....now an opposition party is required to play that role in an issue based manner....not like Oyo motor park men (Tokyo's era in mind). Is the location the problem or the content if Obuah has the intellectual capacity to analyse the budget?

The legislature in most states r playthings of d govs. R/S esp. It was particularly worrisome last year wen dey went t Pledge Allegiance t d gov..d supposed checks
The said budget as well was passed within minutes without (I.m.o) proper deliberation on d fine points of d budget.
The sitting outside d chambers maybe all good n legal, but am afraid its setting a bad precedence that may ve ripple effect within dis n subsequent govts.

Good development on the path of the state house. The police can camp in the house if they deem fit.

House members have done everything humanly possible including signing undertaking with the police that they would be of good behavior (an undertaking Bipi and his group hasn't signed) after court judgement that house be open yet Mbu feel otherwise.

Amaechi has presented the budget and the house with the majority has passed it.

If any has issues with the venue, let such proceed to the law court. In the mean time, Amaechi should continue to implement the budget has passed by the majority.

Long live Rivers.

When Alams was impeached, its on record that it wasn't inside the house premises. The constitution seems to be silent about that.
Am also not happy that the budget wasn't well debated before passage but eh considering what Bipi, gdi, Mbu etc can together do within a short time, time is of essence.
Immediately after the passage, they are dispersed.
Mbu won't protect them when Bipi thugs arrive. cheesy

The Budget has been passed and will be implemented too. Kudos! To Amaechi. PDP, the police and Federal Govt wants to play a fast one by not allowing d police to reopen d state Assembly even when d federal High sitting in Abuja directed so and d police in Rivers state led by Mbu requested d law makers to sign an undertaking to be of good conduct which Evans Bipi and his group refused to. What then do they want Amaechi to do? To sit and have d state grounded by Riff Raffs? Kudos to u Amaechi for being so smart and intelligent to out smart them. As a Rivers state man, I am solidly behind u in Rivers state
